    VOLUNTARY RETIREMENT:

    The Fundamental Rule 56(3) governs the issue of VoluntaryRetirement of Government Servants.

    A Government Servant, who wishes to retire Voluntarily from theGovernment Service, shall fulfill any one of the following conditions on thedate of Voluntary Retirement.

    20 Years of Qualifying Service should have been completed( or )

    Age of 50 years should have been attained.A notice of not less than 3 months shall be given in writing to the

    Appointing Authority, so as to reach such authority 3 months before thedate of Voluntary Retirement. It is enough to mark the copy of the noticeto the immediate superior. Before giving the notice, the GovernmentServant shall satisfy himself / herself that he/she has completed 20 years of

    Qualifying Service or attained the age of 50 years on the date ofVoluntary Retirement. Notice may be given even before completing 20years of Qualifying Service or attaining the age of 50 years. But the dateof Voluntary Retirement will be on or after completing 20 years of QualifyingService or attaining the age of 50 years.

    The period of 3 months notice shall commence from the date ofreceipt of notice by the Appointing Authority. If the date of VoluntaryRetirement before completion of 3 months from the date of receipt ofsuch notice by the Appointing Authority has been indicated, the reviseddate of Voluntary Retirement shall have to be worked out by the

    Appointing Authority himself and there is no need to give another notice

    indicating the revised date of Voluntary Retirement.The notice of Voluntary Retirement can be withdrawn with theapproval of the Appointing Authority either during the period of notice oreven after the acceptance of Voluntary Retirement, but before the expiryof the period of notice.

    The notice of Voluntary Retirement shall be accepted by theAppointing Authority subject to the fulfillment of the following conditions:

    No disciplinary proceedings contemplated or pending againstthe Government Servant concerned for the imposition of a majorpenalty;

    No prosecution contemplated or pending in a Court of

    Law against the Government Servant concerned; A report of the Director of Vigilance and Anti-corruption to

    the effect that no enquiry is contemplated or pending againstthe Government Servant concerned;

    No dues which cannot be recovered from Death-cum-Retirement Gratuity pending to be recovered from theGovernment Servant concerned; and

    no contractual obligation to serve the Government duringthe period in which the Government Servant concerned seeksto retire voluntarily.

    If no orders either accepting or rejecting the Voluntary Retirementare issued before the expiry of the notice period, the Government Servant

    shall be deemed to have been retired voluntarily from the GovernmentService at the end of the period of notice.A weightage of 5 years or the remaining Service till the date of

    Retirement on Superannuation, whichever is less, will be given in additionto the actual Qualifying Service for the purpose of Pension and Gratuity.No weightage will be given, if the actual Qualifying Service exceeds 30years. It will not entitle the Government Servant, who retired voluntarily, toany notional fixation of pay and only the pay drawn on the date ofVoluntary Retirement will be taken into account for the calculation ofPension and Gratuity.

    Unearned Leave on Medical Certificate or Unearned Leave on

    Private Affairs or Earned Leave may be availed during the notice periodof Voluntary Retirement. The Government Servant should rejoin duty afterthe expiry of Leave i.e. the Government Servant should be on duty onthe date of Voluntary Retirement. Leave on Loss of Pay shall not beavailed during the period of notice.
