What better time to think of improving your fi nancial future than now? Interest rates are trending down and lenders are offering discounts to attract new customers. Re-visiting your mortgage can mean savings which in turn can help improve your overall fi nances. However, it has to be done systematically. If you don’t have the time or the knowledge to undertake the exercise yourself, seek professional help.

First, it is important to ascertain if you have the best loan product to suit your individual needs. You may have had the best product when the loan was originally taken out, but with changing personal circumstances as well as the economic trends, there may be another lender and/or product more suited to your needs now.

Then take a good look at your budget. See if there are any expense areas that you can trim. Every dollar saved and put into the mortgage will make a huge difference in the long run.

If you have been comfortably paying the mortgage at the higher interest rate, continue to do so even when the interest rate is reduced. The extra amount you are paying will reduce the loan term and help save on total interest payable.

Also think of other minor adjustments to the repayment. For instance, if you are paying the mortgage monthly, change it to fortnightly. If your minimum repayment amount is an odd fi gure, for example $1,862 per month; round it up to $1,900 or if you can afford it to $2,000. The additional repayments will cut many years off the loan term.

It’s that time of the year again!With winter around the corner, it may be wise to do a routine maintenance check on your investment propertyWinter is about to arrive on the back of extreme wet weather certainly playing havoc in most areas. Whether it is fl ooding, cyclones, gusty winds or all three, it pays to check that your property can weather the storm, so to speak. Any repairs or damages should be carried out promptly before they become a serious issue or cause danger to your tenants.Remember that you are responsible for:• Ensuring all repairs and maintenance

are carried out in a timely manner;• Cleaning/maintaining gutters and

downpipes;• Ensuring all water pipes are

functioning and there are no leaks or cracks;

• Making sure your property is safe to live in;

• Any overhanging branches are removed;

• Checking fences are well maintained and secure. Check with neighbouring property owners if there is a shared fence or boundary as often the repair/cost is a joint responsibility;

• Checking for cracked pavers or fl oor tiles which could pose a legal issue if a tenant trips and injures themselves; and

• Checking the roof tiles are functioning and fi xing any loose or broken tiles, broken ridge capping or loose fl ashing (rotting or water damaged eaves can lead to salt damage and mould issues).

As an added bonus to protect your asset, it may be worth installing an automatic cut-out facility, which prevents power surges and will prevent damage to electrical items.What’s the best investment – an old or new property?It can be quite a daunting task to try and evaluate what property to buy when building up your investment portfolio. Do you buy new properties or old properties?

Do you buy a unit or a house? Do you buy in an established area or a new development?Of course all of the answers to these questions can only be answered by your personal preferences but there are a couple of important things to remember when entering the property market for investment purposes:• Always buy a property that other

people would want to move into, in an area that they would want to buy or rent. Of course remember how you present your property determines the type of tenant you will attract. Tenants will be attracted to a property that presents value for money, has security, in a good location, is clean, has good sized bedrooms, low maintenance and offers heating or cooling facilities with off road parking.

• Always do your research beforehand. Use statistical information to fi nd high growth areas and look for high rental yields in your price range. Identify the

potential returns on your investment and ensure it covers your loan repayments.

• Try and buy in a suburb that is experiencing a growth spurt rather than buying at the peak of the growth.

• Don’t buy a property that needs a lot of upkeep.

• Your investment should be tax effective and provide you with good depreciation costs.

• If you have more than one property in the same area, it may be prudent to have one property manager making the process easier and more streamlined.

The settlement process for real estate in Victoria is mainly governed by the General Conditions contained in the standard form of contract. Today we will essentially outline what occurs leading up to settlement and what happens after settlement.Preparing for SettlementSettlement is what it is all about, where the Purchaser hands over their hard earned money and the Vendor delivers a good title. Leading up to the settlement is primarily the preparation of the paperwork required to achieve the settlement result. In essence, the following is prepared between the parties:Transfer of Land - This is the transfer document which is prepared by the Purchaser’s Conveyancer and is signed by all parties prior to the settlement. It will be held by the Vendor’s Conveyancer in readiness for settlement.Supporting Documents - Other essential documents depending on the nature of the property transaction are prepared, such as Notice of Acquisitions, Nominations, Goods Statements etc. These documents are prepared well in advance of the settlement and will be used by such government agencies as the State Revenue Offi ce and Land Titles Offi ce to name a few.Statement of Adjustments - This is the fi nancial balance sheet for the transaction which addresses three key areas; adjustment of out goings such as council and water rates, a settlement statement which produces the fi nal settlement amount due to the Vendor and fi nally cheque directions. Settlement is conducted using bank cheques. It is rare to see a settlement occur with cash or EFT, however it is possible if the parties agree beforehand.Actual SettlementThe parties negotiate a time and place for the settlement to occur which in most cases occurs at the Vendor’s bank offi ce as they hold the Certifi cate of Title. Generally there are four parties who attend the settlement, the Vendor and Purchaser’s Conveyancer and their respective lenders (if applicable).Generally the settlement process takes 10 - 15 minutes depending on the complexity

of the transaction. The main function at the settlement is to exchange documents and money. The parties will examine the documents which have previously been prepared enabling the new Purchaser to register their name onto the Title. The Vendor’s Conveyancer will then ensure they are receiving the correct amount of money in exchange for the Certifi cate of Title. Once the parties are satisfi ed the transaction is settled, telephone calls are made to inform the parties.Post SettlementOnce settlement has been completed the Purchaser’s Lender will take the settlement documents to the State Revenue Offi ce to have stamp duty paid. Once the Transfer of Land document is “stamped” it’s off to the Titles Offi ce where the transfer is completed and the Purchaser is recorded on the Titles Offi ce register as the new owner of the property and a new title is produced.SummaryThis is a rather simplistic overview of the settlement process, however it details the essential elements which see how a property is transferred from a Vendor to a Purchaser. The system is far from perfect and there are many possibilities for errors to occur. There are also many areas for improvement on such an out dated method of transferring real estate between parties. Settlement - What Happens?

The REIV has released its State Budget submission for 2012–13, highlighting a need to continue state-based tax reform, assist fi rst home buyers and reduce taxes to promote investment in Victoria.

REIV CEO Enzo Raimondo said that, with stamp duty revenues reducing due to the slowing economy, it was timely to reform the structure and level of property taxes to improve equity, remove double taxation and promote investment.

The current structure of property taxes in Victoria is ineffi cient and discourages the necessary investment in housing and commercial property.

Residential home buyers are subject to bracket creep when prices rise, leading to an increasingly high level of taxation. This not only results in a higher level of stamp duty for every dollar spent on a home but also discourages people relocating.

An anomaly of the tax system is that investors are subject to higher stamp duty at the same time as the community relies on them to provide the majority of rental homes.

Another anomaly is that when a

buyer spends $550,001 rather than $550,000 on a home, they pay an extra $3,100 in duty. There is no sensible reason for that.

The REIV also applauds the focus on assisting all fi rst home buyers through cuts to stamp duty and encourages the government to continue the program, even extending it if Budget constraints permit.

It is also clear that the policy aim of the Bonus – boosting the construction of new homes – has been met, making it unnecessary to provide additional funding for the program at this time.

Equalising assistance for all fi rst home buyers will provide them the choice about where to live, rather than encouraging them only into new homes.

It is also high time for the levying of stamp duty on GST in non-residential transactions to cease. When an offi ce block, warehouse or factory is purchased, the new owner has to pay GST on the purchase itself and then stamp duty not only on the value of the property but the GST component as well.

This anomaly has been in place since the GST was introduced and it is time it was corrected.

Experience tells us that in most instances, your business structure will be some form of compromise. It may even involve multiple entities in an attempt to balance the objectives of asset protection, income tax, fl exibility of income distribution or capital gains tax. You should also be aware that under anti-avoidance provisions of the Income Tax Assessment Act, the Commissioner of Taxation can challenge your business structure where the arrangement was undertaken for the sole or dominant purpose of obtaining a tax benefi t. In such case, the relevant tax benefi t may be cancelled and penalty tax imposed.
