By Tom Carothers Sports Editor Once again showing its penchant for a nice rally, the Glencoe-Silver Lake girls’ basketball team battled back from an early 9-0 deficit to defeat host Litchfield 50-42 on Thursday, Feb. 4. The Panthers were in danger of trail- ing by double digits less than four min- utes into the game as the Dragons took full advantage of some early GSL mop- pishness. “We just made bad decisions at the start of the game,” coach Zach Otto- Fisher said. “We had three turnovers on our first four possessions and then we’re chasing their shooters around. It was just jitters. They came out really wanting to kick our butt and we weren’t quite ready for it at the start.” However, the visitors were quick to turn the tide on their hosts, using a suf- focating defensive press to squelch the Dragon fire and climbed back into the contest. “It was phenomenal,” Otto-Fisher said of his team’s press. “We didn’t really do anything special, either. Just forced them to make bad passes. That got us back in the game.” GSL knotted the score at 22-all late in the half before taking their first lead at 25-24 on a buzzer-beating three-pointer from guard Maddie Monahan. The second half played out early on as a back-and-forth affair, with neither team mustering up anything more than a single-possession edge as Litchfield’s superior inside play fought for suprema- cy against GSL’s exceptional perimeter game. “They’d get a bucket, we’d get a bucket. Neither team could really pull ahead,” Otto-Fisher said. It wasn’t until a 10-0 Panther run turned a 40-39 deficit with five minutes, 40 seconds to play into a 49-40 lead with 26 seconds remaining. A game that had been entirely up for grabs was sud- denly firmly in Panther control. GSL was able to kill off large swaths of time late in the contest before emerg- ing with the eight-point victory. The win secured a regular-season sweep of Litch- field as well as giving the Panthers an 11-9 overall record with a 5-3 mark in Wright County Conference West play. “It was just a good, tough Wright County Conference game,” Otto-Fisher said. Maddie Monahan and fellow guard Mac Monahan shared team high scoring honors with 14 points apiece; Maddie Monahan logged seven steals, four re- bounds and three assists, while Mac Monahan had two steals and a pair of re- bounds. Guard Miranda Grack tallied eight points with two assists and an equal number of boards, forwards Sam Voigt and Maddy Kalenberg had six and four points, respectively. Kalenberg also recorded five rebounds with two assists. “Sam made some great adjustments out there and had a strong second half after picking up two quick fouls in the first half,” Otto-Fisher said. “She got some really big buckets for us when we needed it.” GSL returned home for a WCC West matchup against Watertown-Mayer on Tuesday, Feb. 9, after the Chronicle went to press. It wasn’t GSL’s highest score of the season, but it was the team’s first victory of the winter and it came one week before the sectionals, which are scheduled to take place at the K&G Center in Mankato Friday evening. Marissa Greeley and Gia Venier finished second and third, respectively, in the indi- vidual all-around competi- tion. Greeley recorded a 31.325. She won the vault competi- tion with an 8.65, and fin- ished second in the uneven bars (6.95), floor exercise (8.175) and balance beam (7.55). Venier placed third on floor with an 8.025 and fifth on bars with a 6.475. Ellie Schmidt was third on vault (8.425), fourth on floor (7.6) and fifth on beam (7.0); Alexis Bergstrom placed fourth on bars with a 6.475. Canby took a prompt 18-0 lead via a trio of forfeits to begin the competition. Kole Polzin, at 126 pounds, logged the Panthers’ first points by pinning Nolan Fink in one minute, 11 seconds. A Canby win by fall and another forfeit gave the hosts a 30-6 edge before back-to- back major decisions by Alex Mielke and Aaron Donnay. Mielke scored a 14-5 win over Konnor King at 145, Donnay topped Billy Deslau- riers 12-2 at 152. GSL/LP pulled to within 30-20 after Dylan Melchert pinned Preston Snobl at 2:21 of their match at 160 before Canby claimed another win by fall at 170. The Panthers put them- selves in position to earn a come-from-behind victory with three-straight wins from Dalton Kosek, Nick Brelje and Tristan Weber. Kosek was a 5-2 winner over Noah Schott at 182, Brelje won by forfeit at 195 and Weber defeated Evan Stoks 9-2 at 220. However, Canby tallied a decisive win by fall at 285 to finalize the 10-point victory. GSL/LP begins competition in the Section 2AA Tourna- ment this week. The ninth-seeded Panthers open against No. 8 Waterville-Elysian-Morris- town/Janesville-Waldorf- Pemberton at 6 p.m. Thursday at Waconia. An opening-round win ad- vances the Panthers to an im- mediate quarterfinal matchup against top-seeded Waconia. Sectional semifinal and final matchups are on Satur- day at Hutchinson. Once again showing its penchant for anice rally, the Glencoe-Silver Lake girls’basketball team battled back from anearly 9-0 deficit to defeat host Litchfield50-42 on Thursday, Feb. 4.

With the Section 2A meeton deck this Friday, it was agood time for the Glencoe-Silver Lake gymnastics teamto receive a morale boost.

City Engineer Justin Black brieflyreviewed the 2016 Armstrong Av-enue Street and Utility ImprovementsProject.

Discussion was held on several as-pects of the project including streetsmileage affected, need for a detouron Highway 22 for 3 weeks, tempo-rary road to be built west of the MNDot/Street Department facility to ac-commodate Seneca Foods accessneeds, concerns of Councilor Robeckregarding drainage and costs.

Councilor Perschau then intro-duced the following resolution ap-proving the plans and specificationsand ordering the advertisement forbid and setting the bid opening dateof March 3, 2016 at 10:00 a.m.:

FOR BIDSWHEREAS, pursuant to a resolu-

tion passed by the council on No-vember 2, 2015, the consulting engi-neer retained for the purpose has pre-pared plans and specifications for theconstruction of the Armstrong Av-enue Improvements Project, andhas presented such plans and specifi-cations to the council for approval;

NOW THEREFORE, BE IT RE-SOLVED BY THE CITY COUNCILOF GLENCOE, MINNESOTA:

Such plans and specifications, acopy of which is attached hereto andmade a part hereof, are hereby ap-proved.

The City Administrator shall pre-pare and cause to be inserted in theofficial paper an advertisement forbids upon the making of such im-provement under such approvedplans and specifications. The adver-tisement shall be published as re-quired by law, shall specify the workto be done, and shall state that bidswill be received by the City Adminis-trator until 10:00 a.m. on Thursday,March 3, 2016, at which time theywill be publicly opened in the coun-cil chambers of the Glencoe CityHall by the City Administrator andengineer, will then be tabulated, andwill be considered by the council at7:00 p.m. on Monday, March 7,2016, in the council chambers of theGlencoe City Hall. Any bidder whoseresponsibility is questioned duringconsideration of the bid will be givenan opportunity to address the councilon the issue of responsibility. Councilor Ziemer seconded themotion. Upon a roll call vote mem-bers present voting in favor Schrupp,Ziemer and Perschau. MemberRobeck voted no. Whereupon saidresolution was adopted and ap-proved.

Public Works Director Schreifelsmade the council aware that the cur-rent informational system at theWWTP is Data View and WTP usesAccess. The Data View system is nolonger supported and the Access sys-tem is limited in what it can and can-not do and this system has been out-grown for what is needed.

recommending Houston Engineering.Scope of work in the proposal in-cludes procurement and softwaresetup, data review and GIS schemachanges, general GIS consulting andknowledge transfer and GIS develop-ment and scripting for a fee not toexceed $10,080.

Discussion and questions led to amotion by Councilor Perschau ap-proving the proposal of Houston En-gineering for Glencoe GIS consultingand development in the amount notto exceed $10,080. CouncilorSchrupp seconded. Members presentvoting in favor were Schrupp,Ziemer and Perschau. MemberRobeck voted no. Motion carried.

Public Works Director Schreifelspresented the request of the WTP fora new 2016 Chevy Silverado 25004WD regular cab truck with utilitybox to replace the 1998 ¾ ton truckand utility box. As quoted byHarpel’s the cost would be $47,254.The 1998 would be sold at auction byFahey. This is a budgeted item.

Discussion led to a motion to ap-prove the purchase of the truck as re-quested and quoted for $47,254 byCouncilor Ziemer, second by Coun-cilor Robeck. All members presentvoted in favor.

Public Works Director Schreifelsrequested for Public Works the pur-chase of a new 2016 Chevy Silvera-do 4 WD crew cab truck to replacethe 2008 Chevy Colorado. The Col-orado would go to the Fire Chief andthe current Fire Department truckwould go to Fahey to be sold at auc-tion. Crew cab is being requested asit would hold more employees fortraveling to training and conferences.

As quoted by Harpel’s the costwould be $37,488. This is not a bud-geted item. Cost of the vehicle wouldcome out of the WWTP and WTPcash operating.

Motion by Councilor Perschau ap-proving the purchase of a truck as re-quested from Harpel’s for $37,488.Councilor Schrupp seconded. Allmembers present voted in favor.

Councilor Ziemer informed thecouncil of the City Center Board’smotion to disband. They are recom-mending that the council take controlof the board’s duties.

Mayor Wilson recommendedtabling this request to discuss furtherat a Personnel or Finance Committeemeeting. He feels the input fromother residents is beneficial.

Motion to table was made byCouncilor Robeck and seconded byCouncilor Schrupp. Members votingin favor, Robeck, Schrupp andZiemer. Perschau voted no. Motioncarried.

City Administrator Mark Larsonpresented the Waiver of Tort Limitsfor the League of Minnesota CitiesInsurance Trust liability insurance.The City must decide whether or notto waive the statutory tort liabilitylimits to the extent of the coveragepurchased. It is recommended towaive the limits and accept the limitsof $2 million with the LMCIT.

Councilor Ziemer motioned to ap-prove the waiver of statutory liabilitylimits on municipal tort liability es-tablished by Minnesota Statutes, Sec-tion 466.04 to the extent of the limitsof the liability coverage obtainedfrom LMCIT and purchase excessthe liability coverage. CouncilorSchrupp seconded the motion withall members present voting in favor.Motion carried.

The Planning Commission recom-mended the adoption of Right-of-Way and Undergrounding Ordinance.This has been prepared jointly by theCity of Glencoe, Light and PowerCommission and drafted by AttorneyMike Gavin. This ordinance is need-ed to administer and regulate thepublic rights-of-way in the public in-terest, and to provide for issuanceand regulation of right-of-way per-mits. This will help address unrea-sonable delays for City infrastructureprojects.

Motion by Councilor Schrupp toapprove the first reading adopting theRight-of-Way and Underground Util-ity Ordinance 591. Councilor Ziemerseconded the motion. Upon a roll callvote all members present voted infavor.

Public Works Director Schreifelsreviewed the memorandum regardingRulemaking Petition to MPCA asprepared by Flaherty & Hood. Asstated in the memorandum, theCoalition of Greater MN Cities andMN Environmental Science and Eco-nomic Review Board at their respec-tive Fall membership meetings au-thorized filing a petition for rulemak-ing with the MPCA seeking to havethe MPCA amend its newly adoptedriverine standards based upon thepost-rulemaking identification ofnew evidence, which demonstratessuch rules have relied upon two fac-tors for purposes of identifying nutri-ent impairment not accepted by thescientific community or U.S. EPA foruse for such purposes. As a result,the current MPCA riverine standardsrule is significantly flawed, and thedesire at this time is to present suchinformation to the MPCA in the formof a petition for rule amendments sothat the MPCA can take appropriatesteps necessary to correct therule.The following resolution was ap-prove and introduced by CouncilorSchrupp:

TO FILE APETITION ON ITS BEHALF FORAMENDMENT TO MINNESOTARULES 7050.0150, .0220, AND.0222 TO THE MINNESOTA POL-LUTIONCONTROL AGENCYAND THE MINNESOTA OFFICEOF ADMINISTRATIVE HEAR-INGS PURSUANT TO MINNESO-TA STATUTES, SECTION 14.091

WHEREAS, the Minnesota Pollu-tion Control Agency (herein“MPCA” or the “Agency”) adoptedcertain new and revised water qualitystandards and criteria for rivers andstreams under Minn. R. 7050.0150,

.0220, and .0222 (herein the “riverinestandards”) on June 24, 2014; and

WHEREAS, the riverine standardsrely in part on scientifically unsup-ported applications of (1) a test usedto determine biochemical oxygen de-mand (BOD) in water bodies over afive day period (BOD5), and (2) ameasurement of dissolved oxygenvariation (DO flux) in water bodies,to determine whether a measuredbody is impaired because of nutrientgrowth, and thus whether a violationof the riverine standards has oc-curred; and

WHEREAS, the City owns andoperates a wastewater treatment fa-cility that is regulated by the MPCAand subject to National PollutionDischarge Elimination System Per-mit No. MN0022233, which expireson 3/31/13, the terms and conditionsof which will likely be influenced byMPCA’s application of the riverinestandards; and

WHEREAS, significant new evi-dence has come to light since theMPCA formally adopted the riverinestandards on June 24, 2014 (as listedin Paragraph 2 below) which demon-strates that neither BOD5 nor DOflux are reliable indicators of nutrientimpairment; and

WHEREAS, Minn. Stat. § 14.091,subd. (a) authorizes the elected gov-erning body of a city, county or sani-tary district to petition for amend-ment or repeal of a rule or a specifiedportion of a rule by submitting awritten petition to the agency and tothe Office of Administrative Hear-ings (OAH) when “significant newevidence relating to the need for orreasonableness of the rule” has be-come available since the adoption ofthe rule in question; and

WHEREAS, on the basis of thesignificant new evidence listed inParagraph 2 below, the City wishesto petition the MPCA and OAH foramendment of the riverine standardsto correct their unsupported applica-tions of BOD5 and DO flux to deter-mine whether a measured body is im-paired because of nutrient growth,and thus whether a violation of theriverine standards has occurred.

NOW, THEREFORE, BE IT RE-SOLVED BY THE MAYOR ANDCITY COUNCIL THAT:

Pursuant to Minn. Stat. § 14.091,the City Council hereby approves thefiling of a petition on its behalf, inform and substance consistent withthe attached Appendix A (the “Peti-tion”), requesting amendments toMinn. R. 7050.0150, .0220, and.0222 on the basis of significant newevidence relating to the reasonable-ness of these rules discovered afterthe MPCA adopted amendmentsthereto to impose water quality stan-dards and criteria for rivers andstreams on June 24, 2014.

The significant new evidenceupon which the Petition is based in-cludes the following:

A Freedom of Information Act re-quest from Hall & Associates to EPAfor public records regarding the useof the BOD5 test as a valid nutrientimpairment indicator dated Novem-ber 6, 2014 and EPA’s responsethereto dated December 5, 2014, inwhich EPA conceded that it possess-es no documentation supporting theuse of the BOD5 test as a proper nu-trient response criterion. (Exhibit 7to the Petition.)

A memorandum published on No-vember 19, 2014 by Andrew Eaton,of the Joint Editorial Board of theStandard Methods for the Examina-tion of Water and Wastewater, the ex-pert that EPA relies upon for propertest development and usage (see 40C.F.R. § 136.3) and the entity thatdeveloped the BOD5 test, clarifyingthat BOD5 should not be used as aparameter to evaluate the presence ofa nutrient impairment. (Exhibit 8 tothe Petition.)

A Freedom of Information Act re-quest from Hall & Associates to EPAfor public records indicating that DOflux, by itself, causes aquatic life im-pairment, dated July 31, 2014, EPA’sresponse thereto dated September 12,2014, and follow up correspondence,in which EPA affirmed that it pos-sesses no documentation supportingthe use of DO flux as an aquatic lifeimpairment parameter. (Exhibit 9 tothe Petition.)

Excerpts from the Minnesota En-vironmental Science and EconomicReview Board’s Motion to Supple-ment the Administrative Record, De-cember 5, 2014, in Minnesota Courtof Appeals Case No. A14-1694 (870N.W.2d 97), and MPCA’s Responseto Petition to Supplement the Record,December 11, 2014, in which MPCAadmitted that it possesses no infor-mation indicating that it ever request-ed any of the expert peer reviewerstasked with reviewing its riverinestandards to specifically address theBOD5 and DO flux issues. (Exhibit10 to the Petition.)

The City retains and authorizesthe law firm of Flaherty & Hood,P.A. to submit the Petition on theCity’s behalf and thereafter to repre-sent the City in all subsequent pro-ceedings administered by the MPCAand/or OAH concerning the Petition.

Second by Councilor Robeck.Upon roll call vote all membersvoted in favor. Whereupon said reso-lution was adopted and approved.

Justin Black of SEH presentedproject details for an improved outletto the east. Approximately 5,000 feetof pipe placed approximately 9 to 14feet deep. This project includes theupgrading to a 72 inch pipe under therailroad crossing. Options being ex-plored are 30 inch pipe system for anestimated cost of $900,000 or 36 inchpipe system for an estimated$1,005,000. Benefits derived fromthis drainage improvement are an im-proved emergency outlet for thecity’s north central ponds, improvedoutlet for future expansion of theschool, improved drainage for thelandowners upstream of the railroadcrossing and construction of stormsewer outlet for City/County Morn-ingside Avenue Project.

Cost of project will be incurred byCity, County and School District.

Mayor Wilson gave a report on theEDC Committee meeting held withSenator Newman and RepresentativeGruenhagen. Topics of concern andimportance discussed were LGA,state general tax for businesses,

school funding, health care givers2% to state and Morningside Avenueproject.

Public Works Director GarySchreifels presented the 2015 Inflowand Infiltration report documentingthe completed totals as requiredunder the City’s I & I Reduction Pro-gram.

I & I investigations were conduct-ed on all foreclosure and for saleproperties, with the intention to makesure all new property owners have acompliant sanitary sewer lateral be-fore taking ownership.

60 properties had improvementsor replacements completed for a totalcost of $117,664. Average improve-ment cost was $1,961. Televising ofsewer mains and laterals was con-ducted on 5,690 feet for a total of$2,503.

95 residents participated in therain barrel program for a cost of$2,581.

13 sanitary man holes were re-paired at a cost of $29,215. Newcamera, sewer plugs cost of $9,420.

2015 Street Project -30 blocks:Sanitary pipe 11,872 ft cost of$467,000; storm pipe -6960 ft at$251,000 and CIPP – 7667 ft at$329,000

Sanitary sewer cleaning – 8699feet- at a cost of $16,442.

Total cost for I & I reduction for2015: $1,224,825.

CITY BILLS: Member Perschaumotioned to approve payment of thecity bills. Member Schrupp second-ed. All members present voted infavor.

Notice is hereby given that the Municipal Light & Power Plant, Glen-coe, MN, hereinafter referred to as the Owner, will receive sealed Bidsat their offices at 305 11th Street East, Glencoe, MN until 2:00 pm on

the 25th day of February 2016, and will publicly open and read aloudsuch Bids on the following work and equipment: “Municipal Electri-

cal Plant, Glencoe, MN.”

This project involves interior demolition and remodeling of the existingoffice area of approximately 2,000 Sf including selective demolition ofexisting walls, doors/frames, suspended ceilings and related mechani-cal/electrical services. New construction includes; stud walls, SPF in-sulation, aluminum door/frame, suspended acoustical ceilings, finish-es and HVAC/electrical systems.

A single prime contract will be received for general, Mechanical/elec-trical Labor and Materials.

Proposals shall be properly endorsed and delivered in an envelopemarked, “Municipal Electrical Plant” and shall be addressed to DavidMeyer, General Manager, 305 11th Street East, Glencoe, MN.

All proposals shall be submitted in duplicate on the Bidders’ own let-terhead in facsimile of the Proposal Form enclosed in the Specifica-tions, or by utilizing the Proposal Form enclosed with the Specifica-tions by typing the official name of the Bidder at the top of the form.

Each proposal shall be accompanied by a Bid Bond, cash deposit,cashier’s check or certified check made payable to Municipal Electri-cal Plant, Glencoe, Minnesota, in the amount of five per cent (5%) ofthe Bid, as a guarantee that the Bidder will enter into the proposedContract and provide a Performance and Payment Bond after his Bidshall have been accepted.

The successful Bidder shall furnish a Performance and PaymentBond in an amount equal to one hundred per cent (100%) of the Con-tract price to the Owner prior to the approval of the Contract.

No Bidder may withdraw his Bid or Proposal for a Period of thirty (30)days after date of opening of Bids. At the aforementioned time andplace, or at such later time and place as the Owner then may fix, theOwner will act upon Proposals received and with its sole discretionmay award Contract for the furnishing of said labor and equipment.

The Work shall be started within ten (10) days after award of Contract.

sponded to a report of a personwalking in the area of Highway 7and Ulm Avenue, west of Hutchin-son.

3:07 a.m. — A suspicious per-son was reported in the area ofHighway 7 and Highway 22, westof Hutchinson. A respondingdeputy was unable to find any-one.

9:37 a.m. — The sheriff’s of-fice, Hutchinson First Respondersand Allina Ambulance respondedto a medical on 230th Street,northeast of Hutchinson. A personwas taken by ambulance to theHutchinson hospital.

Two single-vehicle acci-dents were reported in SibleyCounty over the weekend.

According to the SibleyCounty Sheriff’s Office, thefirst occurred Saturday, Feb.6, at about 8:43 p.m., when apassenger car driven byKayle Seeman, 20, of Arling-ton, was southbound onCounty State Aid Highway(CSAH) 17. The vehicle lostcontrol on the snow and ice,entered the south ditch justwest of 387th Avenue, startedto roll, and came to rest onthe passenger side door.

Seeman was taken by am-bulance to the Sibley MedicalCenter for treatment of possi-

ble crash-related injuries.On Sunday, Feb. 7, at

10:28 a.m., Dylan KennethSkorczewski of Gibbon wastraveling north on 561st Av-enue, five miles northeast ofWinthrop, when his FordRanger entered the westditch, went airborne for about20 yards, landed and rolled acouple of times.

No injuries were reported.The truck was totalled.

Cub Scout Pack & Boy Scout Troop 352 serve the Glencoe-Silver Lake School District

–––––––––––––––––––––––––––––––––The Cub Scout program is for Kindegarten-5th grade boys who may join at any time. Each year our pack holds a number of

events, including: Pine Wood Derby, Camp-in, Blue and Gold Ceremony, Cubmobile Run, among others. The pack also does com-munity service projects each year like holding food drives for the McLeod County Food Shelf. Dens for each age group have theirown additional activities and meetings. The highlight of the year for most boys is going to resident camp in the summer. The boyshave a ball and learn lots at the camp. They leave with great memories. Scouting has been billed as "A Game with a Purpose." Ourpack works to live up to that billing by teaching our kids great values while they're having fun.

The Boy Scout Program is for boys in 6th grade up through age 17. The program achieves the BSA's objectives of developingcharacter, citizenship, and personal fitness. Boys are trained to lead their own meetings and to plan and execute outings and activi-ties. They also actively participate with leading many activities in the Cub Scouts program. Camping is a focus and highlight for BoyScouts.
