49.21 Regarding consideration of the project proposals, which are located in the critically polluted area of Ludhiana and Mandi Gobindgarh
The SEAC observed that the Office Memorandum dated 28.4.2011 of the Ministry of Environment & Forests is very clear to the effect that the projects of category 'B' for which 'General Condition' is applicable and are to be located within a radius of 10 kms from the critically polluted areas/within critically polluted area as identified by the Central Pollution Control Board (latest list) would be treated as category 'A' projects irrespective of the fact that the moratorium on the

Item No. 50.03: Application for obtaining environmental clearance for development of a Residential Colony Project "Estate N.R.I. Extn-I" in the revenue estate of Village Malko (H.B. No. 298), Village Jaggan (H.B. No. 297) & Badshapur (H.B. No. 296) Jalandhar-Nakodar Road, Jalandhar by M/s Eldeco Jalandhar Properties Pvt. Ltd.
M/s Eldeco Jalandhar Properties Pvt. Ltd., has applied for
obtaining environmental clearance required under the EIA notification dated
14/9/2006 for development of a Residential Colony Project "Estate N.R.I. Extn-I" in
the revenue estate of Village Malko (H.B. No. 298), Village Jaggan (H.B. No. 297) &
Badshapur (H.B. No. 296) Jalandhar-Nakodar Road, Jalandhar. The project is
covered under category 8 (a) of the Schedule appended to the said notification. The
details of the project as per Form I & IA are as under:-
The total plot area is 3,35,340.20 sq. m and the built up area of the project will
be 61,627.04 sq. m.
The total water requirement for the project will be 1969 KLD, out of which 1378
KLD will be met with groundwater by installing tubewells and balance 591 KLD
will be met through recycling of treated wastewater.
The total wastewater generation from the proposed project will be about 1693
KLD, which will be treated in a STP having capacity 2040 KLD. During non-rainy
season at the outlet of STP, about 1524 KLD of treated wastewater will be
discharged, out of which 591 KLD will be used for flushing, 692 KLD for
horticulture, 27 KLD for cooling of DG sets, 10 KLD for recreational purpose and
204 KLD into sewer. However, in rainy season 591 KLD will be used for flushing,
27 KLD for cooling of DG sets, 10 KLD for recreational purpose and 896 KLD into
sewer.
The project proponent has proposed to install a STP having capacity 2040 KLD
based on FAB technology.
The total quantity of MSW has been estimated as 7485 Kg/day, which will be
segregated at source. The biodegrable waste will be treated in an on-site
composting facility and recyclable waste will be sold out to the authorized
vendors and remaining solid waste will be stored within the project premises till
a Govt. designated landfill site is established in the area.
The total power requirement will be 10252.5 KVA and 6 no. DG sets of capacity
625 KVA each will be installed as standby arrangement for power supply.
The project proponent has proposed to provide 64 no. rain water harvesting pits
of capacity 31.4 m3 each to replenish the groundwater.
Parking provision has been kept for 564 ECS.

60,000 TPA in the existing Swaraj Division Foundry unit located in the revenue
estate of Village Majri, Tehsil Kharar, District Mohali. The project of the promoter
pertains to category 'B' and it falls under category 3 (a) of the Schedule appended
to the said Notification. As per application submitted by the industry, the details of
the project are as under :
The area of the existing industrial plant is 18 acres and expansion is to be
carried out in the existing industrial premises.
Presently, the industry is manufacturing differential, rear cover, gear box,
trumpet & other tractor parts @ 35,000 TPA with help of an induction
furnace of 6 Ton/heat capacity and other supporting machinery.
The industry has proposed to increase in the production capacity of
differential, rear cover, gear box, trumpet & other tractor parts from 35,000
TPA to 60,000 TPA by installing another induction furnace of 7 ton/heat
capacity in addition to existing machinery.
The cost of the expansion plan of the project is Rs.40 Crores.
Bifurcation of water being used at present for various activities and
to be used in the proposed expansion project proposal has not been
submitted.
No proper detail regarding generation of wastewater from the existing plant
and to be generated from the expansion proposal has been submitted.
The existing power load available with the industry is 7308 KW, which has
been taken from PSPCL and additional power load of 8000 KW is required
and the same will also be taken from PSPCL.

APCD to contain the concentration of particulate matter in the emissions
within the standards laid down by the Board. The industry has proposal to

Item No. 50.05: Application for obtaining Environmental Clearance for an educational institute namely "RIMT Group of Colleges" already existing in the revenue estate of Village Talwara/Harbanspura, Mandi Gobindgarh, District Fatehgarh Sahib by M/s Om Parkash Bansal Educational & Social Welfare Trust.
M/s Om Parkash Bansal Educational & Social Welfare Trust has
applied for obtaining environmental clearance as required under the EIA notification
dated 14/9/2006 for already developed an educational institution namely "RIMT
Group of Colleges" in the revenue estate of Village Talwara/Harbanspura, Mandi
Gobindgarh, District Fatehgarh Sahib. The project is covered under category 8 (b)
of the schedule appended to the EIA notification dated 14.09.2006. The details of
the project as per Form I & IA are as under:-
The total plot area of project is 58.7 acres and total built up area is 1,66,839 sq.
m.
The total cost of project is Rs. 13 crores.
The total students/staff catering by the educational institution are 10545 day
scholars and 1983 hostlers.
Total water requirement for the proposed project is 743 KLD, which is being met
through tubewell.
Total wastewater generation from the project is 595 KLD, which is being treated
in STP and the treated wastewater is used for plantation within the premises.
Presently the project proponent has installed two STPs of capacity 100 KLD and
375 KLD and the project proponent has proposed to install additional STP of
capacity 150 KLD based on SAFF technology.
About 500 Kg/day of solid waste is being generated which is collected and
segregated at source. The non-biodegradable component is sold out to recyclers
and the biodegradable component of the solid waste is picked up by M.C. Mandi
Gobindgarh.
The sludge from STP is used as manure in green area inside the campus.
Power requirement is 5267.35 KW, which is being supplied by PSPCL. Also, 5 no.
D.G. set of capacity 125 KVA each, 2 no. DG set of capacity 160 KVA each, 1 DG
set of 160 KVA capacity and 1 no. DG set of 65 KVA (Total 1260 KVA) have been
installed as standby arrangement of power supply.

Item No. 50.06: Application for obtaining environmental clearance as required under EIA Notification dated 14.9.2006 for setting up of a CETP of 2 MLD capacity in the revenue estate of Kohara- Machhiwara Road, Village Mangarh, Distt. Ludhiana by M/s JBR Technologies Pvt. Ltd.
M/s JBR Technologies Pvt. Ltd has applied for obtaining
environment clearance as required under EIA Notification dated 14.9.2006 for
setting up of a CETP of 2 MLD capacity in the revenue estate of Kohara-
Machhiwara Road, Village Mangarh, Distt. Ludhiana on Form-1, on 21.6.2010 to
SEIAA, Punjab. But the same was sent to Ministry of Environment & Forests,New
Delhi due to non-functioning of SEIAA, Punjab, at that time. The case of the
project proponent was considered by the EAC of Ministry of Environment & Forests,
New Delhi in 94th meeting held on 30th November, 2010 to 2.12.2010 and the EAC
decided to defer the case since the project proponent did not attend the meeting.
Accordingly, the Ministry of Environment & Forests, requested the project
proponent vide letter no. 10-59/2010-IA.III dated 30.12.2010 to intimate as to
whether the project proponent is willing to obtain the Terms of Reference or not
and to send a request in this regard to the MoEF. But the project proponent did not
respond in connection with letter of the Ministry of Environment & Forests, New
Delhi.
Thereafter, the MoEF has sent the application to SEIAA/SEAC, Punjab
mentioning that the project is of category 'B'. The project is covered under
category 7 (h) of the Schedule appended to EIA notification dated 14/9/2006. The
details of the project proposal as Form-1 are as under:
1. The common Effluent Treatment Plant of capacity 2.0 MLD to treat the wastewater of electroplating units located at Ludhiana will be installed.
2. About 1 acre of land area has been taken on lease for installation of CETP.
3. The common effluent treatment plant shall be based on zero liquid discharge technology and shall consist of following components;
i) Screen Chamber
ii) Equalization/collection tank
iii) Oil & grease trap
iv) Flash mixture

proponent vide letter no. JBR/11-12/EC/12 dated 18.07.2011 has requested to
adjourn the case to the next meeting.
The SEAC agreed to accept the request made by the project
proponent vide letter dated 18.7.2011 and decided to defer the case to the next
meeting of the Committee and to ask the project proponent to submit the following
documents within a week positively:

vide letter No. 318011 dated 03.08.2011, but no reply has been received from the
project proponent in this regard, so far.

Item No. 50.07. Application for obtaining environmental clearance for a Group Housing Project namely “Cooperative Housing Complex Pocket-I” at Sector 79 of Mohali by the HOUSEFED, Punjab.
The HOUSEFED, Punjab has applied for obtaining
environmental clearance under EIA Notification dated 14.09.2006 for developing a
Group Housing Project namely “Cooperative Housing Complex Pocket-I” at Sector
79 of Mohali. The project of the promoter is covered under category 8 (a) of the
Schedule appended to the said notification.
The case was considered by the SEAC in its 43rd meeting held
on 19.3.2011 and the Committee observed that the project proponent is required to
submit the certain documents/data for carrying out appraisal of the project
proposal.
Sh. Arun Vasudeva, Sub-Divisional Officer, HOUSEFED, Punjab,
Kapurthala, who was present in the 43rd meeting of SEAC, informed that the said
documents/data will be submitted within 7 days. The committee agreed to accept
the request made by Sh. Arun Vasudeva and decided to defer the case till the reply
of the observations, is received. The said decision of the Committee was conveyed
to the project proponent vide letter no. 15441 dated 31.3.2011.
The project proponent vide letter dated Nil, received on
25.4.2011 had submitted the reply and the same was considered by the SEAC in its
47th meeting held on 19.3.2011, vide item No. 47.05 (Annexure-1, CP 76-80)
After deliberations in the matter, the committee noted that the reply submitted by
the project proponent in respect of following points is not in order:
1. In the permission granted by the GMADA vide letter no. 3000 dated 8.7.2010
for providing sewer connection, it has been mentioned that the disposal
point of the sewer of the residential colony will be connected with sewerage
system as soon as the sewerage system in the area is made operational,
which is about 10 months old and it does not show the latest position of
providing sewerage system in the area with which the sewer of the
residential colony is to be connected, as such, the said permission cannot be
considered at this stage. Furthermore, the approval granted by the GMADA
does not show as how much quantity of treated wastewater will be allowed
to be discharged into the sewerage system from the residential colony.
2. The promoter has stated in the reply that the permission from CGWA for
abstraction of ground water is not required to be obtained since the site is
located in the safe zone and the quantity of ground water to be abstracted is
less than 1000 KLD. However, the project proponent has not submitted any
documentary evidence in this regard issued by the concerned Competent
Authority.
In the 47th meeting of SEAC, the letter no. 16222 dated 4.5.2011
issued by the Sub Divisional Officer (Building), GMADA, Mohali to the effect that the
site of the project is located in the residential zone as per the Master Plan, was
taken on record. After detailed deliberations in the matter, the Committee decided
to ask the project proponent to submit the reply in respect of its observations,
within 10 days and to place the case in the next meeting of the SEAC after receipt
of proper reply of these observations from the project proponent. The said decision
of the Committee was conveyed to the project proponent vide letter no. 20951
dated 17.5.2011.
Thereafter, the project proponent vide letter no. 6747 dated
28.6.2011 has submitted the reply in connection with letter no. 20951 dated
17.5.2011, the details of which are as under:-

2. Submit, either documentary evidence to the effect that the site of the project is located in the safe zone and the project proponent is not required to obtain permission from CGWA or permission given by the CGWA for abstraction of groundwater.
Submitted an affidavit to the effect that the site of the housing project is located in the safe zone as per guidelines of CGWA.
3. An undertaking to the effect that only run-off from the roof top will be collected and discharged into rain water harvesting system to replenish the groundwater.

5. To explain the reasons as to why construction has been started at site without obtaining environment clearance as required under EIA notification dated 14.9.2006 since the photographs submitted by the project proponent show that substantial construction of the residential colony has been done.
The site is located in the approved township/sector of PUDA/GMADA and due to this fact, we were of the opinion that the environmental clearance is not required. However, after confirming from PUDA/GMADA we have applied for the same and till date the constructed built up area is less than 20,000 sq. m.
The project proponent was requested vide letter No. 2756
dated 8.7.2011 by the SEAC to attend its 49th on 18.7.2011 to present the reply of
the observations of the SEAC. Following representatives on behalf of the project
proponent attended the meeting to present the reply before the SEAC:
1. Sh. Sewa Singh, XEN, HOUSEFED, Punjab
2. Sh. A.K. Ummat, Environmental Consultant, M/s CPTL Enviro-Tech, Chandigarh.
3. Sh. Sital Singh, Environmental Consultant, M/s CPTL Enviro-Tech, Chandigarh.
Sh. A.K. Ummat of M/s CPTL Enviro-Tech and Pollution Control
Consultants, Chandigarh, who is the Environmental Consultant of the project
proponent and the name of his consultancy firm figures at Sr.no.2 of the list B
(Stage 1) uploaded by the MoEF at its official website, presented the reply.
The Committee was not satisfied with the reply submitted by the
project proponent especially with regard to observation no. 1, 2 & 5, as stated
above.
The Committee also deliberated on the contents mentioned in the
letter of GMADA bearing no. 26836 dated 15.07.2011 addressed to the Executive
Engineer, HOUSEFED, Punjab in which it has been mentioned that the GMADA has
calculated and taken into account the potential discharge of sewage to be
discharged into sewer from the housing complex of HOUSEFED and no tubewell will
be allowed to be installed to HOUSEFED at its own level as the water is to be
supplied by the GMADA in the housing complex. The Committee noted that nothing
specific has been mentioned about the quantity of water to be supplied by the
GMADA to the housing complex and quantity of sewage to be discharged into sewer
of GMADA. Therefore, the HOUSEFED, Punjab is required to submit specific
approval regarding aforesaid aspects.
The Committee also brought out in the knowledge of project promoter
that a combined meeting of SEIAA and SEAC was held on 1.6.2011, wherein, it was
decided to get specific approval of the Competent Authority for supplying of water,
discharge of sewage into sewer and disposal of solid waste / inerts before appraisal
of the project proposal.
After detailed deliberations, the Committee in its 49th meeting
observed that the project proponent is required to submit the information/data for
further appraisal of the project proposal.
1. Specific approval be obtained from GMADA giving quantity of water to be
supplied to the project proponent and the latest position of water supply
system of GMADA in the vicinity of the proposed residential colony.
2. The HOUSEFED shall submit an undertaking to the effect that no tubewell
will be installed in the residential colony without the prior written permission
of SEIAA, Punjab.
3. Specific approval be obtained from GMADA giving quantity of treated
wastewater of the residential colony permitted to be discharged into the
sewerage system and the latest position for laying down sewerage system in
the area with which the sewer of the residential colony is proposed to be
connected.
4. Permission of GMADA to the effect that the management and handling of
entire solid waste to be generated from the residential colony will be done by
GMADA.
5. To explain the reasons as to why construction has been started at site
without obtaining environment clearance as required under EIA notification
dated 14.9.2006 since the reasons given by the project proponent vide letter
dated 28.6.2011 are not plausible.
Sh. Sewa Singh, Executive Engineer, HOUSEFED, Punjab informed
that the said documents/data will be submitted within one month. The Committee
agreed to accept the request made by Sh. Sewa Singh, Executive Engineer,
HOUSEFED, Punjab, and decided to defer the case till proper reply of the aforesaid
observations, is received. The said decision was conveyed to the HOUSEFED vide
letter No. 31814 dated 03.08.2011.
Now, the HOUSEFED has submitted a copy of the letter bearing No.
3340 dated 22.7.2011 issued by GMADA to it, in which it has been mentioned that:
(i) The GMADA has designed the peripheral services of Pocket allotted to
HOUSEFED in such a way that these will be able to carry 90 KLD of
treated sewage of Pocket-I
(ii) The GMADA will be able to supply 130 KLD of drinking water for Pocket-I.
It is mentioned here that no reply has been received from the
HOUSEFED regarding observation no. 2, 4 & 5 of the 49th meeting of SEAC.
The case is again placed before the Committee for further
consideration.
Item No. 50.08 Application for obtaining environmental clearance for Group Housing Project namely “Cooperative Housing Complex Pocket-II” at Sector 79 of Mohali by the HOUSEFED, Punjab.
The HOUSEFED, Punjab has applied for obtaining
environmental clearance under EIA Notification dated 14.09.2006 for developing
Group Housing Project namely “Cooperative Housing Complex Pocket-II” at Sector
79 of Mohali. The project of the promoter is covered under category 8 (a) of the
Scheduled appended to the said notification.
The case was considered by the SEAC in its 43rd meeting held on
19.3.2011 and the Committee observed that the project proponent is required to
submit the certain documents/data for carrying out appraisal of the project
proposal.
Sh. Arun Vasudeva, Sub-Divisional Officer, HOUSEFED, Punjab, , who
was present in the 43rd meeting of SEAC, informed that the said documents/data
will be submitted within 7 days. The committee agreed to accept the request made

meeting held on 19.3.2011, vide item No. 47.06 (Annexure-2, CP 81-84) After
deliberations in the matter, the Committee noted that the reply submitted by the
project proponent in respect of following points is not in order:
1. In the permission granted by the GMADA vide letter no. 3000 dated 8.7.2010
for providing sewer connection, it has been mentioned that the disposal
point of the sewer of the residential colony will be connected with sewerage
system as soon as the sewerage system in the area is made operational,
which is about 10 months old and it does not show the latest position of
providing sewerage system in the area with which the sewer of the
residential colony is to be connected, as such, the said permission cannot be
considered at this stage since. Furthermore, the approval granted by the
GMADA does not show as how much quantity of treated wastewater will be
allowed to discharge into the sewerage system from the residential colony.
2. The promoter has stated in the reply that the permission from CGWA for
abstraction of ground water is not required to be obtained since the site is
located in the safe zone and the quantity of ground water to be abstracted is
less than 1000 KLD. However, the project proponent has not submitted any
documentary evidence in this regard issued by the concerned Competent
Authority.
In the 47th meeting of the SEAC, the letter no. 16223 dated 4.5.2011
issued by the Sub Divisional Officer (Building), GMADA, Mohali to the effect that the
site of the project is located in the residential zone as per the Master Plan, was
taken on record. After detailed deliberations in the matter, the Committee decided
to ask the project proponent to submit the reply in respect of its observations
within 10 days and to place the case in the next meeting of the SEAC after receipt
of proper reply of these observations from the project proponent. The said decision
of the Committee was conveyed to the project proponent vide letter no. 20956
dated 17.5.2011.
Thereafter, the project proponent vide letter no. 6748 dated
28.6.2011 has submitted the reply in connection with letter no. 20956 dated
17.5.2011, the details of which are as under:-

5. To explain the reasons as to why construction has been started at site without obtaining environment clearance as required under EIA notification dated 14.9.2006 since the photographs submitted by the project proponent show that substantial construction of the residential colony has been done.
The site is located in the approved township/sector of PUDA/GMADA and due to this fact, we were of the opinion that the environmental clearance is not required. However, after confirming from PUDA/GMADA, we have applied for the same and till date the constructed built up area is less than 20,000 sq. m.
The project proponent was requested by the SEAC to attend its 49th
on 18.7.2011 to present the reply of the observations of the SEAC conveyed vide
letter No. 2758 dated 08.07.2011. Following representatives on behalf of the
project proponent attended the meeting to present the reply before the SEAC:

Sh. A.K. Ummat of M/s CPTL Enviro-Tech and Pollution Control
Consultants, Chandigarh, who is the Environmental Consultant of the project
proponent and the name of his consultancy firm figures at Sr.no.2 of the list B
(Stage 1) uploaded by the MoEF at its official website, presented the reply.
The Committee was not satisfied with the reply submitted by the
project proponent especially with regard to observation no. 1, 2 & 5, as stated
above.
The Committee also deliberated on the contents mentioned in the
letter of GMADA bearing no. 26836 dated 15.07.2011 addressed to the Executive
Engineer, HOUSEFED, Punjab in which it has been mentioned that the GMADA has
calculated and taken into account the potential discharge of sewage to be
discharged into sewer from the housing complex of HOUSEFED, Punjab and no
tubewell will be allowed to be installed to HOUSEFED, Punjab at its own level as the
water is to be supplied by the GMADA in the housing complex. The Committee
noted that nothing specific has been mentioned about the quantity of water to be
supplied by the GMADA to the housing complex and quantity of sewage to be
discharged into sewer of GMADA. Therefore, the HOUSEFED, Punjab is required to
submit specific approval regarding aforesaid aspects.
The Committee also brought out in the knowledge of project promoter
that a combined meeting of SEIAA and SEAC was held on 1.6.2011, wherein, it was
decided to get specific approval of the Competent Authority for supplying of water,
discharge of sewage into sewer and disposal of solid waste / inerts before appraisal
of project proposal.
After detailed deliberations, the SEAC in its 49th meeting observed that
the project proponent is required to submit following information / data for further
appraisal of the project proposal.
1. Specific approval be obtained from GMADA giving quantity of water to be
supplied to the project proponent and the latest position of water supply
system of GMADA in the vicinity of the residential colony.
2. The HOUSEFED shall submit an undertaking to the effect that no tubewell
will be installed in the residential colony without the prior written permission
of SEIAA, Punjab.
3. Specific approval be obtained from GMADA giving as to how much quantity
of treated wastewater of the residential colony permitted to be discharged
into the sewerage system and the latest position for laying down sewerage
system in the area with which the sewer of the residential colony is proposed
to be connected.
4. Permission of GMADA to the effect that the management and handling of
entire solid waste to be generated from the residential colony will be done by
GMADA.
5. To explain the reasons as to why construction has been started at site
without obtaining environment clearance as required under EIA notification
dated 14.9.2006 since the reasons given by the project proponent vide letter
dated 28.6.2011 are not plausible.
Sh. Sewa Singh, Executive Engineer, HOUSEFED, Punjab, who was
also present, informed that the said documents/data will be submitted within one
month. The Committee agreed to accept the request made by Sh. Sewa Singh,
Executive Engineer, HOUSEFED, Punjab, and decided to defer the case till proper
reply of the aforesaid observations, is received. The said decision was conveyed to
the HOUSEFED vide letter No. 31818 dated 03.08.2011.
Now, the HOUSEFED has submitted a copy of the letter bearing No.
3340 dated 22.7.2011 issued by GMADA to it, in which it has been mentioned that:
(i) The GMADA has designed the peripheral services of Pocket allotted to
HOUSEFED in such a way that these will be able to carry 200 KLD of
treated sewage of Pocket-II.
(ii) The GMADA will be able to supply 297 KLD of drinking water for Pocket-
II.
It is mentioned here that no reply has been received from the
HOUSEFED regarding observation no. 2, 4 & 5 of the 49th meeting of SEAC.
The case is again placed before the Committee for further
consideration.
Item No. 50.09 Application for obtaining environmental clearance for a Group Housing Project namely “Cooperative Housing Complex” at Circular Road, Kapurthala by the HOUSEFED, Punjab.
The HOUSEFED, Punjab has applied for obtaining
environmental clearance under EIA Notification dated 14.09.2006 for developing
“Cooperative Housing Complex” at Circular Road, Kapurthala. The project of the
promoter is covered under category 8 (a) of the Schedule appended to the said
notification.
The case was considered by the SEAC in its 43rd meeting held on
19.3.2011 and the Committee observed that the project proponent is required to
submit the certain documents/data for carrying out appraisal of the project
proposal.
Sh. Arun Vasudeva, Sub-Divisional Officer, HOUSEFED, Punjab,
Kapurthala, who was present in the 43rd meeting of SEAC, informed that the said
documents/data will be submitted within 7 days. The committee agreed to accept
the request made by Sh. Arun Vasudeva and decided to defer the case till the reply
of its observations, is received. The said decision of the Committee was conveyed
to the project proponent vide letter no. 15435 dated 31.3.2011.
Thereafter, the project proponent vide letter dated Nil, received on
25.4.2011 had submitted the reply and the same was considered by the SEAC in its
47th meeting held on 19.3.2011, vide item No. 47.07 (Annexure-3, CP 85-88)
After deliberations in the matter, the Committee noted that the permission granted
by the M.C. Kapurthala vide letter no. 336 dated 29.10.2010 to the effect that
water supply and sewerage connection will be made available as soon as necessary
fee is deposited, does not show as to how much quantity of sewage will be allowed
to be discharged into the sewerage system and how much quantity of water supply
will be made available to the residential colony. The Committee decided to ask the
project proponent to submit the reply in respect of its observations within 10 days
and to place the case in the meeting of the SEAC after receipt of proper reply of
these observations from the project proponent. The said decision of the Committee
was conveyed to the project proponent vide letter no. 20937 dated 17.5.2011.
Subsequently, the project proponent vide letter no. 6749 dated
28.6.2011 has submitted the reply in connection with letter no. 20937 dated
17.5.2011, the details of which are as under:-

the sewerage system and the latest position for laying down sewerage
system in the area with which the sewer of the residential colony is proposed
to be connected.
3. Permission of M.C., Kapurthala to the effect that the management &
handling of entire solid waste to be generated from the residential colony
will be done by it.
4. To explain the reasons as to why construction has been started at site
without obtaining environment clearance as required under EIA notification
dated 14.9.2006 since the reasons given by the project proponent vide letter
dated 28.6.2011 are not plausible.
Sh. Sewa Singh, Executive Engineer, HOUSEFED, Punjab informed
that the said documents/data will be submitted within one month. The Committee
agreed to accept the request made by Sh. Sewa Singh, Executive Engineer,
HOUSEFED, Punjab, and decided to defer the case till proper reply of the aforesaid
observations, is received. The said decision was conveyed to the HOUSEFED vide
letter No. 31815 dated 03.08.2011.
Now, the HOUSEFED has submitted a copy of the letter bearing No.
1826/M.E. dated 25.7.2011 issued by Municipal Council, Kapurthala to it, in which it
has been mentioned that the supply of water and discharge of sewage into sewer
will be permitted as per detail given in Annexure 1 & 2. In the said annexures, it
has been mentioned that 53 KLD and 71 KLD of treated wastewater will be
discharged into sewer during normal & worst conditions, respectively. Further, in
these annexures, it has been mentioned that 109 KLD of fresh water will be taken
from M.C., Kapurthala.
It is mentioned here that no reply has been received from the
HOUSEFED, Punjab regarding observation no. 3 & 4 of the 49th meeting of SEAC.
The case is again placed before the Committee for further
consideration.
Item No. 50.10 Application for obtaining Environmental Clearance for development of Mixed land Use Area, 300 m on both sides of 200 feet road from Sector 66, 66-A Junction to NH- 64 near Village Chhat in Urban estate, S.A.S. Nagar (Mohali) by M/s Greater Mohali Development Authority (GMADA).
M/s Greater Mohali Development Authority (GMADA) has
submitted an application for obtaining environmental clearance for development of
Mixed land Use Area, 300 m on both sides of 200 feet road from Sector 66, 66-A
Junction to NH- 64 near Village Chhat in Urban estate, S.A.S. Nagar (Mohali). The
project of the promoter is covered under category 8 (b) of the Schedule appended
to EIA notification dated 14/9/2006 as amended from time to time. The GMADA has
already been issued TOR by the Ministry of Environment & Forests, New Delhi vide
letter no. 21-38/2010-IA.III dated 12.1.2011 and the GMADA has submitted draft
Rapid EIA study report.
The GMADA was requested vide letter no. 3757 dated 8.7.2011 by the
SEAC to present the salient features of the draft Rapid EIA study report, before the
SEAC in its 49th meeting on 18.07.2011. Following were present on behalf of
GMADA in the said meeting:
1. Er. Davinder Singh, Executive Engineer (PH), GMADA, Mohali
2. Sh. Krishan Kumar, Environmental Consultant of M/s IRGSSA.
3. Sh. Sandeep Garg, Advisor of M/s Eco Laboratories and Consultants, Mohali for environmental matters.
Sh. Krishan Kumar, who is the Environmental Consultant of the
project proponent and the name of his consultancy firm figures at Sr. No. 20 of list-
B (in eligible applications) uploaded by the MoEF at its official website, presented
the case before the SEAC as under:
The total area of the project proposal is 771.34 acres (3121478 sq. m), which
has been divided into residential & commercial plots.
The site of the project falls within M.C. limits of Mohali.
The expected cost of the project is Rs. 1311.27 Crores.
The total water requirement for the project will be 17958 KLD, out of which
7034.3 KLD will be met with Canal water supply/groundwater and balance 5998
KLD will be met through recycling of treated wastewater. About 70% of the total
water supply will be met from canal based water supply and the remaining will
be met through by providing tubewells. Since area falls under non-notified area
of CGWA, there is no need to obtain any permission from any Authority.
The total wastewater generation from the proposed project will be about
8968KLD, which will be treated in the STP and the treated wastewater will be
used for flushing purpose and irrigation of green area (45112 sq. m).
About 43 TPD of solid waste will be generated, which will be sent to the
Engineered landfill being developed by GMADA.
The total power requirement will be 20 MVA, which will be supplied by Punjab
State Power Corporation Ltd.
There is no need for providing fire fighting system since this facility is to be
provided by the respective plot holders. He further informed that a site has been
earmarked for construction of Healthcare establishment.
Every plot holder will be directed to provide dual plumbing system so that
treated wastewater can be used for flushing purpose.
During presentation, the representative of the project has submitted
the following documents:
1. Layout plan duly approved by the Competent Authority.
2. Water balance statement in which it has been mentioned that 9762.32 KLD of
wastewater will be generated out of which 7169 KLD will be used for flushing
purpose and HVAC and the remaining 1590 KLD will be used for horticulture
purpose during summer season. However, during winter season, out of 1590
KLD, 795 KLD of treated wastewater will be used for horticulture purpose and
995 KLD for flushing purpose. Similarly, in monsoon season, out of 1590 KLD,
159 KLD of treated wastewater will be used for horticulture purpose and 1431
KLD for flushing purpose.
3. A copy of the letter issued by Senior Town Planner, SAS Nagar to the effect
that no permission for CLU is required being Govt. project.
4. Construction schedule (PERT/CPM Chart)
5. Quantification of energy saved and renewable energy devices used.
6. Affidavits for ;
a) Constitution of Environment Monitoring Cell
b) Use of ready mix concrete or use of fly ash during construction.
c) To provide Fire Fighting System
d) To provide wind breaking curtains and water sprinkling system to minimize dust emissions.
e) To provide adequate safety measures for the construction workers during the construction phase.
The Committee has taken all the aforesaid documents on record and
the Committee observed that the GMADA is required to submit a letter of the
Competent Authority to corroborate the submissions made by the representative of
GMADA before the SEAC to the effect that the project does not attract permission
for abstraction of groundwater as the project is located in the 'Safe Zone', for
further appraisal of the project proposal.
After detailed deliberations, the SEAC decided to request the GMADA
to submit the aforesaid letter within a week and defer the case till such time. The
said decision of the Committee was conveyed to the GMADA vide letter No. 31893
dated 03.08.2011
Now, the GMADA vide letter no. 3641 dated 04.08.2011 has informed
that the CGWA has notified 43 critical & over exploited areas in the country. For
enforcement of the regulatory measures in these areas, the concerned Deputy
Commissioners/District Magistrates have been directed u/s of 5 of the Environment
(Protection) Act, 1986 to regulate groundwater development in these notified areas.
The construction of new groundwater structures is prohibited in the notified areas.
However, permission for drilling of tubewells is being granted only to the Govt.
agencies for drinking water supply. The GMADA has further informed that in
compliance to said guidelines of CGWA, an application has been submitted to the
Deputy Commissioner, Mohali for obtaining permission for abstraction of
groundwater.
The case is again placed before the Committee for further
consideration.
Item No. 50.11: Application for obtaining Environmental Clearance for developing a Residential Apartment Complex namely "Jalandhar Heights" in the revenue estate of Villages Pholriwal & Alipur, Tehsil & District Jalandhar by M/s G.I. Builders (P) Ltd.,
M/s G.I. Builders (P) Ltd., has applied for obtaining
environmental clearance as required under the EIA notification dated 14/9/2006 for
development of a Residential Apartment Complex namely "Jalandhar Heights" in the
revenue estate of Villages Pholriwal & Alipur, Tehsil & District Jalandhar. The
project is covered under category 8 (a) of the schedule appended to the said
notification. The details of the project as per Form I & IA are as under:-
The total plot area is 30070 sq. m and the built up area of the project will be
75125 sq. m.
The project falls within M.C. limits of Jalandhar.
The total water requirement for the project will be 370 KLD, out of which 250
KLD will be met with groundwater by installing tubewell and balance 120 KLD
will be met through recycling of treated wastewater.
The total wastewater generation from the proposed project will be about 225
KLD, out of which 50 KLD will be used for flushing and 70 KLD will be used for
horticulture purpose and the remaining treated wastewater will be discharged
into sewer.
The project proponent has proposed to install a STP having capacity 225 KLD
consisting of bar screen, collection tank, primary clarifier, aeration tank,
secondary clarifier, pressure sand filter, chlorination tank and sludge drying beds
to treat wastewater.
About 600 kg/day of solid waste will be generated, which will be segregated into
dry and wet waste. Dry waste will be collected in separate primary bins and
stored for disposal. Recyclable dry waste will be sold to scrap dealers. Bio-
degradable and non-recyclable will be disposed into MSW landfill through M.C.
Jalandhar.
The total power requirement will be 3.5 MW which will be taken from Punjab
State Power Corporation Ltd.
The project proponent has proposed to provide 9 no. rain water harvesting pits to replenish the groundwater.
Parking provision has been kept for 888 ECS against total requirement of 756
ECS.

submitted by the promoter and the details of the proposed project are as under:

M/s PIEM Hotels Ltd has submitted application for obtaining
environmental clearance for developing a Hotel namely „Vivanta' at Plot No. C-3,
Outer Circular Road, Amritsar, on Form 1 & 1A alongwith basic information and the
project promoter is covered under category 8 (a) of the Schedule appended to EIA
notification dated 14/9/2006 as amended from time to time.
The project proponent was requested by the SEAC vide letter
no. 12752 dated 08.07.2011 to attend its 49th meeting on 18.7.2011 to present the
project proposal. Accordingly, following were present on behalf of the project
proponent to present the project proposal:
1. Mrs. Ananya Gandotra, Head (TSG) of the promoter company
2. Sh. Amit Gupta, GM (Design) of the promoter company
3. Sh. A.K. Ummat, Environmental Consultant, M/s CPTL Enviro-Tech, Chandigarh.
4. Sh. Sital Singh, Environmental Consultant, M/s CPTL Enviro-Tech, Chandigarh.
Sh. A.K. Ummat of M/s CPTL Enviro-Tech, Chandigarh, who is the
Environmental Consultant of the project proponent and the name of his consultancy
firm figures at Sr. No. 2 of list-B (Stage-1) uploaded by the MoEF at its official
website, presented the case before the Committee as under:
The total plot area of the proposed project is 13,777 sq. m and total built up
area is 28893.74 sq. m.
An agreement has been executed on 23rd July, 2009 between Punjab Urban
Planning & Development Authority and M/s PIEM Hotels Ltd to the effect that
the land area measuring as 13,777 sq. m has been taken on lease from PUDA
for developing a Five Star Hotel. Therefore, change of land use is not required
to be submitted.
The estimated cost of the project is Rs.100.5 Crores.
The site of the project falls within M.C. limits Amritsar.
The total water requirement for the project during normal condition will be 240
KLD, out of which 117 KLD (fresh water) will be used for domestic use & as
make up water in the cooling tower, 43 KLD (treated wastewater) for flushing,
46 KLD (treated wastewater) for make up in the cooling tower and 24 KLD
(treated wastewater) for horticulture purpose. Therefore, only 117 KLD of fresh
water will be required and same will be supplied by M.C. Amritsar and the said
Corporation vide letter no. 245 dated 15.7.2011 has issued NOC to the effect
that the supply of water by it.
The total wastewater generation from the proposed project will be about 113
KLD, which will be treated in a STP of capacity 150 KLD, out of which 43 KLD
will be used for flushing purpose, 46 KLD as make up water in the cooling tower
and 24 KLD for horticulture purpose. However, during rainy season, 43 KLD will
be used for flushing purpose, 40 KLD as make up water in the cooling tower, 10
KLD for horticulture purpose and 20 KLD into M.C. sewer. The M.C., Amritsar
has already issued NOC vide letter no. 245 dated 15.7.2011 for discharge of
treated wastewater into the sewer.
The project proponent has proposed to install STP having capacity of 150 KLD
consisting of screen chamber, grit chamber, aeration tank, clarifier, treated
water storage tank, chlorination, pressure sand filter and activated carbon filter
will be installed to treat the wastewater.
There will be about 340 kg/day generation of solid waste which will be
segregated at source. The biodegradable waste will be sent to earmarked site of
M.C., Amritsar. The recyclable and non-biodegradable waste will be sold out to
the recyclers.
The promoter has proposed to provide rainwater harvesting system through
which 5991 KL/year of run-off from roof top, green parks and roads/pavements
will be collected to replenish the groundwater of the area.
The total power requirement will be 1500 KW which will be supplied by Punjab
State Power Corporation Ltd and there is a proposal to install 2 No. DG sets of
1000 KVA capacity each to supply electricity during failure of power supply of
PSPCL. These DG sets will be provided with acoustic enclosures and proper
foundations.
During presentation, the project proponent has submitted the
following documents:
Layout plan duly approved by the Competent Authority.
Topographical map of the area showing Contour Plan.
Photographs showing that no construction activity has been started at site.
Analysis reports of ambient air of M/s Eko Pro Engineers Pvt. Ltd., Ghaziabad
indicate that the conc. of PM2.5 and PM10 in the ambient air of the area is
within the prescribed standards. As per analysis report, ambient noise levels
of the area is conforming to the standards laid down by the Board. Further,
the analysis report of ground water indicates that the groundwater of the
area is potable in nature.
The SEAC deliberated on letter no. 245 dated 15.7.2011 of Municipal
Corporation, Amritsar vide which the Municipal Corporation has issued NOC to the
project proponent to provide supply of water and sewer connection after depositing
Rs.22,89,152/- and noted that the same is not specific to the effect as to how much
quantity of water will be supplied to the project proponent and how much quantity
of treated wastewater will be allowed to be discharged into sewer.
After detailed discussions, the Committee observed that the project
proponent is required to submit the reply of following points for further appraisal of
the project proposal.
1. Specific approval be obtained from M.C., Amritsar giving quantity of supply
of water to be supplied to the project proponent and the latest position of
water supply system of M.C., Amritsar in the vicinity of the hotel.
2. Specific approval be obtained from M.C., Amritsar giving quantity of treated
wastewater of the residential colony permitted to be discharged into the
sewerage system and the latest position for laying down sewerage system in
the area with which the sewer of the hotel is proposed to be connected.
3. An undertaking to the effect that no tubewell will be installed for abstraction
of groundwater at the construction as well as operation stage of the hotel
without written permission of SEIAA.
Mrs. Ananya Gandotra, Head (TSG) of the promoter company
informed that the said documents/data will be submitted within 3-4 days. The
Committee agreed to accept the request made by Mrs. Ananya Gandotra, Head
(TSG) of the promoter company and decided to defer the case till proper reply of
the aforesaid observations, is received. As decided, the decision of the SEAC was
conveyed to the project proponent vide letter no. 31952 dated 03.08.2011.
Now, the project proponent has submitted a letter issued by Municipal
Corporation, Amritsar vide the no. SPL-3 dated 21.07.2011 to the effect that the
project proponent can discharge 20 KLD of treated wastewater into MC sewer
during extreme conditions and it has been mentioned in the said letter that 117
KLD of water will be supplied to the Hotel at prevailing commercial rates, but
shortage, if any, will be compensated by the project proponent by installing own
independent source of water supply.
It is mentioned here that no reply has been received from the
project proponent regarding submission of an undertaking to the effect
that no tubewell will be installed for abstraction of groundwater at the
construction as well as operation stage of the hotel without written
permission of SEIAA.
The case is placed before the SEAC for consideration.
Item No. 50.13 Application for obtaining environmental clearance as required under EIA Notification dated 14.9.2006 for development of an Integrated Residential-cum-Commercial Township namely „Pearls City' at Sector 100 & 104, Mohali by M/s PACL India Ltd.
M/s PACL India Ltd., has applied for obtaining environmental
clearance as required under EIA Notification dated 14.9.2006 for establishment of
an Integrated Residential-cum-Commercial Township namely „Pearls City' at Sector
100 & 104, Mohali. The project of the promoter is covered under category 8 (b) of
the Schedule appended to the said Notification since the area of the project is
413.213 acres (167.20 hectares). The details of the case are as under:
The total project area is 167.20 hectares, which will be developed into
residential and commercial activities and the total built up area of the project
will be 2,70,000 sq. m.
The proposed total water requirement is 3600 m3/day, which will be met
from groundwater.
There will be about 2700 KLD generation of wastewater which will be used
for irrigation of green belt. A water body having capacity 1,00,000 m3 will be
constructed for storage of treated wastewater during wet weather
conditions.
A STP consisting of screen chamber, equalization tank, primary clarifier,
aeration tank, secondary clarifier, pressure sand filter and sludge drying beds
will be installed to treat the wastewater.
About 8000 kg/day of solid waste will be generated, out of which 1600
kg/day will be recyclable in nature and the remaining part will be sent to
own site compositing facility.
The requirement of electricity is 35 MW.

The case of the project proponent was considered by the SEAC,
Punjab in its 39th meeting held on 1.5.2010, wherein, the Committee awarded
'Silver Grading' to the project and decided to recommend the case to SEIAA for
grant of environmental clearance subject certain conditions. However, due to non-
functioning of SEIAA/SEAC for the State of Punjab, the case was forwarded to
Ministry of Environment & Forests, for further necessary action in the matter.
The Ministry of Environment & Forests, vide letter dated 29.6.2011
has returned the file to the SEIAA, Punjab and in the note file, the Ministry of
Environment & Forests has given following remarks, which have been
countersigned by the Hon'ble Minister, Ministry of Environment & Forests.
"The proposal is of 167.20 acres, which is more than 50 hectare. The proposal should have been apprised as category B-1 as per EIA Notification dated 14.9.2006 since the project pertains to category 8 (b) of the said notification. As per clause 7 (i) first stage (1) screening.
"The project requiring EIA shall be termed as category B-1.".
SEIAA/SEAC Punjab has processed the proposal on the basis of Form 1 & 1A, which is not appropriate. It is suggested that the file should be apprised again as per the provisions of the EIA Notification dated 14.9.2006.
The case of the project proponent was considered by the SEIAA in its
32nd meeting held on 07.07.2011 and after detailed deliberations in the matter, the
SEIAA observed that in light of remarks given on the note file by the Ministry of
Environment & Forests, New Delhi, the case is liable to be returned to SEAC for
scoping and appraising the same as category B-1 of the EIA Notification dated
14.9.2006. The Authority, therefore, decided to return the case to SEAC for scoping
and appraising the same as per the provisions of the EIA Notification dated
14.9.2006 within the time frame prescribed under the said notification.
The case is placed before the SEAC for consideration.
Item No. 50.14 Application for obtaining Environmental Clearance for developing an Information Technology Park including SEZ namely "Yellowstone Landmark Info city" at Sector 66 B, Mohali by M/s Sukham Infrastructures Pvt. Ltd.
M/s Sukham Infrastructures Pvt. Ltd. has applied for obtaining
environmental clearance required under EIA notification dated 14.09.2006 for
developing an Information Technology Park including SEZ namely "Yellowstone
Landmark Info city" at Sector 66 B, Mohali. The project is covered under category 8
(b) of the said notification.
The case was considered by the SEAC in its 48th meeting held
on 11.6.2011, vide Item No. 48.26 (Annexure-4 CP 89-91) and the Committee
categorized this project as category B-1 and finalized the 'Terms of Reference' for
preparation of draft rapid EIA study report. The said 'Terms of Reference' were
conveyed to the project proponent vide letter no. 27822 dated 06.07.2011.
Now, the project proponent vide letter no. SIPL/2011/199
dated 01.08.2011 has informed that earlier, the promoter company has proposal to
construct residential apartments and IT Towers on their own. Now, the project
proponent has changed the project proposal and in the revised proposal, only
residential apartments will be constructed by the promoter company having built up
area 101187.49 sq. m and the other saleable area meant for industrial plots and IT
Towers would be sold on as such basis to each purchaser and construction of the
buildings in the said plots will be done by the respective plot holders. The purchaser
who will construct buildings in the plots meant for industrial activities and IT towers
on their own, will be liable to obtain environmental clearance under EIA notification
dated 14.9.2006, in case, the built up area of the building to be constructed by
them will be more than 20,000 sq. m. The project proponent has, therefore,
requested that the project may be appraised under category 8 (a).
The case is placed before the State Expert Appraisal Committee for
consideration.
Item No. 50.15 Application for environmental clearance for Residential Group Housing Project namely “Rosewood Green Housing” to be developed by M/s Virat Infra Projects Pvt. Ltd. at Vill. Sadhe Majra, Habitpur Road, Dera Bassi, Distt. Mohali.
The earlier application submitted by the project proponent for
obtaining environmental clearance for proposed Residential Group Housing Project
namely “Rosewood Green Housing” at Vill. Sadhe Majra, Habitpur Road, Dera Bassi,
Distt. Mohali was refused by the SEIAA vide no. 37379 dated 16/11/2009 due to
following reasons:-
1. There is a rice sheller namely M/s Amrit Rice Mills falls at a distance of 290 m
against the required distance of 500 m from the proposed site of the project.
As such, the proposed site violates the siting criteria framed by the Govt. of
Punjab for establishment of residential colonies / commercial establishments
etc. vide its notification No.3/6/07/STE(4)/ 2274 dated, 25th July, 2008.
2. During 30th meeting of State Expert Appraisal Committee held on
10/10/2009, the Committee noted that a pesticide formulation unit is also
operating in the vicinity of site at a distance of 236 m which may prove
dangerous to the residents of colony. The project proponent has also
concealed the facts in the map of 500 m area from the periphery of site
submitted by it, which is a vital information for consideration of the case for
environmental clearance.
Thereafter, the project proponent has submitted afresh application for
obtaining environmental clearance required under EIA notification dated
14/9/2006 for establishment of a Residential Group Housing Project namely
“Rosewood Green Housing” in the revenue estate of Vill. Sadhe Majra,
Habitpur Road, Dera Bassi, Distt. Mohali. The project promoter is covered
under category 8 (a) of the Schedule attached to EIA notification dated
14/9/2006. The details of the project are as under:-
The plot area of the project is 3.92 acres in which 250 flats will be
constructed having builtup area of 44780 sqm.
The water requirement shall be 169 Kl/day.
There will be about 135 KLD generation of domestic effluent, which will be
treated in a STP based on activated sludge process. After treatment, the
treated sewage would be used for gardening, flushing purpose in toilets and
the remaining shall be discharged into sewer.
Solid waste @ 500 Kg/day would be generated, which will be segregated at
source. The non-biodegradable component will be sold out to the recyclers
and the remaining solid waste will be disposed off in the dumping yard of the
M.C.
The total energy requirement for the project is 2122 KW, which will be taken
from Punjab State Power Corporation Limited. The project proponent has
proposed to install 2 no. D.G. sets of capacity 750 KVA each as stand-by
arrangements.
The other details of the project have been given in the Form 1 & 1-A
submitted by the promoter.
The case of the project proponent was considered in the 38th meeting
of State Expert Appraisal Committee held on 2/4/2010, wherein, the Committee
decided that SEIAA may be requested to obtain clarification from the Chief Town
Planner, Punjab (CTP) as to whether the existence of a rice sheller at a distance of
290 m and a pesticides unit at a distance of 236 m from the site of the project had
been considered or not while preparing the Master Plan of Dera Bassi. He may also
be requested to clarify as to whether a residential project can be allowed to be
established in a mixed use area having rice sheller and pesticides unit. It was also
decided that in the meanwhile, the project proponent may be asked to supply the
following information:
1 Proof of ownership of land
2 CLU status
3 Status of construction, if any, alongwith photographs from all the four sides.
4 Site plan of the project showing the first aid room
5 Permission of CGWA for use of ground water
6 Analysis reports of ambient air quality monitoring data for one month (by collecting the samples twice a week for 24 hours at uniform intervals) from NABL/MoEF accredited lab.
7 Quantification of energy saved and renewable energy devices used and permission of PSEB for power connection.
8 Drawing showing the plumbing system for use of fresh treated and hot water.

It was also made clear to the project proponent that its application
will be treated as incomplete till the above said information is received. The
decision of the Committee was conveyed to the project proponent vide letter no.
18197 dated 13.4.2010. The project proponent vide letter no. GDR/PM/DB dated
27.5.2010 has submitted the reply.
Thereafter CTP, Punjab, Chandigarh was requested vide letter no.
27620 dated 18.6.2010 to provide the copies of notified/draft Master Plans of the
different cities of Punjab to enable the Authority to process the case on merits as
per provisions of the EIA notification.
The SEIAA/SEAC became non-functioning in the State of Punjab due
to resignation of Chairmen of Authority & Committee. Thus, the case was sent to
MoEF for further consideration. However, after constitution of SEIAA / SEAC for the
State of Punjab, Ministry of Environment & Forests, New Delhi returned the case to
the SEAC/SEIAA.
Accordingly, the case of the promoter was placed in the 43rd meeting
of the State Expert Appraisal Committee held on 19/3/2011 and Sh. Vijay Tyagi,
attended the meeting and informed that the reply of observations raised by the
Committee vide letter no. 18197 dated 13/4/2010 has already been submitted vide
letter dated 27/5/2010.
The Committee observed that documents submitted by the promoter
are required to be deliberated and decided to defer the case to the next meeting to
be held on 26/3/2011.
The case was again considered by the SEAC in its 44th meeting held
on 26.03.2011 and the Committee scrutinized the documents submitted by the
project proponent vide letter dated 27.5.2010 and it was observed that all the
documents are in order except the reply in respect of obtaining permission for CLU.
The Committee further observed that the project proponent has intimated vide the
aforesaid letter that 5% of the total construction has been completed. After detailed
deliberations in the matter, it was decided by the Committee as under:
1. The project proponent be requested not to carry out any further construction
activity at site till he obtains environmental clearance required under EIA
Notification dated 14.9.2006. The project proponent be also requested to
submit the latest photographs from all the four sides showing the status of
construction.
2. The project proponent be requested to get information regarding
classification of the area from the Department of Town & Country Planning,
Punjab, in which the site of the project is located, as per Master Plan, within
7 days.
The decision of the Committee was conveyed to the project proponent
vide letter no. 1101 dated 04.04.2011
Now, the project proponent vide letter dated 26.07.2011 has
submitted the reply in connection with letter no. 1101 dated 04.04.2011, the details
of which are as under:-

However, the project proponent has submitted a copy of letter issued by the Chief Town Planner, Punjab vide memo No. 5139 CTP (Pb) SP-46 dated 21.07.2011, addressed to the project proponent, in which it has been mentioned that in the Master Plan of Dera Bassi it is clearly written that those proposed structures, which had been sanctioned by the Competent Authority, will remain the same in the Master Plan.
3. Status of CLU Submitted a copy of letter no. 1831 dated 11.12.2006 of M.C., Dera Bassi to the effect that permission for CLU in FEZ area within M.C. limits is not required.
The case is placed before the SEAC for consideration.
Item No. 50.16: Application for obtaining Environmental Clearance for Hotel Complex namely “Curo North Square” to be developed by M/s Curo India Pvt. Ltd., at Mullanpur, Tehsil Kharar, District Ropar (Formerly known as M/s Dynamic Continental Pvt. Ltd.).
M/s Curo India Pvt. Ltd., has applied for obtaining
environmental clearance required under EIA Notification dated 14.09.2006 for
developing a Hotel Complex namely “Curo North Square" at Mullanpur, Tehsil
Kharar, District Ropar. The project is covered under category 8 (a) of the said
notification.
The case was considered by the SEAC in its 47th meeting held
on 06.05.2011 and following were present on behalf of the project promoter in the
said meeting:
1. Sh. Ritesh Narula, Deputy General Manager of the promoter company
2. Ms Shikha Gaur, Environmental Consultant, M/s Perfect Enviro Solutions (P) Ltd.
Ms Shikha Gaur, Environmental Consultant, M/s Perfect Enviro
Solutions (P) Ltd, who is the Environmental Consultant of the project proponent and
the name of his consultancy firm figures at Sr.no. 19 of the list uploaded by the
MoEF at its official website, presented the case before the SEAC as under:
About 7.888 acres of land area in the revenue estate of Village Mullanpur,
Tehsil Kharar, District Ropar will be developed as hotel complex.
The total built-up area of the project is 1,49,727.10 sq. m., as such, the
project is covered under category 8(a) of the Schedule appended to the EIA
notification dated 14.09.2006.
The total water requirement for the project will be 615 KLD, out of which 296
KLD will be met from municipal supply by installing tubewell and 319 KLD will
be met by recycling of treated wastewater.
The total wastewater generation from the proposed project will be about 364
KLD, which will be treated through a STP having capacity 440 KLD, out of
which 319 KLD of treated wastewater will be used for flushing, horticulture
and HVAC cooling and remaining will be discharged to water body.
STP shall consist of neutralization chamber for laundry waste, perforated
screen chamber, oil & grease chamber, equalization tank, attached growth
fixed film bio-reactor, secondary settling tank, online U.V. treatment, filter
press, treated effluent storage tank and sludge storage sump etc.
The sludge to be generated from STP will be used as manure in the green
area.
About 1577 kg/day solid waste will be generated from the proposed project,
which shall be treated in a mechanical composter.
The total power requirement will be 9061 KW, which will be supplied by
Punjab State Power Corporation Ltd. The project promoter has a provision to
provide 5 No. DG sets of capacity 1010 KVA each, 3 no. DG set of capacity 750
KVA each and 1 No. DG set of capacity 500 KVA as standby arrangement of
power supply.
About 254 m3 of rain water will be charged into ground by providing 8 no. rain
water harvesting pits.
The project proponent had submitted the following documents to the
SEAC during the meeting, which were taken on record:
1. Topographical map of the area showing Contour Plan.
2. Photographs showing construction.
3. 500 meter radius map of the area from periphery of project site showing various features.
4. Analysis reports of ambient air, ground water and noise levels from NABL Accredited laboratories.
The SEAC observed that the project proponent is required to submit
the certain documents/data for carrying out appraisal of the project proposal. Sh.
Ritesh Narula, Deputy General Manager of the promoter company, informed that
the said documents/data will be submitted within 20 days. The Committee agreed
to accept the request made by Sh. Ritesh Narula and decided to defer the case till
the reply of the observations of the Committee, is received. The said decision of the
Committee was conveyed to the project proponent vide letter no. 20957 dated
17.05.2011.
Now, the project proponent has submitted the reply of the
observations of the SEAC, the details of which are as under:

b) The project proponent has submitted an undertaking to the effect that at present, there is no municipal supply of water in the area and he will apply for the same as and when the municipal supply will be available.
4) An undertaking to the effect that electromagnetic flow meter shall be installed at the source of water supply and appropriate flow measuring device will be installed at the outlet of the sewerage system of the residential colony to have a check on the quantity of water supply to be provided by the Competent Authority and quantity of sewage to be generated from the colony.

As per water balance statement, in summer season about 319 KLD of treated wastewater will be generated, out of which 127 KLD will be used for flushing, 30 KLD for horticulture and 162 KLD for HVAC purposes. The project proponent has kept an option to discharge 25 KLD of treated wastewater into water body.
The water balance for in winter season about 152 KLD of treated wastewater will be generated, out of which 127 KLD will be used for flushing, 25 KLD for horticulture, 162 KLD for HVAC. The project proponent has kept an option to discharge 25 KLD of treated wastewater into water body. The sum of treated wastewater for various usages is not matching with total quantity of treated wastewater. Therefore, water balance is not in order.
As per water balance statement in
rainy season about 289 KLD of treated wastewater will be generated, out of which 127 KLD will be used for flushing, 162 KLD for HVAC purposes and 30 KLD into water body. The sum of treated wastewater for various usages is not matching with total quantity of treated wastewater. Therefore, water balance is not in order.
10) An undertaking to the effect that:
a. Run-off from the roof top will be collected and discharged into rain water harvesting system to replenish the groundwater.
b. No wastewater will be discharged into the natural drain located nearby the proposed site of the project.
c. The project land does not fall in the forest area.
d. The built-up area will not exceed 1,49,627.10 sq. m
An undertaking in this regard has been submitted.
11) NOC from the Airport Authority of the nearby Airport.
The project proponent has submitted a copy of letter dated 08.06.2011 vide which he has applied for getting NOC from the Airport Authority.
The case is placed before the SEAC for consideration.
Item No. 50.17: Application for obtaining environmental clearance for construction of 'Emerging Technologies Complex' for Sri Guru Granth Sahib World University, Fatehgarh Sahib.
M/s Sri Guru Granth Sahib World University, Fatehgarh Sahib
has applied for obtaining environmental clearance in respect of construction of
Emerging Technologies Complex at Fatehgarh Sahib. The project is covered under
category 8(a) of the Schedule appended with the EIA Notification dated 2006. The
case of the said University was considered by the SEAC in 43rd meeting held on
19.03.2011 vide item No. 43.20 (Annexure-5, CP 92-96).
Following were present on behalf of the project promoter in the said
meeting:-

2. Sh. B.D. Sharma, Asstt. Engineer
3. Sh. Gagandeep Singh, Project Engineer
Sh. Baljit Singh, Civil Engineer informed that about 20% of the total
construction of Sri Guru Granth Sahib World University, Fatehgarh Sahib has been
completed and he submitted the following documents:
1. Permission for CLU of land area measuring as 80 acres issued by Deptt. of
Town & Country Planning, Punjab vide memo no. 8990 dated 27.12.2010.
2. NOC issued by Govt. of India, Central Ground Water Authority, Ministry of
Water Sources, vide letter no. 2417 dated 21.10.2010 for abstraction of
groundwater.
3. Affidavits for:-
a) Constitution of Environment Monitoring Cell.
b) Use of ready mix concrete or use of fly ash during construction.
c) To provide wind breaking curtains and water sprinkling system to minimize dust emissions.
d) To provide adequate safety measures for the construction workers during the construction phase
4. Analysis reports of ambient air, ground water and ambient noise levels
analysed by M/s Punjab Bio-technology Incubator, Mohali.
After going through analysis report of ambient air, it has been noticed
by the Committee that the value of PM10 varies in the range of 184.23 g/m3 to
397.23 g/m3 against the prescribed standard of 100 g/m3. The value of PM2.5
varies in the range of 44.34 g/m3 to 112.78 g/m3 against the prescribed standard
of 60 g/m3. However, the other parameters are conforming to the standards laid
down by the MoEF. Furthermore, the project proponent is required to submit layout
plan and building plan duly approved by the Competent Authority.
The Committee further observed that there is a need to carry out
representative ambient air sampling of the site area at three-four locations for
atleast 7 days from the NABL accredited/MoEF approved laboratory. Sh. Baljeet
Singh, Civil Engineer informed that the said documents/data will be submitted
within one month. The Committee agreed to accept the request made by Sh.
Baljeet singh Civil Engineer and decided to defer the case till the reply of above
noted observations, is received. The decision of the Committee was conveyed to
the University vide letter no. 15431 dated 31.03.2011.
The representation made by Vice Chancellor, Sri Guru Granth Sahib
World University, Fatehgarh Sahib vide letter no. 4506 dated 22.3.2011 was
considered by the SEAC in its 44th meeting held on 26.03.2011. After detailed
deliberations on the said representation, the Committee decided to request the
project proponent to carry out representative ambient air sampling of the site area
at 3-4 locations for atleast 7 days from the NABL accredited/MoEF approved
Laboratory. Meanwhile, the project proponent also submit the layout/ building plan
duly approved by the Competent Authority of the State.
Subsequently, the University had submitted analysis reports of
ambient air got analysed by M/s AES Laboratories (P) Ltd., Noida, which reveals
that the concentration of PM10 varies in the range of 82 µg/m3 to 98 µg/m3 against
the prescribed standard of 100 µg/m3. The value of PM2.5 varies in the range of
40.34 µg/m3 to 48 µg/m3 against the prescribed standard of 60 µg/m3. Also, the
other parameters are conforming to the standards laid down by the MoEF. This
study has been conducted on 1.5.2011, 4.5.2011, 5.5.2011, 9.5.2011, 10.5.2011,
16.5.2011 and 17.5.2011.
Accordingly, the case of the University was considered by the SEAC in
its 48th meeting held on 11.6.2011 and following were present on behalf of the
University in the said meeting:
(i) Sh. Shinder Singh, Registrar
(ii) Sh. Gagandeep Singh, Project Engineer
Sh. Gagandeep Singh, Project Engineer informed that the layout plan
has been sent by the Executive Officer, Municipal Council Sirhind to Chief Town
Planner, Punjab for according approval of the same and it is expected that the
approval of the said plan will be accorded within one week by the said Authority. He
requested the Committee to grant provisional environmental clearance since the
University is to start its academic session.
The Committee informed to the Registrar of the University that
submission of layout / building plan is mandatory requirement as per Office
Memorandum dated 5.2.2008 of the MoEF, as such, without submission of
approved layout/building plan, the Committee cannot appraise the project. The
Committee further noticed that the University is required to give satisfactory reply
regarding difference between the quality of ambient air monitored at both
occasions.
The Registrar of the University informed that the approved layout
/building plan will be submitted within 7 days.
After detailed deliberations in the matter, the SEAC decided that:
(a) The University shall submit approved layout / building plan within one week.
(b) The University shall intimate the reasons of difference between the ambient
air quality monitored at both occasions.
The above said decision of the Committee was conveyed to the
University vide letter no. 27701 dated 05.07.2011.
Now, the University vide letter no. 5687 dated 21.07.2011 has
submitted the reply in connection with letter no. 27701 dated 05.07.2011, the
details of which are as under:-

Item No. 50.18 Application for obtaining Environmental Clearance for developing Commercial Complex namely „Splendor Nector' Near Tarawal Pul, Opp. Freedom Factory, Sultanwind, G.T. Road, Amritsar by M/s K.G. Infrastructure Private Ltd.
M/s K.G. Infrastructure Private Ltd. has submitted application
for obtaining environmental clearance under EIA Notification dated 14.9.2006 for
developing Commercial Complex namely „Splendor Nector' Near Tarawal Pul, Opp.
Freedom Factory, Sultanwind, G.T. Road, Amritsar .The project is covered under
category 8 (a) of the Schedule appended to the said notification. The details of the
project are as under:
The total plot area of the proposed project is 6271 Sq. m and total built up area
is 20335 Sq. m.
The site of the project falls within M.C. limits of Amritsar.
The expected cost of the project is Rs. 70 Crores.
The total water requirement for the project is 279 KLD, which will be met
through Municipal supply and borewell provision will be made for emergency
requirements. There will be requirement of 194 KLD of fresh water and 85 KLD
will be met with re-circulation of treated wastewater.
The project proponent shall install STP having capacity of 100 KLD consisting of
bar screen, equalization tank, aeration, clarifier, storage tank, pressure sand
filter, activated carbon filter and sludge drying bed.
The total wastewater generation from the proposed project will be about 95
KLD, out of which 85 KLD of treated sewage will be utilized for plantation &
cooling purpose and remaining of treated sewage will be disposed off into M.C.
sewer.
The total quantity of MSW has been estimated 230.9 kg/day, which will be
segregated and sent to centralized collection facility. The project proponent has
proposed to send bio-degradable waste for bio-composting and recyclable waste
will be given to the recyclers.
2 no. Recharging wells of capacity 39.93 m3 will be installed in the complex for
rainwater harvesting.
The total power requirement of 2000 KW will be supplied by State Electricity
Board. The project has provision to provide 3 No. DG sets of capacity 2 x 750
KVA, and 1 x 500 KVA as standby arrangement of power supply, which will be
provided with acoustic enclosures and proper foundations.
The case of the project proponent was considered by the SEAC
in its 42nd meeting held on 5.3.2011, but the project proponent vide letter dated
4/3/2011 has informed that :
(a) The case of the project was discussed in the 95th meeting of Expert Appraisal
Committee (EAC) of MoEF held on 20/1/2011 and has sent a copy of the
minutes of the said meeting.
(b) The reply of the observations raised by the EAC in the meeting held on
20/1/2011, has also been submitted.
The Committee observed that there is no mention of placing
the case before the meeting of EAC held on 20/1/2011 in the case file of the project
proponent received from MoEF. The Committee perused the copy of the minutes of
the EAC sent by the Vice President (Project) of the promoter company and
observed that the copy of the minutes does not bear the signature of the
Competent Authority.
After detailed deliberations, it was decided to get the matter
verified from the MoEF as to whether the case of the project proponent was
considered in the meeting of EAC held on 20/1/2011 and to send a verified copy of
minutes pertaining to this project at the earliest possible and to send a copy of the
reply given by the project proponent regarding the observations raised in the
meeting of EAC, if any, under intimation to the project proponent. In compliance to
the aforesaid decision, the MoEF was requested vide letter No. 12535 dated
14.3.2011 to intimate as to whether the case of the project proponent was
considered in the meeting of EAC of MoEF held on 20.1.2011 and to send a verified
copy of minutes pertaining to the project and reply submitted thereof, if any, to
enable the SEAC to proceed further in the matter.
Thereafter, MoEF vide letter No. F.No. 21-46/2010-IA.III dated
08.04.2011 has sent an extract of item no. 4.43 of the 95th meeting of EAC of
MoEF held on 18th 20th Jan, 2011 duly verified by the Competent Authority, vide
which the case of the project proponent was considered. In the said extract it has
been mentioned as under:
"During discussions, the following points emerged:
(i) Efficient water and sanitary features shall be used in the toilets.
(ii) Submit details of the water and energy conservation plan.
(iii) Submit a copy of the Landscape Plan.
(iv) Submit a copy of the parking and circulation plan separately indicating parking for multiplex, shopping complex and other activities. Also submit details of staff parking and the visitors parking and the norms adopted.
(v) Loading and unloading, areas for shopping mall and a separate entry for service areas should be planned and to submit details.
Provided the response of the project proponent to the
aforesaid observations is to the satisfaction of the committee, the
proposal may be considered for recommendation for clearance."
The project proponent vide letter dated 27.4.2011 has sent a
copy of the reply submitted to the MoEF in connection with the observations raised
by the EAC of Ministry of Environment & Forests in the 95th meeting .
The case was considered by the SEAC in its 47th meeting held
on 6.5.2011 and noted that:
1. The project promoter has not submitted in detail as to which type of efficient
water and sanitary fixtures will be used in the toilets to conserve the water
and no quantification of water to be conserved by adopting the said fixtures
has been made.
2. No quantification of water and energy has been made in the water and
energy conservation plan.
3. The documents submitted by the project promoter vide letter dated 27.4.2011
have not been signed by the authorized signatory.
After detailed deliberations in the matter, the SEAC decided to
convey the aforesaid observations to the project proponent. It was also decided
that the case of the project proponent may be placed in the meeting of SEAC after
the receipt of proper reply of the said observations from the project proponent. The
decision of the Committee was conveyed to the project proponent vide letter no.
20950 dated 17.5.2011.
Thereafter, the project proponent vide letter dated 23.5.2011 has
submitted the reply in connection with letter dated 17.5.2011 containing the
following details:
1. Type of efficient water and sanitary fixtures proposed to be installed
2. Water & Energy conservation plan
3. A copy of the documents submitted by the project proponent vide letter
dated 27.4.2011 duly signed by the authorized signatory.
The project proponent was requested vide letter no.22930 dated
1.6.2011 to attend the 48th meeting of SEAC on 11.6.2011 to present the reply of
the observations. Following were present on behalf of the project promoter in the
said meeting:
1. Sh. Sajan, Vice President Projects of the promoter Company
2. Sh. A.K. Gupta, Director of M/s Shri Env. Tech.
Sh. A.K. Gupta, Director of M/s Shri Enviro Technology
Institute, who is the Environmental Consultant of the project proponent and the
name of his consultancy firm figures at Sr. no. 132 of the list uploaded by the MoEF
at its official website, presented the reply of the observations as under:
1. Following water conservation sanitary fixtures shall be used:
a) Flushing fixtures operating on infrared sensors shall be used for
urinals/WC's
b) Wash basin fixtures operating with battery/electricity based sensors
shall be used.
2. Water conservation plan includes:
a) Water demand meters shall be installed to monitor daily consumption
and regulate water flows to each area.
b) Rainwater shall be collected in soak wells to charge the groundwater
by means of rainwater harvesting system.
c) Drip irrigation system shall be used for the plants and lawns.
d) The recycled treated sewage from Sewage Treatment Plant (STP)
shall be used into flushing / horticulture / cooling tower make up. The
quantity of recycled treated sewage shall be approx. 90 KLD.
3. A copy of letter no. 1390 dated 26.11.2009 of M.C., Amritsar in which it has
been mentioned that the project proponent is yet to obtain CLU and the case
regarding fee for CLU is sub-judice in the Hon'ble Punjab & Haryana High
Court.
The Committee further noted that the project proponent has not
submitted permission for CLU, permission of M.C. Amritsar for discharge of treated
wastewater into sewer and permission from CGWA for abstraction of groundwater,
which are required for appraisal of the project. The Committee, therefore, decided
to defer the case till the project proponent submits the aforesaid information/data.
The said decision was conveyed to the project proponent vide letter no. 27702
dated 5.7.2011.
Now, the project proponent vide letter dated 14.7.20111 has
submitted the reply in connection with letter no. 27702 dated 5.7.2011 of the SEAC,
the details of which are as under:-

c) That before the final decision of CLU fee, the project proponent will not occupy/operate the building in any manner.
2. Permission of M.C. Amritsar for discharge of treated wastewater into sewer
Necessary proportionate charges amounting to Rs.10,43,130/- on account of water and sewerage connection have been deposited with M.C. Amritsar on 26.11.2009 before the release of sanction plan. Since proportionate water connection charges have been deposited with M.C., Amritsar, which implies that the supply of water will be made available by Municipal Corporation, Amritsar.
3. Permission from CGWA for abstraction of groundwater
Applied to CGWA on 16.06.2011 for getting permission for abstraction of groundwater.
The case is placed before the SEAC for consideration.

Item No. 47.05. Application for grant of environmental clearance for Group Housing Project namely “Cooperative Housing Complex Pocket-I” at Sector 79 of Mohali by M/s HOUSEFED, Punjab.
The case of the project proponent was considered by the SEAC
in its 43rd meeting of SEAC held on 19.3.2011.The project proponent was requested
vide letter dated 31.3.2011 to attend the 43rd meeting of SEAC on 19.03.2011 to
make presentation on the project proposal.
The following were present in the 43rd meeting held on
19.3.2011, following were present:
1. Sh. Arun Vesudev, Sub-Divisional Officer, HOUSEFED, Kapurthala.
2. Sh. Rajinder Singh, Sub-Divisional Officer, HOUSEFED, Kapurthala.
3. Sh. A.K. Ummat, Environmental Consultant, CPTL Enviro-Tech, Chandigarh.
4. Sh. Sital Singh, Environmental Consultant, CPTL Enviro-Tech, Chandigarh.
The consultant of the project proponent presented the case before
the Committee as under:
1. M/s HOUSEFED, Punjab has proposal to develop a Group Housing Project
namely “Cooperative Housing Complex Pocket-I” at Sector 79 of Mohali
2. The project promoter is covered under category 8 (a) of the Schedule
appended to EIA notification dated 14/9/2006.
3. The total plot area of the proposed project is 22961.89 sq. m and total built
up area is 30080.08 Sq. m.
4. The site of the project falls within M.C. limits Mohali.
5. The expected cost of the project is Rs. 44 Crores.
6. The total water requirement for the project is 130 KLD, out of which 87 KLD
will be met by through 2 no. tube-wells and remaining 43 KLD will be met
through recycling of treated waste water.
7. The total wastewater generation from the proposed project will be about 104
KLD, out of which 43 KLD of treated waste water will be reused for flushing
purpose, 5 KLD will be used for irrigation of parks and remaining 56 KLD will
be discharged into sewer.
8. The project proponent proposed to set up a STP having capacity 150 KLD.
STP will be consisting of bar screen, grit chamber, aeration tank, clarifier,
treated effluent storage tank, pressure sand filter and activated carbon filter
to treat the wastewater.
9. The project proponent has proposed to install recharging wells designed
according to peak rainfall. However, the capacity of recharging wells has not
been mentioned.
10. The total quantity of MSW has been estimated 384 kg/day, which will be
segregated at the source. The project proponent has proposed to supply the
bio-degradable solid waste to piggeries and poultry farms. Recyclable would
be sold to the authorized recyclers.
11. The total power requirement is 1350 KW will be supplied by Punjab State
Power Corporation Limited. The promoter has made provision to provide DG
sets of required capacity, which will be provided with acoustic enclosures.
The committee observed that the project proponent is required to
submit certain documents/data for carrying out appraisal of the project proposal.
Sh. Arun Vasudeva, Sub-Divisional Officer, HOUSEFED, Punjab,
Kapurthala, informed that the said documents/data will be submitted within 7 days.
The Committee agreed to accept the request made by Sh. Arun Vasudeva and
decided to defer the case till the reply of the observations mentioned in the agenda,
is received. The decision of the Committee was conveyed to the project proponent
vide letter no. 15441 dated 31.03.2011.
Now, the project proponent has submitted the reply of the
observations raised by the Committee in its meeting held on 19.3.2011, as under:

13. The disposal of municipal solid waste as mentioned in the application form to supply the same to the piggeries and poultry farms is not in order, as such the promoter is required to submit complete scheme for collection, segregation, transportation, treatment & disposal etc.
The solid waste shall be segregated at the source and the same will be sent to earmarked site of GMADA.

Item No. 47.06. Application for grant of environmental clearance for Group Housing Project namely “Cooperative Housing Complex Pocket-II” at Sector 79 of Mohali by M/s HOUSEFED, Punjab.
The case of the project proponent was considered by the SEAC
in its 43rd meeting of SEAC held on 19.3.2011.The project proponent was requested
vide letter No. 817 dated 31.3.2011 to attend the 43rd meeting of SEAC on
19.03.2011 to make presentation on the project proposal.
The following were present in the 43rd meeting held on
19.3.2011, following were present:
1. Sh. Arun Vesudev, Sub-Divisional Officer, HOUSEFED, Kapurthala.
2. Sh. Rajinder Singh, Sub-Divisional Officer, HOUSEFED, Kapurthala.
3. Sh. A.K. Ummat, Environmental Consultant, CPTL Enviro-Tech, Chandigarh.
4. Sh. Sital Singh, Environmental Consultant, CPTL Enviro-Tech, Chandigarh.
The consultant of the project proponent presented the case before
the Committee as under:
1. The HOUSEFED, Punjab has proposal to develop a Residential Colony
namely „Cooperative Housing Complex Pocket-II‟ at Sector-79, Mohali.
2. The project promoter is covered under category 8 (a) of the Schedule
appended to EIA notification dated 14/9/2006 since the builtup area
of the residential colony is 33266 sqm, which was mentioned as
330432.24 sqm inadvertently in the application form.
3. The total area of the proposed site is 22326.52 sqm
4. The total cost of the project is Rs.47.50 crores.
5. The proposed site of the project is located at Sector-79, Mohali.
6. Two tubewells will be installed to meet with the requirement of water
supply, out of which 1 tubewell will be operated at a time and other
will be kept as standby arrangement. An underground storage
reservoir of 300 KLD capacity will be constructed and it has been
estimated that there will be about 297 KLD of water consumption for
domestic purposes, out of which 198 KLD will be met from tubewell
and remaining 99 KLD will be met out of treated wastewater.
7. There will be generation of about 237 KLD of domestic effluent, which will be treated in a STP having capacity 250 KLD, out of which 99 KLD will be used for flushing purpose, 5 KLD for irrigation of parks and remaining 133 KLD will be discharged into sewer. The STP shall consist of primary, secondary and tertiary treatment facilities. The treated wastewater will be reused in flushing and green area. Water balance diagram for rainy and non-rainy season submitted.
8 There will be about 880 Kg/day of municipal solid waste generation, which will be segregated at source by providing different type of bins bio-degrable waste will supply to piggeries & poultry farm. Recyclable waste would be sold to authorized vender..
9. The project will require approx. 2840 KW of electricity, which will be supplied by Punjab State Power Corporation Limited.
10. D.G. sets will be provided with proper canopies, to supply the electricity during failure of power supply of Punjab State Power Corporation Limited.
The Committee observed that the project proponent is required to
submit the certain documents/data for carrying out appraisal of the project
proposal.
Sh. Arun Vasudeva, Sub-Divisional Officer, HOUSEFED, Punjab,
Kapurthala, informed that the said documents/data will be submitted within 7 days.
The Committee agreed to accept the request made by Sh. Arun Vasudeva and
decided to defer the case till the reply of the observations mentioned in the agenda,
is received. The decision of the Committee was conveyed to the project proponent
vide letter no. 15425 dated 31.03.2011.
Now, the project proponent has submitted the reply of the
observations raised by the Committee in its meeting held on 19.3.2011, as under:

The case of the project proponent was considered by the SEAC

vide letter No. 820 dated 15.03.2011 to attend the 43rd meeting of SEAC on
19.03.2011 to make presentation on the project proposal.
The following were present on behalf of the project promoter:-

The consultant of the project proponent presented the case before

1. M/s HOUSEFED, Punjab has proposal to develop a Group Housing Project namely “Cooperative Housing Complex” at Circular Road, Kapurthala.
2. The project promoter is covered under category 8 (a) of the Schedule appended to EIA notification dated 14/9/2006.
3. The total plot area of the proposed project is 20998.67 sq. m and total built up area is 34584.81 sq. m.
4. The site of the project falls within M.C. limits of Kapurthala in the residential zone as per the Master Plan of Kapurthala.
5. The expected cost of the project is Rs.64 Crores.
6. The total water requirement for the project is 186 KLD, out of which 109 KLD will be met by through 1 no. tube-well and remaining 54 KLD will be met through recycling of treated wastewater.
7. The total wastewater generation from the proposed project will be about 130 KLD, out of which 54 KLD of treated wastewater will be utilized for flushing purpose, 23 KLD for irrigation of parks and remaining 53 KLD will be discharged into sewer. Dual plumbing will be provided to utilize treated wastewater for flushing purpose.
8. A STP having capacity 150 KLD will be installed, consisting of bar screen, grit chamber, aeration tank, clarifier, treated effluent storage tank, pressure sand filter and activated carbon filter.
9. There will be about 484 kg/day generation of solid waste, which will be segregated at the source by providing different type of bins, which will be sent to piggeries and poultry farm.
10. The recharging wells will be designed according to peak rainfall.
11. The total power requirement is 1570 KW will be supplied by Punjab State Power Corporation and DG sets of required capacity will be installed, which will be provided with acoustic enclosures.
12. No construction will be done under HT line crossing the proposed site of the project.
13. Punjab Pollution Control Board has already granted NOC from pollution angle.
During meeting, the representative of the project proponent
submitted the building plan duly approved by the competent authority and after
meticulously perusing the same, it was noticed by the committee that the
approved building plan was not matching the un-approved building plan submitted
along the application for obtaining environmental clearance. The said approved plan
was taken back by the representative of the project proponent with the request
that the entire matter will be re-looked into.
The Committee observed that the project proponent is required to
submit certain documents/data for carrying out appraisal of the project proposal:-
Sh. Arun Vasudeva, Sub-Divisional Officer, HOUSEFED, Punjab,
Kapurthala, informed that the said documents/data will be submitted within 7 days.
The Committee agreed to accept the request made by Sh. Arun Vasudeva and
decided to defer the case till the reply of the observations mentioned in the agenda,
is received. The decision of the Committee was conveyed to the project proponent
vide letter no. 15435 dated 15.03.2011.
Now, the project proponent has submitted the reply of the
observations raised by the Committee in its meeting held on 19.3.2011, as under:

Item No. 48.26 Application for obtaining Environmental Clearance for developing an Information Technology Park including SEZ namely "Yellowstone Landmark Info city" at Sector 66 B, Mohali by M/s Sukham Infrastructures Pvt. Ltd.
The case of the project proponent was considered by the SEAC
in the 45th meeting held on 8.4.2011, which was attended by the following on
behalf of the project promoter:
1. Sh. D.C. Chopra, Chief Financial Officer of the promoter company
2. Sh. Yash Pal Jain, Environmental Consultant, M/s Ace Engineers & Consultants, Patiala.
Sh. Yash Pal Jain of M/s Ace Engineers & Consultants, Patiala
presented the case before the SEAC as under:
1. The promoter is developing an Information Technology Park including SEZ
namely "Yellowstone Landmark Info city" at Sector 66 B, Mohali, which is
covered under category 8 (b) of the Schedule appended to EIA notification
dated 14/9/2006.
2. The total plot area of the proposed project is 100.064 acres and total built
up area is 3,33,650 Sq. m.
3. The site of the project falls within M.C. limits of Mohali.
4. The expected cost of the project is Rs. 952 Crores.
5. The total water requirement for the project will be 1450 KLD, out of which
950 will be met with groundwater and balance 500 KLD will be met through
recycling of treated effluent.
6. The total wastewater generation from the proposed project will be about 910
KLD, out of which 500 KLD will be used for flushing and remaining 410 KLD
will be used for irrigation of green area to be developed in 23402.21 sq. m.
7. The project proponent shall install two identical STPs having capacity of 500
KLD each consisting of screens, collection tank, clarifier, aeration tank,
secondary clarifier, pressure sand filter ozonation process & sludge drying
beds.
8. The total quantity of MSW has been estimated as 3000 kg/day, which will be
collected separately as recyclable and non- recyclable at primary source. The
recyclable material will be directly sent for the respective processing
industries and the other component will be sent to composting section.
9. The total power requirement will be 17 MW, which will be supplied by Punjab
State Power Corporation Ltd. The project promoter has made provision to
provide 3 number of DG sets of capacity 1000 KVA each as standby
arrangement of power supply.
The Committee observed that the project proponent is required to
submit certain documents/data for carrying out appraisal of the project proposal.
The consultant of the promoter company informed that the said documents/data
will be submitted within 10 days. The committee agreed to accept the request
made by consultant of the project promoter and decided to defer the case till the
reply of the above noted observations, is received. Accordingly, the decision of the
SEAC was conveyed to the project proponent vide letter no. 17112 dated
19.4.2011.
Now, the project proponent vide the letter dated 10.5.2011 has
submitted the reply, the details of which are as under;

Item No. 43.20 Application for grant of environmental clearance for construction of emerging technologies complex for Sri Guru Granth Sahib World University, Fatehgarh Sahib.
M/s Sri Guru Granth Sahib World University, Fatehgarh Sahib
has applied for obtaining environmental clearance in respect of construction of
Emerging Technologies Complex at Fatehgarh Sahib. The project is covered under
category 8(a) of the Schedule appended with the EIA Notification dated 2006. The
detail of the project is as under:-
The built up area of the project is 29,162 sqm.
The expected cost of the project is Rs. 43.52 crores.
The site falls under the jurisdiction of Municipal Council, Fatehgarh Sahib
opposite to the Gurudwara Jyoti Sarup Sahib on Fatehgarh Sahib-Chandigarh
main road.
The nearest Railway Station of Sirhind is situated at approximately 3 km.
from the proposed site.
The ground water will be drawn through borewell to meet the water
requirement.
The sewage treatment plant will be arranged for the treatment of
wastewater to be generated from the complex and 90% of the treated water
will be used for agricultural purposes and green belt etc.
Suitable RWH pits will be proposed for the project.
The solid waste to be generated from the proposed project will be
segregated. The recyclable waste will be sold to the recyclers and organic
waste will be subjected to vermi-composting.
2 no. DG sets of capacity 125 KVA and 325 KVA will be installed as back up
during power failure.
After scrutiny, the certain incompletions were observed in the
application of the promoter, which were conveyed to the promoter vide letter no.
33657 dated 13/10/2009. The project proponent vide letter no. 1800 dated
5/11/2009 has submitted the reply / documents with regard to incompletions.
The case of the project proponent was considered in the 33rd meeting
of SEAC held on 28.11.2008 and it was observed by the Committee that Sh. R.K.
Gupta, Project Engineer, Sh. Harivansh Gupta, Chief Engineer (Retd.), Sh. Dipanjeet
Singh A.E., (Electrical) and Sh. Baljeet Singh, J.E. of the project proponent attended
the meeting of Committee and presented the case. After detailed deliberations on
the presentation made by the representatives of the project proponent, the
Committee decided that the case of the project proponent will be considered only
after he submits the requisite documents / data in view of the incompletions
mentioned in the agenda of the meeting displayed on web site
www.seiaapunjab.co.in. Further, since notification no. GSR.826(E) dated
16/11/2009 issued by Ministry of Environment & Forests, Govt. of India, New Delhi
regarding National Ambient Air Quality Standard came into force w.e.f. 16/11/2009,
therefore, the project proponent was asked to get the Ambient Air Quality
Monitoring done for one month period (twice a week 24 hourly at uniform intervals)
from the NABL / MoEF accredited lab for all pollutants mentioned in the said
notification and submit analysis report. Till then, the case of the project proponent
will be considered as incomplete.
Accordingly, the project proponent was requested vide letter no.
41237 dated 16.12.2009 to submit one month fresh data for ambient air quality
monitoring (twice a week 24 hourly at uniform intervals) from the NABL / MoEF
accredited lab for all pollutants mentioned in the said notification as well as
incompletions mentioned in the agenda of 33rd meeting of Committee displayed on
web site www.seiaapunjab.co.in. The project proponent was also informed that
case will be considered only after the receipt of said information / document. Till
then, the case of the project proponent will be considered as incomplete.
The project proponent vide letter no. 1999 dated 12.3.210 has
intimated as under :-
1. CLU status The case has been referred to the Secretary, Housing and urban Development, Deptt. Punjab that license permission fee is not applicable as per the notification no. 17/17/01-5Hg2/327 dated 11/1/2008 and notification no. 17/17/01-5Hg2/7639 dated 19/9/2007. 2. Approved Layout plan and Building plan from Competent Authority.
The building plans were submitted to M.C., Sirhind on 29/6/2009 for approval. M.C. Sirhind has confirmed vide their letter dated 9/2/2010 that the approval of building plans is under process in their office. Photostat copy of letter of M.C., Sirhind is enclosed for reference.

The project proponent vide its letter dated 11.5.2010 has submitted affidavit and photographs as required at Sr. No. 5 mentioned above and regarding all other points has not submitted any documents and only mentioned that they are perusing the case with the concerned authorities / departments. The project proponent is mentioning again and again the persuasion made with the other departments to obtain the desired information / documents but it has failed to submit the final documents.
The SEIAA/SEAC became non-functioning in the State of Punjab due
to resignation of Chairmen of Authority & Committee. Thus, the case was sent to
MoEF for further consideration. Now, SEIAA / SEAC for the State has been
constituted and the file has been returned by the MoEF to the SEAC/SEIAA.
Thereafter, the project proponent vide letter no. 3444 dated
12.8.2010 has submitted the reply directly to MoEF, New Delhi.
The proposal was considered in the 93rd meeting of EAC held on 9-
10th November, 2010 and it was decided by the Committee to defer the project,
since the project proponent did not attend the meeting.
The decision of the EAC was conveyed to the project proponent by
the MoEF vide letter no. SEAC-184/2010-IA.III dated 26.11.2010 and advised to
send a request to the MoEF, New Delhi and circulate the documents to all the
members of the committee.
Thereafter, the project proponent vide letter dated 8th December,
2010 has submitted the reply to the above mentioned letter of MoEF by submitting
NOC of CGWA, affidavit, analysis reports of ambient air & ambient noise & ground
water quality.
The case is placed before the SEAC for consideration.
