    ry Giving BackFor the third consecutive year, the Sarasota Association

    of Realtors is helping a deserving local family achieve the dream of homeownership through the efforts of Sarasota Habitat for Humanity.

    This year, the Habitat home under construction from the ground up is located at 1353 21st Street in Sarasota. Lillian Sanders is purchasing the home through Habitat, and she and her four children have contributed hundreds of hours of volunteer time to the project to make the dream come true.

    My mother Ruby was the second homeowner in Lime Lake, which is the first subdivision Habitat for Humanity built in Sarasota, so I spent my teenage years in a Habitat home, explained Lillian. My children - Michael, who is 18, Mekayla, 13, Solace, 10 and Myla, 5, are all looking forward to our new home!

    Lillian noted Myla, who attends Children First on Orange Avenue, has even planned to grow sweet potatoes and strawberries in her own garden in the back yard (She just loves sweet potato fries!).

    Michael attended Booker High School and is an aspiring chef who plans to enroll in a culinary arts program. Mekayla is an eighth grader at Booker Middle School in the advanced drama class of the Visual Performing Arts Program.

    Mekayla is an A/B student who has been in advanced work classes since 1st grade at Gocio Elementary. She loves acting but is torn between becoming an actress or a pediatrician. Lately she has talked about a possible career in emergency medicine.

    Solace is a fifth grader at Gocio Elementary and also in advanced work classes since 1st grade. He is very tech savvy and is intrigued with all forms of science, especially the solar system.

    We sincerely appreciate the contributions SAR and your members have made to this project, said Lillian. It has been a dream of mine for so long to have a safe, comfortable home for my family, and its finally coming true!

    SAR contributed $25,000 to the project from the Associations Realtor Affordable Housing Fund, administered by the Sarasota County Community Foundation. The funds primarily helped to build a nice fence around the property, and also assisted in purchase of home-building materials.

    More than 20 SAR members have participated in several Team Build work dates, enjoying fun and beneficial mornings of construction, camaraderie and good will.

    But service to the Sarasota community is nothing new to SAR members, who have been giving back since the organizations founding in 1923, 90 years ago.

    Examples are evident throughout the years - from

    fundraisers for important community causes, to efforts of support after hurricanes and other community disasters; from painting projects to beach cleanups. In the April 1970 SAR newsletter, it was pointed out that dozens of members at that time were serving on city and county boards, committees and advisory groups, as well as being active participants in community service organizations.

    In 1969, the board initiated the Make America Better Property Improvement Awards, which began to recognize the many positive achievements of real estate professionals in the Sarasota community.

    The compassionate history of local SAR members is deeply rooted in community service and the spirit of giving back.

    Not too many people are aware that the Realtor Affordable Housing Fund was created in 2003 - a decade ago - after then-SAR President Darla Furst attended a 2012 NAR conference in New Orleans.

    Darla took part in a roundtable discussion of association presidents and president-elects. One of the topics that came up was how some associations across the nation set up foundations to fund various community projects. They saw the obvious value in neighbor helping neighbor, and also the benefit of promoting the positive efforts of Realtors, which too often go unnoticed and unsung.

    In January 2003, Darla introduced this concept to the SAR Community Outreach Committee during a planning meeting, and soon after, a Foundation Task Force was formed to explore the feasibility of the idea.

    The group met with the SAR Board, and together they came up with three goals: fund the home improvement projects that the Community Outreach Committee was conducting every year; help fund other affordable housing projects in the community; and promote community

    The Sarasota Association of Realtors and Sarasota Habitat for Humanity will stage a Garden Party on Saturday, Nov. 16th from 7:30 to 11:30 a.m. at this years Team Build project site, 1353 21st Street in Sarasota.

    Landscaping will be the project for the day, with new sod, plantings, pavers and much more going in to the big fenced backyard at the home site. The weather will be cooler, so get on your gardening clothes (dont forget your gloves!) and come out to help on this worthy cause!

The project is moving along quickly, and SAR members have helped in all aspects of the home, from preparing the foundation, to building and raising the walls, exterior painting, breaking up the old sidewalk for replacement, building the fence, and much more.

    SAR also contributed $25,000 to the project, which allowed Habitat to purchase additional materials, and plan for and purchase the fencing.

    This year, new Habitat homeowner Lillian Sanders and her family will be able to purchase the home from Habitat and move in to their brand new abode!

    Health care reform myth busted: No home lienA false Facebook post is making the rounds claiming that if

    you dont pay the penalty for not buying health insurance, the IRS can file a lien against your home.

    The health care reform law requires individuals who dont meet one of the laws exemptions to buy an insurance plan that meets minimum requirements or face a penalty. The law set up online state insurance exchanges to simplify cost comparisons among plans and to make purchasing a plan easy. Open enrollment for these insurance plans on the online exchanges began Oct. 1 and runs through March 2014.

    Those who choose to have no insurance at all by the open-enrollment deadline will be penalized $95 or 1 percent of their income (whichever is greater). That penalty will go up to $695 or 2.5 percent of income in 2016.

    However, it is not true that the IRS can file a lien against your home for failing to pay the penalty.

    Though the IRS does have authority to garnish wages and file liens to collect unpaid taxes, the Affordable Care Act explicitly prohibits it from using such measures to collect health-insurance penalties, according to Kaiser Health News, an independent nonprofit news organization dedicated to covering U.S. health policy.

    Instead, the IRS will withhold the penalty from your tax return, Kaiser Health News reports.

    Another myth has been the alleged 3.8 percent levy on certain investment income. The levy on certain investment income was included in healthcare legislation two years ago, and now misinformation about the taxs application to home sales is being passed along over the Internet and e-mail, throwing some prospective home sellers into a panic. In actuality, very few owners will be affected by the new tax taking effect in 2013.

    The tax will only be on investment income of upper income taxpayers. Included in the definition of investment income is capital gains from home sales above a certain amount and for households whose income is above a certain amount.

    This means individuals who make $200,000 a year or more, or married couples who earn at least $250,000 a year are affected. Additionally, the tax is only applied to home sales if the proceeds exceed $250,000 for an individual, or $500,000 for married couples. And there still are other income and tax particulars that are considered before the 3.8 percent tax is triggered.

    NAR has put together a comprehensive article concerning the health care reform and its potential impacts on the real estate community. The article appears in Realtor Magazine Online (realtormag.realtor.org)

    One important point from the article - if youre an independent contractor, as most real estate practitioners are, the most important thing for you to know right now is that a six-month period, called the state exchange open enrollment

    period, begins Oct. 1 to make buying that coverage as easy as possible.

    The open enrollment period is when the new state insurance exchanges are open for business, enabling you to use these online marketplaces to shop for and buy your coverage and, if youre eligible, receive a premium credit to help you reduce the cost.

    November brings us Thanksgiving, plenty of sales and hopefully, cooler weather. It also brings us Veterans Day, a good day in which to put the price we pay for our right to freedom in the context of the much greater sacrifices made by men and women who have put themselves in harms way to secure that right.

    As residents of the State of Florida and Sarasota County we can feel pride in the services our tax dollars fund for veterans, members of the military, and their families as well as the property tax reductions available to disabled veterans and deployed service members.

    In Sarasota County, for the 2013 tax year, over 3,200 qualified deployed service members and disabled veterans or their surviving spouses applied for and received tax exemptions and discounts on their propertys assessed value.

    - 942 homesteaded veterans rated totally and permanently disabled by the Veterans Administration received a total exemption from ad valorem property taxes.

    - 2,345 veterans rated from 10% to 99% disabled by the Veterans Administration received a $5,000 ad valorem tax exemption in addition to their homestead exemption.

    Within that group of 2,345 veterans, 78 disabled veterans who are 65 years of age or older and whose disability ratings are wholly or in part combat related are also benefiting from an assessed value discount equal to the amount of their disability rating.

    And 6 active duty service members who were deployed overseas during 2012 received a discount on their property taxes equal to the percentage of the number of days in the year in which they were deployed.

    By the end of the month we will be gathering with our loved ones to give thanks for the many blessings in our lives. Perhaps Thanksgiving is a good time to reflect and thank over 3,200 of our neighbors for the sacrifices they have made and the price they have paid to help protect the rights, privileges and blessings we all enjoy.

    Statutes Governing Veterans Exemptions and Discounts

    196.081 Exemption for Certain permanently and totally disabled veterans and for surviving spouses of veterans. - Any real estate that is owned and used as a homestead by a veteran who was honorably discharged with a service-connected total and permanent disability is exempt from taxation if the veteran is a permanent resident of this state on January 1 of the tax year for which exemption is being claimed or was a permanent resident of this state on January 1 of the year the veteran died.

    196.082 Discounts for disabled veterans. Each veteran who is age 65 or older and is partially or totally permanently disabled shall receive a discount from the amount of the ad valorem tax on homestead property that the veteran owns and resides in if the disability is combat related, and the veteran was honorably discharged. The discount is equal to the percentage of the veterans disability rating

    196.173 Exemption for deployed service members. The exemption is available to service members who were deployed during the preceding calendar year on active duty outside the continental United States, Alaska, or Hawaii in support of certain military operations.

    196.24 Exemption for disabled ex-service member or surviving spouse. A $5,000 exemption is available to any ex-service member who is a resident of the state, was honorably discharged is disabled to a degree of 10% or more.

  • PSeptember 2013 Sales Up 22.5 Percent Over Last YearProperty sales in September 2013 in Sarasota County hit

    817 (545 single family homes, 272 condos), 22.5 percent higher than in September 2012. However, the total sales figure was down 14.6 percent from August 2013, when 957 sales were closed, mirroring a similar late summer drop last September.

    Last year, the fourth quarter saw stronger sales than typical for the fall months, and strong pending sales point to a similar pattern this year. Overall, September pending sales (properties that went under contract during the month) were at 750 close to the September 2012 figure of 734. In August 2013, pending sales stood at 864.

    The median sale price for single family homes in the county in September 2013 was $185,902, 18.5 percent higher than the September 2012 median price of $157,000. The figure was 5.1 percent lower than Augusts number of $195,000. Condo prices were at $165,000, up 6.4 percent over last Septembers median of $155,000, and slightly higher than the August 2013 figure of $161,000.

    Monthly median prices are susceptible to swings based on sales at one end of the price spectrum. The median price for the 12 months ending in September 2013 for single family homes was $179,000, up 21.7 percent from the 12-month median ending in September 2012 ($147,000). For condominiums, the figure was $160,000 this September, compared to $147,000 a year ago an 8 percent increase. The overall price trend continues to move upward.

    With sales remaining at high levels, and prices trending higher, we continue to be optimistic about the Sarasota real estate market, said SAR President Roger Piro. Interest rates have been up and down in recent months, but still at relatively low levels, which helps the market. The economy has been hindered by the recent government shutdown, but through that period our market has remained steady and strong.

    The inventory of listed properties rose slightly in September to 3,942 from last months 3,793 but remains below last Septembers number of 4,097 active listings in the Sarasota County. The inventory has been relatively steady in recent months after falling substantially in the last two years.

    The September 2013 months of inventory in Sarasota County stood at 4.4 months for single family and 4.0 months for condos, with both property categories below 6 months, which is considered a balanced market between buyers and sellers. Months of inventory represents the time it would take to deplete the current inventory at the current sales rate. Last

    September there were 4.2 months of inventory for single family homes and 5.5 months of inventory for condos. In August 2013, the figures were 4.2 and 4.0, respectively.

    Currently, 569 properties listed for sale in Sarasota County in the MLS are short sales or foreclosures, compared to 499 properties in August. This represents 14.4 percent of available properties, up from last months figure of 13.2 percent. Of the 1,100 new listings on the market, about 15 percent were distressed in October, which contributed to the percentage increase.

    Sales of distressed properties represented 23.9 percent of the overall sales in September 2013, up from the August 2013 figure of 20.6 percent. In September 2012, the figure was 37.1 percent, so the trend overall is downward despite the recent increase.

    If we have our traditional pattern of increased sales in October through the end of the year, the Sarasota real estate industry should remain on course for an excellent year, said Piro. Local agents are busy and enthusiastic, and buyers are certainly benefiting from the high-quality of properties in our market.

    With sales remaining at high levels, and prices trending higher, we continue to be optimistic about the Sarasota real estate market.

    Editors Note: This year, SARs focus is on Raising the Bar and improving the professionalism of our members. We will be providing monthly educational columns to promote the importance of NARs Code of Ethics to our members.

    Case #6-5: Advertising Real Estate-Related Products and Services

    Realtor X, a principal broker in the firm XY&Z, prided himself on his state of the art website that he used both to publicize his firm and to serve the firms clients and customers electronically. Realtor X maintained positive business relationships with providers of real estate-related products and services including financial institutions, title insurance companies, home inspectors, mortgage brokers, insurance agencies, appraisers, exterminators, decorators, landscapers, moving companies, and others. Given the volume of business Realtor Xs firm handled, several of these companies advertised on the XY&Z home page and some of them, including a large bank, included links to their own websites.

    Buyer B, who had earlier entered into an exclusive buyer representation agreement with XY&Z, received frequent, automated reports from Realtor X about new properties coming onto the market. Hoping to purchase a home in the near future, he took advantage of Realtor Xs rich website to familiarize himself with the real estate-related products and services advertised there.

    Hoping to expedite his purchase experience by pre-qualifying for a mortgage loan, Buyer B went to Realtor Xs website and clicked on the bank link. Once at the banks website, he found a mortgage to his liking, completed the on-line application process, and learned in a matter of days that he was qualified for a mortgage loan.

    In the meantime, Buyer Bs property search, guided both by Realtor X personally and through periodic updates from Realtor Xs website, proved fruitful. Realtor X and Buyer B visited a new listing on Hickory Street several times.

    Buyer B decided it met his needs and made an offer which was accepted by the seller.

    A few weeks after the closing, Buyer B hosted a housewarming attended by his friend D, a website designer who had, coincidentally, been instrumental in developing Realtor Xs website. Buyer B told D how helpful the information from Realtor Xs website had been. You know, dont you, that each time a visitor to Realtor Xs website clicks on some of those links, Realtor X is paid a fee?, asked D. I didnt know that, said Buyer B, I thought the links were to products and services Realtor X was recommending.

    Buyer B filed an ethics complaint against Realtor X alleging a violation of Article 6 for having recommended real estate products and services without disclosing the financial benefit or fee that Realtor X would receive for making the recommendation.

    At the hearing, Realtor X defended himself and his website, indicating that the advertisements for real estate-related products and services on his website were simply that, advertisements, and not recommendations or endorsements.

    He acknowledged that he collected a fee each time a visitor to his website clicked on certain links, regardless of whether the visitor chose to do business with the linked to entity or not. In some instances I do recommend products and services to clients and to customers. In some instances I receive a financial benefit; in others I dont.

    But in any instance where I recommend a real estate-related product or service, I go out of my way to make it absolutely clear I am making a recommendation, and I spell out the basis for my recommendation. I also disclose, as required by the Code, the financial benefit or fee that I might receive.

    Those advertisements on my website are simply that, advertisements, no different than classified ads run in the local newspaper.

    The hearing panel agreed with Realtor Xs rationale, concluding that the mere presence of real estate-related advertisements on Realtor Xs website did not constitute a recommendation or endorsement of those products or services, and that the click through fee that Realtor X earned when visitors to his website linked to certain advertisers sites was not the type of financial benefit or fee that must be disclosed under Article 6.

    Realtor not in violation of Article 6

    Article 6Realtors shall not accept any commission, rebate, or profit on expenditures made for their client, without the clients knowledge and consent.When recommending real estate products or services (e.g., homeowners insurance, warranty programs, mortgage financing, title insurance, etc.), Realtors shall disclose to the client or customer to whom the recommendation is made any financial benefits or fees, other than real estate referral fees, the Realtor or Realtors firm may receive as a direct result of such recommendation.

    The 2013 Sarasota International Conference attracted a large group of participants from SARs Global Business Council and from other state and national real estate associations. The keynote speaker was Florida Realtors President Dean Asher, who updated those in attendance concerning his recent trip to the SIMA conference in Madrid, Spain.     The Global Business Council cordially invites its members to a Holiday Networking Reception on Wednesday, Dec. 4 from 5 to 7:30 p.m. at SAR, 2320 Cattlemen Rd. Good food, wine and beer, and networking!

    The GBC has grown by over 80 new members in 2013. There is no cost for GBC members to attend. If a GBC member would like to bring a guest or a spouse, the cost is $10.

    SARs brand-new, state-of-the-art facility is the perfect regional location for you to complete your education. SAR has never cancelled a GRI course (except when Hurricane Charlie forced a postponement in 2004).

    GRI 100 Series earns 45 hours of Salesmans Post-license credit & 14 hours of CE credit. GRI 200 & 300 Series earn 30 hours of Broker Post-License credit and 11 hours of CE credit each.
