TRAFFIC RULES AND ORDERS

TOWN OF DANVERS, MASSACHUSETTS

By virtue of General Laws, Chapter 85, Section 2, and General Laws, Chapter 40, Section 22, the following rules and orders originally adopted by the Board of Selectmen on June 3, 1940, and subsequently amended have been approved by the Department of Public Works and published in the Danvers Herald after such approval and as of September 1, 1993, are in full force and effect:

ARTICLE 1

DEFINITIONS

For the purpose of these rules and orders, the words and phrases used herein shall have the following meanings except in those instances where the context clearly indicates a different meaning. (a) "Street or Highway." The entire width between property lines of every way

open to the use of the public for purposes of travel. (b) "Roadway." That portion of a street or highway between the regular

established curb lines or that part, exclusive of shoulders, improved and intended to be used for vehicular traffic.

(c) "Lane." A longitudinal division of a roadway into a strip of sufficient width

to accommodate the passage of a single line of vehicles. (d) "Vehicle." Every device in, upon or by which any person or property is or

may be transported or drawn upon a street or highway, except devices moved by human power or used exclusively upon stationary rails or tracks.

(e) "Emergency Vehicles." Vehicles of the Fire Department (Fire Patrol),

Police Vehicles, Ambulances and Emergency Vehicles of Federal, State, and Municipal Departments or public service corporations when the latter are responding to an emergency in relation to the Police or Fire Departments.

(f) "Parking." The standing of a vehicle, whether occupied or not, otherwise

than temporarily for the purpose of and while actually engaged in loading or unloading, or in obedience to an officer or traffic signs or signals, or while making emergency repairs, or if disabled, while arrangements are being made to move such vehicle.

(g) "Pedestrian." Any person afoot or riding on a conveyance moved by

human power, except bicycles or tricycles. (h) Sidewalk." That portion of a street or highway set aside for pedestrian

travel. (i) "Crosswalk." that portion of a roadway ordinarily included within the

prolongation or connection of curb lines and property lines at intersections, or at any portion of a roadway clearly indicated for pedestrian crossing by lines on the road surface or by other markings or signs.

(j) "Railroad Crossing." Any intersection of ways with a railroad right of way. (k) "Traffic Control Area." Any area along any way, other than an intersecting

way, at which drivers are to be controlled by traffic signals. (l) "Traffic Island." Any area or space set aside, within a roadway, which is

not intended for use by vehicular traffic. (m) "Safety Zone." any area of space set aside within a roadway for the

exclusive use of pedestrians and which has been indicated by signs, lines or marking, having the written approval of the Department of Public Works, Commonwealth of Massachusetts.

(n) "Traffic." Pedestrians, ridden or herded animals, vehicles, street cares or

other conveyances either single or together while using any street or highway for the purpose of travel.

(o) "Official Traffic Signs." All signs, markings and devices, other than

signals, not inconsistent with these rules and orders, and which conform to the standards prescribed by the Department of Public Works of the Commonwealth of Massachusetts and placed or erected by authority of a public body or official having jurisdiction, for the purpose of guiding, directing, warning, or regulating traffic.

(p) "Official Traffic Signals." All signals, conforming to the standards as

prescribed by the Department of Public Works of the Commonwealth of Massachusetts, not inconsistent with these rules and orders, placed or erected by authority of a public body or official having jurisdiction, for the purpose of directing or warning traffic.

(q) "Traffic Control Signal." Any device using colored lights which conforms to

the standards as prescribed by the Department of Public Works of the Commonwealth of Massachusetts whether manually, electrically or mechanically operated, by which traffic may be alternately directed to stop

and to proceed. (r) "Officer." For the purpose of this ordinance, an officer shall be construed

to mean any officer, any investigator, examiner or inspector of the Registry of Motor Vehicles, any constable or special officer, providing he has his badge of office displayed over his left breast and upon his outer garment.

(s) "Bus Stop." An area in the roadway set aside for the boarding or alighting

from and the parking of busses. (t) "Taxicab Stands." An area in the roadway in which certain taxicabs are

required to park while waiting to be engaged. (u) "Service Zone." An area in the roadway set aside for the accommodation

of commercial and transient vehicular traffic. (v) "Funeral." Any procession of mourners properly identified as such,

accompanying the remains of a human body. (w) "Official Curb Marking." That portion of a curbing, the painting of which

has been authorized by the Selectmen and which complies with the standards of the Department of Public Works of the Commonwealth of Massachusetts and has the written approval of said Department.

(x) "Official Street Marking." Any painted line, marking or marker placed in or

upon any way by authority of the Board of Selectmen and which complies with the standards of the Department of Public Works and has the written approval of said Department.

(y) "U-turn." The turning of a vehicle by means of a continuous left turn

whereby the direction of such vehicle is reversed. (z) "Rotary Traffic." The counter-clockwise operation of a vehicle around an

object or structure. (aa) "Town." The Town of Danvers. (bb) "Person." The word "person" shall mean and include any individual, firm,

partnership, association or corporation. (cc) "Parking Meter." The words "parking meter" shall mean any mechanical

device, not inconsistent with the provision of this regulation, and placed or erected on any public way within the Town of Danvers for the regulation of parking. Each parking meter installed shall indicate by proper legend the legal parking time established by this regulation and when operated shall at all times indicate the balance of legal parking time permitted, and at the

expiration of such period shall indicate illegal or overtime parking. (dd) "Parking Meter Zone." The words "Parking Meter Zone" shall mean and

include any street or portion thereof upon which parking meters are installed and in operation, and upon which parking of vehicles is permitted for a limited time subject to the further provision of this rule and order.

(ee) "Parking Meter Space." The words "Parking Meter Space" shall mean any

space within a parking meter zone, adjacent to a parking meter which is duly designated for the parking of a single vehicle by lines painted on the surface of the street adjacent to or adjoining each parking meter.

(ff) "Commercial Vehicle." Any vehicle being used in the transportation of

goods, wares, or merchandise for commercial purposes. (gg) "Commercial Vehicle - Heavy." Any commercial vehicle two and one-half

(2 1/2) tons capacity or over.

ARTICLE II AUTHORITY AND DUTIES OF POLICE

Section 1. Officers to Direct Traffic. It shall be the duty of officers designated by the Chief of Police to enforce the provisions of these traffic rules and orders. Such officers are hereby authorized to direct all traffic either in person or by means of visible or audible signals in conformance with the provisions of these rules and orders, provided that in the event of a fire or other emergency to expedite traffic or safeguard pedestrians, officers of the Police or Fire Department may direct traffic, as conditions may require, notwithstanding the provisions of these rules and orders. Section 2. Police May Close Streets Temporarily. The Chief of Police is hereby authorized to close temporarily, any street or highway in an impending or existing emergency, or for any lawful assemblage, demonstration or procession, provided there is reasonable justification for the closing of such street. Section 3. Police May Prohibit Parking Temporarily. The Chief of Police is hereby authorized to prohibit, temporarily, parking on any street or highway or part thereof in an impending or existing emergency, or for a lawful assemblage, demonstration or procession, provided there is reasonable justification for such prohibition. Vehicles parked in places where parking is permitted, temporarily may be moved by or under the direction of an officer.

Section 4. Exemptions The provisions of these rules and orders shall not apply to operators actually engaged in work upon a street or highway closed to travel or under construction repair, to officers when engaged in the performance of public duties, nor to drivers of emergency vehicles while operating in an emergency and in performance of public duties when the nature of the work of any of these necessitates a departure from any part of these rules and orders. These exemptions shall not, however, protect the driver of any vehicle from the consequences of a reckless disregard of the safety of others. Section 5. Chief of Police to Make Annual Accident Report. The Chief of Police shall make an annual report concerning the accident situation to the Town, accompanied by his recommendations. Section 6. Police to Keep a Driver File. (a) The police shall keep a record of all operators involved in accidents within

the municipality. (b) The Chief of Police shall report to the Registrar of Motor Vehicles such

operators as are found to be constant violators of these regulations. Section 7. Police to Submit Annual Traffic Safety Report. The Chief of Police shall include in his report to the Town: 1. The number of operators reported to the Registrar of Motor Vehicles. 2. He shall report other pertinent data on safety activities accompanied by

his recommendations.

3. The plans and recommendations for future traffic safety activities.

ARTICLE III TRAFFIC SIGNS, SIGNALS, MARKING AND ZONES

Section 1. Traffic Signs and Signals. (a) The Chief of Police is hereby authorized, and to these signs and signals

required hereunder it shall be his duty to place and maintain or cause to be placed and maintained all official traffic signs, signals, markings and safety zones. All signs, signals, markings and safety zones shall conform to the standards as prescribed by the Department of Public Works of the

Commonwealth of Massachusetts. (b) Sections 2 and 3 of Article II and Sections 2 to 6 both inclusive and 9 of

Article V relating to parking and Section 21 of Article VIII and Section 9 of Article VIII shall be effective only when a sufficient number of official signs are erected and maintained in each block designating the provisions of such sections and located so as to be easily visible to approaching drivers.

(c) Sections relating to one-way streets shall be effective only during such

time as a sufficient number of official signs are erected and maintained at each of the exits for each one-way street, so that at least one sign will be clearly visible for a distance of at least seventy-five (75) feet to drivers approaching such an exit.

Section 2. Display of Unauthorized Signs, Signals and Markings Prohibited. It shall be unlawful for any person to place or maintain or display upon or in view of any street any unofficial sign, signal, marking or device which purports to be or in an imitation of or resembles an official traffic sign, signal, marking, or device, or which attempts to direct the movement of traffic or which hides from view any official sign or signal. The Chief of Police is hereby empowered to remove every such prohibited sign, signal, marking, or device or cause it to be removed without notice. Section 3. Interface with Signs, Signals and Markings Prohibited. Any person who willfully defaces, injures, moves, obstructs or interferes with any official traffic sign, signal, or making shall be liable to a penalty not exceeding twenty ($20.00) dollars for each and every offense. Section 4. Location of bus Stops, Taxicab Stands and Service Zones. The location of all bus stops, taxicab stands and service zones shall be specified by the Board of Selectmen and in the case of taxicab stands the Board of Selectmen shall designate who may use them as such. Section 5. Obedience to Traffic Signs and Signals. No driver of any vehicle or of any street car shall disobey the instructions of any official traffic control signal, sign, marking, marker or legend, unless otherwise directed by a police officer.

ARTICLE IV COASTERS AND ZONES OF QUIET

Section 1. Streets Reserved for Coasting. (a) On those days when conditions are suitable for coasting, vehicular traffic

is hereby prohibited from using the following streets or parts of streets, during such time as official signs are erected indicating that such streets or parts of streets are reserved for coasting.

(b) The foregoing provision shall not apply to drivers of vehicles having

business within such reserved areas or to drivers of vehicles whose residences are within such reserved areas.

Section 2. Zones of Quiet (a) All of the territory within two hundred feet of the premises of each hospital

in this Town is hereby created and established as a Zone of Quiet. The Chief of Police is hereby authorized to erect and maintain in a conspicuous manner within this area such signs and markings as are necessary to designate it as a zone of quiet.

(b) The Chief of Police may temporarily establish a zone of quiet upon any

street where a person is seriously ill. Said temporary zone of quiet shall embrace all territory within a radius of two hundred (200) feet. Said temporary zones of quiet shall be designated by the police placing in a conspicuous place in the street a sign or marker bearing the words "Zone of Quiet."

(c) No person operating a motor vehicle within any designated and signed

zone of quiet shall sound the horn or other warding device of said vehicle except in an emergency.

ARTICLE V PARKING

Section 1. General Provisions. No person shall park a vehicle in any of the following places and vehicles found parked in violation of the provisions of this section may be moved by or under the direction of an officer and at the expenses of the owner to a place where parking is permitted.

(a) Within an intersection. (b) Upon a sidewalk. (c) Upon any crosswalk. (d) Upon a roadway where parking is permitted unless both wheels on the

right side of the vehicle are within 12 inches of the curb or edge of the roadway, except upon those streets which are designated as one-way streets. On such one-way streets vehicles shall be parked in the direction in which said vehicle is moving and with both wheels within 12 inches of the curb. This shall not apply to streets or parts of streets where angled parking is required by these regulations.

(e) Upon any roadway where the parking of a vehicle will not leave a clear

unobstructed lane at least ten (10) feet wide for passing traffic. (f) Upon any street or highway within (10) feet of a fire hydrant. (g) Upon or in front of any private road, driveway or alleyway. (h) Upon any street or highway within twenty (20) feet of an intersection way

or where signs indicating a greater distance have been erected. (i) Within fifteen (15) feet of the wall of a fire station or directly across the

street from such fire station provided signs are erected acquainting the driver of such restriction.

(j) Alongside or opposite any street excavation or obstruction when such

stopping, standing, or parking would obstruct traffic. Section 2. Prohibited Safety Zone No person shall park a vehicle within twenty (20) feet of either end of a safety zone which is located within thirty (30) feet of the curb or edge of the roadway. Section 3. Bus Stops. (a) No person shall park a vehicle other than a bus in a bus stop. (b) No person shall park a bus upon any street within a business district at

any place other than a bus stop, when a nearby bus stop is available for use.

(a) No person shall park a vehicle other than a taxicab upon any street within a business district in any taxicab stand for a period longer than fifteen (15) minutes except while actually engaged in loading or unloading provided that such loading and unloading does not exceed a period of time longer than one-half (1/2) hour.

(b) No person shall park a taxicab upon any street within a business district at

any place other than the taxicab stand or stands designated for the use of his taxicab or while waiting for an opportunity to use a taxicab stand designated for his use.

Section 5. Time Limited to Designated Places - One Hour - . No person shall park a vehicle longer than one hour between the hours of 9:00 A.M. and 9:00 P.M. on Fridays and between the hours of 9:00 A.M. and 6:00 P.M. on all other days except Sundays and Holidays on the following described streets and parts thereof: ALDEN STREET on the easterly side from Conant Street to Hunt Street

excepting the space where 15 minute parking is permitted. 51 CHERRY STREET on the northerly side from the intersection of Maple

and Cherry Street to the intersection of Cherry Street and Charter Street. CONANT STREET both sides from the intersection of Maple Street and

High Street to a point one hundred and twenty-six (126) feet West of the intersection of Chase and Franklin Streets.

CONANT STREET on the northerly side a distance of three hundred and

fifty (350) feet West from Poplar Street. CONANT STREET both sides from Alden Street to the intersection of

Franklin Street and Chase Street, excepting the space where 15 minute parking is permitted on the Southerly side in front of the Post Office.

ELM STREET on the northerly side from Maple Street to a point twenty

(20) feet East of Page Street. ELM STREET both sides from Page Street to Essex Street and Park

Street. HIGH STREET both sides from Park Street to a point sixty (60) feet from

the intersection of Conant Street and Elm Street. 42 HOBART STREET on the northerly side, from the intersection of Maple

Street and Hobart Street to the intersection of Hobart Street and North

and Hobart Streets to the intersection of Hobart Street and Charter Street. HOLTEN STREET on the northerly side from Wadsworth Street to Pine

Street. MAPLE STREET both sides from Conant Street and Elm Street to the

intersection of Locust Street and Hobart Street. 96 MAPLE STREET on the easterly side from Conant Street to Central

Avenue. 113 MUNICIPAL PARKING LOT ON PAGE AND ELM STREETS and that

stickers or lottery parking not be allowed at this location. PARK STREET on the Southerly side from High Street to Berry Street and

on the northerly side from 107 feet from High Street to Berry Street. Section 5A. Two Hour Parking No person shall park a vehicle longer than two hours except on Sundays and Holidays between the hours of 9:00 A.M. and 9:00 P.M. on the following streets or parts thereof: ADAMS STREET both sides for a distance of six hundred (600) feet

northwesterly from the corner of Sylvan Street. 124 BERRY STREET on the westerly side between Conant Street and Park

Street. CENTRAL AVENUE on the southerly side. 156 CENTRAL ALVENUE MUNICIPAL PARKING LOT 51 CHERRY STREET on the northerly side from the intersection of Cherry

Street and Charter Street to a point opposite the intersection of Cherry Street and Essex Street.

COTTAGE AVENUE on the southerly side. 144 ELM STREET MUNICIPAL PARKING LOT ENDICOTT STREET on the northerly side from 51 Endicott Street to

Route 128.

intersection of School Street and Franklin Street. 72 HIGH STREET both sides from the intersection of Park Street and High

Street to a point one hundred and fifty (150) feet northerly of the intersection of Gould Street and High Street.

100 HIGH & PARK STREETS - Municipal Parking Lot. 162 Holten-Richmond Middle School, Drop-off/Pick-up Zones on the easterly

side 138 HOBART STREET on the easterly side from Charter Street to Maple

Street. HOLTEN STREET on the southerly side from the Town Hall to the

easterly property line of 32 Holten Street. HOLTEN STREET on the northerly side from Fletcher Street to

Wadsworth Street, and from Pine Street to Washington Street. HOLTEN STREET on the southerly side between a point opposite the

easterly corner of Wadsworth Street to Pine Street and from 102 Holten Street to a point opposite the easterly side of Washington Street.

162 Lane Parkway on the westerly side. LOCUST STREET both sides from Maple Street to Poplar Street. 140 OAK STREET on the southerly side. 170 PAGE STREET on both sides. 72 PARK STREET on the northerly side from the intersection of Beacon

Street to the intersection of High Street and Park Street. PINE STREET on the easterly side from Holten Street to Braman Street. SCHOOL STREET on the northerly side. SCHOOL STREET off-street parking lot owned by the Town. SYLVAN STREET on the northerly side from the Town Hall for a distance

of four hundred (400) feet.

Section 7. Parking Vehicles For Sale Prohibited. It shall be unlawful for any person to park upon a street or highway any vehicle displayed for sale. Section 8. No All Night Parking. 175 When an overnight parking ban is called by the Director of Public Works in

anticipation of a winter storm, it shall be unlawful for the driver of any vehicle, other than one acting in an emergency, to park said vehicle on any street between the hours of 1:00 A.M. and 6:00 A.M. In extreme circumstances, when a major winter storm with significant amounts of precipitation is forecasted to impact the municipality, the Director of Public Works, after consulting with the Chief of Police and Town Manager, may call for a full parking ban, during which time it shall be unlawful for the driver of any vehicle, other than one acting in an emergency, to park said vehicle on any street until such time as the full parking ban is lifted. No person shall park a vehicle for a period of time longer than twelve (12) minutes between the hours of 9:00 A.M. and 6:00 P.M. on any of the streets or parts of streets hereinafter designated in this and the following paragraph or as may be hereinafter fixed by regulation on any day. This restriction shall not apply on Sundays or during the hours of legal holidays during which business establishments are required by law to remain closed. In accordance with the foregoing, parking meter zones are hereby established in the following streets or parts of streets: CENTRAL AVENUE southerly side from Maple Street easterly for a

distance of approximately sixty (60) feet.

15 Minute Parking

No person shall park a vehicle for a period of time longer than fifteen (15) minutes between the hours of 8:00 A.M. and 6:00 P.M. on any of the streets hereinafter designated in this section on any day, except that this restriction shall not apply on Sundays or during the hours of legal holidays during which the Post Office remains closed: ALDEN STREET on the easterly side for a distance of one hundred and

forty-four (144) feet southerly from the intersection of Conant Street. CONANT STREET on the southerly side for a distance of one hundred

thirty-two and one-half (132.5) feet easterly from the intersection of Alden Street.

HOLTEN-RICHMOND SCHOOL parking spaces in the rear of the school. Section 10A. The Town Manager is hereby empowered to contract in accordance with the provisions of Chapter 40 as amended by Chapter 442 of the Acts of 1947, for the acquisition and installation of parking meters provided for by this regulation and to maintain said meter in good workable condition. Section 10B.

The Town Manager is hereby authorized and directed to install parking meters within the areas described in this regulation or cause the same to be so installed. The meters shall be placed at intervals of not less than 20 feet apart except that beginning and ending space may be 18 feet, and not less than 12 inches nor more than 24 inches from the face of the curb adjacent to individual meter spaces. Meters shall be so constructed as to display a signal showing legal parking upon the deposit therein of the proper coin or coins of the United States as indicated by instructions on said meters and for such period of time as is or shall be indicated by legend on meters. Said signal shall remain in evidence until expiration of the parking period designated, at which time a dropping of a signal automatically or some other mechanical operation shall indicate expiration of said parking period. Section 10C. The Town Manager is hereby authorized and directed to establish parking meter spaces, in such parking meter zones, as are herein specified, or as may be hereafter fixed by regulation and to indicate the same by white markings upon the surface of the highway. Section 10D. Whenever any vehicle shall be parked adjacent to a parking meter, the owner or operator of said vehicle shall park within the space designated by street marking lines and upon entering such space shall immediately deposit in said meter the required coin of the United States for the legal parking period as indicated or shown on the meter and if so required set the mechanism in motion. Section 10E. The fee for the maximum parking time shall be five (5) cents or one (1) cent for each proportionate period of said maximum limit as shown on the meter, and except at twelve minute meters where the fee for the maximum and minimum parking time shall be one (1) cent, except in off-street parking areas where the fee for the maximum parking time shall be ten (10) cents or one (1) cent for each proportionate period of said maximum. It shall be unlawful for any person to deposit or cause to be deposited in a parking meter any coin for the purpose of permitting the vehicle of which he is in charge to remain in a parking space beyond the maximum period of time allowed in a particular zone. It shall be unlawful for any person to park a vehicle within a parking space unless such vehicle is wholly within the painted lines adjacent to such meter. It shall be unlawful for an unauthorized person to open, tamper with, break, injure or destroy any parking meter or to deposit or cause to be deposited in such meter any slug, device or metallic substance or any other substitute for coins required. Section 10F.

Operators of commercial vehicles may park in a metered space without depositing a coin for a period not to exceed thirty minutes for purposes of loading and unloading. Parking in excess of this limit without depositing the proper coin shall be deemed a violation of the provisions of this regulation. Section 10G. The sealer of weights and measures is hereby designated as the person authorized to collect all moneys deposited in parking meters or to cause the same to be collected. Such moneys shall be deposited forthwith with the Town Treasurer in a separate account to be known as the Danvers Parking Meter Account. Section 10H. It shall be the duty of police officers to enforce the provisions of this regulation. Section 10I. Any person who violates any parking provision shall be subject to the penalties provided in Article IX, Section 3 of these Rules and Orders. Section 10J. All rules and orders or parts of rules and orders inconsistent herewith are hereby repealed. Section 10K. Reservation of Powers. Nothing contained in this parking meter regulation shall be construed to prohibit the Board of Selectmen from making provisions for bus stops, taxicab stands, service zones and loading zones as authorized by law on any street or portion of street which has been or may be hereafter designated herein as a parking meter zone. Section 10L. The above regulations from Section 10 through 10K both inclusive shall apply to all municipal parking areas duly established except that there shall be a two hour limit: Municipal Off-Street Parking Area Number 1: That off-street parking area to the East of Maple Street and running from Central Avenue to Cottage Avenue. Municipal Off-Street Parking Area Number 2: That off-street parking area on the

148 Section 11. HIGH STREET no commercial vehicle may occupy the zone on the westerly side of High Street from Healy Court northerly to a point 150 feet from Healy Court.

ARTICLE VI ADVERTISING SIGNS, DISPLAY AND STORAGE OF MATERIALS IN

STREETS, TRUCKING AND PARADES

Section 1. Using Vehicle for Sale Purpose of Displaying Advertising Prohibited. No person shall operate or park a vehicle on any street or highway for the sole purpose of displaying advertising signs. Section 2. Placing of Structures or Property in Streets Prohibited. (a) No person shall place, erect or cause to be placed or erected within any

sidewalk, street or highway any fixture or structure unless a permit, issued by the Board of Selectmen, in the case of Town ways of the Department of Public Works, Commonwealth of Massachusetts, in the case of state highways, authorizing such placing or erection has been granted and is in effect.

(b) No person, other than one employed directly or indirectly by the Town or

by the Commonwealth of Massachusetts and while in the performance of necessary public duties, shall at any time place or leave in any sidewalk, street or highway any article, material, or merchandise, or park a vehicle or cart in any sidewalk, street or highway for the purpose of displaying merchandise unless a permit issued by the Board of Selectmen in the case of Town ways or by the Department of Public Works in the case of State highways, authorizing the use of the sidewalk, street or highway has been granted and is in effect except as may be necessary for the reasonable and expeditious loading or unloading of any such article, material, merchandise, cart or vehicle, provided, however, that such property shall never be left so as to obstruct the free passage of pedestrians or vehicular travel.

(c) Any such fixture, structure or property as referred to in this section which has

been erected, placed or left illegally in any street, highway or sidewalk, may be moved by or under the direction of an officer and at the owners expense.

Putnam Street - No Person shall park a vehicle other than a commercial delivery vehicle on the northerly side from a point 140 feet west of Elm Street for a distance of 45 feet. Section 3. Deposit, Bond or Insurance Policy May be Required for

the Privilege of Using Street for Special Purposes. The Board or officer issuing permits for such use of sidewalks, streets, or highways as are described in the two previous sections may in its or his discretion when occasion justifies demand a suitable cash deposit, surety bond or insurance indemnity police to save the Town or the Commonwealth of Massachusetts harmless from all liability of any nature whatsoever caused directly or indirectly by such use of the sidewalk, street or highway. Section 4. Obstructing Traffic by Stopping or Loitering or Sauntering. No person shall stop, stand, loiter or saunter on any sidewalk, street or highway so as to obstruct or impede the normal movement of traffic and any person doing so shall move on if directed to do so by an officer. Section 5. Parades and Processions. No procession or parade, excepting the forces of the United States Army or Navy, the military forces of the Commonwealth of Massachusetts, the forces of the police and fire departments and funerals shall occupy, march or proceed along any way except in accordance with a permit issued by the Chief of Police and such other regulations as are set forth herein which may apply.

ARTICLE VII ONE WAY STREETS

ARTICLE VIII OPERATIONS OF VEHICLES

Section 1. Drive Within Marked Lanes. When any roadway has been divided into lanes, a driver of a vehicle shall drive so as to be entirely within a single lane and shall not move from the lane in which he is driving until he has first ascertained if such movement can be made with safety. Section 2. Use Right Lane. Upon all roadways the driver of a vehicle shall drive in the lane nearest the right side of the roadway when said lane is available for travel except when overtaking another vehicle or when preparing for a left turn. 65 Section 2A. turn left into Federal Street. 83 SYLVAN STREET northbound drivers on Collins Street, left lane must turn

left into Collins Street. WATER STREET northbound drivers at Endicott Street, left lane must turn

left. Section 3. Overtake Only When There is a Space Ahead. The driver of a vehicle shall not overtake and pass a vehicle proceeding in the same direction unless there is sufficient clear space ahead on the right side of the roadway to permit the overtaking to be completed without impeding the safe operation of any vehicle ahead. Section 4. Driver to Give Way to Overtaking Vehicle. The driver of a vehicle when about to be overtaken and passed by another vehicle approaching from the rear shall give way to the right in favor of the overtaking vehicle, on suitable and audible signal being given by the driver of the overtaking vehicle, and shall not increase the speed of his vehicle until completely passed by the overtaking vehicle. Section 5. Obstructing Traffic. (a) No person shall drive in such a manner as to obstruct unnecessarily the

normal movement of traffic upon any street or highway. Officers are hereby authorized to require any driver who fails to comply with this section to drive to the side of the roadway and wait until such traffic as has been delayed has passed.

(b) No driver shall enter an intersection or a marked cross-walk unless there

is sufficient space on the other side of the intersection or crosswalk and on the right half of the roadway to accommodate the vehicle he is operating

without obstructing the passage of other vehicles or pedestrians notwithstanding any traffic control signal indication to proceed.

Section 6. Following Too Closely. The driver of a vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard to the speed of such vehicle and the traffic upon and condition of the street or highway. Section 7. Slow Vehicles to Stay 200 Feet Apart. Upon roadways less than twenty-seven (27) feet wide and upon which vehicular traffic is permitted to operate in both directions the driver of any slow moving vehicle when traveling outside of a business or residential district shall not follow another slow moving vehicle within two hundred (200) feet, but this shall not be construed to prevent such slow moving vehicle from overtaking and passing another slow moving vehicle. This section shall not apply to funerals or other lawful processions. This rule shall apply to vehicles described in General Laws (Ter. ed.) Chapter 90, Section 19. Section 8. Care in Starting, Stopping, Turning and Backing. The driver of any vehicle before starting, stopping, turning from a direct line or backing shall first see that such movement can be made in safety. If the operation of another vehicle should be affected by a stopping or turning movement, the driver of such vehicle shall be given a plainly visible signal as required. Section 9. Exclusion of Heavy Commercial Vehicles. (a) The use and operation of heavy commercial vehicles are hereby restricted

on those streets or parts of streets described in this section in the manner outlined and during the period of time set forth:

123 ASH STREET between Elm Street and Purchase Street at all times. The

alternate route shall be Elm Street, High Street, and Purchase Street. BELGIAN ROAD between Poplar Street and Brookvale Drive at all times. 50 CENTRE STREET between Andover Street (Route 114) and US Route 1-

24 hours. The alternate route shall be Route 114 and US Route 1. 74 CENTRE STREET between Southside Road and Prince Street at all

times. The alternate route shall be via Newbury Street and Andover Street.

alternate route shall be via Collins Street and Pine Street. 74 PRINCE STREET at all times. The alternate route shall be via Newbury

Street and Andover Street. SHETLAND ROAD between Poplar Street and Morningside Drive at all

times. (b) This section shall not apply to heavy commercial vehicles going to or

coming from places upon said streets or adjoining streets or ways to which access cannot otherwise be gained, or to vehicles of municipal departments of public service corporations having emergency work to do on said streets or adjoining streets, or to the US Mail vehicles collecting mail on the said streets, or to the police and fire departments vehicles or to ambulances.

Section 10. Sound Horn When Necessary. The driver of a vehicle shall give an audible warning with his horn or other suitable warning device whenever necessary to insure safe operation. Section 11. Obedience to Traffic Control Signals. Colors and arrow indications in traffic control signals shall have the commands ascribed to them in this section, and no other meanings, and every driver of a vehicle, railway car or other conveyance shall comply therewith, except when otherwise directed by an officer or by a lawful traffic regulating sign (other than a "Stop" sign) signal or device, or except as provided in Section 18B of this Article. In no case shall a driver enter or proceed through an intersection without due regard to the safety of other persons within the intersection regardless of what indications may be given by traffic control signals. (a) GREEN: While the green lens is illuminated, drivers facing the signal may

proceed through the intersection, but shall yield the right of way to pedestrians and vehicles lawfully within a crosswalk or the intersection at the time such signal was exhibited. Drivers of vehicles making a right or left turn shall yield the right of way to pedestrians crossing with the flow of traffic.

(b) RIGHT, LEFT AND VERTICAL GREEN ARROWS: When a right green

arrow is illuminated, drivers facing said signal may turn right. When a left green arrow is illuminated, drivers facing said signal may turn left. When a

vertical green arrow is illuminated, drivers facing said signal may go straight ahead. When a green arrow is exhibited together with a red or yellow lens, drivers may enter the intersection to make the movement permitted by the arrow,, but shall yield the right of way to vehicles and pedestrians proceeding from another direction on a green indication.

(c) YELLOW: While the yellow lens is illuminated, waiting drivers shall not

proceed and any driver approaching the intersection or a marked stop line, shall stop at such point unless so close to the intersection that a stop cannot be made in safety, provided, however, that if a green arrow is illuminated at the same time, drivers may enter the intersection to make the movement permitted by such arrow.

77 (d) -1- RED: Traffic facing a steady Circular Red Signal alone shall stop at a

clearly marked stop line, or if none, before entering the crosswalk on the near side of the intersection, or if none, then before entering the intersection and shall remain standing until an indication to proceed is shown except as allowed by Chapter 89, Section 8 of the General Laws.

make a right turn at the following intersections: BURLEY FARM ROAD at CONANT STREET Southbound drivers on

(e) RED AND YELLOW: While the red and yellow lenses are illuminated

together, drivers shall not enter the intersection and during such time the intersection shall be reserved for the exclusive use of pedestrians.

(f) FLASHING RED: A flashing red lens shall indicate those intersections at

which a driver is required by law to stop before entering. (g) FLASHING YELLOW: A flashing yellow lens shall indicate the presence

of a hazard and drivers may proceed only with caution. (h) FLASHING GREEN: A flashing green lens shall indicate an intersection

or pedestrian crosswalk in use or subject to use by entering or crossing traffic. Drivers may proceed only with caution and shall be prepared to comply with a change in the signal to a red or yellow indication.

Section 12. Obedience to Isolated Stop Signs. Every driver of a vehicle or other conveyance, approaching an intersection of ways where there exists facing him an official sign, bearing the word "STOP" and authorized by this section said sign having apart from this regulation, the written approval of the Department of Public Works, Commonwealth of Massachusetts, and such approval being in effect, shall before proceeding through the intersection, bring such vehicle or other conveyance to a complete stop at such point as may be clearly marked by a sign or line or if a point is not so marked, then at a place between the said "STOP" sign and the nearest line of the street intersection. In the case of a line of two or more vehicles approaching such

"STOP" sign, the drivers of the second and third vehicles in line in any group shall not be required to stop more than once before proceeding through the intersection. This section shall not apply when the traffic is otherwise directed by an officer or by a lawful traffic regulating sign, signal or device, except as provided in Section 18 (c). In accordance with the foregoing the erection and maintenance of an official "STOP" sign or signs are authorized so as to face: North and South bound drivers on Adams Street at Sylvan Street. 34 Eastbound drives on Adams Street at Ash Street. 86 Westbound drivers on Adams Street at Pine Street. Keep to Right of Roadway Division. Upon such roadways as are divided by a parkway, grass plot, reservation, viaduct, subway or by any structure or area, drivers shall keep to the right of such a division except when otherwise directed by an officer, signs, signals or markings. Section 14. Driving on Road Surfaces Under Construction or Repair. No operator shall enter upon the road surface of any street or highway or section thereof, when, by reasons of construction, surface treatment, maintenance or the

like, or because of some unprotected hazard, such road surface is closed to travel, and one or more signs, lights, or signals have been erected to indicate that all or part of the road surface of the street or highway is not to be used, or when so advised by an officer, watchman, member of the street or highway crew of employee of the Town either audibly or by signals. Section 15. No Driving on Sidewalks. The driver of a vehicle shall not drive upon any sidewalk except at a permanent or temporary driveway. Section 16. No Driving Through Safety Zones. It shall be unlawful for the driver of a vehicle, except on signal from a police officer to drive the same over or through a safety zone. Section 17. Funerals to be Properly Identified. A funeral composed entirely or partly of a procession of vehicles shall be identified as such by means of black pennants bearing a purple cross attached to both the first and last vehicle. Section 18. Rights and Duties of Drivers in Funeral or Other Processions. (a) It shall be the duty of each driver in a funeral or other procession to keep

as near to the edge of the roadway as is feasible and to follow the vehicle as closely as is practicable and safe.

(b) At an intersection where a traffic control signal is operating the driver of

the first vehicle in a funeral or other procession shall be the only one required to stop for a red or red and yellow indication.

(c) At an intersection where a lawful stop exists, the driver of the first vehicle

in a funeral or other procession shall be the only one required to stop before proceeding through the intersection.

Section 19. Dropping or Leaking Loads. No vehicle shall be driven or moved on any street or highway nor shall any owner of any vehicle knowingly permit such vehicle to be driven or moved on any street or highway unless such vehicle is so constructed or so loaded as to prevent its contents from spilling, dropping, sifting, leaking or otherwise escaping therefrom. Vehicles loaded with any mater which may be blown about by the wind shall be suitably covered to prevent the contents from being blown upon the streets or highways.

Section 20. Emerging from Alley or Private Driveway. The operator of a vehicle emerging from an alley, driveway or garage shall stop such vehicle immediately prior to driving onto a sidewalk or on to the sidewalk area extending across an alleyway or driveway. Section 21. No "U-turns". No "U-turns" of a vehicle shall be permitted: 133 On Avon Road from Thorpe Circle to the Thorpe School. On Maple Street from the Southwesterly corner of High Street and Elm

Street to the Central Fire Station. Section 22. Operation at Under or Overpasses and at Intersections with Islands. At any junction or crossing of ways where the roadway grades have been separated and where the ways have been connected by ramps and at intersections of ways in which there are traffic islands, drives of vehicles shall proceed only as indicated by official signs, signals, or markings. 162 Section 23. ARTICLE IX ACCIDENT REPORTS

RESPONSIBILITY, PENALTIES, AND REPEALS

Section 1. Drivers Must Report Accidents. The driver of any vehicle involved in an accident resulting in an injury or death of any person or property damage to an apparent extent of one hundred ($100) dollars or more shall within twenty-four hours make a full and complete report in writing of such accident to the police headquarters in this Town. A driver who has been incapacitated as a result of such accident, and to such extent as to make reporting impossible or unfavorable to his recovery, shall not be required to

report such accident until he has recovered sufficiently to be able to do so. The report shall be made on a form furnished by the police station. Compliance with this section, however, shall not relieve such driver from the additional responsibility of reporting to the Registrar of Motor Vehicles any accident which a person is killed or injured. Section 2. Owner Prima Fascia Responsible for Violations. No person shall allow, permit or suffer any vehicle registered in his name to stand or park in any street, way, highway, road, or parkway under control of the Town of Danvers in violation of any of the rules and orders passed by the Board of Selectmen in relation to parking. Section 3. Penalties. 37 (a) Any person convicted of a violation of any rule, regulation or order made 115 hereunder, shall be punished by a fine not exceeding fifty dollars for each offense, except as otherwise herein provided. 88 (b) Pursuant to the provisions of General Laws (Ter. Ed.) Section 20C, 144A Chapter 90, any person violating any provision of any rule; regulation, 175 order or ordinance regulating the parking of motor vehicles, shall be

punished by a fine for each offense as hereinafter set forth:

25 Street Cleaning 25.00 Section 4. Repeal. These rules are adopted with the intent that each of them shall have the force and effect separately and from independently from every other except insofar as by express reference or necessary implication any rule or part of a rule is made dependent upon another rule or part thereof. The provisions of these rules so far as they are the same in effect as those of an existing valid rules or orders heretofore made by the Board of Selectmen of the Town of Danvers relative to or in connection with official signs, lights, markings, signal systems or devices shall be construed as a continuation thereof, but all other existing rules and orders so made for the regulation of vehicles are hereby expressly repealed. This repeal, however, shall not affect any punishment or penalty imposed or any complaint or prosecution pending at the time of the passage hereof for any offense committed under any of the said valid rules or orders hereby repealed.
