Duy Xuyen 11 OkV substation and its branch line are constructed for:- Electrical supply for Tay An Industrial Zone, Duy Trung Commune, Duy XuyenDistrict,- Decreasing of loads of Out-going feeder N0547 of Nam Phuoc 35/15(22)kVtransfer substation,- Parting the transmission lines from Dai Loc 110/35/15kV and Thang Binh1 10/35/22kV substations.

2. Project locationDuy Xuyen 1 OkV substation is located on Village N04 - Duy Trung Commune -

Duy Xuyen District.The branch line is gone through Duy Trung Commune (Duy Xuyen District) with

the length of 70m.

7. Means for transportation of materials, equipment and machinery to the site

- Materials and equipment will be long-distance transported from freight yards andstorehouses of PMU by specific trucks and packaged suitably. After that, its will betransported to project site by trucks with loading capacity of 5 - 7.5 tons. After temporarilyloaded on roadsides, materials and equipment will be carried manually to construction site.

- Constructing materials such as: sand, stone, cement ... will be supplied by localsuppliers in local areas with the radius of 5 - 15 km.

- Materials and equipment will be imported into Da Nang Port and transported toconstruction site by trucks in the distance of 40km.

III- LEGAL FRAMEWORK

1. Vietnamese laws and regulations

- The Environment Law of The Socialist Republic of Vietnam issued at decisionN°52/2005/QHl 1 issued on December 29"h, 2005 and come into effect on July Is', 2006.- Decree N° 80/2006/ND-CP dated August 9"h, 2006 of Vietnamese Government on detailregulations and guidance on the implementation of some Articles of the Environment Law.- Decree N0 81/2006/ND-CP dated August 9 th, 2006 of Vietnamese Government onadministrative fine in environmental violation.- Circular No 08/TT-BTNMT dated September 8th, 2006 of Ministry of Natural Resourcesand Environment guiding the preparations of strategic environment assessment,environmental impact assessment and environmental safeguard commitment.- Decree No 106/2005/ND-CP dated August 1 7 th, 2005 of Vietnamese Government guidingthe implementation of some Articles of The Power Law on safety for high voltage powernetwork.- Decree No 24/2000/ND-CP of Vietnamese Government guiding the implementation ofThe Foreign Investment Law in Vietnam (Article 82 related to environment safeguard)- Vietnamese Standards are set by Ministry of Science and Technology and applied toGovernment Agencies. These standards include manufacture, construction, science andenvironment norms. Environmental standards include allowable levels of noise level, airand water quality.

IV. ENVIRONMENTAL IMPACT SCREENINGAND GENERAL

1. Environmental screening:

VII- PUBLIC CONSULTATION ANDINFORMATION DISCLOSURE

In the first stage of the project (2007), PMB has carried out following activities:(1) Information supply for and discussion with Local Authorities about substation

location and line route direction.(2) Check and inventory the number of effected households and impacts.(3) Contact with project affected households (PAHs)

When fulfil the check, PMB wvill co-ordinate with the Representatives of Districts,Communes and Villages (in project areas) to hold meetings for contacting with PAHs. Inthe meetings, PMB's staff will inform to them following documents: Summary of theproject; Draft of the Resettlement plan; Draft of the report on environmental impacts (thatcan occur when implementation of the project); Draft of the environmental managementplan; The maps; Statistics and Other related documents.

PAHs' questions are cleared up; propositions of PAHs and suggestions of localpeople will be recorded. PMB and Investor will recheck and consider when makingproject's design document and EMP. Suggestions of local people will be noted in minutesand collected in following table (See table 7.1 as follow)

(4) Continue to get feedback from PAHs.(5) Publicize information (official results)

The project has got decision of investment and construction engineering design -general budget approval only after appropriate adjustment of project location, designdocument, capacity and/or methodologies for meeting the demans of environmentalprotection and resettlement. In order to meet the demand of OP 4.01 on informationannouncement, PMU will be:

- Give documents of project summary, reports on resettlement plan andenvironmental management plan to the People's Committees of Communes and Districts(in project areas) in Vietnamese.

- Put up and announce to local people about the project summary, reports onresettlement plan and environmental management plan in 2 months, in working time at (1)Headquarters of District People's Commitees and (2) Comrnunal People's Commitees.

2. Responsibilities of Safeguard Independent Monitoring Consultant

al Objectives: The Independent Safeguard Monitoring Consultant (hereafterreferred as the Consultant) is required to provide assessment of the EMP implementation.The Consultant will carry out monitoring of mitigation measures by the contractors andimpacts of the project on environment and project affected people, verify the effectivenessof reporting procedures, and suggest corrective actions and/or measures for impronementto environmental performance compliance.

b/ Tasks:A. Monitor the implementation of EMP as suggested in EIA report on effects on

environment and local people by the project.

* Visually look at construction sites and monitor environmental issues included interms of references as well as in EMP, such as:

- General clean up after constructrion works,- Clear trees in forest land in project area (area, quantity, cleaning up woody

residues after tree cutting)- Status of access roads- Status of re-vegetation- Impacts by construction work (level of noise, dust and damage of roads...) atconstruction site and surrounding residential areas.- Status of construction worker camps and sanitation facilities for them- Proper distance between houses and transmission line- Status of implementation of safety measures- Other issues included in EIA

* Public consultation:- Assess the level of involvement by local Authorities in dealing with

environmental issues (dust, noise, damages to roads due to transportation of constructionmaterials, tree cutting on public land and protected zones)

- Identify any other environmental issues and record environmental complaintsfrom the PAHs.

- Report on responses (if any) from appropriate local Authorities on environmentalcomplaints or incompliance.

B. Assess the effectiveness of monitoring and internal reporting system to EMP ofPMB- PC3- EVN, as well as other related Agencies included in EIA report.

C. Make termly reports and give comments on changes when EMP implementationor monitoring or internal reporting in order to provide suggestions to PMU and PC on howto improve the EMP implementation as well as other environmental mitigating measures.

c/Schedule:The Consultant is required to provide semi-annual monotoring reports (every 6

months) for the project and the last one after one year that project commpleted.For the project which can be completed within one year, the Consultant has to carry

out mid-term and post-commissioning monitoring reports within 2 weeks after eachmission.
