Each unit within Safe Storage (“Safe”), 2783 East 12th Street, Oakland, California, is rented according to the terms and conditions of the Rental Agreement which you have signed with us. The unit you have rented is expressly for the storage of non-hazardous, non-flammable items. (Hazardous and Flammable items are strictly “prohibited items”). Besides being expressly prohibited under the Rental Agreement terms and conditions, your storage of such prohibited items immediately invalidates any express or implied representation from Safe that your stored items will be maintained in a reasonably safe and secure condition. Moreover, besides being solely for the month-to-month storage of items (not constituting prohibited items as noted above), each unit within Safe is not intended for nor is to be utilized for storage of any type of food, perishable or otherwise. Expressly disallowed without Safe’s prior knowledge and express agreement is the conduct of any type of activity or active use (whether commercial or non-commercial) within each unit whereby it is utilized for, without limitation, the manufacture, repair, restoration, or other modification of the items stored within the unit or of any other items brought within such unit, even if only temporarily. Any such activity or active use done with Safe’s prior knowledge and express agreement shall be considered to be a “conditionally permitted usage.” In conjunction with this, the use of any sort of electrical power within each unit, other than the electrical lighting provided by Safe, must be conditionally permitted usage with the requisite prior knowledge and agreement of Safe. Even if such use of power is adapted and constitutes a conditionally permitted usage, as above, Safe expressly disavows and disclaims that any conditionally permitted usage of a unit shall otherwise be and remain suitable for the use to which it is being put as a conditionally permitted usage, and such disavowal and disclaimer shall apply to any cause, accidental or otherwise, leading to any harm, disruption, or permanent stoppage of such conditionally permitted usage within each rented unit, including any harm or death, accidental or not, to the person or persons engaged in such conditionally permitted usage within the unit, or to other persons allowed by them into the unit.

THIS IS AN AMENDMENT TO THE LEASE BY AND BETWEEN YOU, THE CUSTOMER, AND SAFE STORAGE MANAGEMENT COMPANY (SSMCO).

This storage facility provides you with a basic level of service pursuant to the terms and conditions of the Rental Agreement that you signed. Among other things, the Rental Agreement states:

Your property is stored at your sole risk of loss or damage. The self storage operator is not liable for loss of or damage to your stored property. You must insure your property while it is on the premises.

In consideration of payment of monthly rent, Safe Protect assumes liability for loss of or damage to Customer’s property stored within the storage units identified in the Rental Agreement you signed, up to the amount initialed below for losses caused by the following: ● Roof Leak/Water Damage ● Fire ● Explosion ● Collapse of Building ● Theft or Vandalism (requires visible, forcible signs of damage to the unit) ● Windstorm ● Smoke ● Impact of Aircraft, Missile or Vehicle ● Vermin & Insects Damage (only up to $300) SAFE PROTECT PROVIDES AN ASSUMPTION OF LIABILITY THAT IS A MODIFICATION TO THE RELEASE OF LIABILITY LANGUAGE IN PARAGRAPH 4, “RELEASE OF SSMCO'S LIABILITY” OF THE RENTAL AGREEMENT. THIS SAFE PROTECT ALSO SATISFIES THE PROTECTION REQUIREMENT STATED IN PARAGRAPH 5, “PROTECTION.” SAFE STORAGE HAS NO LIABILITY FOR LOSS OF OR DAMAGE TO CUSTOMER'S STORED PROPERTY BEYOND THAT DESCRIBED IN THIS ADDENDUM.

Liability Not Assumed by Safe Storage

Safe Storage will not pay for damage to Customer’s stored property caused by the following: ● Flood ● War or Military Action ● Surface Water ● Earthquake* ● Underground Water ● Volcanic Eruption ● Mold, Mildew or Rot ● Radiation ● Nuclear Reaction ● Biological or Chemical Contamination

* Including resulting leakage from systems damaged by earthquake Property that Safe Storage Will Not Repair or Replace

Property that we will not pay to have repaired or replaced or pay for if lost or damaged is as follows: ● Motor Vehicles, Boats or Other Property stored outdoors ● Money or Any Other Type of Securities or Currency ● Jewelry or Furs ● Antiques, Art and Photos ● Food ● Animals ● Tires ● Stolen Goods or Contraband When Making a Claim

Customer will perform the following actions: ● Allow Safe Storage to inspect unit and goods ● Allow Safe Storage to take photos of unit and goods ● Fill out Customer’s Report of Loss form

● File Police Report, if items lost by theft Failure to Pay Rent

If rent is not received within FIFTEEN (15) days of the due date, Customer’s participation in Safe Protect shall terminate and Safe Storage shall not be liable for loss of or damage to Customer’s stored property from any cause whatsoever. At Safe Storage’s sole discretion, Customer’s participation in Safe Protect may be reinstated upon payment of all rent and other charges due and owing. Safe Protect will pay the lesser of the actual amount you pay to repair the lost or damaged item(s) or to replace them with property of similar quality. In no event will Safe Protect pay more than the amount initialed above. The Rental Agreement
