NOTIFICATION .

New Delhi.jhe 71h April, 2010

S.O. 819(E).-ln exercise of the powers conferredby the proviso to article 309 and clause (5) of article 148 ofthe Constitution and after consultation with the Comptrollerand Auditor-General of India in relation 10 persons servingin the Indian Audit and ACCOWIIS Department, the Presidenthereby makes the following rules further to amend theCentral Civil Services (Pension) Rules, 1972. namely :-

1. (I) These rules may be called the Central CivilServices (Pension) (Amendment) Rules, 2010.

(2) They shall come into force on the dale of theirpublication in the Official Gazette.

2. In the Central Civil Services (Pension) Rules, 1972(hereinafter referred 10 as the said rules), in rule 64, insub-rule (4), in clause (a), in sub-clause (ii), for the words"ten per cent of gratuity or one thousand rupees, whichever

is less", the words "ten per cent of gratuity" shall besubstituted.

3. In rule 71 of the said rules, in sub-rule (3), inclause (a), afler the words "licence fee", the followingshall be inserted. namely :~

"as well as damages (for the occupation of-0 the Government accommodation beyond the

permissible period aft ••. the d.W>of retirementof all on. e)".

4. In rule 72 ofthesaid rules,-

(a) in sub-rule (S), for the words "ten percentof gratuity or one thousand rupees,whichever is less", the words "ten per centof gratuity" shall be substituted,

(b) for sub-rule (6), the following sub-rulesshall be substituted, namely :--

"(6) Ihe recovery of licence fee (where it is notpossible for the Directorate of Estates todetermine the outstanding licence fee) as wellas damages (for the occupation of theGovernment accommodation beyond thepermissible period after the date of retirementof all one e) shall be the respondibility of theDirectorate of Estates and the withheldamount of gratuity under sub-rule (5) above.the retiring Government cmplo.Y~, who arein occupation of Government accomodation,shall be paid immediately on production of"No Demand Certificate" from the Directorate'of Estates after actual vacation of theGovernment accommodation;

(7) The Directorate of Estates shall ensure that"No Demand Certificate" shall be given tothe Government employee within a period offourteen days from the actual date ofvacation of the Government accommodationand the allonee shall be entitled to paymentof interest (at the rate applicable to GeneralProvident FlUId deposit determined from timeto time by the Government oflndia) on theexcess withheld amount of gratuity which isrequired to be refunded, after adjusting thearrears of licence fee and damages, if any,payable by the allottee and the, interest shallbe payable by the Directorate of Estatesthrough the concerned Accounts Officer ofthe Government employee from the actualdate of vacation of the Governmentaccommodation up to the date of refund ofexcess withheld amount of gratuity;

(8) On account of licence fee or damagesremaining unpaid after adjustment from thewithheld amount of gratuity IIICIltioned undersub-rule (5) above, may be ordered to be

recovered by the Directorate of Estatesthrough the concerned Accounts Officer fromthe Dearness Reliefwithoutthe consent of thepensioners and in such cases no DearnessReliefshall be disbursed until full recovery ofsuch dues has been made." .

5. In rule 80 of the said rule, in sub-rule (4), In clause(C), for the words "ten per cent of the amount of gratuity orrupees one thousand, whichever is less", the words "tenper cent of the amount of gratuity" shall be substituted.

6. In rule 80.c of the said rules, in sub-rule (I), inclause (v), for the words "ten per cent of the death graruiryor one thousand rupees, whichever is less", the words"ten per cent of death gratuity" shall be substituted.
