Memorandum of Understanding between the Government of the Republic of India and the Government of the United Arab Emirates on Mutual Exemption of Entry Visa Requirements for Holders of Diplomatic, Special and Official Passports The Government of the Republic of India and the Government of the United Arab Emirates (hereinafter jointly referred to as the "Parties"), Desiring to develop their bilateral relations and strengthen the existing cooperation between the two countries, Confirming their willingness to exempt the nationals of their two countries, who are holders of diplomatic, special and official passports, from entry visa requirements to enter each other's territory, Taking into account the Vienna Convention on Diplomatic Relations of 1961 and the Vienna Convention on Consular Relations of 1963, Have agreed as follows: Article 1 The nationals of the two countries holding the following passports are exempt from visa requirements: (a) for nationals of the United Arab Emirates: diplomatic and special Passports which have a remaining period of validity of not less than six months; (b) for nationals of the Government of the Republic ofIndia: diplomatic and official, which have a remaining period of validity of not less than six months. Article 2 1. Each Party shall allow the other Party's nationals holding the passports specified in Article 1 to enter in, exit from and transit through its territory without an entry visa and free of charge. 2. Each Party shall allow the nationals of the other Party holding the passports specified in Article 1 to stay in its territory without an entry visa for a maximum period of 90 days . Article 3 1. In case either Party appoints any of its nationals to its diplomatic missions or consular posts in the territory of the other Party, it shall notify in advance, the other Party of such appointee's arrival as well as on the final departure of the appointee from the territory of the other Party.

The Government of the Republic of India and the Government of theUnited Arab Emirates (hereinafter jointly referred to as the "Parties"),

• Desiring to develop their bilateral relations and strengthen theexisting cooperation between the two countries,

Confirming their willingness to exempt the nationals of their twocountries, who are holders of diplomatic, special and official passports,from entry visa requirements to enter each other's territory,

Taking into account the Vienna Convention on Diplomatic Relationsof 1961 and the Vienna Convention on Consular Relations of 1963,

Have agreed as follows:

Article 1

The nationals of the two countries holding the following passports areexempt from visa requirements:

(a) for nationals of the United Arab Emirates: diplomatic and specialPassports which have a remaining period of validity of not less thansix months;

(b) for nationals of the Government of the Republic ofIndia: diplomaticand official, which have a remaining period of validity of not lessthan six months.

Article 2

1. Each Party shall allow the other Party's nationals holding the passportsspecified in Article 1 to enter in, exit from and transit through its territorywithout an entry visa and free of charge.

•2. Each Party shall allow the nationals of the other Party holding the

passports specified in Article 1 to stay in its territory without an entryvisa for a maximum period of 90 days .

Article 3

1. In case either Party appoints any of its nationals to its diplomaticmissions or consular posts in the territory of the other Party, it shallnotify in advance, the other Party of such appointee's arrival as wellas on the final departure of the appointee from the territory of theother Party.

2. Nationals of one Party holding valid diplomatic, special and officialpassports who are accredited to the diplomatic missions or consularposts of that Party or to international organizations in the territory ofthe other Party shall be required to obtain visa to enter in, exit from,transit through or stay in the territory of the other Party for the entireperiod of their official mission.

• 3. The visa requirements mentioned in paragraph 2 of this Article shallalso apply to the spouse, parents and children accompanying themember of a diplomatic mission, consular post or international.organization.

Article 4

1. The two Parties shall exchange specimens of their passports specifiedin Article 1 through diplomatic channels at least 30 days before theentry into force of this MDV.

2. In case either Party introduces any amendments to its passports, thatParty shall provide to the other Party specimens of these newpassports before their introduction date.

3. Both Parties shall notify each other in case of any amendments totheir domestic laws and regulations pertaining to the passportsspecified in Article 1 prior to the entry into force of suchamendments.

Article 5

Nationals of a Party holding the valid passports specified in Article 1 may notwork, engage in any profession or study in the territory of the other Party unlessthey obtain permission in accordance with the relevant laws and regulationsapplicable in the host country.

Article 6

1. The nationals of each Party may enter the territory of the other Partyonly through the border points designated for international passengertraffic.

2. The nationals of each Party holding the passports specified in Article1 shall comply with the laws and regulations in force in the territory ofthe other Party throughout the duration of their stay.

Article 7

1. Each Party has the right to deny the entry or stay in its territory of anyholders of the passports specified in Article I whom it may considerpersona non grata or undesirable.

2. In case the passport of a national of one Party has been lost or damaged inthe territory of the other Party, he/she shall inform the competentauthority of that Party so that it can take appropriate action. Theconcerned diplomatic mission or consular post of the first Party shallissue a new passport or travel document to its national in accordancewith the applicable laws and regulations and shall inform the concernedauthorities of the host Party .• Article 8

Both Parties shall express their readiness to ensure the highest level of securityfor their passports and travel documents to guard against forgery. They shall takeinto account the minimum security standards for machine-readable traveldocuments recommended by International Civil Aviation Organization.

Article 9

This MOU does not affect the rights and obligations of the two Partiesarising from conventions and other international agreements to whicheither or both of them are parties.

Article 10

Any differences arising from the interpretation or application of this MOUshall be settled by consultations and negotiations between the two Parties viadiplomatic channels.

Article 11

1. Any amendments to this MOU shall be mutually agreed upon by the twoParties through an exchange of official notes through diplomaticchannels.

2. Such amendments shall enter into force as provided for in Article 12 of thisMOU.

•3. Either Party may suspend the application of this MOU, either wholly or

partially, for reasons of national security, public order or public health.Any such suspension, shall be immediately communicated to the otherParty through diplomatic channels. The suspension shall not affect therights of nationals who have already entered the territory of theother Party .

Article 12

This MOU shall enter into force 30 days after the date of signature and shallremain in force for an indefinite period, unless either Party notifies the other inwriting through diplomatic channels of its intention to terminate it. Suchtermination shall take effect 30 days after the date of the official notification oftermination. The termination shall not affect the rights of nationals whohave already entered the territory of the other Party.

Done at New Delhi on .'2..5... January 2017, in two original copies each inthe Arabic, Hindi and English languages, and all texts being equally authentic.In case of any divergence of interpretation, the English text shall prevail.
