1. About the Mayor’s Telstra Technology Award

1.1 Background

In keeping with the City’s focus on driving innovation and inspiring the ‘have a go spirit’, the City is proud to partner with Telstra to deliver this annual award exclusively to Gold Coast high schools.

With this award, we’re looking for the next big technological idea - it could be a new app, new concepts in social media, gaming technology or robotics. It could be a smarter phone, watch or digital camera. It could even be a revolutionary new idea for transport, health or recreation. The possibilities are endless and that’s what makes this award so exciting.

The main aims of The Mayor's Telstra Technology Award 2015 (the “Award”) are to:

• nurture the knowledge base that exists among the young people of our city

• encourage students to be innovative by:

o encouraging project team work between students

o giving students an opportunity to present their ideas and concepts to a wider community audience

o offering recognition for students efforts and achievements.

• highlight the importance of study in STEAM (Science, Technology, Engineering Maths -STEM + Arts) fields for the future of the Gold Coast – building a knowledge-based economy.

1.2 The role of The City of Gold Coast

The City’s Economic Development Branch’s Workforce Development Framework identifies a focus on increasing skills and jobs in the STEAM sectors, The Mayor's Telstra Technology Award 2015 is delivered by the City of Gold Coast to encourage and support students studying in STEM fields.

1.3 Prizes

i. Prizes for the winning Teams are:

• First Prize – Three HP Pavilion 15-inch Notebooks PCs (one device for each Team member)

• Second Prize – Three HP Stream 8-inch Tablets (one device for each Team member)

• Third Prize – Three HP Roar Bluetooth Speakers (one device for each Team member)

ii. Prizes for the school that the winning Team is from are:

• a suite of Hewlett Packard educational products to the value of $10,000 (RRP)

• an eight-week Startup Apprentice Program delivered by Startup Apprentice.

iii. Prize for the Telstra People’s Choice Award is:

• One Telstra Thanks® private screening at a Gold Class cinema with invited guests.

In conjunction with the Mayor’s Telstra Technology Award 2015, Telstra is proud to be promoting the Telstra People’s Choice Award, which enables the general public to vote via social media on which of the finalist’s idea they like the best. Please refer to Annexure A) for the terms and conditions of this promotion which is being run independently by Telstra in connection with the Mayor’s Telstra Technology Award 2015.

1.4 The Evaluation Panel

The Evaluation Panel who will evaluate Phase 1 entries will include representation from the City of Gold Coast, and major sponsors and partners of the Award:

2. General information

2.1 Competition overview

• The launch of The Mayor’s Telstra Technology Award 2015 took place at Bond University 20 April 2015. To view the Award launch please see http://bit.ly/1OkpZbV.

• Award Competition Entry Packs have been sent to all Gold Coast high schools and are available online at: cityofgoldcoast.qld.gov.au/techaward.

• Each participating school is required to assign a School Coordinator as a central point of contact.

• Entry into The Award is open to students from year 9 to 12 in Teams of three; who attend a Gold Coast high school.

• There is no limit to the amount of teams a school can enter, however any Team must comprise of three students from the one Gold Coast school.

• Phase 1 of the Award commences 27 April 2015 with Teams having 8 weeks to generate their ‘next big technological idea or concept’.

• Competition entries for Phase 1 close 19 June 2015 and are required to be submitted online at: cityofgoldcoast.qld.gov.au/techaward.

• The Evaluation Panel will review all the entries and applying the criteria set out in clause 3.3, shortlist 12 Finalist Teams which will be announced 13 July 2015. These 12 Finalist Teams will be eligible to participate in Phase 2 of the competition. Notification of the 12 Finalist Teams will be emailed to School Coordinators and published on the website at goldcoast.qld.gov.au/techaward.

• During Phase 2, Teams have a further 8 weeks to develop their original technological idea or concept.

• During this phase, Bond University will host four mentoring sessions where students will have the opportunity to be coached and assisted by members of the teaching faculty as well as representatives from Hewlett Packard, Telstra and Startup Apprentice.

• Phase 2 competition entries close 11 September 2015.

• The Evaluation Panel will review the entries (uploaded video up to 3 min in length) and allocate scores (50 per cent of the final score) based on the criteria set out in clause 4.3. Judging for Phase 2 will take place between 14 September – 24 September and the results will not be released until the final presentation ceremony on 14 October.

• At a final presentation ceremony to be held 14 October 2015 at Bond University, the 12 Finalist Teams will present their ideas or concepts in a 5 minute ‘Pitch’ to the Evaluation Panel. Final scores (20 per cent) for this presentation will be allocated in accordance with the criteria set out in clause 5.2 and first, second and third placed winners of the Award will be announced as well as the Telstra People’s Choice Award being announced.

3. Competition - Phase 1 3.1 Requirements

Phase 1 is about student Teams coming up with their ‘next big technological idea or concept’.

Phase 1 Entries open Monday 27 April 2015.

Phase 1 Entries close Friday, 19 June 2015 at 4pm.

Students are required to fill out the online application form found at goldcoast.qld.gov.au/techaward.

Students are required to download and fill out the parental consent form found at goldcoast.qld.gov.au/techaward.

Students are asked to download and fill out the PowerPoint template found at goldcoast.qld.gov.au/techaward.

3.2 How to enter

Teams must complete the PowerPoint template with information about their ‘next big technological idea or concept’ which responds to the following:

• What is the innovative idea or concept?

• What technology will the idea or concept use?

• How does the idea impact the community?

• And can include any photos, graphics, drawing etc. to support the idea.

The PowerPoint template and parental consent form, once completed need to be uploaded with the application form and will need, to be submitted online at goldcoast.qld.gov.au/techaward by 4pm Friday 19 July 2015.

12 Finalist Teams will be announced on Monday 13 July 2015 when all School Coordinators will be informed via email. This information will then be publically available via the website goldcoast.qld.gov.au/techaward.

3.3 Judging Criteria (30% of final score)

Each criteria will be marked individually, this will represent 30% of the teams’ total score;

• Is the entry original, innovative and inventive? 0/20

• The concept uses new technology, or acknowledges that it is inspired by existing technology, using it in a new way 0/20

• Does the entry demonstrate a sound understanding of the technology to be used? 0/20

• Does the entry solve a real problem and have positive benefits to the community? 0/15

• If supporting material such as photos, graphic and drawing are included, do they complement the idea? e.g. graphics, drawing, links, video's 0/10

4. Competition – Phase 2 4.1 Requirements

Phase 2 is about the 12 Finalist Team students developing their original technological idea or concept.

Phase 2 Entries open Monday 13 July 2015.

During Phase 2 of the competition, students will have the opportunity to attend four mentoring and coaching sessions at Bond University. These sessions will be run by members of the teaching faculty and will include technical representatives from Telstra, Hewlett Packard and Startup Apprentice. The purpose of these sessions will be to provide Finalist Teams with specialised guidance on how to further develop their ideas.

During this Phase, students will be invited to display their competition entries at the Science and Tech Fair at Broadwater Parklands on the weekend of 21-22 August 2015.

Phase 2 Entries close Friday 11 September 2015 at 4pm.

The Phase 2 entry demonstrates the following:

• The initial idea or concept submitted in Phase 1 has been developed and/or enhanced.

• Knowledge gained in the mentoring sessions at Bond University during Phase 2 and how that knowledge has been applied. e.g. entrepreneurial skills, teamwork, development of a business model.

• Links to the Phase 1 requirement of impact on the community.

4.2 How to enter

Finalist Teams are required to upload a video submission to YouTube as a private movie, up to 3 minutes in length. The URL is to be submitted via the original application form available at goldcoast.qld.gov.au/techaward by 4pm Friday 11 September 2015.

4.3 Judging Criteria (50% of the final score)

Each criteria will be marked individually, this will represent 50% of the teams total score;

• Does the concept show significant development of the initial entry submitted in Phase 1? 0/20

• Has the team demonstrated learnings from mentoring sessions and incorporated aspects into their idea or concept. 0/20

• Has the team provided/demonstrated entrepreneurial skills including the development of a business model? e.g. marketing channels, customer feedback. 0/20

• The team has demonstrated an understanding of who their potential customers are. 0/20

• Has a prototype been developed? 0/20

5. Competition – Final presentation and the ‘Pitch’ 5.1 Requirements

The final presentation at Bond University on 14 October 2015 is where the Finalist Teams are given the opportunity to make a final ‘pitch’ of their innovative technological idea or concept to the Evaluation Panel.

Each Team will have five minutes in which to make a pitch which includes a viewing of the Team’s video submission and the demonstration of any working prototypes which may have been developed.

Some things to consider:

• This is each Team’s final opportunity to convince the Evaluation Panel that their idea is the best and worthy of further development.

• Presentations must be structured, rehearsed and keep to the five minute time allocation – each presentation will be timed.

• Judges will be given the opportunity to ask questions about the idea or concept (2 mins).

5.2 Judging Criteria (20% of the final score)

Each criteria will be marked individually, this will represent 20% of the teams total score;

• Did the presentation keep to the five minute allocation? 0/5

• Does the pitch tell a story sharing the team’s vision for their concept? 0/20

• Was the team able to communicate their idea and/or concept effectively and confidently to the audience? 0/30

• Did the team demonstrate a good understanding of their audience and the judge’s fields of expertise? 0/10

• Was the team’s final pitch unique and creative, using a variety of mediums e.g. PPT, video, graphics, posters etc. 0/30

• Team member/s answered the judge’s question satisfactorily in a confident and articulate manner. 0/5

7. About the School Coordinator’s role

Each school that enters the Award is required to appoint a School Coordinator. This person will be the contact person for all correspondence relating to their Teams’ participation in the Award and is responsible for the following:

• Publicising the Award in their schools and ensuring students and parents and guardians are given the relevant information concerning the Phases of the Award competition.

• Addressing queries from students and other staff members about the Award

• Ensuring that the students and school are fully aware of the Award competition terms and conditions.

• Ensuring that students have obtained parent or guardian consent for the student to participate in the competition and attend related events.

• Assisting teams to enter correctly and fully, and provide all required information and entry details on online entry form for the Award, thereby ensuring all Teams fulfil all entry submission requirements for Phase 1 of the Award competition.

• Communicating the announcement of Finalist Teams within their schools.

• Coordinating the attendance of each Team at the scheduled mentoring sessions with Bond University during Phase 2 of the Award competition.

• Ensuring all Teams fulfil all entry submission requirements for Phase 2 of the award competition.

• Coordinating the attendance of all Finalist Teams at the final presentation and Award ceremony at Bond University.

• Ensuring all Teams’ entries are the students’ own ideas and that Teams do not submit any content that is unlawful or fraudulent, or which without authorisation, infringes upon any intellectual property, privacy, or other rights of any person or entity.

8. Further terms and conditions This section contains the further terms and conditions of the Award and are in addition to those contained in sections 1 to 7 of this Handbook.

8.1 General

a) This competition is conducted by the Council of the City of Gold Coast of 135 Bundall Road, Bundall Queensland, as promoter (“City of Gold Coast”).

b) By submitting an entry in the Award, each Team, student, respective parent or guardian, School Coordinator and school agrees to be bound by these terms and conditions.

c) The City of Gold Coast, reserves the right to interpret these terms and conditions and, if required, change them at its sole discretion.

d) Any amendments to the terms and conditions will be published on the website at cityofgoldcoast.com.au/techaward and through any other communication method approved by the City of Gold Coast. If these terms and conditions are changed during the competition, each School Coordinator will be formally notified of these changes.

e) The duration of the competition is from 27 April 2015 to 14 October 2015.

8.2 Waivers and releases

a) Teams and students and their respective parents, guardians and schools, consent to the City of Gold Coast, it’s employees or agents and partners/sponsors, photographing and/or filming student participants and using the name, image and/or voice of such participants, in any media for an unlimited period without remuneration to promote the Award or any of the City of Gold Coast’s activities.

b) Teams and students and their respective parents, guardians and schools, acknowledge that all right, title and interest in, or relating to any image taken by or on behalf of the City of Gold Coast belongs to the City of Gold Coast for its own use. Any image taken by a partner or sponsor of the Award is not an image taken on behalf of the City of Gold Coast.

c) Teams and students and their respective parents, guardians and schools, release the City of Gold Coast and the partners and sponsors of the Award from any claim by themselves, or on their behalf, arising out of the use of any photo/film by the City of Gold Coast, and partners and sponsors of the Award.

8.3 Judging and decisions

a) Entries in the Award will be judged by the Evaluation Panel appointed by The City of Gold Coast. Every effort will be made to ensure that Evaluation Panel members are

impartial and suitably qualified. Appointments to the Evaluation Panel will be made at the sole discretion of the City of Gold Coast.

b) The decisions of the Evaluation Panel will be final and no correspondence will be entered into.

c) Judging and decisions made by the Evaluation Panel will be based on the ‘Judging Criteria’ set out above in sections 3.3, 4.3 and 5.2.

d) In the event of a tie for first, second or third place it will be the City of Gold Coast (Mayor Tom Tate) decision. The decision will be final and no correspondence will be entered into.

8.4 Eligibility

a) Teams and students must comply with the following requirements to be eligible for entry into, and continued participation in, the Award:

i. The Award is open to all full-time year 9 to 12 students from all Gold Coast high schools.

ii. Team members must be available to participate in the Award and the associated events and mentoring sessions (listed in the ‘Important Dates’ section) for the period 27 April 2015 to 14 October 2015.

iii. There is no limit to the number of Teams a school can enter into the Award.

iv. Each Team must consist of three (3) students all enrolled at the same school. Mixed gender teams are strongly encouraged.

v. A school Team can comprise of students from different school years. For example, a Team may have two year 11 students and one year 12 student, or any other combination as long as the students are from years 9 to 12 from the same school.

vi. Each Team is only allowed to submit one entry into the Award.

vii. If a Team member has to withdraw from the competition at any point, the Team’s School Coordinator may submit a request in writing to the City of Gold Coast to replace the team member with another student. Such request may be granted at the discretion of the City of Gold Coast.

viii. Each Team is encouraged to appoint a Team leader to coordinate the work and act as spokesperson. However, each member of the team should be able to serve as spokesperson, be fully involved with the project, and be familiar with all aspects of the project. The final work should reflect the coordinated efforts of all team members and will be evaluated during the presentation ceremony.

8.5 Prizes

a) 12 teams selected as Finalists will receive access to an exclusive mentoring and coaching program through Bond University. This program consists of four mentoring sessions scheduled in Phase 2 of the competition which students must attend as part of Phase 2 of the Award.

b) This competition is a game of skill and chance plays no part. Prizes will be awarded at the discretion of the Evaluation Panel according to the ‘Judging Criteria’ set out in sections 3, 4 and 5. The nature and quantity of any prizes will be determined by the City of Gold Coast in conjunction with the Award partner/sponsors and published on the website cityofgoldcoast.com.au/techaward.

c) Any published prize in association with the Award, both for students and schools, must be claimed within one (1) year of the date of the announcement of that prize at the final presentation ceremony. Any prizes not claimed within that timeframe remain the property of the sponsor/partner offering the prize.

d) The time, location and additional information relating to the final presentation ceremony will be published on the website cityofgoldcoast.com.au/techaward and by other means deemed appropriate by the City of Gold Coast.

e) If for any reason any winner does not take a prize by the time stipulated by the City of Gold Coast, then the prize will be forfeited.

f) If any prize is unavailable, the City of Gold Coast, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.

g) Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

h) In the event of unforeseen circumstances or events arising which are beyond the control of the City of Gold coast and which adversely affect the administration of the competition, the City of Gold Coast reserves the right to cancel, terminate, modify or suspend the completion or suspend or modify a prize.

i) All prizes will be delivered directly to the schools of the winnings students within three days of the presentation ceremony on Wednesday, 14 October 2015.

8.6 Intellectual property, confidentiality and liability

a) Teams are required to submit their entries in the manner detailed in sections 3, 4 and 5 of this Handbook.

b) The protection of any information that a Team may require to be kept confidential and/or any intellectual property rights in a Team’s entry is the sole responsibility of each Team.

c) All intellectual property created by each Team remains the property of that Team and students in equal proportions.

d) Each Team agrees to grant the City of Gold Coast a perpetual, irrevocable, non-exclusive, royalty free, world-wide licence to the City of Gold Coast to use, publish, reproduce, modify, adapt, and display, any or all of the Team’s entry including the Team’s responses, pictures, images, videos, drawings and illustrations ("Content") and otherwise exercise all such intellectual property rights in respect of the Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Each Team and each student participant agrees not to assert any moral rights in relation to such use and warrant that they have the full authority to grant

these rights; but only to the extent that such use is not for commercial purposes and is in connection with the Award and/or to promote the City of Gold Coast.

e) Each participating student and each Team agrees that they are fully responsible for the Content they submit. The City of Gold Coast shall not be liable in any way for such Content to the full extent permitted by law. The City of Gold Coast may remove any Content without notice for any reason whatsoever. Each participating student and Team warrants and agrees that: (a) they will not submit any Content that is unlawful or fraudulent, or that the City of Gold Coast may deem in breach of any intellectual property, privacy, publicity or other rights, (b) Content submitted will not be defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children attending Grades 9 to 12 in Australia, or otherwise unsuitable for publication; (c) they will obtain prior consent from any person or the owner(s) of any property that appears in their Content; (d) the Content is their own original work or they have full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein, and the Content does not infringe the rights of any third party; (e) their Content shall not contain viruses or cause injury or harm to any person or entity; and (f) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.

f) If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the City of Gold Coast, including but not limited to technical difficulties, unauthorised intervention or fraud, the City of Gold Coast reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Team; or (b) to modify, suspend, terminate or cancel the competition, as appropriate.

g) Any cost associated with accessing the promotional website or creating and submitting an entry is the Team’s responsibility.

h) All entries and materials submitted to the City of Gold Coast in conjunction with this Award (in any form including hard copy, electronic forms or working prototypes) remain the property of the Team and students in equal proportions.

i) Each Team and student agrees to respect and protect the confidentiality of any information shared between other teams and students participating in the Award.

j) Participation in the Award is voluntary and is at each participant’s own risk.

k) None of the City of Gold Coast or the Award sponsors and partners or any employee or agent of the City of Gold Coast or the Award sponsors and partners will be liable (to the extent permitted by law) to the teams or students or their respective parents, guardians, School Coordinators or schools for:

i. Any injury or death of any person or persons and/or property and/or cost, loss, damage, expense or claim occasioned or incurred (including without limitation

any indirect economic or consequential loss) arising from or in connection with the Award or any person’s participating in it, or the receipt of any prize.

ii. Any taxes, duties, charges or levis to be paid to any person in connection with any any prize a Team or student or school may receive in connection with the Award.

8.7 Information privacy

a) Where students provide personal information to the City of Gold Coast, noting that the participation in the competition is voluntary, the personal information will be used by the City of Gold Coast to administer the competition in accordance with these terms and conditions. All personal information will be stored securely and except as provided for in these terms and conditions, will not be given to any other person or agency unless participants have given the City of Gold Coast permission or the City of Gold Coast is authorised or required by law.

b) The collection, use and disclosure of all personal information will be handled in accordance with the Information Privacy Act 2009 and the City of Gold Coast’s privacy policy which is available at:

9. Annexures 9.1 Annexures A – Terms and Conditions Telstra People’s Choice Award

Terms and Conditions of Entry for the Telstra Gold Coast “Telstra People’s Choice Award” (in conjunction with the Mayor’s Telstra Technology Award) Promotion (“Promotion”)

a) Information on how to enter a vote and prize details for the winning school chosen by the public form part of these terms and conditions. Entry into this Promotion is deemed acceptance of these terms and conditions of entry.

b) This promotion is being run by Telstra Corporation Limited (ABN 33 051 775 556) of 275, George Street, Brisbane QLD 4000 ("we", “us” or “our”).

c) The Promotion will be open from 9am Australian Eastern Standard Time (AEST) on Monday 14th September 2015 and will continue until 1pm ‘AEST’ on Friday 9th October 2015 ("Promotion Period").

d) Entry for voting is open to all Gold Coast residents, other than management, employees or contractors of the Promoter ("Eligible Entrants").

e) To enter and be eligible to vote, Eligible Entrants must:

i. visit the Telstra Gold Coast Facebook page located at https://www.facebook.com/TelstraGoldCoast; (“Website”); and

ii. Like the “Telstra Gold Coast” Facebook page;

iii. Navigate to any of the Telstra People Choice Award posts (in conjunction with the Mayor’s Telstra Technology Award);

iv. Tell us ‘The name of the school and the name of the idea you are voting for” under the Telstra People’s Choice Award post in conjunction with the Mayor’s Telstra Technology Award:

v. Highest number of votes for a top 12 school award entry wins. (“eligible entry”).

f) (Completion of each of the above steps 5(a) to 5(e) is an “Eligible Participation”)

g) Multiple entries per Eligible Entrant will be accepted based on participation. Each entry must be submitted separately and in accordance with the entry requirements.

h) There will be one winning school team decided from Eligible Entries / Votes received during the Promotion Period and will take place on the Monday 12th October 2015. The calculation of entries / votes will take place at 275 George Street, Brisbane 4000. The judging will be conducted by a representative of the Promoter. This is a game of skill only. There is no element of chance in determining the winners.

i) The winning school team will be announced at the final presentation for the Mayor’s Telstra Technology Award on Wednesday 14th October by Area General Manager Darren Clark or Business Development Specialist Danielle Norton-Smith and will be confirmed via a post on Facebook on Thursday 15th October 2015.

j) In the event that the Prize has not been claimed and used by 5pm AEST on Monday 21st December 2015, it will be either cancelled or re-distributed at the Promoter’s

absolute discretion. The cinema screening needs to be co-ordinated with Telstra Gold Coast representative Danielle Norton-Smith once the prize has been awarded to the winning school team.

k) The Promoter’s decision (including any decisions as to prize distribution) is final and will not enter into correspondence regarding the result.

General

l) The prize of a Gold Class Cinema Screening is valued at approximately $1600 depending on the cinema size and location. The total Prize is valued at $1600 (including GST). The prize includes a Gold Class Cinema Screening only. Food and drink is not included.

m) The Prizes are not transferable or exchangeable and are not redeemable for cash.

n) The prize winners may be required to sign a release and indemnity form in favour of the Promoter and return that document to the promoter prior to receiving the Prize.

o) This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. Entrants are providing their information to the Promoter and not to Facebook. The information provided will only used for this Promotion. Any questions, comments or complaints regarding this Promotion should be directed to the Promoter and not to Facebook. The Promoter releases Facebook from each Entrant in to the Promotion.

p) The Promoter shall not be liable for any prize that may be lost, stolen, forged, damaged or tampered with in any way after it leaves the Promoter.

q) The Promoter accepts no responsibility for any variation in the value of a Prize.

r) If the Promoter is unable to provide a finalist or winner with the nominated Prize, the Promoter reserves the right to supply an alternative prize of equal or greater monetary value, subject to written directions by the relevant State and Territory gaming departments

s) If a winner chooses not to take their Prize (or is unable to), they forfeit the prize and the Promoter is not obliged to substitute the Prize.

t) The Promoter excludes all warranties in relation to supply of the Prize, except those that cannot be excluded by law. To the fullest extent permitted by law, any liability of the Promoter or its employees or agents for breach of any rights a consumer may have which are unable to be excluded under Australian law, is limited to the payment of the costs of having the Prize supplied again.

u) The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. Entries will be deemed to be accepted at the time of receipt by the Promoter

v) The judges’ decision is final and binding and no correspondence will be entered into. Incomplete, illegible and incorrect entries or entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win.

w) If, for any reason, the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to take any action that may be available, subject to State and Territory regulations.

x) Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process, will be ineligible to win.

y) The Promoter reserves the right to disqualify entries in the event of non-compliance with these terms and conditions of entry. In the event there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each entrant and no correspondence will be entered into.

z) By entering the Promotion, the entrant understands and agrees that the Promoter may use and disclose the information provided by the entrant for the purposes of conducting this promotion and on the terms and for the purposes (including marketing) set out in the Promoter’s Privacy Statement availableatwww.telstra.com.au/privacy/privacy_statement.html or by calling 1800 039 059, as if they were a customer of the Promoter. The entrant agrees that the Promoter can continue to contact them even after this Promotion ends. If the entrant would like to access or correct the personal information that the Promoter holds about the entrant, or if the entrant does not wish the information to be disclosed, the entrant should advise the Promoter by phoning 1800 039 059.

aa) By entering into the Promotion, the entrant agrees and acknowledges that:

i. they may be contacted by the Promoter to provide comments about the competition and the Promoter (or an agent of the Promoter) may take photos of them;

ii. the Promoter may use such comments or photos (the "Materials") for the Promoter's future promotional and marketing purposes without further reference or compensation to them;

iii. the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at anytime, anywhere, and by any means. The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;

iv. they grant to the Promoter on creation of the Materials a royalty free, perpetual, exclusive and irrevocable licence to use the Materials for whatever purpose;

v. they unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given ("Moral Rights");

vi. they waive all Moral Rights in the Materials that arise outside Australia; and

vii. they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials.

bb) To the extent permitted by law, the Promoter shall not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) or personal injury suffered or sustained in connection with this Promotion.

cc) The Promoter accepts no responsibility for any tax liabilities that may arise from winning the Prize.
