Aggregate Limit of Liability  Any cap on coverage or a system or systems as

specied by the policy. Te cap would consist o any and all claims made in a single policy year.  Any and all limitations specied reset upon therenewal o the policy.

Claim Any time a covered ailure is reported to RWS by the Policyholder.

Non-claim  Any time an incident outside o coverage isreported to RWS by the Policyholder.

RWS  Acronym used to describe Residential Warranty Services, Inc., your home warranty provider.

Service Call FeeSimilar to a “deductible” or “Co-pay” you might beacquainted with already or other risk managementproducts, the Service Call Fee is a ee incurred by the Policyholder each time a claim is made and oreach mechanical malunction repaired under thepolicy terms.

Emergency Claim A urnace or heating system condition resulting in

no heat when outdoor temperatures reported areless than 55 °F, a sump pump malunction whena risk o water intrusion via the sump pit exists, oran active pressurized water leak where the activeleak cannot be temporarily resolved by a valve.

Non-Emergency Claim  Any claim type not specically listed in theclassication o “emergency” or “urgent” claimsdened.

Urgent ClaimNo hot water, no water or a plumbing leak thatrequires the main water valve to be shut o to

prevent damage, rerigerator not cooling, airconditioning system not cooling.

Policy Terms

Tis policy covers all items as described and excludes all others.

Call RWS at 1-800-544-8156, and report your covered issue along with the make o the covered item.Te service call ee will be due to the servicing contractor upon arrival. RWS has the right to selectthe service contractor, but the type o contractor to be dispatched is ultimately up to the Policyholder.

Listing Coverage(Seller’s Coverage)Listing coverage is or the seller o a property listed with a multiple listing system member only. Tecoverage is the same as that o the buyer’s coverage,

 with two exceptions;

1. Listing coverage does not cover pre-existingconditions or deects discovered by a property inspector.

2. Te aggregate limit o liability is $500.00.

Listing coverage is ree or up to 180 days. Uponexpiration o 180 days, coverage under the warranty or the seller o the property is void. However, the warranty will be reactivated upon transer o titleto the buyer, and the policy premium shall be paidor at closing.

Failure to pay or the policy at closing will resultin reasonable attorney’s ees to be added to thetotal due that is incurred by RWS in collectingthe warranty premiums rom the seller. In other  words, in consideration o coverage providedduring the listing period, the seller agrees topurchase a policy rom RWS or the subject policy or the buyers at closing. I you don’t plan onproviding the warranty to the buyers at the time o closing, you have the option to oer the warranty 

 without instituting the listing coverage. RWS willeven provide marketing material you can provideto prospective buyers.

Unilateral ContractTis service contract is a policy o adhesion,unilaterally presented by RWS to the policyholder.Payment or acceptance o coverage indicatesacceptance o the terms and conditions.

Additional Coverage Limits OfferedConsequential Damages- up to $50 per claim,$150 aggregate. While nearly every other home warranty policy onthe market today excludes consequential damages- we have you covered! So when a pipe leaks, a wiresparks, an oven burns, or a rerigerator spoils…make sure to submit your claim or reimbursementunder our RWS exclusive Consequential Damages

coverage.

  Access Fees- up to $50 per claim, $200aggregate.Home warranties generally exclude normal costsassociated with gaining access to home mechanicalsystems that are behind drywall, beneath concrete,or otherwise not readily accessible. RWS willautomatically pay up to $50 towards that costs onany covered claim

Aggregate Limit of Liability

 Aggregate limit or the policy is$25,000. See chart below or systemlimitations.

T he aggregate limit of liability for the buyer of 

the property for each of the home’s systems is

as follows (all totals are the gross repair costs);

HVAC $10,000.00Furnaces, air conditioners, heat pumps,

ductwork, and all other HVAC compo-

Main panels, sub panels, branch wiring, ex-haust fans, and all other electrical system

components.

Plumbing $5,000.00Supply lines, drain lines, and all other

plumbing system components with the

exception of well pump, sewage pumps,

water softeners and water heaters.

Appliances $5,000.00Refrigerators, dishwashers, ovens, stoves,

built-in microwaves, garbage disposals,

range hoods, trash compactors, washers,

and dryers.

Well Pump $500.00Well pumps, pressure tanks, all plumbing

Service Call FeeTe Service Call Fee or the Simple Warranty by RWS is $150.00. Te service call ee is thepayment the Policyholder must make to theservicing contractor on each and every claim in

accordance with this policy. RWS is responsibleor the cost o approved repairs beyond the servicecall ee, subject to the limitations o liability. A service call ee is the maximum ee a Policyholdershould expect to pay on a covered claim- NO theminimum.

  A service call ee applies to each mechanicalbreakdown, or each distinct malunction. Attimes, multiple malunctions may be discoveredin the same component. A service call ee wouldapply or each repair or the actual cost to repair, whichever is less.

Non-ClaimsIn the event o a “non-claim,” whereby a contractoris requested and the mechanical malunction iseither not covered by the policy or is not relatedto the contractor’s trade, the trip charge rom thecontractor will be payable by the Policyholder.RWS claims representatives are well-trained and  will do everything within their power to ensurethe right contractor is dispatched the rst time.However, the ultimate determination o whetherto request service and by what type o contractoris up to the Policyholder.

Making a Claim  All claim types can be made during normalbusiness hours, rom 8:00 AM to 5:00 PM, ED,by calling 1-800-544-8156. A claims processor

 will eld your call and ask you to provide contactnumbers, an email address, and a description o the problem. I the claim is not covered under the warranty policy, we will inorm you so that you donot have to pay a service call ee or a non-claim.

I the claim appears to all under the warranty coverage provided, then the claims processor willorward your claim to a contractor, who will thencall you to schedule an appointment time. RWS will make every reasonable eort to get a servicecontractor dispatched within 24 business hours o contacting RWS. Urgent claims will be processedahead o non-emergency claims.

Emergency claims will be handled 24-hours a day or Policyholders. Just call 1-800-544-8156 andollow the simple instructions provided.

Overtime feesNearly every home warranty policy chargesovertime ees. Not RWS- when you truly needservice ater hours or your Emergency claim, youpay the exact same amount as you would any othertime.

In other words, there are no overtime ees assessedby RWS or Emergency claims. I you choose tohave a Non-emergency or Urgent claim addressedoutside o normal business hours, additional eesmay apply as assessed by the contractor.

Mandatory Additional Coverages  While most policies require the purchase o coverage or multiple urnaces, water heaters, andother components- the Simple Warranty by RWS

 A service call eeapplies or eachrepair or the actualcost to repair, whichever is less.

It’s included in the policy. Te only reason we wouldn’t cover these components under the termso this contract would be because the squareootage o the covered property had been reportedto us inaccurately. Please conrm your squareootage with us by calling 1-800-544-8156. It’snot required by any means, and we do our best toensure we receive accurate inormation or billing

purposes at the time the warranty order is placed. Basis for CoverageUnless otherwise agreed to in writing, allclaims must be made between the date o policy commencement at noon and the date o expirationat midnight. Tis policy covers mechanicalbreakdowns to covered items as specied herein.Te Policyholder is entitled to service beyond thedate o the warranty’s expiration so long as theclaim has been led within the warranty period.

Te Policyholder may be oered a renewable

policy in the orm o a renewal notice in themonth preceding the expiration o their policy.Policyholders who renew their existing home warranty policy with RWS will receive a renewaldiscount o o current rates. For more inormationregarding renewal o your policy, please call RWS at

1-800-544-8156.

Tis policy covers only items as described andexcludes all others. All repairs will be made/oered in a manner determined by RWS. RWSshall have the sole option o determining in whatmanner mechanical breakdowns will be corrected.Policyholder has the option o taking a cashpayment in lieu o repair on any claim, a decision

that must be made ater diagnosis and approvalo the claim by RWS and beore any repairs havecommenced and/or parts have been ordered ontheir behal.

Tere are no optional coverages with the Simple  Warranty by RWS. In other words, your policy includes all components as listed in this policy  without paying any additional ees.

Te coverage in this policy applies only to itemsalling within the perimeter o the oundation o thehome and attached garages with the exception o air conditioning units and well pumps. Tis policy only applies to homes on permanent oundations.Each and every distinct breakdown o any part orcomponent o any covered mechanical system, asdetermined by an authorized contractor, constitutesa distinct claim or which the Policyholder will beresponsible or a service call ee or the actual cost, whichever is lower. Te service call ee is payableto the contractor at time o service unless otherwisespecied by RWS.

Do Not Call a Contractor

Before You Call RWS.RWS will not be liable or any costs associated witha contractor selected by the Policyholder withoutprior authorization. Policyholder’s contractorscontacted prior to making a claim with RWS and without prior authorization will not be considered

or servicing any claim, nor will any bill bereimbursed. RWS does not cover componentdamaged by outside contractors. Tis includesbut is not limited to scheduled maintenance orHVAC systems. Beore you have work done, callRWS to nd out i it is covered.

Contractor AvailabilityRWS will make every reasonable eort to get a

contractor dispatched within 8 hours o makingan emergency claim, within 24 hours in the case o an urgent claim, and within 48 hours or all otherclaims. During certain exceptional high volumeclaim periods, these times may be exceeded. RWSis not responsible or damage caused by delays inservice.

Should the trade o the contractor requested notbe the trade necessary to x a covered issue, it willbe treated as a “non-claim.”

More on Getting Service After-Hours  Any claim, regardless o classication, may behandled ater normal business hours based on theavailability o RWS authorized contractors. Forany claims not classied as Emergency claims,RWS shall only be liable or the standard costso repair beyond the service call ee. Hence,the Policyholder would be responsible or any overtime charges imposed by the contractor.

Emergency claims are handled per the termso this policy and with no overtime charges. Inother words, RWS covers overtime charges or

Emergency claims.

Return Service CallsI the contractor does not adequately rectiy themechanical issue reported by the Policyholder onthe rst visit, and a similar problem persists shortly ater a service call, please call RWS to inorm themo the unsatisactory repair. I the problem isrelated to inadequate repair, the contractor willcome back out to commence urther repairs atno additional cost to the Policyholder when thatcontractor is in the RWS network.

Right of the PolicyholderTe contractor selected by RWS does not haveto be the contractor to perorm the repair. Aterdiagnosis and beore any repair actions havecommenced, the Policyholder may request cashin lieu o repair or that claim. RWS is notresponsible or the work o contractors outside o our network under our “single service call ee perclaim” policy (see next section).

Single Service Call Fee per ClaimAn RWS Exclusive!RWS is not a contractor. However, all RWSnetwork contractors are screened or mandatory qualications, insurance, and reerences. MostRWS contractors have served hundreds i not overa thousand RWS claims. RWS does not guaranteethe work o our network contractors, nor do weinsure them or liabilities they may incur in thecourse o oering service. Should a Policyholderor Policyholder’s property sustain any sort o damage resultant rom the work o a contractor,the contractor should be notied immediately.RWS does, however, have a single service callee per claim policy. Should a single mechanicalmalunction result in the replacement o acomponent (i.e. a gas valve, aucet, disposal, motor,switch, relay, etc.), and that same component ailsat any time during the same policy year, it shallbe xed or replaced at no additional cost to thePolicyholder. Te circumstances under which thecomponent ailed must be covered by the warranty and RWS reserves the right to send the same

contractor to the home i the problem persistsduring the same warranty period. Furthermore,it is our policy that our contractors leave a copy o the invoice or work perormed at the warrantedproperty or any repair. Each contractor hastheir own policy on how long they guaranteetheir workmanship and parts, which may extendbeyond the term o your warranty with RWS. Callthe contractor or urther details or inquire abouttheir guarantees at the time service is perormed.

Second OpinionsRWS reserves the right to a second opinion aterthe diagnosis o a covered issue by an approvedRWS contractor, at the cost o RWS and at nourther cost to the Policyholder. In the event o an“emergency” claim as dened by the policy, i thePolicyholder incurs hotel ees as a result o RWSexercising the option to receive a second opinion  which takes more than 24 hours to complete,

RWS shall reimburse the Policyholder up to $100per night a covered claim’s decision has not beenmade.

In the case o a Policyholder opting to utilizetheir own contractor, RWS reserves the right toa second opinion ater diagnosis and estimates, atthe cost o RWS less the service call ee that appliesto that claim.

Getting ServiceGetting the contractor you want is simple with RWS.Just follow these 3 easy steps to make a claim andchoose your contractor.

Call RWS at 1-800-544-8156 to report your coveredissue along with the make o the covered item and letthe operator know that you would like to contact acontractor o your own choosing.

Call any contractor you would like, but make sure tolet them know that you are working with RWS and thatall repairs must be approved prior to commencing. Inother words, the contractor needs to deliver to RWS adetailed diagnosis including;

a. Te cause o the malunction.b. What components need repair or replacementand or what reason.c. A detailed estimate including:

i. Itemized parts list and corresponding pricesii. Te total number o hours the job will take andthe hourly rate being charged.

Call RWS with the diagnosis and estimate prior toproceeding with the repair(s). Upon approval, RWS will issue a P.O. number or the repairs listed and the

amount quoted. Te contractor will receive billinginstructions rom the RWS representative.

 While most warranty companies will only permit you to utilize the contractor o their choosing, RWS allows our Simple Warranty clients the option to utilize the contractor o their choosing. Te process or using your own contractor is as ollows;

Getting Service

RWS has the right to request multiple estimates or diagnosis at its discretion,  which may include contacting acontractor o RWS’ choosing and/or a RWS representative. RWS is notresponsible or damages caused by contractors outside o the RWS network.Policyholder assumes all responsibility 

or the actions o their own contractor.

Why would RWS approve a claimbut request a second estimate?RWS handles literally tens o thousandso home warranty claims, and whilepricing on some service calls are airly consistent in some areas, other servicecalls have large disparity in pricing. RWS

has the option to request additionalestimates and to even consult with theirown contractor where pricing exceedsRWS’ acceptable levels.

 When a claim is approved and acceptedby RWS to utilize your own contractor,RWS will automatically deduct the

service call ee rom the amount o that approved claim. You will pay the contractor directly that amount.Many contractors oer ree diagnosis/estimates, and RWS would suggest whenyou utilize your own contractor that yourequest this level o service rom thecontractor. I the contractor charges aee or a diagnosis, it will not be credited

toward the service call ee in any o theollowing situations;

a.) Te contractor’s estimate wasnot approved due to exceedingRWS’ acceptable charges.

b.) Te contractor’s diagnosis is in

error or raudulent.

c.) I another contractor completesthe work required.

CENTRAL HEATING SYSTEMCovered:  Tis policy covers heating unitsincluding orced air systems and heat pumps, heatexchangers, secondary heat exchangers, burners,elements, urnace mounted humidiers, electronicair cleaners, baseboard electric heating systems,thermostats, accessible interior gas lines, accessibleductwork, permanently mounted wall units,inaccessible ductwork (Policyholder must pay togain access), ues & vents, registers, grills, clocks.Geothermal, oil, steam, water, wood burning,coal, radiant heat and solar systems are covered with a $1500 aggregate limitation. TERMITE PROTECTION PLANCovered: Conventional chemical treatment inthe case o a new inestation.

Requirement:  Te home must have had aclear termite report within the six month periodpreceding the start o the policy.

Example of Items/ Conditions that are Not Covered:  Baiting systems, inestations resultingrom removal or non-maintenance o baiting

systems, damage caused by wood destroyinginsects, inestation in decks, encing, or any otherarea outside the perimeter o the oundation o thehome and attached garage.

OTHER COVERAGE  Also covered by this policy:  Up to $400towards any mandatory code upgrade includingthose related to changing rerigerant type in airconditioning systems. Tis shall be applied tothe aggregate limitation o the system that wasbenetted by the coverage.

CancellationRWS may cancel this contract without reundto the Policyholder under any o the ollowingcircumstances: (1) In the event o raud ormisrepresentation by the Policyholder or any related parties, (2) I the Policyholder ails to pay the service call ee or any item serviced, and (3) I the home is vacated.

1. I a covered system repair or replacement involves anupgrade or any reason, RWS will cover up to $400 towards themandatory code upgrade including those related to changingrerigerant type in air conditioning systems. Tis shall beapplied to the aggregate limitation o the system that was

beneted by the coverage.2. RWS is not responsible or the cost to gain access or closeaccess to a covered item except where specied.

3. RWS reserves the right to a second opinion at no additionalcharge to the Policyholder unless the rst contractor was chosenby the Policyholder, in which case additional charges may apply.

4. Coverage or all items encased in concrete is limited to $400aggregate.

5. RWS does not cover items where environmental issues arisesuch as lead, mold, or asbestos. RWS is not responsible or thepresence o lead, mold, asbestos or any other environmental

hazard or the removal o such hazard.

6. RWS does not cover consequential or secondary damagecaused by malunctions o covered items except where specied.For example, i a covered plumbing issue results in damageto drywall on the walls or ceiling o the house, RWS is notresponsible or these secondary damages. RWS is not an insurer.

7. RWS does not pay or the costs o permits except wherespecied.

8. RWS reserves the right to make a cash payment to aPolicyholder in lieu o repair/replacement. Te cash payment  will reect RWS negotiated cost or service and may be lessthan retail.

9. RWS shall be responsible only or the costs o installationo a similar part in the case o an obsolete or unavailable part.

10. Repairs necessary as a result o any act o nature, misuse,abuse, lack o maintenance, wind, rain, tornado, re, hurricane,riots, civil commotion, or any other outside inuence, naturalor unnatural, are not covered under this policy.

11. Single Deductible Per Claim Policy: RWS is not the servicingcontractor. All RWS contractors are screened or mandatory qualications, insurance, and reerences. Most RWS contractorshave serviced hundreds o RWS claims or our policyholders. As a risk management company, we cannot guarantee the work 

o our contractors, or take responsibility or liabilities they may incur through the course o work. We do, however, have asingle deductible per claim policy. Should a single mechanicalmalunction result in the replacement o a component (i.e. a gasvalve, aucet, disposal, motor, switch, relay, etc.), and that samecomponent ails at any time during the same policy year, it willbe xed and/or replaced at no urther cost to the policyholder.Te circumstances under which it broke must be covered by the warranty and we reserve the right to send the same contractorto your home i the problem reoccurs within the warranty period. Furthermore, it is our policy that the contractor leave

a copy o the invoice or work perormed at the policyholder’shome or any repair. Each contractor has their own policy onhow long they guarantee their workmanship and parts, whichmay extend beyond the term o your warranty with us. Pleasecall your contractor or details.

12. Solar systems, holding tanks, system managementcontrollers, and electronic equipment are not covered underthis policy unless specied.

13. Commercial equipment is not covered. Commercial-likeequipment and non-domestic equipment is limited to $500aggregate coverage or the policy term. Any premium, ultra-premium, double-wall ovens, and combination ovens (i.e.oven/microwave) have an aggregate coverage limit o $600.

14. RWS has the sole right o determining whether acomponent shall be repaired or replaced. Replacementcomponents shall have similar capacity and eatures, however,RWS is not responsible or matching brand, colors, dimensions,

or modiying cabinets or structure o any kind. Should thePolicyholder wish to replace a repairable item, at their election,the Policyholder may choose to receive a cash payment orallowance in lieu o repair. In such cases, the cash paymentshall be made in accordance with RWS negotiated service andrepair rates.

15. Policyholder is responsible or the dierence in costs orany rerigerants other than R-22, or blower motors otherthan standard AC motors, and or units and components inexcess o 5 tons capacity. Policyholder is responsible or thecosts o access to components that are on rootops or otherwiseelevated. RWS will not cover components travelling throughcommunity property.

16. RWS will pay a maximum o $250 or induction ans on water heater and HVAC systems.

17. Tis policy does not apply to leased equipment and any and all other warranties shall be exhausted rst. Coverageapplies only to real property, xtures, and appurtenances.

18. Coverage may be voided i the correct square ootage,including nished and non-nished spaces, was not reportedto RWS and was not appropriately ordered.

19. Tis policy is a service contract and not a reimbursementpolicy. You must call or service at 1-800-544-8156.

20. Te aggregate limitation or ermite reatment is $700.Te aggregate limitation or drain line stoppage is $275. Teaggregate limitation or garage door spring coverage is $250.

21. RWS will pay a maximum o $1000 or pre-existingconditions that were not known to any party involved inthe transaction. As a part o the verication process, thepolicyholder will be required to provide RWS with a copy o any home inspection reports and seller’s disclosure statements.
