    An employer contesting a claim has to prove that the

    dierence between your pay and that o the comparator

    results rom a genuine material actor other than gender.

    Such a actor cannot arise rom indirect discrimination (e.g.the requirement to possess a particular qualifcation which is

    not strictly necessary and which one gender is less likely than

    the other to possess). Possible deences might include market

    conditions, movements up an incremental pay scale, previous

    job evaluations or pay protection under a red circling

    arrangement though in each o these cases tribunals and

    the courts have taken a narrower view over time as to what is

    a permissible deence.

    A fnding in your avour can lead to a rise in pay to that o

    the comparator, plus compensation in the orm o back payor up to six years.

    Equa pay aim

    You can make a claim or equal pay by comparing your job

    with that o a member o the opposite sex (the comparator)

    in three ways:

    Like work

    Your job must be the same, or broadly similar: minor

    dierences will be examined to see whether they justiy

    dierent pay.

    Work rated as equivalent

    A valid job evaluation scheme, compatible with the Equal Pay

    Act, has rated your job as equivalent to the comparator.

    Work of equal value

    Your job has not been evaluated, but (though it can be very

    dierent in nature) is claimed to involve the same level o

    skills as that o the comparator: an employment tribunal will

    appoint an independent expert to evaluate the job.

    The comparator must be a person o the opposite sex.

    Note that men can claim equal pay with a better-paid

    emale: though such cases are rare, they are not unknown.

    A comparator could be a predecessor (or a successor) in the

    same job role. He or she must be employed by the same orassociated employers, though the ull meaning o this has

    still to be established because o ambiguities between UK

    and European law. Comparisons can be made with dierent

    elements o a contract. For instance, you can make a case i,

    although your basic pay is the same as your comparator, you

    receive a smaller bonus.
