The rest of the Common Pleas Court packets, before Probate Court wasformed, are missing. It appears the last packet number would have been 544.Let's hope that these missing packets will eventually turn up.

Addition - This should have appeared on page 39, Volume 10, Issue 4, Nov.1991, PASTFINDER: Partial settlement account of John RAKER Ex of David PROUD-gIT, filed 2 Oct 1848, no original Will in packet (75)

Addition - This should have appeared on page 38, Volume 10, Issue 4, Nov.1991, PASTFINDER: Elizabeth STOBER vs Thomas STOBER etal, Spring 1850 term,Action In Chancery, Elizabeth Stober is complainant and Thomas, David, Edward,William, James, & Samuel Stober, John LONSER?, Ann LONSER? are defendants; Ac-tion In Chancery, March 1850 term, David STOBER etal vs James W. SMITH etal,David, Edward, William & Samuel STOBER, John LOUSER?, Ann LOUSER?, John CLARK,Margaret CLARK, John TARR? and Eliza FARR? were complainants and James W SMITH,Elizabeth STOBER & Nicholas PERINE were defendants (35)

It has been my pleasure to have found these "missing" packets, abstractthem, present the abstracts in this newsletter and refile them in the Court-house. For those of you who have not been members since the beginning of thesearticles, Aug 1991, the following information is important to these packets.

During the 1950s the Common Pleas Court microfilmed these Case FilePackets. These were then "thrown out", or at least that is what I have beentold for the last 22 years of research. The microfilm is impossible toread and one had to use the Journals for research. What a shame to have "lost"all those original signatures. As can be seen by these articles, some of thesepackets were found. How? "Snooping" in the basement storeroom of the Court-house, which I do periodically with permission. IT PAYS OFF!! There settingon a lower shelf was a rather large, filth covered box, tied with a rope.Reaching in and pulling out a sheet of paper, getting covered with dirt, youmembers in CA probably heard my cry of joy, were these packets. What a reliefto have found these after twenty-two years of searching. Where did this boxcome from? No one could tell me - probably the GENEALOGY ANGEL. This allhappened shortly after Mary BEEBE, Ruth FOCKLER, Marilyn McPHERSON and myself"rescued" other important papers from the sub-basement (these are still beingsorted). Could Courthouse staff have shuffled boxes at one time and forgot? We will probably never know - but miracles do happen if you stay at this hobbylong enough. Thanks for being a member and don't miss paying your membership -who knows what will be found next. Your Editor, Rita Bone Kopp

To obtain copies of these original packet papers contact Probate Court,Ashland County Courthouse, 2nd Street, Ashland, Ohio, 44805. Their currentcharge is $1.00 per page. Most of these packets only contained one sheet ofpaper, except for those with further information after the ";" Include abusiness size S.A.S.E. for a reply as to the cost of the copies.

SMITH

From THE ASHLAND PRESS newspaper, Thursday, 27 September 1876.Mr. Samuel Smith of Ashland died very suddenly on Friday evening, September

22d, 1876, aged 76 years and 4 months. He was born in New Milford township, Litchfield county, Connecticut, May 23,

1800. At the age of fifteen years he was apprenticed to learn the trade of acarpenter and house joiner, and served six years. At the expiration of his ap-prenticeship he married, and followed his trade for ten years, in his nativeState. In 1832, he removed to Lorain county, Ohio, where he again resumued histrade. While a citizen of Lorain county, he took an active part in military or-ganizations, and was elected captain, and subsequently promoted to Lieut. Col-onel, and finally Colonel of his regiment. In 1837 he located in Milton township,Richland county, now Ashland county. While a citizen of Milton, he served twelveyears as Justice of the Peace, and acquited himself to the satisfaction of hisfriends. Milton was largely Democratic and Col. Smith was an Old Whig. His in-tegrity, and uprightness, elevated him above party bias, rendered him personallypopular, and hence, he was re-elected to the same position twice. In 1860, hedisposed of his farm and removed to Ashland, where in 1863, his excellent ladydeceased, aged 63 years. He again married. Mr. Smith for many years, was anactive and influential member of the Presbyterian church. His family consistedof Orlow, Riley, Charles, Nelson, Augustus, Lemon and three daughters. Orlowserved in the late war and was promoted to Brigadier General. Nelson fell atthe sanquinary battle of Chickamauga. The rest of the family, we believe, allservive.

The funeral services were conducted by Elder N.P. LAWRENCE of the Discipleor Christian church, at the late residence of Col. Smith, South Ashland, at 2o'clock P.M., Sabbath, Sept. 24th, when his remains were conducted to and de-posited in the cemetery of Ashland.

From the same paper, under Ashland County Pioneer Association, "an error occurredin the report of last meeting relative to the marriage of Francis GRAHAM & AmeliaSHEPPARD, which took place on the 13th day of March, 1823, instead of the lSth,as reported".
