.....li:.lil:..........To improve the efficacy of the Regulation on the Permlsslon for Forelgn Researchers to Conduct Researchin Thalland 8.E, 2525, the Executive Eoard of the Narionat Research Louncif of Thalland issues thefollowing regulations as authorlzed In Sections 6, l1 (12) and (13) as wellas ln Sectton 13 of theNational Research'Council Act B,E. 2502, amended by the Nattonal Research Councy Ad B.E. 2507, andthe Announcement of the Revolution Pafty vot, 3ls dated December 13, B.E. 2515 ;

Articfe 1 These regulatlons shall be called "Regulations on the Permlssion for Foretgn Researcherc toConduct Research in Thailand B.E 2550."

Article 2 These Regulations become effectlve on the next date announced In the Royal Gazette.

Articfe 3 The Regulation on the Permission for Foreign Researcherc to Conduct Research in Thaitand B,E.2525 ls repealed.

Artlcle 4 These regulations on the permisslon for foreign researcherc to conduct research ln Thallandhave been formulated to achieve the followlng objectives;

(1) Enhanclng cooperatlon and collaboratlon betweenThai and foreign researchers, and providingopportunfties for the exchange of knowledge, technlcaf expertise, and Cxperience

(2) Promoting research activltles ln Thalland so that the results can be used to further the country'sdevelopment

(3) Stabilizing the soclal and economic security of Thalfand(4) Controlltng and regulatlng the country's natural resources to ensure that Thailand recelves their

beneflts.

Artlcle 5 In these regulatlons:

"Regearch" means scholarly or sclentiflc Investlgatlon, exploratlon, excavatlon, analylls, orexperlrnentatlon. The goal of tils enterprlse is to not only to search for new prlnciples and knowledge inorder to formulate theories or to establlsh guldelines for lmplementation, but also to gatn In-depthknowledge or develop modem technology in the subJect being researched.

uOffice" means the Natlonal Research Council of Thalland (NRCI).

"Thai researcher" means a researcher who is a Thai cltizen and conducts research In cooperation wlthforeign researchers; a Thai universlty faculty member who gerves as a co-advisor, an academic, and/oran officlal of a partlcipating organization who ls asslgned to jolntly conduct research or collaborate wlthforeign researchers.

nForelgn regearchern means a researcher who is not a Thal citlzen, who resides in Thalland or elsewhere,and conducts research In Thafland as an Indivldual or wfth a group.

Aftlcle 6 The Secretary-General of the Offlce is charged with admlnlsterlng these Regulatlons and hasthe authorlty to igsue announcements or alter procedures related to conformity wlth these Regulations.

In the event of any amblguity In these Regulatlons or other problems regardlng procedures not specifiedln these Regulatlons, the declsion of the Executive Board of the Office wifl be flnal,

Chapter IGencral Provlelong

Artlclc 7 Research should possess one or more of the following characteristics:(1) Useful to each party or particfpant; not for the beneflt of one researcher only(2) Fulfills graduation requirements for the degree program of a forelgn researcher(3) Constltutes a cooperatlve or asslstance program between a forelgn govemment or Instltute and a

Thal Instltute of governmental branch.

Afticle 8 Forelgn researchers wlll be classlfled into one of the followfng four categorles:Category one - foreign researchers who conduct research ln Thalland under Jn aid program or a

cooperative program wlth the Thai governrnent.Cstcgory two - foreign researchers who conduct research in Thailand under a cooperative agreement

between a dlvlslon of the Th-ai government and a foreign organlzatlon. Letters of verificailon lnclirding aMemorandum of understandlng (Mou) slgned by each organlzation are requlred.

If a foreign researcher conducts research wlth a Thai governmental organlzaflon or governmentalacademlc institute, a letter of recomm€ndatlon from the organizaflon ls needed.

Category three - forelgn researchers who conduct research ln Thailand to fulflll graduationrequirements for a degree program at a forelgn unlverslty *

Category four - forelgn researchers whose quallfications dlffer from those specified In the abovethree categories.

Artlcle 9 Research involving a forelgner must be conducted jolntty wlth a Thal researcher or consultant.However, a forelgn researcher can apply to conduct research as an lndivldual. Authorlzation for researchby a foreigner acting as an indivldual depends upon the decislon of the Office and related organlzaflons,

Article 1O Depending on thelr researcher category, forelgn researchers must take responslblllty forexpenses Incurred In Thalland in accordance wlth the followlng sflpulations:

Foreign researchers in category one will be responsible for all expenses.

Forelgn researchers in category two wlll be responslble elther for some or aff expenses as specifled in theMOU.

Forelgn researchers in categories three and four will be responslble for all expenses. lncludlngremuneration for Thai researchers. laboratory fees, and the wages of research asslstants (if any) unless aThai organizatlon agrees to take responsiblllty for such expenses.

Arffclc tl The Secretary-General ls authorized to requlre a monetary deposlt that wlll be returned uponsubmlssion of the complete and final research report.

At'lfcle t2 IC a forelgn researcher vlolates these regulatlons or strays from the stated research objecHvesor proposed research plan, the Office reserves lts rlght to termlnate the researcherk research perrnlt inThailand.

If a forelgn researcher's conduct ls deemed to be detrlmental to natural resources, the environment,society, or the security of Thalland, the Offlce reserves its rlght to termtnate the researcher's researchpermlt in Thalland,

Chaptar 2Applylng for Permlseion to Conduct Rescarch in Thalland

Article 13 Forelgn researchers must review this document, Regulatlons on the Permisslon for ForelgnResearchers to Conduct Research in Thailand 8,8.2550 and request an Application Form for Permlsslon toConduct Research (M94, from the Offlce.

Afiicle 14 Thal organlzatlons conducting thelr own projects with forelgn researchers in category one are

required to provide the Offlce wlth informatlon concernlng the foreign researcher using the form "USl/t"wlthln 15 days of the project's commencernent.

Forelgn researcher under categorl€s two, three and four should submit the followlng documents to theOfflce at least 90 days prlor to thelr anticipated starting date:

(1) Appllcation for Permlssion to Conduct Research(2) Letters of recommendatlon

Artlcle 15 If the forelgn researcher ls In Thaltand when submitting the application, he or she should notstart research untff recelvlng the permlt from the Qfflce,

Articlc 16 Upon recelving authorizatlon to conduct research In Thailand, foreign researchers should brlngthe permission letter from the Office to a Royal Thai Embassy or Consufate to appfy for a non-lmmlgrantvisa.

' Articf e 17 If a foretgn researcher recelves the permlssfon letter while he or she ts In Thaltand, he or sheshould repoft to the office ln person or vla email wlthln seven days from the date the permlsslon letterwas recelved to,complete Form NRCT-O2 and recelve an identiflcaHon card and reporlng letter(s)addressed to collaborating Thai researchers or other speclfled organizations.

Chapter 3Repoftlng and Pcying the Oeposlt for the Complete Report

Artlcle 18 Forelgn researchers must report to the Office in person or vta emall wlthln seven days aftertheir arrival in Thalland or after the date they receive their permisslon letter to register lnorm niRCf-Oz),receive an ldentlficatlon card, and receive reporting letter(s) addressed to the colliborating Thal "researchers or organization(s).

Article 19 Forelgn rescarchers In categories three and four must pay a deposlt guaranteeing submlsslonof the complete research report of 10,000 baht per proJect. The deposit wiit be rEturned to tFe foreignresearcher upon receipt of the complete repoft by the Office.

Artfcle 2o Forelgn researchers need to meet wlth thelr Thal coflaborators prior to conducting research.

Article 22 Should lt become necessary to change the research plan, the forelgn researcher must Informthe ofilce at least 60 days before the project's scheduled completion date in alcordince wlth the office'sspeciflcatlons,

ArHclc 23 While conductlng research, the foreign researcher must submit a progress report In Engllsh orThai to the Office and to collaboratlng Thai researchers in agreement wlth Form ttncr-oj followinf thetlme schedule specified by the Office.

Chapter 5Applylng for a Research Permit Extenrlon

Articfe 24 Forelgn researchers who wlsh to extend the duratlon of thelr prgject must submit theApplication Form for Research Extension Permlssion (N*€l!9il to the Offlce at least 60 days prlor to theexplratlon date of thelr permlt.

The decisfon to approve the applfcatlon for extension wlll be decided by the Offlce togother with theresearchert collaborati ng Thai org anization(s).

Artlcle 25 A summary report In Engllsh or Thai and a research plan must be submltted to the Office as asupplement to Form NRCT-O4 when applylng for a research permlt extension.

Chapter 6Compfsting Reccarch ln Thalfand

Artlcle 26 After completlng thelr research in Thalland, forelgn researchem must submlt a summary oftheir research actlvlties in English orThal on Form NRCT;Q5 to the Office and to theirThal collaboratorswithin one month from the day that thelr research In Thalland terminates.

Artiele 27 Forelgn researchers must submlt all research samples collected durlng the course of thelrresearch together wlth the summary of thelr research actlvitles to the Offlce and/ar to a Thaiorganization(s) approved by the Office.

Article 28 lf a forelgn researcher needs to take research sampfes abroad for further analysls, he or shemust receive permlsslon from the Office orfrom the collaborathg Thal organizatlon(s) Involved.

Artlclc 29 Forelgn researchers must submlt a CD with a copy of their complete report ln English or Thaifoffowlng the guldelines In Form NRCT-05 to the Offlce wlthin one year from the termlnatlon date of theirresearch actlvities ln Thalland.

If a foreign researcher has requested an. extenslon of their researdt permit, the deadlfne for submlttingthe complete repoft may not exceed two years after the completion of the research conducted InThailand.

Adlcle 30 A forelgn researcher who has prevlously received a permlt to conduct research In Thallandmust submlt the complete report from their latest prorect to the Offlce before applylng for a new researchpermit.

The Office may allow a foreign researcher to conduct research on more than one concurrent project inThalland if approprlate.

Arffcle 31 Foreign researchers must submlt all published research articles related to thelr research InThailand as a hard copy and on CD wlthln three months of publicatlon ln the splrlt of dlsseminatlngresearch results in thelr country of origln.

Article 32 Violating the provlsion3 specified ln thls Regulatlon, conducting research other than thatspeclfied ln the approved research project, or fallure to submlt research repofts or other documents in atlmely manner are sufflclent grounds for the Offlce to revoke a researcher's permit.

The Offfce may cancel a forelgn researcher's permlt or non-lmrnlgrant vlsa by coordinating wlth therelevant Thal organizatlon(s).
