Recommended Approval of Bids Extension of Bid #004-07: Internet Connectivity Services Opening Date: January 5, 2004 Original Term of Contract: January 20, 2004 – January 20, 2005 First Extension of Contract: January 20, 2005 – January 20, 2006 Second Extension of Contract: January 20, 2006 – January 20, 2007 Third Extension of Contract: January 20, 2007 – January 20, 2008 Fourth Extension of Contract: January 20, 2008 – January 20, 2009 (Supporting Information – Bid Recommendation Memo)

The above-referenced bid was previously extended at the January 31, 2007 Board Meeting. The current contract expires on January 20, 2008, and the specifications provide for an option to extend the original contract for four additional years, in one-year increments at $96,000 per year. The purpose of this bid is to provide a secure and unfiltered T-3 access to the internet for use by ESBOCES and any of its program participants. Open Access/Cogent of Melville, NY was awarded the bid. The service provided by Open Access/Cogent during the past four years was satisfactory and the vendor has agreed to extend the contract under the same terms and conditions specified in the original bid. RECOMMENDED MOTION: “BE IT RESOLVED, that the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, hereby extends the award of Bid #004-07: Internet Connectivity Services to Open Access/Cogent of Melville, NY for the period of January 20, 2008 through January 20, 2009.”

Extension of Bid #007-38: Field Trips and Coach Bus Services Opening Date: December 28, 2006 Original Term of Contract: January 31, 2007 – January 31, 2008 First Extension of Contract: January 31, 2008 – January 31, 2009 (Supporting Information – Bid Recommendation Memo)

The above-referenced bid for field trips and coach bus services was previously awarded at the January 31, 2007 Board Meeting to Alert Coach Lines of Ronkonkoma, NY; Baumann & Sons Buses, Inc. of Ronkonkoma, NY; and Hampton Jitney, Inc. of Southampton, NY. The current contract expires on January 31, 2008, and the specifications provide an option to extend the original contract for four additional years, in one-year increments. The specifications provide that the vendor(s) may increase prices for items by an amount equal to the current percentage used by the New York State Education Department (NYSED) for school district transportation contract increases, which is usually published in May of each year, not to exceed 4%. The May CPI was 2.5%. The Purchasing office negotiated with each of the vendors and one vendor agreed to an increase less than the renewal rates. The following table reflects the negotiated increases:

Term of Contract: January 30, 2008 – November 28, 2008 with an option to renew for two additional one-year periods. (Supporting Information – Bid Recommendation Memo, Award Report, and Disclosure Forms)

The Purchasing Office solicited bids to procure cosmetology and barber supplies for various ESBOCES locations. Bid specifications were developed in collaboration with the Career and Technical Education staff. Bids were requested for a total of 1,064 items. Bid packets were distributed to 17 vendors as a result of

advertising and direct solicitation. Five bids were received and one no-bid was received. Based on the results received for this bid, the estimated annual expenditure is approximately $70,000. The Purchasing Office contacted the lowest responsible bidders, Major Advance International; Marianna Industries, Inc.; OPI Products, Inc.; Symbiotic Salon Systems; and The Burmax Co., Inc, to negotiate better prices, and each vendor indicated that the prices were firm. All vendors have provided services to ESBOCES in the past, and their performance has been satisfactory. Of the 1,064 items bid, no bids were received for 557 items. Since this is the second time that we bid these items, and a majority of the items are from a sole source, we will purchase these items from direct quotes.

Bid packets were distributed to eleven vendors as a result of advertising and direct solicitation. One bid was received. Since there was a sole bidder, the Purchasing Office contacted the vendors who did not submit a bid. Based upon these discussions, some of the vendors indicated that they will submit a bid upon receipt of a new bid packet.

Reject Bid #008-59: HVAC Alterations at the James Hines Administration Center Opening Date: December 13, 2007 (Supporting Information – Bid Recommendation Memo)

The Purchasing Office solicited bids for the HVAC alterations at the James Hines Administration Center. Bid specifications were developed in collaboration with the Operations & Maintenance staff and the ESBOCES architectural consultant, Wiedersum Associates Architects, PLLC. Bid packets were distributed to eight vendors as a result of advertising and direct solicitation. Six bids were received. A letter from Summit Mechanical, the apparent low bidder, was sent to Pamela Betheil, Board President, indicating that the vendor misinterpreted the specifications provided by our architect. The Director of Administrative Services indicated that due to this misinterpretation of the specifications by Summit Mechanical, and their failure to withdraw their bid, it is necessary to issue a new bid.

RECOMMENDED MOTION: “BE IT RESOLVED, that the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, hereby rejects Bid #008-59: HVAC Alterations at the James Hines Administration Center.”

Award Bid #008-60: Rebid Learning and Literacy Seminar Conference Space Opening Date: December 20, 2007 Term of Contract: April 11, 2008 to April 12, 2008 (Supporting Information – Bid Recommendation Memo and Disclosure Form)

The Purchasing Office solicited bids to provide conference hall space and other accommodations for the Learning and Literacy Seminar. Bid specifications were developed in collaboration with the Educational Support Services staff. Bid packets were distributed to three vendors as a result of advertising and direct solicitation. One bid was received and one no-bid was received. Based on the results received for this bid, the estimated annual expenditure is approximately $50,000. The Purchasing Office contacted the sole bidder, Hilton Long Island Huntington to negotiate better prices, and the vendor indicated that the prices were firm. Hilton Long Island Huntington has provided services to ESBOCES in the past, and its performance has been satisfactory. The no-bid that was received from the Hyatt Regency Long Island indicated that it was unable to meet specifications due to space constraints.

Bid specifications were developed in collaboration with the Buildings and Grounds staff. Bid packets were distributed to ten vendors as a result of advertising and direct solicitation. One bid was received. Since there was a sole bidder, the Purchasing Office contacted the vendors who did not submit a bid. Based upon these discussions, some of the vendors indicated that they would submit a bid upon receipt of a new bid packet.

The Purchasing Office solicited bids for a second time to provide conference hall space and other accommodations for use by the Employee Assistance Program and Student Assistance Program. Bid specifications were developed in collaboration with the Employee Assistance Program and Student Assistance Program staff. Bid packets were distributed to three vendors as a result of advertising and direct solicitation. One bid was received. The Employee Assistance Program and Student Assistance Program recently notified the Purchasing Office that the conference will not take place due to scheduling conflicts. As a result, this bid is no longer required by the program.

The Purchasing Office contacted the low bidder, SunTrust Equipment Finance & Leasing Corp., to negotiate better index values. When each project is financed, Sun Trust Equipment Finance & Leasing Corp. agreed to lower all rates by four basis points provided that the resultant rate is not lower than the “A” rated muni

bond. References for SunTrust Equipment Finance & Leasing Corp. have been verified, and they have been found to be satisfactory.

RECOMMENDED MOTION: “WHEREAS, the Board of Cooperative Educational Services, First Supervisory District of Suffolk County (hereinafter “ESBOCES”), acts as the lead agency for participants in the Joint Municipal Cooperative Bidding Program (hereinafter the “Program”) organized pursuant to General Municipal Law §119-0 and Education Law §1950; and

WHEREAS, ESBOCES has been delegated the responsibility for awarding program bids on behalf of certain participants as evidenced by ESBOCES possession of a duly adopted resolution by each of their governing boards; and

WHEREAS, ESBOCES has solicited, duly received, and opened Bid #2008-008: Technology Education Supplies (Lumber/Tools/Metal/Etc.) Resolution to Participate in Onondaga-Cortland-Madison BOCES Cooperative Bid for the Purchase of Computer Peripherals

The purpose of this resolution is to authorize participation in the Onondaga-Cortland-Madison BOCES Cooperative Bid for the purchase of Computer Peripherals for the fiscal year beginning January 30, 2008.

RECOMMENDED MOTION: ”WHEREAS, it is the plan of a number of Boards of Cooperative Educational Services (BOCES) during the 2007-2008 school year to bid jointly for the purchase of Data Communications Equipment-OCM BOCES Bid #RFB-28-23; and

WHEREAS, the Board of Cooperative Educational Services (BOCES) desires to participate with other BOCES in New York State in the joint bidding of the above-mentioned commodities as authorized by General Municipal Law, Article 5-G; and

THEREFORE, BE IT RESOLVED, that the Eastern Suffolk BOCES Board hereby appoints the Onondaga-Cortland-Madison BOCES to represent it in all matters related to the above, which are relative to the fiscal year 2007-2008.”

K. Recommended Approval of Eastern Suffolk BOCES School Library System

Council Members (Supporting Information - List) Recommendation is made to approve the Eastern Suffolk BOCES School Library System Council Members for 2007-2008. The council advises the School Library System of policies and procedures. The terms are for three years, and the council meets four times a year as specified in the Commissioner's Regulation. Recommended Approval for Students and Staff to Attend the Greater New York Automotive Dealers Association State Competition Recommendation is made to approve the attendance of four students and two staff members from the Harry B. Ward Technical and Academic Center at the Greater New York Automotive Dealers Association (GNYADA) State Competition at the GNYADA Center in Whitestone, New York on Tuesday, February 5, 2008.

Our students competed on January 10, 2008, at the GNYADA regional competition and have been invited to compete in the GNYADA state competition. The cost to the agency is approximately $932.25 for bus transportation. Ward Technical and Academic Center to participate in the ProStart Culinary Competition at the Culinary Institute of America in Hyde Park, New York on February 8 and 9, 2008.

Our students participating in this prestigious competition have been hand-picked by the instructor according to their ability, experience, and dedication to the trade and will be judged by some of the most qualified culinaries in the country. This competition is an excellent showcase for our Eastern Suffolk BOCES culinary students, and the experience gained from this high-end contest, coupled with exposure to other top culinary students from around the state, will be invaluable.

Students will be competing for scholarships and awards and will be given the opportunity to compete in the national competition in San Diego, California.

The total cost to the agency is approximately $2,346. The agency will be reimbursed for all costs through a legislative grant, which was received through Senator Charles Fuschillo and designated for a Suffolk County school to showcase young culinary talent. Milliken Technical Center, Islip Career Center, and Harry B. Ward Technical and Academic Center to attend the Career Education Day at Raceway Park in Englishtown, New Jersey on Friday, June 20, 2008.

This trip will allow students to observe performance engines being built and run in a safe and controlled environment; to be exposed to career possibilities in the automotive and military fields; and to speak with pit crews, drivers, owners, and vendors about job opportunities in motor sports. The only cost to the agency is approximately $5,300 for bus transportation. RECOMMENDED MOTION: “BE IT RESOLVED, that the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, hereby approves the attendance of 130 students and 16 staff members from the Edward J. Recommendation is made to approve the attendance of 225 students and 25 staff members from the Islip Career Center, Harry B. Ward Technical and Academic Center, and Edward J. Milliken Technical Center to attend the 2008 Automotive Career Fair on Wednesday, March 26, 2008.

Attendance at the 2008 Automotive Career Fair will afford students the opportunity to interact and learn about careers in the automotive industry as car manufacturers, suppliers, and automotive training centers will be gathered in one location. In addition, students will have a chance to win over $100,000 in tools

from Snap-On Tools and college scholarships from various colleges. The only cost to the agency is approximately $4,463.50 for bus transportation. Corrections is an integral part of the Law Enforcement curriculum, and employment as a Corrections Officer is a realistic goal and a viable opportunity. Visiting and touring the New York City Corrections Academy will allow students from the Law Enforcement I Program to observe recruit training at the academy. The cost to the agency is approximately $575 for bus transportation. S. Recommended Approval of the Eastern Suffolk BOCES Central Shared Decision Making Plan Recommendation is made for the approval of the Eastern Suffolk BOCES Central Shared Decision Making Plan. The plan was developed in 1994 in accordance with the State Education Department's guidelines. The Central Shared Decision Making Committee meets monthly to discuss agency-wide concerns. Every two years the Eastern Suffolk BOCES Plan must be reviewed. At its January 7, 2008 meeting, the committee reviewed and unanimously recommended that the current plan remain in effect. Upon Board approval, it will be submitted to the State Education Department prior to the March 1, 2008 deadline.” RECOMMENDED MOTION: “BE IT RESOLVED, that the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, hereby approves the Recertified Plan for Shared Decision Making and School Based Planning as part of the 2008 Biennial Review Process.”

T. Recommended Approval of a Multi-Year Service Agreement – Project #MP-25-010708-2007-2012 for the Miller Place Union Free School District (Supporting Information – Agreement) This is a five-year, multi-year service agreement for the installment purchase of 16 Oce network copier/printer systems by the Miller Place Union Free School District. ESBOCES will purchase the equipment, which will be leased to the district through the Regional Information Center. This equipment does not require third party financing as it is being purchased through a New York State Contract that provides for zero-interest deferred payments. The estimated cost for the project is

$1,055,907.60 and consists of $518,856 for equipment costs, $441,060 for maintenance, and $95,991.60 for project coordination fees.

U. Recommended Approval of a Capital Project - Sayville Learning Center

This Capital Project is being established to fund the ventilation and air conditioning project at the Sayville Learning Center. The project includes the removal of all window air conditioning units, the installation of new split air conditioning units with wall-hung evaporators and roof mounted condensers which will serve all occupied spaces, and the installation of dedicated outside air systems to provide ventilation to all occupied spaces and repair of the heating controls. This work will be limited to the main floor and second floor (not to include the Cafeteria and Gymnasium) at an estimated cost of $350,000, which includes the construction cost of $300,000 and architect/engineering fees at a cost not to exceed $50,000. RECOMMENDED MOTION: “BE IT RESOLVED, that the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, hereby approves the establishment of a capital project for the installation of air conditioning and ventilation at the Sayville Learning Center at an estimated cost of $350,000.”

V. Recommended Approval of a Capital Project - Jefferson Academic Center - Serving Kitchen

This Capital Project is being established to fund the installation of a hand washing sink in the cafeteria of the Jefferson Academic Center at an estimated cost of $50,000 which includes all contingencies and fees to provide the necessary carpentry, plumbing and electricity and architect/engineering fees. RECOMMENDED MOTION: “BE IT RESOLVED, that the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, hereby approves the establishment of a capital project for the installation of a hand washing sink at the Jefferson Academic Center at an estimated cost of $50,000.”

This Capital Project is being established to fund renovations in rooms 2, 12 and 18 at the Brookhaven Academic Center East to accommodate the North Country Learning Center population programmatic needs. Classroom 2 will be divided in two classrooms, and all commercial kitchen equipment will be removed at an estimated cost of $225,000; classroom 12 will be divided into two classrooms at an estimated cost of $225,000; and classroom 18 will be divided and designed into office and storage areas in the rear of the room and classroom space in the front of the room at an estimated cost of $225,000. All classrooms will conform to SED regulations and all estimates include the necessary contingencies, incidental costs, and architectural/engineering fees. Y. Recommended Approval of a Lease Amendment with Port Jefferson Union Free School District

(Supporting Information - Amendment)

This amendment to the lease with the Port Jefferson Union Free School District that was approved at the June 27, 2007 Board Meeting for use of the Spring Street School building and parking facilities to house the Jefferson Academic Center will modify the original lease to include alterations to the main parking lot to create additional parking. The term of this agreement is from January 30, 2008 through June 30, 2008 in an amount not to exceed $765,383. This leasehold space agreement provides for the use of two classrooms at the Aquebogue Elementary School and one classroom at the Riverhead Middle School in the Riverhead Central School District for a five-year period commencing September 1, 2007. The total annual base rent for the 2007-08 year is $8,200 per classroom for the two classrooms at the Aquebogue Elementary School and $4,100 for the one classroom at the Riverhead Middle School, totaling $20,500, plus annual construction costs for the two classrooms at the Aquebogue Elementary School at $10,522 per classroom, totaling $21,044. The base rent is frozen for the 2007-08 year unless the Consumers Price Index exceeds three percent, in which case the base rent shall increase by the amount in excess of three percent.

The original lease agreement with New York Institute of Technology (NYIT) was approved at the August 30, 2005 Board Meeting for the use of 12,284 square feet of space on the first floor of Kennedy Hall at the Central Islip Campus by the ESBOCES adult nursing program. The first amendment of the lease added the second floor of Kennedy Hall—excluding rooms 204, 205, 206, and the second floor common area for the period August 1, 2006 through December 31, 2006; and then commencing on January 1, 2007 and continuing through August 31, 2007, added the entire second floor, including rooms 204, 205, 206 and the second floor common area. Upon execution of this second amendment, commencing September 1, 2007, ESBOCES will lease the entire first and second floors of Kennedy Hall for a term to run coterminous with that of Challenger Hall through June 30, 2008. The total annual rental, including utilities, cartage, and electric will be $301,190.30 or $25,099.19 monthly. HH. Recommended Approval of a Resolution at the Brookhaven Academic Center West (BRAC-West) - Emergency Repairs Due to Water Main Break

The Director of Administrative Services is recommending the approval of a

resolution declaring the condition at the Brookhaven Academic Center West (BRAC West) an emergency requiring immediate repair due to a water main break. The service provided by WindRiver Environmental included an emergency backhoe mobilization and de-mobilization, an emergency operator, an on-site supervisor, an emergency plumber for on-site mobilization and de-mobilization, and parts at a cost of $10,370.

RECOMMENDED MOTION: “WHEREAS, on November 16, 2007, the administration of the Eastern Suffolk Board of Cooperative Educational Services learned that there was a water main break at the Brookhaven Academic Center (BRAC West); and

WHEREAS, the condition at the BRAC West requires immediate repair, which

repair could not await competitive bidding; THEREFORE, BE IT RESOLVED, that the Board of Trustees of the Eastern

Suffolk Board of Cooperative Educational Services hereby declares the water main break at BRAC West an emergency requiring repairs which could not await competitive bidding; and

BE IT FURTHER RESOLVED, that the District Superintendent shall be authorized to retain the services of WindRiver Environmental to contract for such repairs at the BRAC West as are necessary to rectify the emergency as declared herein.”

II. Recommended Approval of an Agreement with 1199 SEIU League Training and Upgrading Fund (TUF)

(Supporting Information - Agreement)

This is an agreement with 1199 SEIU League Training and Upgrading Fund (TUF) through which the TUF will provide tuition assistance to students attending the ESBOCES Adult Education Licensed Practical Nursing program. This agreement covers full-time day and part-time evening sessions from September 5, 2007 to March 27, 2009.”

RECOMMENDED MOTION: "BE IT RESOLVED, that the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, hereby approves the agreement with 1199 SEIU League Training and Upgrading Fund (TUF) for tuition assistance for students attending the ESBOCES Licensed Practical Nursing program for the period of September 5, 2007 to March 27, 2009.”

JJ. Recommended Approval of an Agreement with the Brentwood Public Library (Supporting Information - Agreement)

The Brentwood Parent-Child Home Program will be providing the Brentwood Public Library with a Bilingual Story Time for one hour, one Saturday per month, from November 2007 through May 2008. The Brentwood Public Library will be compensating the Brentwood Parent-Child Home Program $1,050 per hour for these services, which includes supervision by a teacher, two home visitors, and all necessary supplies and materials. There is no cost to ESBOCES. RECOMMENDED MOTION: “BE IT RESOLVED, that the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, hereby approves the agreement with the Brentwood Public Library for a monthly Bilingual Story Time provided by the Brentwood Parent-Child Home Program.”

This is a proposal for a four-year, purchase option plan of a Xerox 4595 Digital Copier/Printer for use in the Model Schools program. This equipment is being purchased through New York State Contract #PC-59472 that provides for zero-interest purchase option plan. The optional buy-out is $1,010. The estimated cost is $40,445.76 for equipment costs and 35,000 copies per month; additional copies at $.0060. This is a replacement for an existing machine. The monthly cost is changing from $953.43 that includes 35,000 copies per month to $842.62 for 35,000 copies per month.
