Welcome the IP Clinic at Lincoln Law School of San Jose!

The IP Clinic is a first in many aspects. It is the first patent clinic inNorthern California and Silicon Valley, the first trademark clinic inSilicon Valley (the second in Northern California), the first USPTOapproved patent agent program in California, and the first non-ABAschool to ever be admitted into the USTPO clinic program.

Lincoln Law School of San Jose is distinguished in its offering ofintellectual property (IP) coursework and focus. The Law Schoolprovides many courses relating to IP, and has many faculty memberswith a background specifically focused on patents, copyrights, ortrademarks. Further, the IP Clinic has written and published its ownmanual on intellectual property (available on Amazon), which has alsobeen distributed to other USPTO approved clinics for their use.

Additionally, the IP Clinic allows students to have “hands on”experience in working with professors, inventors, businesses, and otherentities. Under the direction of a supervising attorney, students workwith clients in areas of trademarks and patents. Students interactdirectly with the United States Patent and Trademark Office to file andprosecute patent and trademark applications. This IP Clinic is the onlynon-ABA USPTO approved clinic in the United States, and is one of onlya limited number of patent and trademark clinics nationally.

The IP Clinic provides, free of charge, the following services: clientcounseling, patentability and/or registerability searches, patent and/or trademark application drafting, responses to USPTOcorrespondence, and Examiner Interviews, among other services.

Clients are selected based on financial need, matching of technologybackground with student and faculty members, potential of thetechnology, and potential to create jobs in Northern California. However,we provide services to clients from across the entire United States whoare able to satisfy the requirements sufficiently.

Once accepted into the IP Clinic, the client will be assigned to a teamof students, supervised by a practicing attorney. Additionally, the IPClinic runs on an academic yearly basis, from late August to late March.

TRADEMARK TIMING: Once a trademark application is filed,

you should receive a response from the USPTO within six to

seven months from filing. The total time to the granting of a

trademark may be anywhere from almost a year to several

years.

TRADEMARK FILING COST: Filing costs for trademarks

depends on the number of class/goods as well as the method

for submitting your application. At a minimum, the trademark

would cost $225 per class of goods or services.
