What is a Driver’s Motor Vehicle Record?•The State is required under federal driver
licensing rules to maintain driver records on any person with a valid class “A”,”B” or “C” drivers license.
•Federal Law furthermore requires the state in which the driver is operating to maintain a data base which includes all the driver’s personal information, license status and 10-year history of any violations.

Federal & State Requirements• Both State and Federal Regulations require The
Transportation Guy's to obtain and review from the new hire or transfer the driver’s motor vehicle record prior to working or operating in any DOT sensitive function.
• Both State and Federal Regulations also mandate the drivers must provide The Transportation Guy’s a current DMVR printed within 30-days of the actual date of hire or transfer into any DOT defined safety sensitive function.

Definition- Safety Sensitive Function• Safety-sensitive function means all time from the time a driver begins to work or is
required to be in readiness to work until the time he/she is relieved from work and all responsibility for performing work. Safety-sensitive functions shall include:
• (1) All time at an employer or shipper plant, terminal, facility, or other property, or on any public property, waiting to be dispatched, unless the driver has been relieved from duty by the employer;
• (2) All time inspecting equipment as required by §§392.7 and 392.8 of this subchapter or otherwise inspecting, servicing, or conditioning any commercial motor vehicle at any time;
• (3) All time spent at the driving controls of a commercial motor vehicle in operation;• (4) All time, other than driving time, in or upon any commercial motor vehicle
except time spent resting in a sleeper berth (a berth conforming to the requirements of §393.76 of this subchapter);
• (5) All time loading or unloading a vehicle, supervising, or assisting in the loading or unloading, attending a vehicle being loaded or unloaded, remaining in readiness to operate the vehicle, or in giving or receiving receipts for shipments loaded or unloaded; and
• (6) All time repairing, obtaining assistance, or remaining in attendance upon a disabled vehicle.

Employer Requirements• All supervisors involved in the hiring of drivers
must ensure each new hire, rehire or transfer driver provides a current DMVR printed date within 30-days of the date of hire.
• The Transportation Guy's supervisor’s must ensure the applicant provides a 10-year DMVR.
• The Transportation Guy's has adopted policy to state all drivers shall provide a 10-year DMVR. A 3-year DMVR is not acceptable without prior approval.

“Vehicle Classes” Drivers License Class “A”
A Class “A” drivers license is required when a driver operates any vehicle over 26,001 lbs. gross vehicle weight and in a combination is towing any trailer over 10,001 lbs. gross trailer weight.
As a supervisor you need to know which class of vehicles a driver will operate prior to placing them.

Procedures for Reviewing the 2nd Section of the DMVR - License Class “B”
•A Class “B” drivers license is required when a driver operates any vehicle over 26,001 lbs gross vehicle rating or;
•When operating any vehicle over 26,001 gross rated pounds and towing any trailer under 10,000 pounds gross trailer rated.

The 3-year DMVR Section 3 Commercial License Statusa) The Department of Motor Vehicles will list any
other certificates the driver may hold. These are considered secondary certificates that do not impact the license class or endorsements.
b) Example of Certificate:
DMV issues the Agricultural Hazardous MaterialsEndorsement DL-267 to class “C” driver’s who transportagricultural haz mat like diesel tanks fromthe farm to the filed within 100 miles. This is not an endorsement or class its just a certificate.

The 3-year DMVR Section 3 Commercial License Statusa) DMV lists the status of the driver’s
driver license as either• Valid, or• Suspended, or • The space is left blank• If the space is left blank or if there is any
verbiage other than VALID call DMV and verbally check the drivers status.

The 3-year DMVR Section 3 Drivers License Statusb) A driver may have a suspended commercial
license, but have a valid class “C” drivers license to operate his/her car or visa versa
• A driver may have a valid Class “A” license only to operate commercial vehicle during employment purposes, and is only allowed to drive to and from work directly home.
• Again if there is any question mark or if either the commercial license status or the drivers license status indicates anything other than valid call DMV and verbally verify if the driver’s license is valid.

The 3-year DMVR Section 3 Departmental Actionsc) DMV will list any departmental actions
taken against the driver’s license. i.e.,• The date & reason the driver’s license
will be suspended, or• Any failures to appear or failures to pay

The 3-year DMVR Section 5 Failure to Appear
When a driver receives a citation the officer will indicate on the citation the time and date the driver must appear at the designated court.
• If the driver does not take clear up the citation by mail prior to the court date, and/or misses fails to show up for his/her court appearance DMV will issue a “failure to appear”.
• DMV will update the driver’s pull notice to indicate a FTA on the printout. If the driver does not clear up the citation with the courts DMV must may at anytime suspend the driver’s license.

The 3-year DMVR Section 5 Accidents •Any accident over $750.00 damage must
be reported to the DMV on a SR-1 Form. •Also CHP or any other state law
enforcement may provide documentation to DMV of the driver’s accident.

California Accident Reporting Procedures
• Reporting The Accident• When you have an accident, report it to DMV within 10 days if:• More than $750 in damage was done to the property of any person. • Anyone was injured (no matter how slightly) or killed. • Each driver (or the driver’s insurance agent, broker, or legal representative) must make a report to DMV using the
Report of Traffic Accident Occurring in California form (SR 1. The CHP or police will not make this report for you. Call 1-800-777-0133 and ask for the SR 1 or go online at www.dmv.ca.gov.
• You must make this report:• Whether or not you caused the accident and • Even if the accident occurred on private property. • Your driving privilege will be suspended:• If you don’t make this report. • For four years, if you did not have proper insurance coverage. During the last three years of the suspension, your
license can be returned if you provide a California Insurance Proof Certificate (SR 22) and maintain it during this period.
• Accidents On Your Record • Every accident reported to DMV by:• Law enforcement shows on your driving record unless the reporting officer says another person was at fault. • You, or another party in the accident, shows on your record if any one person has over $750 in damage or if anyone is
injured or dies. • It does not matter who caused the accident, DMV must keep this record.

Supervisor’s Must Verifying The DMVR is Valid.1) Verify by checking the State of California DMV seal can be seen
on the DMVR. As long as you can see the seal you do not have to have an original and/or you can make a copy.
2) Check to ensure the printed date on the top of the DMVR is current within 30-days of the actual hire date of the employee. If the DMVR is over 30-days the driver must obtain a new DMVR from DMV.
3) Review the whole page looking for misplacing or letters that are cut off. If you identify any of these potential problems request the driver to provide either the original copy of his or her DMVR or a new DMVR from DMV.
4) Check to ensure the driver’s CDL number & endorsement matches the CDL number and endorsements on the DMVR.

11.Check driver status is it valid or not valid

DMV Point Count Violations Requiring Driver Suspension• Level III (Probation/Suspension)• The driving privilege will be suspended and an Order of
Probation/Suspension will be sent to the driver under the following conditions:
• Point Count Time Period• 4 Within 12 months • 6 Within 24 months • 8 Within 36 months • Under 12810.5 Vehicle Code, the driver is presumed to be a
"prima facie" negligent operator. Prima facie evidence is evidence sufficient to establish a given fact and which, if not rebutted or contradicted, will remain sufficient.
• The action is a one year probation which includes a six month suspension which run concurrently. The action is effective 34 days from the date the order is mailed.

Failure to Appear or Failure to Pay
15. Failures to appear and Failures to Pay.a) Immediately notify the driver if they have
a FTA or FTP and request they take care of it.
b) If you have an applicant with a FTA or FTP, request they take care of it before operating in a safety sensitive function.
c) The majority of the time the driver has cleared the citation with the courts but did not send the court affidavit to DMV.

Failure to Pay or Failure to Appear
c) Courts sometimes do not send the abstract to DMV, instead they assume the driver will submit the abstract to DMV.
d) If the driver assumes the court will take care of the abstract ( the legal document indicating from the courts the citation has been cleared) and they don’t DMV will automatically issue a FTA or FTP.
e) The only way a driver can clear an FTA or FTP is to go to the court that processed the citation, pay for an abstract that indicates the citation was cleared and have the driver personally deliver it to DMV for processing.

Accidents16. DMV will list any accidents reported by law
enforcement agencies, insurance company’s, employer’s or the driver’s evolved in the accident.

Understanding Suspensions DMV mailed on 04-06-98 to the driver that he/she was on driver DMV probation effective 4-6-98 by DMV.
DMV mailed a suspension letter on 4/15/99 to the driver
The effective date of the driver suspension is 4/19/99. If DMV does not list a thru date on for the suspension it is to be understood the suspension is final until further notification by DMV.
Section of the vehicle code that the driver was suspended on
13551- Surrender of license to DMV.
On 4/19/99 DMV terminated the driver suspension with the reason it was set aside.
When you see action terminated (ACT-Term) listed it implies all actions have been terminated by DMV. Go to the status part of the DMV printout and identify if the driver is valid to operate a motor vehicle.
Enrolling Drivers in the DMV’s Commercial Pull Notice Program.•Upon the hiring of a driver, The
Transportation Guy's has thirty (30) days to enroll the new hire driver in the DMV commercial pull notice program.
•The DMV commercial pull notice program is a department within DMV that solely tracks the status of commercial drivers throughout the state of California.
