    The first Miss Fountain ValleyScholarship Pageant in over20 years is set to be held on

    March 10, 2012.The Pageant committee, supported

    by the city and the ChamberCommerce and many of FountainValleys business leaders and resi-dents will host this event that will beheld at the Saigon Performing ArtsCenter at 6pm on March 10th.

    There are 11 intelligent, talentedand beautiful young women vyingfor the title of Miss FV. The

    committee has raised Scholarshipfunding to be awarded the eveningof the pageant in excess of $14,000under the leadership of Keeli ScottLisack, Executive Director of thePageant, who herself was Miss FVin 1977 and director of the last

    pageant held in 1991. I felt it wasimportant to the city, its residentsand the business and communityleaders to sponsor a pageant thatthey could all be proud of, and onein which the outstanding youngwomen of FV could compete formeaningful educational scholarships,

    as well as many other prizes andawards. We have a wonderful groupof ladies that are working hard to

    produce an exciting, fun andinspirational program.

    The pageant is affili-ated with the MissAmerica Or-g a n i z a t i o nwho awardsmore educa-tional scholar-ships to youngwomen than

    any other or-ganization inthe US. MissAmerica haschosen theC h i l d r e n sMiracle Net-work as theircharity ofchoice, and each contestant will do-nate toward this charity as part oftheir participation in the Pageant.

    The community has really cometogether and embraced the resurrec-tion of the pageant. We are so ex-

    cited that so many of the local businesses and organizations arehelping to sponsor this historic

    More than700 people, in-cluding 36thDistrict of California Congress-woman Janice Hahn, and Los Ange-les Fourth District Council MemberTom LaBonge, ra n into the 57 de-gree water at Cabrillo Beach in SanPedro to celebrate the New Year.Hundreds of spectators cheered andwaved at the annual event sponsored

    by The Cabrillo Beach Polar BearClub, which just celebrated its 60th

    Anniversary. The clubmeets daily and runs intothe ocean for an invigorat-ing swim.

    At the annual event, thenew King & Queen,Domino and Miriam Santrofrom San Pedro, werecrowned and will serve asambassadors throughoutthe year. On hand to offici-

    ate was CabrilloBeach Polar BearsPresident Kim M.White and represen-tatives from CabrilloMarine Aquariumwho led the crowd in

    a "Grunion Dance" before enteringthe water. The yearly event draws

    people young to old from around theworld. There was a 94 year oldwoman who ran into the water and aman from Germany who partici-

    Six internationalfriends gathered

    and ran The SurfCity USA HalfMarathon on SuperBowl Sundayromping and roar-ing over Hunting-ton Beaches' streets and Pacific CoastHighway. Clare Shweyk, a native ofEngland and a HB librarian, organ-ized her running squad by calling hersister, Mary Maguire, a high schoolteacher in Ireland; fellow Englishtransplant to HB, Brigitte Connelly, anurse, and three of their pals from Al-

    berta, Calgary, Canada, Pam El-derkin, Dawn Craig and LynneGleave. The companions all made a

    pact to participate in the interest offitness and friendship. They were partof 17,000 half-marathoners and 3,000marathoners who enjoyed beautiful

    blue skies, cheering spectators andeach others' company as racerslooked like massive, endless humanwaves washing along streets by the

    beach.

    Clare and her comrades could beheard encouraging each other as they

    passed a man running with a water-melon on his head and a woman par-

    ticipating, whilehula hooping.

    They accom-plished their goal by finishing at agood pace, thentreated themselvesto a massage.

    Clare, a former marathon runner, isknown in Huntington Beach for herformer popular televised Children'sShow at the Central Library. Her like-able British accent is still heard atHope View Elementary School,where she's librarian. Although I'msure she inspired many students, whosaw her running, Clare is making alifelong impact not only on the valueof fitness but by teaching them theimportance of reading. Books are fullof facts, contain lots of wisdom, areentertaining and fun to read. As myfriend Rueben Martinez of LibreriaMartinez of Santa Ana says, "Don'tread a book once, read it twice. You'll

    be glad you did!" Congrads to Clare,her friends and everyone else whohad anything to do with putting on,

    participating in or watching theamazing event. Every year, it really

    puts HB on the map, nationally andinternationally.

    Before you file your 2011federal income tax return in2012, you should be aware

    of a few important tax changes thattook effect in 2011. Checkwww.IRS.gov before you file forupdates on any new legislation thatmay affect your tax return.

    Due date of return. File yourfederal tax return by April 17, 2012.The due date is April 17, instead ofApril 15, because April 15 is aSunday and April 16is the EmancipationDay holiday in theDistrict of Columbia. New forms. In most

    cases, you must reportyour capital gains andlosses on the new Form8949, Sales and OtherDispositions of Capital

    Assets. Then, you reportcertain totals from that formon Schedule D (Form 1040).If you had foreign financialassets in 2011, you may haveto file the new Form 8938,Statement of Foreign FinancialAssets, with your return.

    Standard mileage rates. The2011 rates for mileage aredifferent for January 1 throughJune 30 than for July 1 throughDecember 31. For businessuse of your car, you can deduct51 cents a mile for miles driventhe first half of the year and55 cents for the second half.Medical and moving mileageare both 19 cents per mile for theearly half of the year and 23 cents in the latter half.

    for some taxpayers who do notitemize deductions on IRS ScheduleA (Form 1040). The amountdepends on your filing status.

    The amount you can deduct for

    each exemption has increased $50to $3,700 for 2011.

    Self-employed health insurancededuction. This deduction is nolonger allowed on Schedule SE(Form 1040), but you can still takeit on Form 1040, line 29.

    Alternative minimum tax (AMT)exemption amount increased. TheAMT exemption amount hasincreased to $48,450 ($74,450if married filing jointly or aqualifying widow(er); $37,225 ifmarried filing separately).

    Health savings accounts(HSAs) and Archer MSAs. Theadditional tax on distributionsfrom HSAs

    and ArcherMSAs not used for qualifiedmedical expenses increased to 20

    percent. Beginning in 2011, only prescribed drugs or insulin arequalified medical expenses.

    Roth IRAs. If you converted orrolled over an amount from atraditional IRA to a Roth IRA ordesignated Roth in 2010 and didnot elect to report the taxableamount on your 2010 return, yougenerally must report half of it onyour 2011 return and the rest onyour 2012 return.

    Alternative motor vehicle credit.

    You can claim the alternative motorvehicle credit for a 2011 purchaseonly if the vehicle is a new fuel cellmotor vehicle.

    First-time homebuyer credit. Thecredit expired for most taxpayers for2011. Some military personnel and

    members ofthe intelligence community can stillclaim the credit in 2011 for qualified

    purchases.Health coverage tax credit. Recent

    legislation changed the amount ofthis credit, which pays qualifiedhealth insurance premiums foreligible individuals and their fami-lies. Participants who received the65 percent tax credit in any monthfrom March to December 2011 mayclaim an additional 7.5 percentretroactive credit when they filetheir 2011 tax return.

    Mailing a return. The IRSchanged the filing location forseveral areas. If you're mailing a

    paper return, see the Form 1040instructions for the correct address.

    Huntington BeachFire Department 2011

    Recorded IncidentsIn 2011, the Huntington Beach

    Fire Department continued toexperience an increase in thenumber of emergency incidents.The Fire Department responded tonearly 16,000 emergency calls in2011, which represented an almost3 percent increase over 2010,and nearly 7 percent increase overthe past two years.

    Whoever said you cant teach an old dognew tricks, wasnt referring to the federalgovernment.

    Last week federal prosecutors announcedthey were abandoning their almosttwo-year investigation of seven-time Tourde France winner Lance Armstrong ondoping-related charges. The brief,three-sentence press release issued by U.S.Attorney Andre Birotte, Jr. gave no reasonfor the decision, but there was no need tostate the obvious. Despite the testimony of

    a number of first-hand witnesses whoclaimed to have observed Armstrongdoping, there was no realistic hope of everobtaining a conviction against a man whois idolized by so many Americans.

    As a cancer survivor who has raised tens-of-millions of dollars to combat the disease,Armstrong is an inspiration to countlesspeople in this country and around the globe.By some estimates, cancer will affect oneof every three men and one of every twowomen, leaving no family unscathed.

    In an effort to bury the embarrassingnews of their failed investigation, thegovernment chose the Friday before theSuper Bowl, the biggest sporting event ofthe year and the focus of virtually all mediaattention, to announce its decision.

    The good news is the governmentsdecision will save taxpayers untold millionsthat hopefully will be put to better use

    fighting real crimeor feeding thehungry. But whythe governmentspent millionsgoing down thisroad in the first place shouldi tse l f be thef o c u s o f a ninvestigation. Thatdoesnt mean Arm-strong didnt dope, ashe has always maintained.The government dismissalisnt so much amatter of proof asit is of conviction.

    N u m e r o u scommentators have compared Armstrongscase with those of Barry Bonds and RogerClemens. While there are a number ofsimilarities between the cases, includingthe fact they all involve high-profileathletes, there are also a number ofdifferences. Bonds was subpoenaed totestify before a grand jury about hisknowledge of the BALCO drug case. Theslugger was told he would not be chargedwith a crime if he testified truthfully aboutwhat he knew and what h e did. It was onlyafter the government was convinced that Bondshad lied that he was charged with perjury.

    The feds also added a charge for obstructionbased on a rambling, 60-second responseBonds gave to one question during his fourhours of testimony before the grand jury.That count resulted in the only conviction,which Bonds has appealed.

    Clemens was alsocharged with perjury,not before a grand jury, but beforeCongress. His firsttrial resulted ina mistrial based on

    p r os e c u t o r i a lincompetence. Asecond trial is

    scheduled for April.Unlike Bonds and

    Clemens, Armstrongwas never subpoenaed

    before a grand juryor Congress.While prosecutorshave never said

    why, they donthave to. Given Armstrongs stature, it isunlikely any grand jury would haveindicted him after hearing him testify.While his ego may be as big as that of thetwo baseball players, unlike Bonds andClemens, Armstrong knows how to hold itin check. He can be gregarious, gracious,unassuming and self-depre-cating. And his good deeds,unlike those of Bonds andClemens, are a matter ofpublic record.

    Another difference betweenthe cases is the Armstronginvestigation wasnt about perjury, but centered onallegations of conspiracy,fraud and racketeering basedon doping by his team whilethey accepted government

    sponsorship funds through the U.S. PostalService. Ironically, the USPS maintains itis an independent agency and their annualmulti-billion dollar losses, including $5 billion last year, have no affect on U.S.taxpayers because the agency doesntreceive federal funds. If thats true, howcould Armstrong have been indictedon federal charges?

    The government elected to charge Bondsand Clemens with perjury, rather than theillegal use of a controlled substance. Ifathletes use drugs in violation of federallaw, let the government pursue them forthose activities, rather than on perjurycharges. Does it strike anyone else as ironicthat government bureaucrats and electedofficials can lie to the American people

    with impunity but citizens are prohibitedfrom lying to government officials?

    Whether Armstrong is guilty or not,all taxpayers should rejoice in the fedsdecision to abandon the investigation. Atleast the government learned from theBonds and Clemens cases, and thats amessage we should all heed.

    A diabetes support group will meet on the first Thursday of each

    month from 8:45am to 10:15am to teach various methods of diabetes

    management at The Center at Founders Village. Nurse Jane

    Hannah-Herin, a public health nurse for Orange County Health Care

    Agency, will lead this free discussion.

    Diabetes affects almost 26 million people in America with 79 million at

    risk for developing the disease; this discussion, for Seniors 55 and older,

    will teach helpful coping strategies, and problem-solving skills to manage

    living with diabetes. Different topics will be addressed each month.

    The Senate Rules Committeeapproved some committee

    m em bersh i p shuff l i ngyesterday, including some changes

    made at the request of the newSenate GOP leader Bob Huff.

    One of the biggest changes wasto the Senate Health Committee,

    where Sen. Tom Harman,

    R-Huntington Beach, replaces Sen.Tony Strickland, R-Moorpark,

    as vice-chair.

    Strickland and Sen. Mimi

    Walters, R-Laguna Niguel, alsoswapped their respective posts on

    the Senate Governmental Organiza-tion and Senate Budget and Fiscal

    Review Committees.

    Several GOP members picked upnew committee assignments to

    fill seats vacated by Huff, whosespokesman said he needed to

    free up time to focus on hisresponsibilities as leader.

    While committee changes underthe dome are often

    sparked by politicalconsiderations, a Huffspokesman said these

    shifts were made tomove the leader off the

    committees and honorsome requests made bymembers.

    According to amateur video and a report from Fox 5Vegas, a man suffered from a heart attack whiledining at Heart Attack Grill in Las Vegas. He was

    eating a Triple Bypass burger at the time of his cardiac arrest.The unnamed man is reportedly alive and recuperating.

    The restaurant's now sadly predictive name was coupledwith the even more unfortunate slogan, "Taste Worth DyingFor." The incident comes just of one year after the death ofthe Heart Attack Grill's 575-pound, 29-year-old spokesman.

    The Vegas owner of Heart Attack Grill, "Doctor" Jon Basso-- who is not actually a doctor -- first thought the man's

    cardiac arrest was a joke, but soon phoned 911. Basso toldFox 5, "I actually felt horrible for the gentleman becausethe tourists were taking photos of him as if it were some

    type of stunt. Even with our own morbid sense of humor, wewould never pull a stunt like that," he said.

    How andwhen didit become

    so popular to ragon the rich? Arethey really the in-carnation of all evilas their uber-envious detractorsclaim? Are theyRobin Hood inreverse?

    Daily we readabout Mitt Romney paying only 15percent in incometaxes. It is said that

    Warren Buffet's secretary pays a higher income taxthan her billionaire boss. We are told that the 1

    percent richest Americans got there and stay there onthe backs of the rest of us, the 99 percent reportedlystruggling to make distant ends meet.

    Here in the Coachella Valley, very vocal andfrequently unruly protesters rally against the infamousKoch brothers and their invitation-only meetings.

    Charles and Dave Koch have been meeting withlike-minded 1 percenters here for nine years andraised in the $100 million range for their conservative

    causes, much to the consternation of highlyindignant local liberals.

    Professional athletes, paid in the tens and hundredsof millions, are also frequent targets of the rallyagainst the rich crowd. They claim that teachers aremore important than point guards and are usually

    better role models.I may be looking at this wealth business in a

    convoluted way, but I see nothing wrong in a free en-terprise system, with Mitt Romney and Warren Buffetmaking mega millions, with the Koch boys givingmillions to the candidates of their choice or with KobeBryant making more than all four combined.

    Romney rebuilt a collapsed Bain Capital into oneof the nation's most successful private equityinvestment firms and is reported to have a net worthof between $190 million and $250 million. Therecently touted implication that Romney pays onlyabout 15 percent in income taxes is perfectly under-standable. He contributes heavily to his church and

    probably realizes most of his income from capitalgains and dividends, taxed at 15 percent.

    Buffet likes to claim that he pays a lower tax ratethan his secretary does. He conveniently overlooks afew inconvenient facts. If he makes $3 million a year

    on his capital gains and dividends, at the 15 percentrate he's paying a whopping $450,000 in federalincome taxes. Assuming that his Omaha secretary is

    well paid at $80,000, she pays 25 percent or $20,000.The lower tax rate is just w ord play.

    As far as Bryant is concerned, he may be the bestbasketball player on the planet. His net worth wasestimated to be between $150 million and $350million. Even with the $75 million awarded to hisformer wife, he's still not missing any meals.

    Many claim that Bryant and his fellow superstarathletes are overcompensated. In my view, basketball,like any other professional sport, is a business.Bryant's compensation is directly related to howmany seats are filled at the Staples Center and howmany pairs of his Nike brand shoes go through thescanners. We are the reason he is a m ultimillionaire.

    In an attempt to crystallize this reportedly unfairtax and income situation, let us look at who's

    paying what.It is those reviled top 1 percent of all w age-earners,

    those making over $343,927 a year, who pay astaggering 36.73 percent of all federal income taxes.

    Those in the top 10 percent, earning more than$112,124, pay 70.47 percent of all federal taxes.

    Conversely, those marching in the street against thenasty fat cat 1 percent, if they make $32,396 per yearor less, pay only 2.25 percent of all taxes or $728.

    For many American homeowners, one of thehighlights of Obamas State of the Union addressinvolved a new plan to bring refinancing optionsto struggling homeowners. This new plan would helpeven the most upside-down homeowners takeadvantage of todays record low mortgage r ates.

    Recognizing that many American homeowners arestill unable to refinance because they lack sufficientequity to qualify for conventional loans, the Obamaadministration has implemented prior programs toaccomplish this same task. The most popular ofthese programs has been the Home AffordableRefinance Program (HARP). Although HARPhas been popularly discussed, its effectiveness has

    been extremely limited.

    The first limitation is that HARP would onlyallow refinancing for individuals who owed up to125% of their propertys value. Any homeownerwho was even more upside down on their homethan this limit was simply not able to refinanceeven if they wanted to. The 125% ceiling wasrecently removed as part of the revised HARP 2.0announced in December.

    A bigger limitation of HARP is that it is onlyavailable for homeowners whose mortgage is cur-rently backed by the Government SponsoredEnterprises (GSE) of Fannie Mae or Freddie Mac.Its estimated that only 5% of American homeownershave a mortgage that is eligible to take advantage ofHARP. The remaining 95% of mortgages are noteligible, primarily because they are backed by a

    private investor other than Fannie and F reddie. Buteven many mortgages that do currently carry the

    backing of these GSEs are still not eligible, primarilybecause they were not delivered to Fannie or Freddieprior to March of 2009. By default, any mortgagethat was originated after this date is ineligible.

    Perhaps the biggest limitation of HARP and HARP

    2.0 is that the government has absolutely zerocontrol in making the banks implement and offerthese programs. Essentially, participation in theserelief programs is optional for banks. Evensome of the banks that do participate make the

    process extremely lengthy and difficult, oftendragging out over months.

    Obamas new plan is purported to solve manyof these issues. Very few details of the program have

    been announced to date and what we know is, todate, very limited. Qualifying will require aminimum 580 credit score, the homeowner musthave been current on all mortgage payments over the

    prior 6 months, and the homeowner must becurrently employed and able to document sufficientincome to support the new mortgage payments. The

    program claims to not require equity in the propertyand will be available to all homeowners regardlessof who backs their mortgage currently. The idea isto make refinancing options available to just aboutevery homeowner in America.

    As details become available, there are two mainquestions that remain to be answered. First, will the

    program have loan level price adjustments? BothHARP and HARP 2.0 have this. Under these current

    programs, the best rates are available to

    homeowners whosemortgage is below 95%of their propertys value.Once that 95% thresholdis breached, the home-owner begins to see a ticup in their rate. Themore upside-down theyare, the more their final

    rate will be affected.One can only assume that this new program willinclude similar loan level price adjustments.

    But perhaps the biggest question that everyonewill be watching for is how to make sure the

    banks implement these new programs. Oneparticular problem of HARP was that many ofthe banks that offered the program did not

    participate all the way up to the 125% limit.Some banks stopped at 105%, and yet others only

    participated up to 95%. Given that this newprogram is claiming no equity restrictions, ob-taining bank participation will be the largest

    challenge for this new program.

    Despite the headwinds that this program faces,there are many desperate homeowners who havealready gained something from the mere mentionof this new program. It has brought them hope.Hope that they might finally be able to get out fromunder a high mortgage rate.
