The Scheme of Conversion fromLease Hold System of Land Tenure
into Free Holdln pursuance of orders issued by Govt. of lndia, Delhi
Development Authority has decided to convert Shops as well as
Commercial/lndustrial Built up plots irrespective of the size in Delhi
from lease hold to free hold on payment of conversion charges. The
prescribed conversion charges are applicable upto 31,03.2004
SALIENT FEATURES OFTHE SCHEME
1 , The scheme covers the following properties:-
a) All built up Commercial/lndustriat/DDAbuilt up Shops inctuding
Commercial Flats where the lease has been granted on behalf
of the President of lndia/Delhi DevelopmentAuthority.
2. The one time charges payable for conversion from leasehold to
freehold are set out in Annexure- "A" read with Annexure-,,B,,
These charges are to be paid in lump sum.
Original lessees/sublessees (wherever the words suilessees
appears it is applicable only in case of plots allotted frrough
Cooperative Industrial Societies),/allottees would be entifled to 40%
remission in the conversion charges as specified inAnnexure-?"
3. Conversion would be allowed onlywhen the Commercial/lndustrial
building on the plot has been constructed and Completion
Certificate/D Form forthe Building has been obtained.
4. The application for conversion shall not be entertained unless
accompanied by prescribed documents,
5. The arrears of Ground Rent alongwith interest @llYoperannumwherever applicable would have to be paid by the applicant before
conversion can be permitted. ln case where revision of Ground
Rent has become due, the revised amount of rent will be notified to
the lessee for depositing the amount before the execution of the
Conveyance Deed.
6. fhe conversion shall be applicable only for properties which are on
land for which the land use prescribed in the Lease Deed/
Sub-Lease Deed/Allotment Letter is Commercial/lndustrial as the
case may be.
7. ln cases on mortgaged properties, conversion would be allowed
only on submission of 'No Objection Certiflcate(s)' from all the
.+nortgagees. lf the property has been mortgaged more than once,
'No Objection Certificate' from all the mortgagees are required
to besubmitted.

8. ln cases where a lease deed has not been signed, conversion wibe arowed provided that the non-execution ofthe rease deed har
been on account of adminishative reasons and not because o
certain defaurts on the part of the aflottees. However in such cases
the stamp duty wourd be payabre on the amount of conversion
charges and the surcharge wherever applicable as well as theprice/premium of the property.
. 9" ln c1se. of ,any telBt dispute getqting to tiile of the property,
conversion shall not be allowed until the legal dispute is setfled.
10' (i) conversion wiil be ailowed onry when ail dues incruding charges
towards Misuse, Damage, Ground Rent, service/rtlaintenance chargesetc. havebeen paid bytheapplicantin respectofthepropefi.
10. (ii) in case of re-entered properties conversion wourd be alrowed
only when re-entry notice has been withdrawn and the Lease /Sublease /Allotment restored.
10. (iii) Forthe purpose of conversion, misuse charges would be livableupto the date of apprication of conversion even after which actionagainst misuse wourd continue to be taken by the respective locarbodies under the byelaws / regulations.
10' (iv) conversion to freehord sha, not be permitted in respect ofproperties involving encroachment on governmenUpublic land.The lessee would have to vacate the encroached land beforeconsideration of the conversion application and shall also beliable to payment of occupation charges for the part period as pernormal rules.
11. ln case of any dispute between the original lesseeisub_
Iessee/allottee and power ofAttorney holder, application for grant offreehold rights wourd be entertained onry after the dispute is set ed.
12. ln case where applications for mutation or substitution are pending
with the lessor, conversion would be allowed only after thenecessary mutation/substitution has been canied out.
1 3' The conversion shail arso be ailowed in the cases where ressee/sub-
lessee/allottee has parted with the possession of the property,
provided that:
a) Application for conversion is made by a person holding power ofattorney from lessee/sub-lessee/allottee to alienate(sell/hansfer) the propefi.
b) Proof is given of possession of the property in favour of theperson in whose name conversion is being sought.

Where there are successive powerof attorneys, conversion will
be allowed after verifying the factum of possession provided
that the linkage of original lessee/sub-lessee/allottee with the
last power of attorney is established and attested copies of
powerof attorneys are submitted,
ln such cases, a surcharge of 33-1130/o on the conversion fee
would be payable over and above the normal conversion charges
applicable for a regular lessee (no unearned increase will be
recoverable).
14. ln case of the DDAShops ailotted on instailment basis, conversion
shall be allowed only after all the installments have be paid with
interest, if any.
1 5. The scheme of Conversion is optional.
16 (i) The conversion rates for commercial/indushial plots and DDA
built up shops have been given in Annexure A'. The zone_
wise/location-wise rates are given in Annexure 'B'. The
localities for which land rates have not been given in Annexure 'B',
the rates of the adjoinlng/comparable localitywould be applicable.
1 6. (ii) A remission of 40% on the conversion charges will be allowed in
case of conversion in favour of original lessees,
17. Model calculations of conversion charges and surcharge have
been inAnnexure'C'
18. The requisite conversion charges and surcharge as applicable
alongwith processing fee of Rs. 500i- are required to be deposited
atthetime of submission of applicationsform.
19. Mode of remittance shall be preferable by pay Order, Bank Draft
payable at Delhi. For amounts less than Rs. 20,000L, cash will also
be accepted. The amount of remittance has to be rounded of to the
nearest rupee. The payment is to be made through the prescribed
chllan form which is a part of application and is in quadruplicate.
After depositing the application form and the conversion
charges, applicants must ensure to obtain an
acknowledgment from the bank together with a copy of the
challan to serve as proof of payment fortheirfurther reference.
The conversion charges, and surcharge wherever applicable are to
be deposited in lumpsum.
20. The original lease deed should be produced at the time of execution
of the conveyance deed. The same will be cancelled and returned
alongwith the conveyance deed.

2'1. lf the original lease deed was lost, the lessee/applicant must issue
notice In a prominent paper having circulation in the area where the
property is situated and also excute an affidavit before the 1" Class

A copy of the'publii nOtice published in the newspapers and the
original affidavit must be submitted at least 10 days before the date
of execution of the conveyance deed.

The brochure alongwith prescribed application form will be available for
sale on payment of Rs. 100/- at the following offices of the DDA.

Application Forms in three different colours have been printed in respect
of:-
(i) Commercial Plots (in Red)
(ii) lndustrialPlots (Red Printon BIue Paper)
(iii) DDABuiltup Shops including Commercial Flats (Black)
The application forms duly complete in all respects alongiwth
prescribed conversion and other charges may be deposited at the
Vikas Sadan (DDA Head Office, Near INA Market), Branches of either
the Central Bank of lndia or the State Bank of lndia.
lf any application is found incomplete or defective in any manner, the
applicant shall be given an opportunity to furnish the prescribed
documents not enclosed to the applicant and to remove the defects
within a period f 30 days. 0n the failure of the applicant to remove the
defects within the period specified, the application shall be deemed to
have been rejected. Applications found in order will be disposed of
within a maximum period of 90 days from the date on which the
prescribed formalities are completed. Conveyance Deed shall be sent

lfthere is only one ailottee/subressee/ressee ofthe propertysought
to be converted into freehord, his name and other particurars shourd
be given in sub-corumn (a). rf there are two ailottees/sub-ressees/
lessees, the names and other particulars should be given
separately in sub.column (a) & (b). lf there are more than two
lbssees/silb:lessees/allott6e, a sepdra'te sheet be attached giving
the required particulars.
Column2
lf the application is submitted by an attorney dury authorised to seek
sale permission, execute the Sale Deed and get it registered on
behalf of the lessee/subressee/ailottee, his particurars shourd be
given in the column. However, ,1,'column also shall be filled up in
such cases. lf there are successive power of Attorneys, the
application shall be entertained onry form the rastAttorney provided
that attested copies of ail the power of Attorneys estabrishing the

Column4
Under sub-column (ii), some authentic document viz attested
Photostat copy of Ration Card, passport, and Driving Licence etc
should be submitted in proof of possession with the person named
in column 3. Under sub-column (iii), attested true copy of
Agreement to sellorany otherauthentic document showing that the
person named in column 3 has already agreed to purchase the
property is required to be submitted.
Column 5
Files number is given on the communication sent to the ressee/sub-
lessee/allottee bythe DDAand can betaken from there.
Column 18
It is necessary to pay up to date Ground Rent, alongwith simple
interest @ 10% per annum for arrears, if any, before applying for
conversion. ln cases of plots allotted by co-operative lndustrial
Societies, conversion shall be allowed only after the society has
paid upto-date Ground Rent alongwith interest on arrears, if any.
Proof of payment of Ground Rent by the Society to DDA as well as
proof of payment made in respect of individual plot is required to be
submitted alongwith the application.
Column 19
The applicant is required to assess the conversion charges
carefully on the basis of the formula and the notified land
rates, applicable in respect of plots/shops as given in Annexure
A'and'B'
Column20
Surcharge is required to be paid in the cases where the application
is submitted by the Attorney of the lessee/sublessee / allottee and
conversion is sought in favour of a person other than the allottee /Iessee / sublessee. fhe amount of surcharge is ffih % of the
prescribed conversion charges.
