NEW DELHI, Nov 25: No one can claim the names of holy books and scriptures like Ramayana or Quran and use them as trademarks for selling goods and services, the Supreme Court has ruled. "There are many holy and reli- gious books like Quran, Bible, Guru Granth Sahib, Ramayan, etc. The answer to the question as to whether any person can claim the name of a holy or religious book as a trademark for goods or serv- ices marketed by him is clearly 'No'," a bench of justices Ranjan Gogoi and R K Agrawal said. It also said that allowing names of gods or holy books to be trademarked could offend "people's sensibilities". The apex court ruling came on an appeal filed by Bihar- based Lal Babu Priyadarshi, who had sought to trademark the word 'Ramayan' to sell incense sticks and perfumes, against the order of the Intellectual Property Appellate Board (IPAB). "The word 'Ramayan' repre- sents the title of a book written by Maharishi Valmiki and is consid- ered a religious book of the Hindus in our country. Thus, using exclusive name of the book 'Ramayan', for getting it registered as a trademark for any commodity cannot be permissible under the (Trade and Merchandise Marks) Act," the apex court observed in its 16-page judgement. The court also objected to pic- tures used by him on the incense stick packets and said "...The pho- tographs of Lord Rama, Sita and Lakshman are also shown on the label, which is a clear indication that he is taking advantage of Gods and Goddesses, which is otherwise not permitted." Priyadarshi had submitted before the court that through exten- sive use, wide advertisement and the excellent quality of the prod- ucts, the trademark 'Ramayan' and the carton in which the products are sold had become distinctive in such a manner that use of a similar trademark by any other person would cause confusion and decep- tion in the trade and amongst the public. He claimed prior use, aver- ring that he was using the Trademark since 1981. The court, however, observed that "if any other word is added as suffix or prefix to the word 'Ramayan' and the alphabets or design or length of the words are same as of the word 'Ramayan', then the word 'Ramayan' may lose its significance as a religious book and it may be considered for reg- istration as a trade mark." The court took note of the Eighth Report on the Trade Marks Bill, 1993, submitted by a Parliamentary Standing Committee, which said any sym- bol relating to gods or places of worship should not ordinarily be registered as a trademark. Priyadarshi had come in appeal against the IPAB's deci- sion in favour of one Amritpal Singh, who had contended that 'Ramayan' cannot be registered as a trademark as the name of a religious book cannot be monopolised by an individual. Priyadarshi had contended that the law does not bar using the name of a religious book as a trademark, and there was no evi- dence on record to show that feel- ings of any section of Hindus have been hurt by doing so. Brushing aside, Priyadarshi's contention, the court said that as per the law, one cannot take advantage of gods and goddess- es to sell products. It also concurred with Singh's arguments that no individual can be given an exclusive right over gods and holy books, especially to make a profit. "First let me state categori- cally that neither I, nor my wife Kiran, have any intention of leaving the country. We never did, and nor would we like to in the future. "Anyone implying the oppo- site has either not seen my inter- view or is deliberately trying to distort what I have said. India is my country, I love it, I feel fortu- nate for being born here, and this is where I am staying," he said. The actor had kicked up a political storm with his remarks at a function in Delhi on Monday about his wife express- ing fear for their child in the current atmosphere. She fears for her child, she fears about what the atmosphere around us will be."(PTI) CVC examines Wal-Mart’s top executives over corruption charges NEW DELHI, Nov 25: Top executives of the US- based world's biggest retailer Wal-Mart have been examined by Central Vigilance Commission (CVC) amid allegations that the company gave bribes to govern- ment officials to get customs clearances and obtain permits to set up stores in India. The company officials have submitted balance sheets of past seven years and sought time to give some more documents required by the anti-corruption watchdog. "We had summoned Wal- Mart's officials. Following which, two of their senior executives including company's India head have been examined. They have sought time till December 15 to submit more documents relevant in the case," Vigilance Commissioner T M Bhasin said here today. The officials were examined recently. It is for the first time that the probity watchdog has started investigations involving a pri- vate company. Bhasin said that both the offi- cials were summoned under the relevant section of the CVC Act which empowers it to summon and enforce the attendance of any per- son from any part of the country and requisition any public record or copy, among others.(PTI)
