ACTION REQUESTED: Approve the final TAP project list as recommended by the Bicycle & Pedestrian Work Group. TCC RECOMMENDATION: At its February 2016 meeting, the Technical Coordinating Committee unanimously recommended that the MPO adopt the TAP project list.

BACKGROUND: • The Bicycle & Pedestrian Work Group (BPWG) used the MPO-approved TAP methodology

to score and rank projects submitted to the MPO for TAP funding. • 16 projects were submitted for consideration and four were ultimately recommended by the

BPWG for this cycle of TAP funding. • This project list must be approved by the MPO so that the TAP funds can ultimately be

programmed into the Transportation Improvement Program. ATTACHMENT: Project list.

7. Miscellaneous 2016-2025 TIP Amendments Neil Burke ACTION REQUESTED: Approve amendments to the 2016-2025 Transportation Improvement Program.

TCC RECOMMENDATION: At its March 2016 meeting, the Technical Coordinating Committee

8. FY 2017 Unified Planning Work Program Robert Cook ACTION REQUESTED: Approve the FY 2017 Unified Planning Work Program. TCC RECOMMENDATION: At its March 2016 meeting, the Technical Coordinating Committee unanimously recommended that the MPO approve the FY 2017 UPWP. BACKGROUND: See the attached memorandum for details.

9. MPO Self-Certification Robert Cook ACTION REQUESTED: Adopt the attached resolution certifying the CRTPO’s compliance with all federal transportation planning laws, statutes, etc. during FY 2016. TCC RECOMMENDATION: At its March 2016 meeting, the Technical Coordinating Committee unanimously recommended that the MPO adopt the self-certification resolution. BACKGROUND: See the attached memorandum for details.

10. Prioritization 4.0 Neil Burke

ACTION REQUESTED: Endorse the P4.0 local input points methodology. TCC RECOMMENDATION: At its March 2016 meeting, the Technical Coordinating Committee unanimously recommended that the MPO endorse the P4.0 local input points methodology. BACKGROUND: • The TCC’s P4.0 Subcommittee has recommended that the methodology used during the P3.0

local input points process be endorsed for use during P4.0 due to its success in allocating points to a sizable number of projects that ultimately were funded in the 2016-2025 TIP.

• Minor revisions have been proposed to the methodology to ensure that the information is current.

• A methodology must be adopted and submitted to the SPOT office prior to April 1, 2016. ATTACHMENT: Click here to view the local input points methodology.

11. Bonus Allocation Reprogramming Recommendation Bill Coxe ACTION REQUESTED: Approve the reprogramming of Bonus Allocation funds based upon a proposal developed by the Project Oversight Committee.

TCC RECOMMENDATION: At its March 2016 meeting, the Technical Coordinating Committee

unanimously recommended that the MPO approve the proposed reprogramming. BACKGROUND: • The US 21 widening project (U-5767) in Cornelius was initially approved for Bonus

Allocation (BA) funding in the amount of $23 million. • NCDOT approved additional state revenue to accelerate and fund U-5767; therefore the

CRTPO’s Project Oversight Committee has developed a recommendation to reallocate the $23 million in BA funds initially programmed to this project.

12. Project Oversight Committee Update Bill Coxe ACTION REQUESTED: FYI

BACKGROUND: • The establishment of the Project Oversight Committee (POC) was approved by the MPO in

September 2015. • The POC’s purpose is to serve as a TCC subcommittee charged with making project selection

recommendations for Bonus Allocation and STP-DA funds and to monitor the implementation of projects funded from those sources, as well as Congestion Mitigation & Air Quality (CMAQ) and Transportation Alternatives Program (TAP) funds.

• The POC has met nine times since its establishment and has developed recommendations for the reprogramming of funds and has tracked the progress of the CRTPO’s locally-administered projects.

13. Freight Roundtable Robert Cook

ACTION REQUESTED: FYI BACKGROUND: • The FHWA Administrator hosted a Beyond Traffic Roundtable in Charlotte on March 4

focused on issues related to the freight economy. • It was one of several similar events being held around the country. • A report on the event will be provided.

Motion: Mr. Washam made a motion to adopt the January 2016 meeting minutes as presented. Rob Kidwell seconded the motion. Upon being put to a vote, the motion was adopted unanimously.

6. 2040 MTP & 2016-2025 TIP Amendments

Presenter: Summary: Mr. Cook stated that the request before the board was to approve amendments to the 2040 Metropolitan Transportation Plan (MTP) and the 2016-2025 Transportation Improvement Program (TIP) and to make a finding of air quality conformity. The TCC unanimously recommended at its February meeting that the MPO take the aforementioned action. The memo included in the agenda packet was reviewed. The public involvement activities were reviewed. Mr. Cook stated that there were three categories of amendments: clean up items from the 2016-2025 TIP development process; project schedule accelerations; technical analysis. 7. Miscellaneous 2016-2025 TIP Amendments Presenter: Robert Cook Summary: Mr. Cook stated that the request before the board was to approve 12 amendments to the 2016-2025 TIP. The 12 projects were reviewed and the various reasons for the proposed changes were discussed. The projects are listed below. The TCC unanimously recommended that the MPO amend the TIP to include the project changes at meetings held in December 2015 and February 2016.

8. Transportation Alternatives Program (TAP) Recommended Projects

Presenter: Curtis Bridges Summary: Mr. Bridges provided information to the MPO via a Power Point presentation, the contents of which are incorporated into the minutes. The presentation’s purpose was to provide an update on the status of the Transportation Alternatives Program (TAP) project ranking process and the recommended projects that will be presented to the board for approval at the March meeting. The call for projects and project selection processes were reviewed. Sixteen projects were submitted for consideration and, based on available funding, four were selected by the Bicycle & Pedestrian Work Group. The projects were: McDowell Creek Greenway, Magnolia

9. Bonus Allocation Reprogramming Recommendation

Presenter: Kelsie Anderson, Town of Mooresville Summary: Ms. Anderson provided information to the MPO via a Power Point presentation, the contents of which are incorporated into the minutes. The presentation’s purpose was to notify the MPO of the need to reprogram $23 million in bonus allocation funding allocated to the US 21 widening project in Cornelius (U-5767, Northcross Center Ct. Drive to Westmoreland Road). The reallocation was necessary because NCDOT decided to fund the project with STI funds. Ms. Anderson stated that the CRTPO’s Project Oversight Committee (POC) made recommendations as outlined in the memorandum that was included in the agenda packet and attached to, and made a part of, the February minutes. Ms. Anderson stated that the TCC will consider this topic at its March meeting, and its recommendation will be presented to the board for action at the March meeting.

10. Prioritization 4.0

Presenter: Neil Burke Summary: Mr. Burke provided information to the MPO via a Power Point presentation, the contents of which are incorporated into the minutes. The presentation’s purpose was to 1.) review the CRTPO’s local input point allocation methodology in advance of a request to be made at the March meeting to approve the methodology; and 2.) discuss a public involvement strategy for the local input point process. There were no questions or comments about the methodology; however, the board engaged in significant discussion about public involvement. The board’s direction was to develop a strategy that maximizes opportunities for as much public involvement as possible, which roughly approximated Option A that was reviewed during the presentation. Option A called for two separate points allocation periods for the two tiers (Regional and Division Needs), as well as two public comment periods. Other details regarding upcoming P4.0-related activities were discussed.

11. Upcoming Agenda Items

Presenter: Robert Cook Summary: Mr. Cook stated that the following items would be brought before the board for action at its March meeting: adoption of the FY 2017 Unified Planning Work Program; approval of the TAP project list; Prioritization 4.0 action items; Bonus Allocation reprogramming. In addition, the board was notified of the upcoming CRAFT Executive Committee meeting, scheduled for Monday, February 29 at 4:00 PM in Concord.

12. Other Business

Chairman Taylor thanked all the members who were able to attend the P4.0 workshop. He also mentioned that he had received an email from NCDOT Secretary Tennyson stating that all CRTPO jurisdictions would receive a letter from him requesting comments on specific concerns about the I-77 express lanes contract.

Project Oversight Committee Recommendation BACKGROUND

• The US 21 widening project (U-5767) in Cornelius was initially approved for BA funding in the amount of $23 million.

• NCDOT has approved additional state revenue to accelerate and fund U-5767, therefore the Projects Oversight Committee (POC) has developed a recommendation to reallocate the $23 million in BA funds that were initially programmed to this project.

FINDINGS The POC agreed to the following findings regarding the reallocation of the BA funds:

1. Reallocation of BA funds should help close the gap in over-programming of BA funds. The Bonus Allocation project list was approved with the recognition that the estimated cost of the 22 projects exceeded the available BA funds by $22 million. Stipulations within the STI legislation prevent additional BA funding from being spent within the Division Needs tier.

2. Reallocation of BA funds should be distributed to existing, approved BA projects. The five-year timeframe to obligate BA funds to projects began on July 1, 2015; therefore, the POC agreed that opening a call for new projects is not recommended.

3. Tier 2 projects were identified during the Bonus Allocation programming process as projects that should be considered next in the event that a Tier 1 project could not be delivered within the five-year timeframe. The projects within Tier 2 either exceeded the $23 million of BA funding available or could not be delivered within the specified timeframe, thus the subcommittee sought to develop another recommendation.

4. Cost estimates on projects within the Regional Impact tier may be low; therefore, “contingency funds” should be set aside within that tier.

RECOMMENDATIONS The POC agreed to the following recommendations:

1. The POC agreed that reallocated BA funds should be programmed to address the $10.9 million over-programming amount in the Statewide Mobility Tier and the $4.9 million over-programming amount in the Regional Impact Tier.

2. The POC agreed that $4.5 million of the reallocated BA funds should be appropriated to the US 21 and Gilead Road intersection improvement project in Huntersville (U-5114). U-5114 is an existing BA project currently in design. This BA fund allocation would replace $3.6 million of STP-DA funds which would then be available to be reprogrammed to other project(s) within CRTPO’s planning area.

3. The POC agreed that the remainder of the reallocated BA funds, $2.7 million, should

be held in reserve as a contingency fund for approved Regional Impact tier projects.

TCC RECOMMENDATION At its March 2016 meeting, the Technical Coordinating Committee unanimously recommended that the MPO adopt the FY 2017 UPWP. BACKGROUND • The UPWP is adopted annually in accordance with joint FHWA and FTA guidelines. • It describes the planning activities that are anticipated for the coming fiscal year and

documents the allocation of state and federal funds associated with each planning activity. • The FY 2017 UPWP was prepared in cooperation with a staff work team and the UPWP Review

Subcommittee. FUNDING Final FY 2017 funding allocations have not yet been provided by NCDOT, thus the following amounts are FY 2016 funding levels. Staff will request an amendment to the UPWP once final allocations are provided. The exception to this is for the unobligated balance of PL funds. This is an accurate amount as provided by NCDOT. (The unobligated balance is funds not used in previous fiscal years that are now available for allocation.)

• Six projects were originally submitted for consideration. The UPWP Review Subcommittee reviewed all proposals and recommended that all be funded. The list of local projects can be found below.

• Shortly before the March Technical Coordinating Committee meeting, the Town of Mooresville notified staff that it was withdrawing its request for one of its three proposed projects. The $100,000 allocated to the withdrawn project will be allocated to tasks associated with the development of the 2045 Metropolitan Transportation Plan in Task Code IV-1, Community Goals & Objectives.

• The total amount of funding requested for local projects is $303,000. The unobligated balance of $443,106 will be sufficient to fund the five proposed projects.

• The remaining $40,106 of the unobligated balance will be programmed to support the update of the Public Involvement Plan as recommended in the draft 2017 Certification Review issued by the FHWA and FTA.

Total $303,000 CARRYOVER REQUESTS • The Town of Huntersville was awarded $50,000 in Planning (PL) funds in FY 2016 for its

Northwest Huntersville Transportation Study-Phase II project. The Town was unable to pursue the project this year, and has requested that NCDOT permit the FY 2016 funds to be carried over into FY 2017 in order for the project to be started next year.

• The City of Charlotte was awarded $200,000 in Planning (PL) funds in FY 2016 for its Transportation Corridor Studies projects. A total of three corridors were proposed for analysis when the project was proposed. The City has begun work on two of the three corridors, but due to contract-related delays, has not been able to begin work on the third project. The City therefore has requested that NCDOT permit $100,000 of the awarded PL funds to be carried over into FY 2017 in order for the project to be fully completed.

• The requested carryover funds have been programmed in Task Code VI-10, Corridor Protection & Special Studies in anticipation of NCDOT’s approval of the requests.

Charlotte Regional Transportation Planning Organization FY 2016 Self-Certification Checklist

Background 23 CFR* 450.334 requires Metropolitan Planning Organizations (MPO) to annually self-certify to the Federal Highway Administration (FHWA) and the Federal Transit Administration (FTA) that its planning process is addressing the major issues facing the urban area and is being conducted in accordance with all applicable requirements of the metropolitan planning process and related requirements. The checklist below assists staff as it conducts the self-certification process. Each question is followed by CRTPO staff’s response, and if necessary, additional explanation. (All CRTPO staff inputs are in green italics.) Questions 1. Is the MPO properly designated by agreement between the Governor and 75% of the

h. The Older Americans Act, as amended (42 U.S.C. 6101), prohibiting discrimination on the basis of age in programs or activities receiving Federal financial assistance;

i. Section 324 of title 23 U.S.C. regarding the prohibition of discrimination based on gender; and

j. Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. 794) and 49 CFR part 27 regarding discrimination against individuals with disabilities.

The agencies and organizations receive all CRTPO policy board agenda packets and other public meeting notifications (e.g., public comment period notifications). CERTIFYING THE TRANSPORTATION PLANNING PROCESS OF THE CHARLOTTE REGIONAL TRANSPORTATION PLANNING ORGANIZATION

FOR FY 2016 WHEREAS, the Charlotte Regional Transportation Planning Organization has found that it is conducting transportation planning in a continuous, cooperative, and comprehensive manner in accordance with 23 USC 134 and 49 USC 1607; and

WHEREAS, the Charlotte Regional Transportation Planning Organization has found the transportation planning process to be in compliance with Sections 174 and 176 (c) and (d) of the Clean Air Act (42 USC 7504, 7506 (c) and (d); and

WHEREAS, the Charlotte Regional Transportation Planning Organization has found the transportation planning process to be in full compliance with Title VI of the Civil Rights Act of 1964 and the Title VI Assurance executed by each State under 23 USC 324 and 29 USC 794; and

WHEREAS, the Charlotte Regional Transportation Planning Organization has considered how the transportation planning process will affect the involvement of Disadvantaged Business Enterprises in FHWA and FTA funded planning projects (Section 105(f), Pub. L. 97-424, 96 Stat. 2100, 49 CFR part 23); and

WHEREAS, the Charlotte Regional Transportation Planning Organization has considered how the transportation planning process will affect the elderly and disabled per the provision of the Americans with Disabilities Act of 1990 (Pub. L. 101-336, 104 Stat. 327, as amended) and the US DOT implementing regulations; and

WHEREAS, the Charlotte Regional Transportation Planning Organization Transportation Improvement Program is a subset of the currently conforming 2040 Metropolitan Transportation Plan; and

WHEREAS, the 2040 Metropolitan Transportation Plan has a planning horizon year of 2040 and meets all the requirements of an adequate Transportation Plan.

NOW THEREFORE BE IT RESOLVED that the Charlotte Regional Transportation Planning Organization certifies its transportation planning process on this the 16th day of March, 2016.

Project Oversight Committee Recommendation ACTION REQUESTED Approve the reallocation of Bonus Allocation funds based upon a recommendation developed by the Project Oversight Committee. BACKGROUND

• The US 21 widening project (U-5767) in Cornelius was initially approved for BA funding in the amount of $23 million.

• NCDOT has approved additional state revenue to accelerate and fund U-5767, therefore the Projects Oversight Committee (POC) has developed a recommendation to reallocate the $23 million in BA funds that were initially programmed to this project.

TCC RECOMMENDATION At its March 2016 meeting, the TCC unanimously recommended that the MPO approve the reallocation of Bonus Allocation funds as described below. FINDINGS The POC agreed to the following findings regarding the reallocation of the BA funds:

1. Reallocation of BA funds should help close the gap in over-programming of BA funds. The Bonus Allocation project list was approved with the recognition that the estimated cost of the 22 projects exceeded the available BA funds by $22 million. Stipulations within the STI legislation prevent additional BA funding from being spent within the Division Needs tier.

2. Reallocation of BA funds should be distributed to existing, approved BA projects. The five-year timeframe to obligate BA funds to projects began on July 1, 2015; therefore, the POC agreed that opening a call for new projects is not recommended.

3. Tier 2 projects were identified during the Bonus Allocation programming process as projects that should be considered next in the event that a Tier 1 project could not be delivered within the five-year timeframe. The projects within Tier 2 either exceeded the $23 million of BA funding available or could not be delivered within the specified timeframe, thus the subcommittee sought to develop another recommendation.

4. Cost estimates on projects within the Regional Impact tier may be low; therefore, “contingency funds” should be set aside within that tier.

RECOMMENDATIONS The POC agreed to the following recommendations:

1. The POC agreed that reallocated BA funds should be programmed to address the $10.9 million over-programming amount in the Statewide Mobility Tier and the $4.9 million over-programming amount in the Regional Impact Tier.

2. The POC agreed that $4.5 million of the reallocated BA funds should be appropriated to the US 21 and Gilead Road intersection improvement project in Huntersville (U-5114). U-5114 is an existing BA project currently in design. This BA fund allocation would replace $3.6 million of STP-DA funds which would then be available to be reprogrammed to other project(s) within CRTPO’s planning area.

3. The POC agreed that the remainder of the reallocated BA funds, $2.7 million, should be held in reserve as a contingency fund for approved Regional Impact tier projects.
