SOFTWARE LICENSE AGREEMENTIMPORTANT: CAREFULLY READ THIS SOFTWARE LICENSE AGREEMENT (THIS gAGREEMENTh)BEFORE INSTALLING PLAYONLINE SYSTEM INFORMATION PROGRAM (THE gPRODUCTh).BY CLICKING ON THE " YES " BUTTON, YOU ARE HEREBY AUTHORIZED TO INSTALL THEPRODUCT IN YOUR PERSONAL COMPUTER, AND TO USE THE PRODUCT IN ACCORDANCE WITH THETERMS AND CONDITIONS HEREOF. IF YOU DO NOT AGREE WITH THIS AGREEMENT, CLICK ONTHE " NO " BUTTON. IF YOU CLICK ON THE " YES " BUTTON, YOU ARE DEEMED TO AGREEWITH ALL OF THE TERMS AND CONDITIONS HEREOF.LICENSE(1) All copyrights in the Product shall remain with SQUARE ENIX CO., LTD. (the"Licenser").(2) The Licenser grants you a non-exclusive license to use the Product, withouta right to sublicense the same. In no event does the Licenser sell@or transferthe Product to you.(3) You may install and use the Product on only one personal computer owned byyou (the gComputerh). You may not use the Product in any other manner, andnot for any other purposes including, without limitation, commercial use.(4) You may not decompile, disassemble, reverse engineer, or translate theProduct.NO WARRANTY(1) THE LICENSER MAKES NO WARRANTY THAT THE PRODUCT IS OPERABLE OR FUNCTIONALUNDER ANY CONDITION. THE LICENSER MAY MODIFY THE PRODUCT FROM TIME TO TIMEWITHOUT PRIOR NOTICE TO YOU.(2) THE LICENSER PROVIDES YOU WITH THE PRODUCT UPON "AS IS" BASIS FOR FREE. THELICENSER EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS, IMPLIED ORSTATUTORY FOR THE PRODUCT, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIESOF ACCURACY, PERFECTION, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ANDRELIABILITY.LIMITATION OF LIABILITY(1) THE LICENSER SHALL NOT BE LIABLE TO YOU FOR ANY DAMAGES ARISING OUT OF, ORIN CONNECTION WITH, YOUR USE OF THE PRODUCT.(2) EVEN IF THE LICENSER IS HELD LIABLE FOR THE DAMAGE UNDER THE LAWS OF JAPAN,THE LICNESERfS MAXIMUM LIABILITY TO YOU SHALL NOT EXCEED THE TOTAL AMOUNT OFDIRECT, NORMAL AND REAL DAMAGES ARISING OUT OF, OR IN CONNECTION WITH, YOUR USEOF THE PRODUCT. THE LICENSER SHALL IN NO EVENT BE LIABLE FOR ANY INDIRECT,SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, EVEN IF THE LICENSER IS AWARE OFTHE POSSIBILITY OF SUCH DAMAGES.(3) CLAUSES (1) AND (2) ABOVE SHALL NOT APPLY TO DAMAGES CAUSED BY THELICENSERfS WILLFUL CONDUCT OR GROSS NEGLIGENCE.TERMINATIONThe Licenser may terminate without prior notice to you if you fail to complywith any of the terms and conditions hereof. Upon termination, you shalluninstall the Product entirely from the Computer, and destroy all copies of theProduct, if any.MISCELLANEOUS.(1) This Agreement shall be governed by, construed, interpreted and executed inaccordance with the laws of Japan.(2) If any provision of this Agreement is held to be invalid or unenforceable,the remaining provisions shall be fully effective and enforceable.(3) The Licenser and you hereby irrevocably agree with the exclusivejurisdiction of the Tokyo District Court in connection with any proceeding, suitor action arising out of or in connection with this Agreement.
