Taxi driver Jacob Humphreys(56) will be spending 20 years be-hind bars.
Judge Robert Henney yesterdaysentenced Humphreys to 12 years’imprisonment on each of the 10murder charges to be served con-currently. He also handed down asix-year prison sentence on each ofthe four attempted murder chargesof which four years on each chargewould run concurrently with 12-year sentence for murder. This add-ed in effect another eight years –bringing the total jail term to 20years.
Humphreys was convicted in De-cember last year on 10 counts ofmurder and four counts of attempt-ed murder.
He was transporting children toschool on 25 August 2010 when histaxi collided with a train. Hum-phreys overtook a row of cars at theButtskop level crossing in Black-heath, ignored safety signals anddrove over the track in front of theoncoming train. Ten children werekilled and four injured.
The courtroom was packed withparents, friends and family mem-bers, dressed in T-shirts printedwith the faces of the children who
died in the accident, yesterday asHenney passed his judgement.
“We live in a country where somepeople are poor and cannot affordtheir own transport. More oftenthan not, they make use of minibustaxis in which a fare is paid.” Withthat he sketched the scenario of the14 children in that taxi and themeans of transport many South Af-ricans make use of.
Henney said three major aspectsthat were taken into considerationwith the sentencing was Hum-phreys’s circumstances, the offencethatwas committedand the interestof society.
A brief summary of Humphreys’sbackground was given where it waspointed out that this was a first timeoffence and he had no previous con-
victions. He had been transportingchildren since 2001 until the day ofthe incident.
Henney read statistics out to thecourt of the number of minibus taxiaccidents and level crossing acci-dents that happen every year.
“Disregarding the rules of theroad is regarded as a minor offenceas opposed to crimes such as mur-der. And it’s seldom that perpetra-tors get caught. It’s only whentransgressions result in damage ofproperty, injury or death that it istaken seriously. It is because of thisattitude that there are so many ofthese incidents. It’s clear that some-thing drastic has to be done to stopthis kind of behaviour,” Henneysaid.
When Henney ran through the
events of that fatal day he describedHumphreys’s driving as reckless.
“He fully accepted the responsi-bility of transporting the childrensafely. Through his actions he lostthe trust of the parents,” Henneysaid.
When sentencing was passed,Humphreys’s attorney, Adv JohanEngelbrecht, interrupted by tryingto put up one last fight. He told Hen-ney that even though what Hum-phreys did can be seen as negligent,he had over-emphasised the seri-ousness of the offence. Engelbrechtwent further to say that anothercourt would find a different sen-tence.
His last attempt to save Hum-phreys did not work and Hum-phreys was handcuffed and taken
down to the holding cells.“Pappa wag vir jou,” a catch
phrase from a drinking and drivingadvertising campaign came fromthe gallery as he was taken down.
After the sentencing family andfriends congregated in the hope ofseeing Humphreys being takenaway outside the court. An upsetEngelbrecht stormed out, leavingparents agitated with his final com-ment: “It’s not the end of the road”.
. WesternCapeminister of trans-port and public works, Robin Car-lisle, said this sentence sends apow-erful message that in the future cansave lives. “We in the Safely Hometeam see this as a turning point inthe history of road safety not onlyin the Western Cape, but in SouthAfrica as a whole.”

Two parents from Kleinvlei have beencharged with assault and child abuse afterappearing in the Blue Downs Magistrate’sCourt and Children’s Court in Kuils River onThursday.
This followed the ongoing abuse of theirdaughter. The girl came to the police stationon Wednesday morning after both her par-ents had gone to work to lay a charge of abuseagainst them.
It was found that an argument broke outbetween the 12-year-old girl and her motherafter her mother asked her to hang the wash-ing on the line earlier that morning. Whenshe refused, her mother started hitting her,
said Sgt Carmen Marinus, head of socialcrime at Kleinvlei Police Station.
Thegirlwas taken toKarlBremerHospitalwhere she was examined by the district sur-geon. After the examination it was foundthat the girl had blue marks on her arm, bodyand face, giving clear signs of abuse. The girltold the police that this type of physicalabuse had been going on for three years.
According to Marinus, she requested to beput in the custody of her aunt in Belhar whobroke down in tears after hearing the girl’srequest. Marinus said that the aunt had beenaware of the abuse.
Both her parents will be appearing in theBlue Downs Magistrate’s Court on 18 Marchand the Children’s Court on 8 March.

The tears well up in the eyes of 31-year-old Colleen West, but unlike the tearswhich flowed after her previous five mis-carriages, these were tears of joy.
She looks down at tiny Willow in her armsand thanks God for the strength, persever-ance and hope.
“Say hello to your daddy,” whispers Col-leen.
As always, the proud Lowellan (33) is byher side.
“My Willow! My Willow!” exclaims Cohen(two), her baby brother.
The West family’s newest addition saw the
light on 22 February at 14:00 in Goodwood’sNetcare N1 City Hospital, but it is what theKuils River family had to go through for fiveyears before she was born which makes herbirth so inspiring.
Colleen explains: “Lowellan always usedto joke by saying I was pregnant for the lastfive years.”
Five miscarriages in seven is, of course, nolaughing matter, but the Wests had no optionbut to try to deal with the constant tragedy.
“We were high school sweethearts and tiedthe knot in 2004 – I was 24 and my husband26. Two years later we made a decision tostart a family. When I fell pregnant in 2007,we were extremely excited and immediatelyinformed all our friends and family. We were
even more surprised when the doc-tor informed us that we were expect-ing twins, both boys. However, ourexcitement was short-lived, becauseat 20 weeks I had a miscarriage andlost both babies,” she says.
Suffice it to say it was a very pain-ful time for the family.
Lowellan says they very much de-pended on the support of family andfriends during the difficult times, but above all they were there for oneanother.
“We were as tight as a mouse’sears!” he laughs, before adding thatnothing could ever come betweenthem.
Colleen continues: “We decided totry again and I conceived for the sec-ond time and was informed that wewere expecting another boy. Onceagain our joy was short-lived ... Thistime I had a miscarriage at 16weeks.”
After a brief period of devastationand hopelessness, they decided theywere not going to give up on theirdream of becoming parents.
Colleen fell pregnant for a thirdtime – only to have another miscar-riage at seven weeks.
She had an ectopic pregnancywhen she was pregnant again, butthe baby had to be terminated yet
again.“By then we did not know what to do any
more,” remembers Colleen.“The doctors did not really have any an-
swers for us, so we decided to stop trying, ashaving a child had now become an obses-sion,” she says. Yet, soon thereafter withoutthem even trying, she was pregnant again, and this time, she gave birth to a beautifulbaby boy named Cohen.
“He is perfect in every way!”Colleen was pregnant again nine months
later, but sadly their hopes were dashedwhen the baby boy was still-born just fourweeks before the due date.
As a result, Colleen had to spend sevenweeks in Netcare N1 City Hospital before thebirth of Willow.
Says Lowellan: “I was so anxious ... It’s dif-ficult to put it in words. Colleen was so af-raid. We wouldn’t do normal things, such ascamping, because she was worried some-thing might happen to the baby. Shewouldn’t even eat sushi!”
According to him they had different namesfor each of the babies.
“We can both write a book!” he exclaims.“A book of hope to all those who have suffe-
red the same way.”While Colleen was in the hospital, Lowel-
lan approached the Wiesenhof coffee shop atN1 City. He asked Wiesenhof’s owner, LouiseAbrahams, to host a stork party for his wife, andAbrahams immediately felt compelled tohelp them. Says Abrahams: “He is such awonderful person and I wanted Colleen to fe-el special. I decorated the place with flowers, banners and balloons!”
Some of Colleen’s friends came to the storkparty to witness her pleasant surprise whenLowellan unveiled his present to her – abrand new 1 series BMW!
“I can’t wait to drive it,” says the sparklingmother of two. She is still recovering at ho-me, but as soon as she is healthy enough shewill experience “sheer driving pleasure”.
Netcare N1 City Hospital’s marketing ma-nager, Chanel Lotz said: “We would like tocongratulate the West family on the birth oftheir special baby girl and wish them all thevery best for the future!”

Elton van Rooyen, saakbestuurder by dié
hof, het verduidelik hoe die proses werk van-dat die kinderslagoffer se saak aangemeld is,tot die kind na dié traumakamers gebringword, en uiteindelik moet getuig.
By dié hof kan kinders via videostromingin ’n hofsaak getuig.
. Mense wat wil voortgaan om die trau-makamers te ondersteun, kan Monique Stry-dom, direkteur van Matla A Bana, kontak by021 913 9107 of 083 212 9824.

On the way home, hungry schoolchildrencan always use the home of JesmeanBooysen as a pit stop to get something toeat every Thursday.
The soup kitchen which is run from hergarage, in Forest Heights, is not just open tochildren but adults that pass by during theafternoons as well.
This project started three years ago whensomeone knocked at Jesmean’s door askingfor something to eat.
“You know, it’s not nice to send someoneaway from your door when they ask for food.It was then that I decided to start the soupkitchen,” Jesmean said.
This is not your average soup kitchen asit does not just serve soup but a variety ofmeals. For the past two weeks, Jesmean said, the children preferred eating spaghetti.
Jesmean has four volunteers who help herprepare the food every week; she also has adonor who provides them with 20 loaves ofbread every week.
She said they used to have someone who
donated gas to help them cook the food butthat has stopped. At the moment all the vol-unteers are financing the soup kitchen fromtheir own pockets.
With the growing number of people com-ing to the soup kitchen, this has really beenfinancially straining on the volunteers. Be-fore, they were able to feed people twice aweek but now they are only able to do so oncea week. Jesmean said it really gets difficultwhen it comes to winter, as this is when themost people come for food.
Currently, they are feeding up to 200 peo-ple every Thursday.
The volunteers also extend their help toKleinvlei Police Station by helping out attheir victim support group where they coun-sel victims of crime.
“I am sure they will use their soup kitchenas a platform to help others become awareof gender and domestic violence in the areaand will be able to refer them to the police,”said Sgt Carmen Marinus, head of socialcrime at Kleinvlei Police Station.
If anybodywould like to get involved in thesoup kitchen or make a contribution, con-tact Jeasmean Booysen on 071 918 5342.

Being a champion was the word of the dayfor the Insight Class Graduates of TeenChallenge Rehab Centre on Sunday.
Members were encouraged with thispowerful word at the Enon TabernacleBaptist Church which was preached by DrRev Jacobus Nomdoe.
“When Christ is in us, there is a promiseof being a champion. Now, not all battlesare meant for us to win, sometimes as achampion we lose but that does not makeus a loser. There is a difference betweenlosing and being a loser,” Nomdoe said.
The Insight Class Graduation is a reha-bilitation class for drug addicts, gangstersand prostitutes wanting to change theirlives. The class has nine phases which dealwith different aspects of the root of the in-dividual’s problem.
“The Insight class is usually a 12-weekprogramme but we usually do it in threeto four weeks. This is just an introduction
to the fuller programme which is a year.In the programme we look at where theproblem started, what are the controllingproblems and facing the problem with ad-diction. The classes are also strictly confi-dential so what gets said at the classes, stays there,” said Quinton Mathews, aleader at Teen Challenge.
Reinette Myburgh from God TV, an or-ganisation who really admires the work ofTeen Challenge attended the graduation aswell. She found out about the work of TeenChallenge when installing God TV in TeenChallenge’s centre. God TV is the fastestgrowing Christian channel in the worldand was founded by two South Africans. This channel can be found on two leadingsatellite television networks namely DStvand Top TV.
Having God TV present raised great ex-citement as Enon Tabernacle BaptistChurch announced that they would bebroadcasting their services on the channelin the coming future.

Do racists fear jazz? That it the question that has been going
through my head for some time now becausefollowing on the previous piece about racialstereotyping, and mistaken identities, some-times the K-word comes up when you’re mis-taken for being “white”.
This time around I was at a bit of a jazzfunction when once again one of the fairerskinned fellows at the table revealed that hereally “did not like this “Kaffir” music.
Strange at the time because the group thatwas performing was representative of ourrainbow nation, and I kind-ly pointed it out to the perpe-trator of this vile statement.
But, then I realised thatracists have good reason tofear this genre of music;hasn’t it been breakingdown barriers since it start-ed?
We don’t have to start oursearch in South Africa butin the country where it orig-inated, America, and dis-cover how it broke downtheir segregation policiesonce cats started jammingtogether.
Going into that historywould need more space thanis available here, but whenwe get closer to home we will see how it de-stroyed the “hate” thatApartheidwas tryingto enforce into the minds of our nation.
At the same time that Dr Verwoerd wasproving his reasons for separation of the na-tion using the Bible and other concocted the-ories in Parliament, just a few minutes downthe road at the Green Point Art Centre (usedto be where the McDonalds is near the stadi-um) the music was proving him wrong.
This was one of the places where our rain-bow nation came together and threw allthese racist theories into the gutter where
they belonged. The stories of the jam sessions that took
place in those years are the stuff of legend, but it only encouraged the lawmakers of thetime to intensify their fight against this har-mony.
Luckily for us, most of it still continued,in secret at times, but it was always thereeven when musicians risked arrest forbreaking those laws.
Throughout the struggle for freedom, thisgenre of music was always playing its part, not just at political meetings but also on the
social side where there wasalways a “whitey” or 10, atsome of the jazz gigs aroundtown.
Just think of the sessionsat the old Sherwood/Mon-treal venue in Manenberg.Hey, the who’s who of SouthAfrica used to rock up thereto listen to pianist TonySchilder make his magic. Iremember the lateProfChrisBarnard bringing a group offriends there.
Trumpeter Ian Smith, nowdoing wonderful work withthe Delft Big Band, had noqualms about being part ofvarious ensembles in clubsall around the Cape Flats,
which probably has inspired him to take thetalents that are still out there to biggerthings.
There’s so many stories out there wherethis music is changing lives, speak to theyoungsters who are part of the Delft BigBand project, let them tell you how theirlives have changed, and you realise that itmay not just be the racists who want to de-stroy the love for this music – but all the poli-ticians who want to maintain the status quoof keeping the underprivileged without ahope of achieving economic progress.

Keep the Dream 292, a daycare centre inKuils River for children with disabilities, has been adopted by the Apostolic Faith Mis-sion churchas thebeneficiary for theirOasisProject of Hope.
“As a church we want to get involved inprojects in our area where we want to helporganisations such as Keep the Dream withwhatever they need to help them to go for-ward and grow,” says Cheryl Fortuin, theOasis of Hope project co-ordinator.
In the Western Cape, there are over 300children on waiting lists for schools for chil-dren with disabilities.
The aim of the organisation is to provide
a residential facility that is accessible to peo-ple with disabilities from all socio-economicbackgrounds.
Most special care centres are too expen-sive for middle- or low-income families andthe waiting lists at the more affordable facili-ties are extremely long, explains Fortuin.
Keep the Dream 292 was founded in 2010by Mrs Angela Coetzee, the mother of a disa-bled child, after she identified the need foran affordable residential facility for youngadults with disabilities.
The main objective of the organisation isto enhance independent living of people withdisabilities. Contact Cheryl Fortuin on021 903 4708 or Angela Coetzee on 083 969 0687for more information on Keep the Dream.

Everyone looking to renew their spent CFLs for free
raise your hands!
www.eskom.co.za/idm
Five years ago, we managed to convert
millions of South Africans to using CFL
energy saving lightbulbs and saved you
money. Now, five years later, we’re
back to change your energy savers that
have reached the end of their life.
Continue to use energy savers to
collectively save South Africa’s energy.
Energy saving lightbulbs have an
environmental benefit because they cut
your lighting cost by using less electricity
and last up to eight times longer,
resulting in a reduction in greenhouse
gases. The small amount of mercury that
energy saving lightbulbs contain is almost
used up by the time the lightbulb is ready
for disposal. So try not to break the
lamp and dispose of CFLs at participating
retailers.
Spent CFLs can be exchangedfor new ones in two ways:
a. There will be a door-to-door exchange
(people will come to your door to do
the exchange).
b. Self exchange points will be set up in
certain areas, where you will be able
to go and do the exchange.
Don’t miss out!Save energy and save money!
The exchange period will run from February 2012 to March 2012.
Students at universities andtechnikonsareat the forefrontofHIV testing with a new project inthe country.
The 2012 “First Things First”mass voluntary HIV testing andcounselling campaign was official-ly launched by the minister ofhealth, Dr Aaron Motsoaledi, andthe deputy minister of higher edu-cation, Prof Hlengiwe Mkhize, atthe University of the Western Capeon Tuesday 21 February.
This campaign aims to test atleast 35 000 students at all campusesof South Africa’s 23 public higher
education institutions. It also aims to reach out to other
members of the higher educationcommunity, including academics, administration staff and servicestaff.
In alignment with the nationalstrategic plan for HIV, STIs and TB,many of these individuals will alsobe screened for tuberculosis (TB)because of the high HIV and TB co-infection rate and the interface be-tween treatment and prevention forboth HIV and TB.
Last year this award-winningcampaign touched the lives of 22 000students across 17 universities.
Some 58 percent of these studentshad never been tested for HIV be-fore.
The campaign encourages stu-dents and staff within the higher ed-ucation sector to know their HIVstatus – and aims also to influencebehaviour and perceptions aroundHIV and Aids in general.
As part of the testing programme, participants receive pre-test andpost-test counselling.
Motsoaledi said: “The campaignis a very important one from thepoint of view of prevention ... thatyoung people are at the centre ofour prevention strategies.”.

From its humble beginnings inKuils River, Lyrical Warfarehas found a new home in LongStreet.
Lyrical Warfare, presented bySuburban Menace and MobcowEntertainment hopes to becomethe premier Hip-Hop MC BattleLeague in Cape Town.
The team started hosting HipHop events four years ago, mov-ing around different venues inthe northern suburbs since theystarted at Stones Kuils River.
Organiser, Marvin Levendal, explains that Suburban Menacewanted to create a platform toshowcase their work this side ofthe world. The events proved tobe anopportunity to alsohelp oth-er local hip-hop artists.
Initially the events would in-clude different aspects of hip-hop,but after their last venue change, the events lost steam, and Marvinsays they decided to change thescope of the events, creating a
brand around one aspect. The MC battles, known as Lyri-
cal Warfare, have attracted lots ofattention.
Lyrical Warfare will now be-come an MC league with prizesfor winning MCs.
“We want to use the conceptand build a movement around thebrand itself,” Marvin says.
The battles will take place onthe last Wednesday of everymonth and will be linked to daysof observance, like World AidsDay, and will highlight signifi-cant events within the hip-hop in-dustry, like local album releases, remembrance of past artists andbirthdays.
Marvin says they hope to re-lease monthly mix tapes with lo-cal artists and producers. Thesewill be made available at the Lyri-cal Warfare events.
He points out that they are alsolooking for local producers tosupply “beats” for the battles, who will receive exposure in re-turn.
“Wewant to create ahiveof eco-
nomic creativity between us,”Marvin says.
“In our community, the eco-nomics are not taken seriously,”he says, explaining that that hip-hop is deeply rooted in social con-sciousness.
Marvin says: “Don’t let yourconsciousness overpower yourability to live off your passion.”
Lyrical Warfare will runthroughout 2012, based on aleague points system.
Participants will earn pointsand win cash prizes, with month-ly winners taking home R1 000and a goodie bag compliments ofSprite and other sponsors. Allpoints will be carried towards agrand event in December.

LIAM MOSES
The Stormers will be forced todip further into their youthfulreserves over the next twomonths, after captain and in-cumbent openside flank SchalkBurger was ruled out for up tosix weeks on Saturday. Burgersuffered damage to his medialligament during the team’s 13point victory over the Hurri-canes at Newlands, and his ab-sence will rob the team of not on-ly his leadership skills and expe-rience, but also his high workrate, aggressive rucking and ex-cellent distribution skills.
The Stormers have lacked a pre-mier openside flank since the de-parture of Francois Louw to Bath inthe off season, but it was believedthat Burger would be able to excelin the position where he began hisfirst-class career.
Siya Kolisi, a versatile and athlet-ic young loose forward, substitutedforBurgerduring thematch, andheseems likely to fill the position nextweek when the Stormers take onthe Sharks.
However, coach Alister Coetzeesaid he would consider all of his op-tions for the position.
“In the pre-season games we hadSiya (Kolisi) coming on at six andhe actually didn’t do a bad job,” saidCoetzee.
“ But with the loose trio situation,we were playing our best loosies.
“We’ll be looking at our reserves. There’s Rueben Johannes, and Ni-zaam Carr and Don Armandt.”
The inclusion of Kolisi in thestarting line-up team, and either Jo-hannes, Carr or Armandt on thesubstitutes’ bench will serve to fur-ther decrease the average age andexperience level of the first team.
The Stormers fielded four playersaged 23 or younger (Nick Koster,Eben Etzebeth, Steven Kitshof andGary van Aswegen) in their start-ing line-up, and the number grew to
five when Kolisi took the place ofhis injured captain.
Coetzee was understandably hap-py with how the youngsters han-dled the increasedphysicality of Su-per Rugby.
“All youngsters, like I said previ-ously, have the potential to play atthis level. And again today itshowed,” said Coetzee.
“Siya (Kolisi) is physically ma-
ture, Eben Etzebeth is physicallymature, and Steven Kitshof, to playat this level.
“Our pack was outstanding to-day, and they have been taken a lotof flak over the past couple of weeksand a lot of people had a lot to say.”
Although all five of the young-sters played with varying degreesof success, and brought a necessaryyouthful vigour to the side, it could
be argued that Burger’s loss willdamage the delicate balance be-tween youth and experience thatsets champions apart from the also-rans.
Whoever replaces the hard manof the loose trio, be it Kolisi, Johan-nes, Carr or Armandt, will be thrustinto the inferno that is Super Rug-by, and either be forged into a steelycompetitor or melt into obscurity.

Crowds were treated to an exciting local der-by last week.
Ajax Cape Town and Engen Santos playedto a 1-1 draw in an Absa Premier Leaguematch at the Cape Town Stadium on Satur-day night as local fans were treated to a feastof entertainment and football which they en-joyed every minute of.
The first half belonged to Ajax, who start-ed the game with farmore purpose thanthe visitors, Santos.Having conceded onnumerous occasionsin the opening stagesof matches.
A drawback for the“People’s Team” isthat they were tootentative not to makemistakes, causingthem to constantlyfall under siege andstruggle to find theirfooting in the opening45 minutes.
Ajax took the game to their visitors in thefirst half, but they could not make good ofthe chances created in front of goal. In theopening minutes both Billiat and GeorgeMalueka came close, and Brent Carelse’sshot from close range hit the crossbar.
The Parow side finally broke the deadlockwhen Carelse managed to find Pa DemboTouray’s net from the penalty spot after San-tos conceded a needless penalty.
Jurie Basie made an ill-timed sliding tack-le that was completely unnecessary asNasief Morris and Touray were still behind
the ball. The second half was a different kettle of
fish with Santos having made one substitu-tion during the break period, SiyabulelaSongwiqi being replaced by Salmaan King.
The introduction of King brought stabilityand attacking prowess to Santos’ left sideand they displayed elegant football from themoment the second part of the game started.
It was Eleazar Rodgers who helped Santosdraw level after having a relatively quite en-
counter for most of thegame being marked byMatthew Booth.
Rodgers finally man-aged to lose his markerand headed home su-perbly from an ErwinIsaacs cross from theleft channel.
Ajax continued tosearch for awinner andalmost found the targetbut for Tyren Arendsewho cleared the ball offthe goal-line, whileAiden Jenniker raced
shoulder to shoulder with Isaacs before pok-ing the ball wide for a corner.
Cole Alexander won possession deep in hisown half before his long pass forward foundMaluleka who passed to Billiat then to Akpa-bio but Santos, defending in numbers smoth-ered the danger.
Both teams had their chances in attack forthe remainder of the game, with Ajax havinglost their effect in attack since entering thetunnel at half time. Nonetheless , Santos canbe grateful to have the experienced Tourayin goal, an intergral cog that aided them ingathering the point.
Exciting derbyends in a draw
