    PARTIES

    1. Plaintiff, Scott Cornel iou s (hereinafter "Plaintiff"),s an adul t individual an d resident ofPerry Coun ty within th e Commonwea l t h of Pennsylvania. Plaintiff is e m plo ye d b y th eCamp Hill B orou g h P o l ic e D e pa rtm e n t within Cumber land County.

    2. Defendant,Camp Hill Borough (hereinafter "Defendant "),is a municipal corporation andpolitical subdivision of th e Commonwealth of Pennsylvania, organized and existing inaccordance with the provision of the Borough Code, 53 PS 45101 et. seq., ndmainta in ing a principle place of operat ion at 2145 Walnut Street, Camp Hill,PA,17011.

    3. Jurisdiction in th is m a tte r is properly situated in th e Cou r t of C o m m o n Pleas p u rs u an t tothe provisions of42 Pa.CS 31.

    4. Venue in th is matter is proper ly placed in th e Cour t of C o m m o n Pleas of Cumber landCounty pursuant to Pa.RP006, as it is in this venue that th e cause of action arose andth a t b o th p artie s can be found.

    ALLEGATIONS OFFACT

    5. Plaintiff is employed a s a pol ice officer of th e Camp Hill Borough Pol ice DepartmentPolice Depar tment ) since September 5, 1995 , presently serving in th e capacity of apatrolman.

    6. Pr ior to being h i red b y th e Po l i ce Depar tment , Plaintiff served in th e United States armedforces. To wit:Plaintiff served in th e Army (Reserve and Active Duty) nd th e ArmyNat ional Guard for var ious per iods of t ime between 1987 and 1997 .

    7. O n January 24,2009,Plaintiff enlisted in th e Pennsy lvan ia Army National Guard and h ascont inuous ly served a s a reservist t h rough th e present .

    8. In 2009, Plaintiff was d ep lo ye d to a ctiv e -duty service, equiring him to t ake a militaryleave of absence from h is employment a s a patrolman with th e Po l ice Department.P l a i n t i f f 'sep loymen t was to Fo rt Indiantown Gap;and h is service dates were from June7, 00 9 to August 16,2009.

    9. In 2010, Plaintiff was d ep lo ye d to a ctive -duty service, equiring him to tak e a militaryleave of absence from h is emp loymen t as a pat ro lman with th e Po l i ce Department.P l a i n t i f f 'sep loymen t was to Afghanistan;and h is service dates were from A u g u s t 1,

    2010 to approximately the beginning of January 2011. This deployment to a combatzonewasordered pursuant to 10USC 2301(D.

    10. In 2011, Plaintiff was deployed to active -duty service, equir ing h im to tak e a militaryleave of absence from h is e m plo ym e nt a s a patrolman with th e Pol ice Depar tment .P l a i n t i f f 'seployment wa s fo r th e purpose of provid ing service and s u pp ort to thosedevastated by Hurr icane Le e within Pennsylvania (state active duty); nd h is s ervic edates were from September 7,2011 t o Sep tember 11, 2011.

    11. In 2011, Plaintiff was deployed to active -duty service, equiring him to take a militaryleave of absence from h is employment a s a patro lman with th e Pol ice Depar tment .Plaintiffs dep loyment was to Fort Indiantown Gap f o r Wa rr io r Leader Training; and h isservice dates were from M ay 13,2011 to May 28,2011.

    12. In 2012, Plaintiff was d ep lo y ed to active -duty service, equir ing h im to take a militaryleave of absence f rom h is employment a s a patro lman with th e Pol ice Depar tment .P l a i n t i f f 'sep loymen t was to Cam p She lby in Mississippi; and h is service dates werefrom October 9, 01 2 to approximately February 2013.

    13. In each of th e above -noted instances, Plaintiff wa s approved fo r a military leave ofabsence upo n providing proof of h i s a c tiv e -duty orders to Defendant.

    14.In each of th e abo ve -noted instances, Plaintiff utilized h is accrued, but unused, eavetime.

    15. In each of th e ab ove -noted instances, Defendant fai led to pay Plaintiff a to ta l of fifteen15) ays paid military leave inaccordance with 51PaCSA 102.

    16.In th e in sta n ce for which Plaintiff was cal led to active duty for state service relating tosupport for Hurr i cane Lee,Defendant failed to pay Plaintiff for all of h is military leave inaccordance with 51 Pa.CSA 102.

    17. In April of 2013,Plaintiff requested th a t D e fe n d an t address th e failure to pay th e var iousperiods ofmilitary leave in each of th e y ea rs 2009,2010,2011 and 2012.

    18.By e -mail of April 23,2013, Defendant informed Plaintiff t ha t h e was du e and /or owedno t h i ng from the time period from 2009 t h rough 2012. D e fe n d an t a c k n o w le d ge d theirresponsibility under the 51 Pa.CSA102, however, b y stat ing t hey would providePaid Military Leave" or dates requested after April 16, 2013.
