En la Gaceta Oficial N 39.798 de fecha 11 de

noviembre de 2011, fue publicada la Resolucin N 11-11-02 emanada del Banco Central de Venezuela(BCV), en el cual se dictan las Normas Generales delSistema de Transacciones con Ttulos en MonedaExtranjera (SITME).

La Resolucin establece que el BCV determinar atravs de manuales, instructivos o circulares, el montomnimo por postura de compra o venta de ttulosvalores denominados en divisas, a ser canalizadas atravs del SITME

Asimismo, se dispone la obligatoriedad de que todapersona natural o jurdica interesada en realizarposturas con Ttulos en Moneda Extranjera a travs deSITME, sea en condicin de demandante u oferente,deba estar previamente inscrita en el Registro deUsuarios del Sistema de Transacciones con Ttulos enMoneda Extranjera (RUSITME).

Tales operaciones de compra y venta de TtulosValores en el SITME slo podrn ser realizadas atravs de las Instituciones Autorizadas por el BCV, asaber: (i) los bancos universales, (ii) los bancoscomerciales, (iii) entidades de ahorro y prstamo en

proceso de reestructuracin conforme a lo previsto enla Ley de Instituciones del Sector Bancario,autorizados, y (iv) cualquier otro ente o sujeto que elDirectorio de BCV que autorice a tal efecto.

Establece la norma, a cargo de las InstitucionesAutorizadas el deber de tramitar todas las solicitudesde canalizacin de operaciones a travs del SITME, einformar a sus clientes sobre el resultado de sussolicitudes o el estado de compra o venta de dichosTtulos Valores en Moneda Extranjera canalizadas atravs del SITME, los cuales debern ser ofrecidos enventa inmediatamente en los mercadosinternacionales por parte de sus tenedores.

Resolution N11-11-02, issued by the Central Bank of

Venezuela (BCV), was published in Official GazetteN39,798 of November 11, 2011, establishing theGeneral Rules for the System for Transactions withForeign Currency Securities (SITME).

The Resolution establishes that BCV shall determine,by means of manuals, instructions or bulletins, theminimum amount for bids for purchase or sale ofsecurities denominated in foreign currency, to becanalized through SITME

It also establishes that individuals and corporationsinterested in bidding with foreign currency securitiesthrough SITME, either as the requesting or offeringparty, are required to register with the Registry of Usersof the System for Transactions with Foreign CurrencySecurities (RUSITME).

Such securities purchase and sale transactions withSITME shall be conducted only through the InstitutionsAuthorized by BCV, namely: (i) universal banks, (ii)commercial banks, (iii) savings and loan entities inrestructuring process, in conformity with the matters setforth in the Law of Banking Sector Institutions,authorized, and (iv) any other entity or subject

authorized by the Board of Directors of BCV for suchpurpose.

The rule provides that Authorized Institutions shall beresponsible for canalizing all requests through SITME,and for informing customers as to the status of theirrequests or of the purchase and sale of such ForeignCurrency Securities canalized through SITME, whichshall be offered for sale immediately at the internationalmarket by their holders.

Las instituciones Autorizadas , as como las personas

naturales y jurdicas cuyas ofertas de compra hayanresultado favorecidas, debern mantener a disposicindel BCV la documentacin que soporta talesoperaciones por al menos 2 aos.

Igualmente, la mencionada Resolucin dispone queadems de las sanciones de Ley, el incumplimiento delo establecido en la norma, dar lugar a la suspensintemporal o definitiva en el caso de las InstitucionesAutorizadas y en el caso de las personas naturales ojurdicas, su exclusin del RUSITME.

Cabe acotar, que esta Resolucin sustituye a losLineamientos para realizar operaciones de compra de

Ttulos Valores denominados en Moneda Extranjera enel SITME de fecha 14 de junio de 2010. No obstante

las operaciones ordenadas a la fecha de entrada envigencia de la presente la Resolucin comentada,conforme a lo previsto a los mencionadosLineamientos, continuarn su curso de acuerdo con loestablecido en los mismos.

La Resolucin comentada entrar en vigencia a partirdel 1 de enero de 2012, ello sin perjuicio de que lainformacin para la inscripcin en el RUSITME, pueda

estar disponible a partir de la tercera semana del mesde noviembre de 2011.

The Authorized Institutions, as well as the individuals

and corporations with purchase offers awarded, shallhave the documentation supporting such transactionsavailable to BCV for at least 2 years.

In addition to the penalties in the Law, the Resolutionestablishes that incompliance with the standards shallresult in temporary or final suspension for AuthorizedInstitutions, and in the exclusion from RUSITME forindividuals and corporations.

This Resolution supersedes the Guidelines for

purchase transactions of foreign currency securitieswith SITME of June 14, 2010. However, transactionsin course at the effective date of the presentResolution, in conformity with those Guidelines, shallcontinue in force according to the matters set forththerein.

The Resolution is effective from January 1, 2012;however, the information for the registration withRUSITME may be available from the third week ofNovember 2011.
