Dear Brothers and Sisters,

My hearty christmas, New year and Pongal Greetings to you and your family members.

I am very much thankful to you all for making the IMA - 69th Annual State Conference TIMACON 2014 a grand success and a memorable event in the annals of IMA Tamilnadu.

It was a well attended of IMA Tamilnadu. Conference was inaugurated by Secretary to Govt. Health and Family welfare dept. Govt of tamilnadu -who said the good schemes of the Govt. must be taken to the patients and general public by the members of IMA. Installation function held in the evening. Our chief guest was Dr.Vijayabashkar - Hon. Health Minster - Govt. of Tamilnadu, National IMA President, Dr. Marthandapillai, Past National Presidents, Dr.K.Vijayakumar, Dr. Velayutham Pillai IMA National vice President Dr.Veeranna, National Vice President Elect, Dr.L.P.Thangavelu, and National Leaders Dr.Arulraj, Dr. Appa Rao were present to bless the occasion. Dr.M.Balasubramaniyan installed me as President IMA in the presence of Dr.C.N.Raja Hony. State Secertary, Dr.Senthil. TNGDA President said IMA and TNGDA are the birds of same feather and work together to attain our legitimate rights.

Hon.Minister Dr.Vijayabashkar said Tamilnadu Govt. has many innovative schemes for the benefit of the people and IMA doctors must take them to the needy and create an awareness among general public. He said he will safeguard the legitimate interests of Doctors of Tamilnadu and protect them as a shield.

Thanks to the organizers of the TIMACON-2014 Chettinadu Branch and is leaders Dr.Muthiah - Dr.Devakumar - Dr. Natesan and Dr.Chellappa.

Hon. Minister accepted in principle our demand to allot a site for us to build unified tamilnadu IMA Head Quarters building at Chennai and to Create “Doctos welfare Fund” by the Govt. of Tamilnadu.

1. All branches must conduct their elections and submit the list of new office bearers before 31st of January 2015.

2. Any branch requesting the state office bearers for their functions must enroll atleast 10 new numbers on that day.

3. Form crisis management committee immediately in each branch and at district level.

New office bearers are taking over the reins of branches and Dr.Ashok Sheshan, Dr.Kumaran and Dr.Nandha Kumar were installed as New President, Secretary, and Finance secretary of TUTICORIN IMA branch on 20th Dec. in a nice function where - I was the chief Guest. on 21st dec - diabetic conference KUMP MET CON - 2014 was inaugurated by me and our IMA branch office bearers were with me gracing the occasion at Kumbakonam.

I congratulate all the Branches and Members who have received the State Awards. And In the State Council Meeting on 14th December, We passed resolution to oppose MTP Act Amendment 2014, which enables the Ayush Doctors to do MTP. Requesting Tamil Nadu Government to pass Anti Quackery bills Memorandum on these two issues are already submitted to the Honorable Health Minister last week. I Thank the Human Rights Commission for taking up the issue of Quackery Sumoto from the press release given by our Immediate Past President Dr.M.Balasubramanian at State Council Meet at Namakkal.

I take this opportunity to thank our National IMA for giving Best President Award to Dr.M.Balasubramanian and Best Secretary Award to myself. This is possible only by the whole hearted support and encouragement given by all the members' branch Presidents and Secretaries and by the Past Presidents.

On 27th & 28th December, we have attended National Conference at Ahmadabad in large numbers. Where Dr. Marthandam Pillai taken over as the National President and Dr.K.K. Agarwal as Hony. Secretary General. On behalf of IMATNSB we wish them all the very Best. I request all the branches to conduct the Elections before 31st January and send New Office Bearers list, State Council Members List, Central Council Members list.

All the branch Presidents and Secretaries are requested to consult the State Office before inviting the National Leaders to enable us in conducting the events smoothly at state and National level.

National IMA Theme of this year is “Dedicated to a Healthy India”.

Let us at the outset wish you all a Happy and prosperous 2015 and a Happy Pongal!

We from NHB wish to give you some happy news regarding Insurance and provide a solid platform for accreditation in this new year. At the outset we offer our hearty welcome to the new team of office bearers headed by Dr.R.V.S. Surendran. We have just had a wonderful state conference in NHB Secretary's home turf Karaikudi. We are very sure you all thoroughly

enjoyed the conference, its food, the sessions and hospitality. NHB promises the new president that we will co operate with him in all the matters of the state office and be supportive of his initiatives.

2014 saw NHB very actively engaged in various programs of the state mainly due to the encouragement given by the IPP Dr.M. Balasubramanian and secretary Dr. CN. Raja. The year started with a bang when we celebrated the 100th meet at Mahabalipuram. Our Chairman with his good office, managed to get a postage stamp released on the particular day to mark the event.

All the four zonal meets were well attended and useful discussions held. The most important milestone was our meeting with IRDA officials and subsequent negotiations with insurance people over package rates. We simultaneously held talks with a private insurance giant , for total empanelment of all the members of NHB with them for cashless treatment and package rates. Both these are about to yield fruit and probably we will able to give you good news in the next TIMA news edition. NHB took part in IMA activities like 'Clean India Project'. We involved all the members in this program. NHB launched a online diabetic/hyper tension survey involving its members during the diabetic week. The results were presented to the health secretary in the annual conference. All these were possible because of the able guidance of our leaders especially Dr.M. Balasubramanian, Dr. V. Varadharajan, Dr. CN. Raja and Dr. V. Madhavan.

This year we want to focus on making accreditation procedure affordable and accessible to all our members by seeking the help of our own experts and some organizations. so that all our hospitals will be able to make themselves eligible for the insurance coverage. Our aim is that even the smaller hospitals in the periphery should be able to avail the benefits of insurance covered medical and surgical treatment. We want to point out that our members should also strive to raise their standards of infrastructure to a level that will be accepted and accredited. Need of the hour is to realize the expectations of our patients and mould ourselves suitably. Fortunately, we have a President who has always been a supporter of small hospitals. With his help and guidance, we are sure that this year also will be a successful one for NHB

IMA TNSB Paramedical

Dear Dr:

Greetings! From paramedical wing. Hope 2014 WAS a successful year for all.

We wish you all healthy, wealthy, peaceful, hastle free 2015.

We all understand that the paramedics are the backbone for our institutions. But they are like glass ware to be handled with care! Most of us start humbly with a clinic move on to few bedded hospital expanding to multi specialty 50-100 bedded hospital. Most of us will have one(or)two paramedic who will be a multifaceted but unqualified self trained person looking after all the affairs for us from the beginning. As our institution grows we have to deploy qualified persons pertaining to each department and decentralize the work for smooth and effective functioning Here comes the problem in handling the senior multifaceted self trained paramedic. They feel they are being degraded. In one of the institution she resigned the job, took away many important records, started giving too much of problem demanding huge money, joining hands with local press people started threatening the doctor that they will write in press defaming the name and reputation etc. Best way to tackle such staffs would be either to promote them as supervisor (or)give them voluntary retirement with a nice party and good money. So be cautious in handling the paramedics.

Federation of Indian Chambers of Commerce & Industry (FICCI) organized “TANCARE 2014" seventh edition, on 23rd December 2014. at park hyatt hotel, chennai on the theme, “Tamil Nadu Vision -2023" “Health for All” Dr.R.V.S.Surendran State President delivered special addess myself, Dr.C.N.Raja, Dr.Muthurajan, Dr.Anbarasu, Dr.Sridhar, Dr. Shaila V.Rao & Dr. Gayatri participated on behalf of IMA.

Sessons were organized under various heads : Empowering women & Child welfare - Tamil Nadu as model tamilnadu as the hub for technology innovations & Medical devises industry, enhancing medical tourism potential in tamilnadu, ‘Public Private partnership in tamil nadu for advancement in health informatics & tamil nadu as the preferred destination for medical education.

Dr.J.Radhakrishnan IAS secretary to govt. Health & Family welfare, in his keynote address appreciated and lauded the role of IMA in all these arenas, especially with regards to public private partnership (PPP) the cmes organised by IMA enable our members to keep abreast with what’s happening in different parts of the world on various developments in therapeutics and medical technology.

11.Difference of openion / Deviation from normal practice.

A doctor is not expected to follow any particular line of treatment , but bolams test must

be followed. Mere difference of opinion amongst doctors cannot be construed as basis for

negligence.

12. Emergency Situations:

Doctors are given greater protection of law for genuine mistakes , errors , absence of

consent, etc, in emergencies. There is a need for 'Good Samaritan Law', 'Which is present in

other jurisdictions like US , where added statutory protections are provided for those offering

services in emergency situations.

13. Free Service:

This is a defence only in cases under CPA. But it is important to note that institutions

which have both free and paid treatments cannot avail of this defense.

14.No duty of Care:

In a number of situations, the doctor does not have a duty of care and this will operate as

complete defense. [e.g] A casual advise given on telephone does not give rise to duty of care, and

hence no liability.

15.Absence of proof:

A patient should have to prove medical negligence by producing medical records, medical

literature or testimony by medical experts.

16.Causation:

In case there is no link between the alleged negligent conduct of the doctor , and the

resulting injury suffered by the patient or in case the negligent

conduct is not a substantial factor causing injury, both these aspects will

operate as complete defense.

Dear Colleagues,

You must have seen the model case sheet published in the previous issue. You may think that so much elaborated details are not necessary. It is necessary. Why?'Thy shall do no harm' is our ethics. Professionals like us are trained and paid precisely to insure we do the right things. But there is also 'To err is human'! Coming to the aspect of medical accidents, some are inevitable and some might occur through carelessness. To say accidents are inevitable and mistakes will always be made may be true. But it carries our responsibility to give an apology or an explanation to the satisfaction of the person injured and/or to the law. The same is reiterated in Honorable Justice R.C.Lahoti's Judgment –“For a medical accident or failure, the responsibility may lie with the medical practitioner and equally it may not!”So we owe an explanation to the patient.

PPLSSS is trying to give a proper and complete explanation to the satisfaction of the patient and/or the law. It is a must since both lawyers and Courts have acknowledged that they have very minimum knowledge about working and practice of medical science. To give that kind of explanation we need complete case sheet details. In the last 1&3/4th years, I have come across about 200 case sheets. I am sorry to say that to gather evidences for good defense or explanation, we had to struggle through a bundle of case sheet papers. No doubt they are there. Finding them is the problem. If lawyers or Court, who are to give judgments on matters in which they have minimum knowledge, were to pursue the records, I do not think that they will spend so much time in searching for good evidences and may take an easier route. So it is our duty to explain them that we did our duty by listening to the complaints, examined them, investigated them, explained them the disease, explained them about the treatment methods available, treatment proposed by us, its complications and accidents that might occur, taken their informed consent and gave appropriate treatment.

Search for that kind of evidences consumes a long time. In the case sheets pursued, even the complaints are not mentioned in the front page in some cases. Sometimes to know the vital signs, we had to go to nursing notes or other notes! The same is for provisional diagnosis. The model case sheet given, in my opinion, will make it simple to enter the particulars. As all of us know that first impression is the best impression, this case sheet will impress anyone who sees it that we had taken pains to keep a good record. One need not fill all the columns; relevant ones pertaining to the case and specialty may be filled.

We shall discuss the consent portion given at the bottom and other pages in the subsequent issues. Please compare it with some of the case sheets we received.
