Award RFP #20-19-0514: Internal Audit Services Opening Date: May 14, 2019 Term of Contract: July 1, 2019 - June 30, 2020 with an option to extend for four additional years in one-year increments (Supporting Information – Bid Recommendation Memo, Award Report, and Disclosure Form) The Purchasing Office solicited bids to procure internal audit services. Request for proposal specifications were developed in collaboration with the Business Services staff. Proposal packets were distributed to 16 vendors as a result of advertising and direct solicitation. Five proposals and one no bid were received. An RFP review committee was established consisting of Christopher Carlos, Colleen Lipponer, Patricia McCabe, William Miller, Catherine Romano, Ryan Ruf, and Wendy Tromblee. The committee evaluated each proposal based on the vendor’s compliance with the RFP specifications using the evaluation criteria specified in the RFP. This was a two-phase evaluation consisting of review of the criteria and interview. The two vendors who scored the highest were interviewed. Based on both parts of the evaluation, the compilation of all evaluators scores were averaged and the results are as follows: Cullen & Danowski, LLP scored 90.42 points and Questar III BOCES scored 90.17 points. Agreed-Upon Procedures from Bonadio & Company, LLP (Supporting Information – Report on Applying Agreed Upon Procedures) The New York State Office of Alcohol and Substance Abuse Services requires that

the New York State Consolidated Fiscal Report submitted for the program be reviewed by an independent auditor before they approve it. To that end, the agency’s independent auditor, Bonadio and Company, LLP, has performed Agreed-Upon Procedures and issued their report, which contained one comment:

“Although the Consolidated Fiscal Report reporting period is January 1, 2018

through December 31, 2018, the information that is included in this report for the OPWDD Supported Employment program is for the period of July 1, 2017 through June 30, 2018. The funding source is aware of this and has indicated that management can continue to record this information using a different fiscal period.”

Card, LLC (Supporting Information – Amendment to Agreement and Disclosure Form) This amendment to the agreement with ScholarChip Card, LLC will allow Eastern Suffolk BOCES to continue to offer software that manages classroom attendance, visitor management, staff attendance, and emergency notifications to school districts, for an additional one-year term commencing on July 1, 2019 and ending on June 30, 2020, at a cost not to exceed $900,000, which will be offset by school district participation. UU. Recommended Approval of an Amendment to the Agreement with Kmart

Corporation (Supporting Information – Amendment to Agreement) This amendment to the agreement with Kmart Corporation will provide flu immunizations to practical nursing, medical assisting, and nurse assisting students for an additional one-year term commencing on July 1, 2019 and ending on June 30, 2020, at no cost to Eastern Suffolk BOCES. RECOMMENDED MOTION: “BE IT RESOLVED, that the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, hereby approves an amendment to the agreement with Kmart Corporation for an additional one-year

VV. Recommended Approval of an Amendment to the Agreement with Educational

Vistas, Inc. (Supporting Information – Amendment to Agreement and Disclosure Form) This amendment to the agreement with Educational Vistas, Inc. will allow Eastern

Suffolk BOCES to continue to offer the DataSync Tool, which connects to Student Information Systems (SIS) of participating school districts, and runs or executes scheduled tasks to create current data files in the specified format as required for upload into the Eastern Suffolk BOCES Assessment Reporting System (BARS) program for an additional one-year term commencing on July 1, 2019 and ending on June 30, 2020, at a cost not to exceed $65,000.


Educational Services, First Supervisory District of Suffolk County, hereby approves an amendment to the agreement with Educational Vistas, Inc. for an additional one-year term commencing on July 1, 2019 and ending on June 30, 2020, at a cost not to exceed $65,000.”

WW. Recommended Approval of an Amendment to the Agreement with Certica

Solutions, Inc. (Supporting Information – Amendment to Agreement and Disclosure Form) This amendment to the agreement with Certica Solutions, Inc. will extend the agreement for an additional one-year term commencing on July 1, 2019 and ending on June 30, 2020, at a cost not to exceed $175,000. RECOMMENDED MOTION: “BE IT RESOLVED, that the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, hereby approves an amendment to the agreement with Certica Solutions, Inc. for an additional one-year term commencing on July 1, 2019 and ending on June 30, 2020, at a cost not to exceed $175,000.”

XX. Recommended Approval of a Resolution to Authorize Transfers to Reserve Funds

A recommendation is being made for the approval of the following resolution to authorize maximum amounts to be transferred to reserve funds from the year-end surplus when the year-end surplus is finalized. The remaining surplus will be returned to the participating school districts of each Co-Ser based on their participation in accordance with Education Law.

RECOMMENDED MOTION: “BE IT RESOLVED, that the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, hereby authorizes the transfer of 2018-19 program surplus to the Accrued Liability for Compensated Absences in an amount not to exceed $8,000,000.

BE IT FURTHER RESOLVED, that the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, hereby authorizes the transfer of 2018-19 program surplus to the Teachers’ Retirement Contribution Sub-Fund Reserve in an amount not to exceed 2% of TRS payroll for the preceding fiscal year.

BE IT FURTHER RESOLVED, that the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, hereby authorizes the transfer of 2018-19 program surplus to the Retirement Contribution Reserve in an amount not to exceed $3,000,000.”

YY. Recommended Approval of an Amendment to the Lease Agreement with the West

Islip Union Free School District (Supporting Information – Amendment to Lease Agreement) It is being recommended by the Director of Administrative Services that the Board

approve this amendment to the existing lease agreement with the West Islip Union Free School District for the use of the building and land by Eastern Suffolk BOCES for its Special Education Program at the Emil D. Masera School located at 650 Udall Road, West Islip, NY for an extension of three additional months commencing on July 1, 2019 and ending on September 30, 2019.


Educational Services, First Supervisory District of Suffolk County, hereby approves an amendment to the existing lease agreement with the West Islip Union Free

School District for use of the building and land by Eastern Suffolk BOCES for its Special Education Program at the Emil D. Masera School located at 650 Udall Road, West Islip, NY for an extension of three additional months commencing on July 1, 2019 and ending on September 30, 2019. The total rent for the period of July, August, and September 2019 shall be $103,957.80, plus additional rent of $3,847.74 for the two months of July and August for security services. This amendment to the lease agreement was developed by a committee of supervisory district and Eastern Suffolk BOCES representatives, fulfills the New York State Education Department’s Special Education Space Requirement Plan and is in the best financial interest of the supervisory district.”

ZZ. Recommended Approval of an Amendment to the Leasehold Space Agreement

with the Sachem Central School District (Supporting Information – Amendment to Leasehold Space Agreement) It is being recommended by the Director of Administrative Services that the Board

approve this amendment to the existing leasehold space agreement with the Sachem Central School District, which commenced on September 1, 2018 and ends on June 30, 2023, to lease the entire building known as Tecumseh Elementary School located at 179 Granny Road, Farmingville, NY as of July 1, 2019 rather than portions of the building, and to extend the lease for an additional year until June 30, 2024; the premises of the revised leasehold are deemed to contain

approximately 68,370 square feet and the revised lease will run from July 1, 2019 through June 30, 2024.


Educational Services, First Supervisory District of Suffolk County, hereby approves this amendment to the existing leasehold space agreement with the Sachem Central School District, which commenced on September 1, 2018 and ends on June 30, 2023, to lease the entire building known as Tecumseh Elementary School located at 179 Granny Road, Farmingville, NY as of July 1, 2019 rather than portions thereof, and also extend the lease an additional year until June 30, 2024. The total annual base rent for the 2019-20 school year shall be $534,188.40. The rent will increase by the property tax cap’s most recent allowable growth factor (i.e., the lesser of 2% or the CPI-U) in each subsequent year of the lease (2020-21, 2021-22, 2022-23, and 2023-24). This amendment to the leasehold space agreement was developed by a committee of supervisory district and Eastern Suffolk BOCES representatives, fulfills the New York State Education Department Special Education Space Requirement Plan, and is in the best financial interest of the supervisory district.”

AAA. Recommended Approval of an Amendment to the Agreement with Project Lead the

Way, Inc. (Supporting Information – Amendment to Agreement and Disclosure Form)

Recommendation is being made to approve an amendment to the agreement with Project Lead the Way, Inc. for the participation and curriculum fees associated with the curriculum used by Eastern Suffolk BOCES Regional Science, Technology, Engineering, Mathematics (STEM) High School for a one-year term commencing on July 1, 2019 and ending on June 30, 2020. The participation fee is $5,000 and any additional fees will not exceed $9,600 for a total of $14,600. window replacement project at the Brookhaven Learning Center West in the credit amount of $5,000. This credit amount was the result of an allowance within the specifications that was not used. The contractor, Empire Energy Specialists, and the architect, BBS Architects, Landscape Architects & Engineers, PC, have signed

The estimated cost is $7,574.88 for equipment and maintenance costs and 5,000 copies per month; additional black and white copies at $.0039. The monthly cost is changing from $141.66 per month for 3,000 copies per month to $157.81 per month for 5,000 copies per month. This is a replacement for an obsolete machine. PPP. Recommended Approval of the Transfer for Reimbursement of Funds from the

Graduating Senior Scholarship Account (formally general donations) to the Fitzgerald Donation Account

During the 2018-19 school year, in accordance with the donor’s wishes, the Fitzgerald Donation Account paid to support various activities in ESBOCES Special Education programs. At this time, it has an unfunded balance of $213.21. At the recommendation of the internal auditors, a scholarship committee was convened consisting of Peggie Staib, Colleen Lipponer, Maryellen Marinaro, and Trish Rivers to determine how to balance the account. The committee is recommending that $213.21 be transferred from the Graduating Senior Scholarship Account (formally general donations) to the Fitzgerald Donation Account.

RECOMMENDED MOTION: “BE IT RESOLVED, that the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, hereby approves the transfer of $231.21 from the Graduating Senior Scholarship Account to the Fitzgerald Donation Account.”

QQQ. Recommended Approval of the List of Eastern Suffolk BOCES School Library System Council Members for the 2019-20 School Year (Supporting Information – List of Eastern Suffolk BOCES School Library System Council Members)

A recommendation is made to approve the list of Eastern Suffolk BOCES School Library System Council Members for the 2019-2020 school year. The Council advises the School Library System of policies and procedures. The Council’s term is for three years and the Council meets four times a year, as specified in the Commissioner's Regulations.

RECOMMENDED MOTION: "BE IT RESOLVED, that the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, hereby approves the list of Eastern Suffolk BOCES School Library System Council Members for the 2019-2020 school year.”

RRR. Recommended Approval of an Amendment to Resolution Approved at May 15, 2019 Board Meeting for Student and Staff to Attend the SkillsUSA National Conference

At the May 15, 2019, Board Meeting, the Board approved a resolution for one student and two staff members from the Gary D. Bixhorn Technical Center to attend the SkillsUSA National Conference in Louisville, KY from Monday, June 24, 2019 through Friday, June 28, 2019, at a cost not to exceed $5,200.00. It is recommended that the Board approve an amendment to the resolution for the additional expense of a single hotel room to be utilized by the administrator attending the conference. The cost to the agency will be $790.00 for the single hotel room. The total cost to the agency for the student and staff to attend the SkillsUSA National Conference will not exceed $5,990.00.

RECOMMENDED MOTION: "BE IT RESOLVED, that the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, hereby approves an amendment to the resolution for the addition of a single hotel room to be utilized by the administrator attending the conference for $790.00 and that the total cost to the agency for the student and staff to attend the SkillsUSA National Conference will not exceed $5,990.00.”
