My Dear friends,

My first month as your state president was eventful and I have to cope-up with hectic schedule. New office bearers installation at Tuticorin - Coimbatore - Salem - Madurai - Attur and Thanjavur were really wonderful. The out going leaders have made roads and roadmaps for the incoming team who have assumed office with courage confidence and rich in new ideas innovations and dynamism.

On 23.12.2014 I was invited for the “TANCARE” function conducted by FICCI where in I have requested the Chamber of Commerce and Industry State and national office bearers to invest in “Health vision 2023" of tamilnadu chief minister. I have also requested the secretary to govt. health and family welfare - govt of tamilnadu to sanction one medical college for IMA and reserve 50% of seats in that college for IMA doctor’s off springs.

Myself and Dr.C.N.Raja camped at Rajapalayam for two days during the Dengue - out break - went around the municipal wards along with the team headed by the Hon.Health Minister and also conducted meetings in the G.H and press meet and our doctor’s of IMA Rajapalayam - headed by Dr.Gothandaraman did a good job which was appreciated by every body.

Installation of office bearers of IMA C.G.P - Dr. Prabavathi and Dr.Rajarajeshwar was a memorable event well attended by both state and national leaders.

Death in a hospital and also deaths due to treatment failures haunt doctors and hospitals as a night - mare. In January alone there were many instances. The disheartening features are well organized - Preplanned - crowds - relative - friends - caste - and religious out fits - small time political parties along with some lawers misinformed press try to extract maximum by blackmailing the besieged doctor - Hospital - subjecting him to trememdous fear of violence and in many cases they were able achieve their goal because the field level, law - enforcing authorities in the district are a confused - preplexed lot - not well versed in rules - G.O, and acts.Even if they know - many times they pretend as though not knowing it and show misplaced sympathy towards the crowd. why not the law enforcing authorities treat the hospital attacks and attack on doctors as a law and order problem and disperse the crowd as per law which they do when a Taluk office or an - police station is gheroed or “Road Rokho” is done? will not the police arrest them or disperse them using minor or at times major force ? what is needed is implicit implementation of rules and acts to protect the hospital so that community is benefited.

we want : 1. Hospital and health care institutions must be declared as protected zones.

we want : 2. The state chief secretary - Home secretary to instruct the district law enforcing authorities to enforce the existing rules and acts without complacency or lethargy.

3.Then “Hospital protection services a cadre of security guards” must be in place - both in govt. and private hospitals put in by the govt or by govt - private hospitals partership mode.

I am planning to give full thrust in the above areas. while other issues take these place second to protection of practice and hospitals including doctors.

CRISIS

There are lot of incidences are happening in our state which is severely affecting the patients and Doctors relationship. Many a times incidence of death happening in the hospital inspite of good care and treatment. Though the attenders and the close relatives accept the facts, some unwanted elements appear suddenly and create crisis. For every death in the hospital a ransom is demanded. This is totally unacceptable and to be avoided.

304 A and PCR Act

Though we have very clear cut guidelines by Supreme Court of India that no Doctor should be arrested or booked under 304 A sections on private complaints, but it is still continuing all over the state against the Doctors. We are not against any proper police and judiciary actions. Now apart from 304A section Doctors are booked under PCR act this deeply affects the morale of the doctors. This often happens by the pressure given by some sections of the public, which police is yielding.

The doctors never give treatment on the basis of caste, creed or religion. It gives lot of mental agony, pain to the medical community if the PCR act thrusted up on the doctors. So my dear colleagues this is the time that we should find a clear code of conduct for the police and other officials in the untoward incidence of hospital death.

ZONAL MEETS FOR THE PRESIDENTS AND SECRETARIES

We are going on our Zonal meet of Presidents and Secretaries of the respective zone very soon, 1st Zonal meet for West zone is on March 15th at Erode. I request our zone vice Presidents to come forward and fix up suitable dates for the respective zones.

HEALTH POLICY-2015

Government of India has come with New Health policy draft for our Country. They are making health as a fundamental right. It is in the union Government Health Department website kindly go through it and give your feed back to the State Office.

BRANCH ELECTIONS

Once again I request all the branch Presidents and Secretaries to complete the Elections and update the New Office Bearers list including State Council and Central Council Members. Otherwise it is very very difficult to give the communication properly and on time. If the State Council and Central Council members are not updated this may not appear in the Register.

All the Branches are requested to contact the State Office before they invite the National leaders for their Branch activities. So that it will avoid the clash of dates in the State Level activities.

All of you know that IMA is the only organization to protect our profession in all aspects. Unless we show good strength by attending in large numbers in all meetings, we will not achieve the goal.

I attended 1964 Stanleyians meet on 10-1-15, arranged nicely by Dr.C.Ganesan and T.Chandrasekaran of Salem. It was a thrilling experience meeting our old friends after fifty years. I attended pongal vizha and installation ceremony of new office bearers of Vellore IMA. National leader Dr.N.Appa Rao was the chief guest and North zone Vice President Dr. Amudha Karunanithi was the guest of honor. They celebrated it in a grand manner. I participated in the installation ceremony of new office bearers of C.G.P. headquarters in Chennai, Dr.E.prabavathi (Hyderabad) as dean and Dr. Rajarajeswar as hony secratry and I congratulate them.

I attended the meeting on 23-1-15 organised by NHB and state office bearers with Dr.S.Prakash, executive director of Star health and allied insurance Ltd and discussed about the rates of various surgeries.

I congratulate the new office bearers of all local branches.

Greetings from NHB TNSB!

Last month has been very busy and we have been kept active by various developments. The most important one is our negotiations with both GIPSA and Star Health. With GIPSA ,Coimbatore IMA NHB has been holding talks for some time. This time IMA NHB and state involved themselves directly to help Coimbatore IMA to come to a fruitful understanding

with GIPSA. State Secretary Dr.CN.Raja and NHB Secretary under instructions from the state President Dr.RVS. Surendran attended the meeting at regional office of UIIC on 6-1-2015. The negotiations were fruitful and a near agreement has been arrived at on almost all packages baring a few. We expect the small gap also to be filled up in the near future so that a comprehensive understanding can be arrived at and the same can be carried over to the rest of the state. IMA NHB thanks Dr. Abdul Azeez (CRM UIIC), and Dr.Gunasekaran (Vidal) for their excellent co-operation. IMA NHB conveys its appreciation to the members of IMA Coimbatore for their effective handling of the negotiations which we are sure will be a win-win for both sides.

Next important development has been our negotiations with star health alliance for empanelment of all the members of NHB under their insurance package. The meeting was held in Chennai on 23-1-2015 at their corporate office in the presence of the state President, Secretary and other senior leaders. We thank the leaders for their enthusiasm in seeing this negotiations through. We expect to sign a MoU with the health insurance giant at the earliest. We are sure that this will be a new beginning of hope for all small and medium hospitals especially in the periphery. IMA NHB expresses its gratitude to all the state and national leaders who helped us achieve this. We also place on record the helpful attitude of the executive director of star health Dr.S.Prakash FRCS and his team in conducting the negotiations in a very friendly atmosphere.

Our 104th NHB meet shall be held in Kanchipuram on 22-3-2015. We thank IMA Kanchipuram for agreeing to host the meet. We request all our members and aspiring nursing home owners to make use of the opportunity- We promise you a very engaging agenda. Meet you in Kanchipuram.

Dear all,

Greetings! Hope you all had enjoyable

festive season. Most of you would have had

tough time managing the hospital due to short

of hands during this season due to many

absentees of paramedical during Pongal.

It is high time that we give adequate

practical training in all aspects right from

administration, front desk management, Patient care, communication

skills etc, to our paramedics. We request all the branch Presidents and Secretaries to

encourage the Joint Secretary in charge of Nursing Home Board from their Branches to conduct

at least monthly one programme on practical issues for the staffs of the member Hospitals and

also to have interaction session among the Directors and Doctors in charge of the member

hospitals and exchange views. This will help us very much in solving many problems and

issues. Congrats to Dr.Anburajan Vice President of South Zone and Office Bearers of

Tirunelveli Branch for initiating such program in their branch. Such programmes are already

being done periodically in Coimbatore Branch. We wish all branches will take up this.

Our next para medical zonal meet is at Kancheepuram during 2nd week of March. We

anticipate a great show by Kancheepuram IMA under the Dynamic young leader Dr.Saravanan.

Dear Colleagues ! Greetings ! The last module of the Diabetology Course for Madurai Centre was held on Sunday the 11th January 2015 in Madurai IMA. The Valedictory Function was held on the same day at 1pm in our IMA Hall under the Presidentship of IMA President Dr.K.N.Shahul Hameed. The Office bearers of IMA Madurai branch Co- ordinator Dr.Parthiban, Faculties Dr.Vadivelmurugan and Dr.Kumaravel participated and they were honoured suitably. The last module of Diabetology Course for Chennai Centre is to be held on Sunday the 8th Feb 2015 at Chennai. The last module of Oncology Course is to be held on Sunday the 22nd February 2015 at Medicity Hospital, Madurai. Greetings and best wishes from the FSS office!

Hope you have all received the year book of the FSS of IMA TNSB by now. It has been our first attempt. There will be lot of avenues for the improvements; please let us know so as to pass it on to the new team for this year's book. This year's due for the 20th due is Rs. 9500 to cover for 50 deaths will have to be paid before March 31st 2015. There are some 1200 some 1000 odd members who have to pay the past due which we request you to pay immediately. The rules and byelaws have been already been sent to you all in the year book. If you have more than two dues to be paid your membership can be deleted and your paid up amount will be lost. Please bear this in mind and pay the balance amount if any before February 28th.

We had a good response and understanding members who paid up the due on intimating them. We request those members who have missed to pay may remit the amount immediately to the FSS office. This statement is been reprinted in all the issues for the past 18 months. Hope everybody read it and act accordingly as this FSS not only supports your family but in the process you are giving a helping hand to your colleague's family. We have been able to recover to the tune of more than two crores of rupees in the past 15 months. It is only less than a crores to be paid and if you are one of them please do it immediately.

SUPREME COURT OF INDIA JUDGMENT “We, therefore, direct that whenever a complaint is

received against a doctor or hospital by the Consumer for a

(whether District, State or National) or by the Criminal Court

then before issuing notice to the doctor or hospital against

whom the complaint was made the consumer forum or

Criminal Court should first refer the matter to the competent

doctor or committee of doctors, specialized in the field

relating to which the medical negligence is attributed, and

only after that doctor or committee reports that there is a

prima facie case of medical negligence should notice be

then issued to the concerned doctor/hospital. This is necessary to

a v o i d h a r a s s m e n t t o d o c t o r s w h o m a y n o t b e

ultimately found to be negligent. We further warn the facts clearly

come within the parameters laid down in Jacob Mathew’s case

(Supra), Otherwise the policemen will themselves have to face

legal action.”


Dear Doctor , “The achievement of one goal should bethe starting point of another”

Death of the patient under Treatment / Death on table.:

In cases where medico legal problem is foreseen, it is advisable to request the police to send the dead body for post mortem rather than certifying the cause of death.

There may be request or at times even pressure not to inform police, but heeding to any such request would amount to patent illegality.

More over, if the relatives of the dead choose to file a case of negligence, one of the common allegations is that the doctor had not sent the dead body for postmortem to cover his mistakes.

In case of any unnatural death, the onus to inform the police lies on the doctor or the hospital. Police must be informed in writing of the death, and a copy bearing their acknowledgment must be preserved. Doctors must specifically request for a postmortem eventhough the discretion to send the dead body for postmortem lies with the police.Complications during the course of treatment::

In case of complications, appropriate investigations must be advised without delay, other specialists must be consulted and proactive remedial steps must be taken. If indicated, the patient must be transferred to a higher center or appropriate facility.

It is imperative that we examine the patient to come to a provisional diagnosis and then we advise him accordingly; and if patient agrees, only then the contract for service comes into existence. Instead of taking it as implied consent, it is better to get it in writing in the format given below in the front page itself.

Advantages of the format are:- 1.This obviates the accusation that we are ordering investigations unnecessarily. 2.In many lawyer notices it is alleged that we gave assurance of cure falsely. 3.Complaint of informed consent not given will be prevented.4.In certain lawyer notices it is alleged that doctor assured that all facilities are available and that is why the complainant have got admitted in the nursing home. This will be prevented. 5.The rights of the patients are made clear as you might have seen in American films – Police say to the person to be arrested about his rights to get a lawyer to defend. 6.I think it is impossible to employ enough personal to supervise and prevent mishaps, fall from bed, fall over rails, and fall in the bath room etc. So it is better we get a consent as above. Ilford and District Hospital Management Committee. “a hospital authority was held liable for injury suffered by a patient when attempting suicide, on the ground that hospital had omitted to provide supervision of patient which was an identified risk.”

The 2nd page of the case sheet has list of investigations done. This may be completed by hand or zerox copies may be attached to the case sheet. In the next pages progress of the patient should be written in chronological order. Specialists giving opinion should be written in the same page of the daily observation notes of the doctor concerned and not in separate sheet. Separate sheets for specific hand written consent and full particulars of specific procedures
