(JUNE 11, 2012)—Chief Justice JohnG. Roberts’ nomination disclosure sayshe was co-counsel on two cases in2002-2003 with Theodore B. Olson,former U.S. Solicitor General, now Co-Chair of Gibson Dunn’s Appellate andConstitutional Law Practice Group.[01]Those cases were Tahoe v. Tahoe, 535US 302 (2002) and Smith v. Doe, 538US 84 (2003).[02]

Olson hired Thomas G. Hungar towork for him as Deputy SolicitorGeneral in 2003, while he wascollaborating with John G. Roberts inSmith v. Doe.[03] Scratching this nowraging investigative itch, we googled"Theodore B. Olson AND Thomas G. Hungar'."

The results are jaw-dropping.

JUSTICE ROBERTS IS FACEBOOK ATTORNEY THOMAS HUNGAR’S MENTOR.

Here’s what Thomas Hungar told Law360 in 2009 about their relationship:

“The Deputy Solicitor General who supervised my first Supreme Courtargument back in 1992 was John G. Roberts Jr. (he’s since gone on tosomewhat greater fame). That experience has played a foundational role in myoral argument preparation ever since, because I’ve always tried to prepare theway he taught me.” “Q&A With Gibson Dunn’s Thomas Hungar, Law360, Sep.30, 2009[04] .

In 2004, Theodore B. Olson moved to Gibson Dunn. Then, in 2008, Olson hired Hungar atGibson Dunn, evidently putting the team back together to capitalize on their “inside”

relationship at the U.S. Supreme Court with their colleague and mentor John G. Roberts.

Here’s what Olson said about Hungar at his hiring in 2008:

"Tom is a brilliant lawyer and is highly respected by the legal community." [05]

In 2011, Chief Justice Roberts recused himself in the Microsoft v. i4i case “apparentlybecause he owns Microsoft stock,” according to The New York Times, Apr. 18, 2011.[06]

The more likely reasons were because: (1) Thomas G. Hungar was Roberts' protégé, and theclose personal relationship precluded his participation; and (2) Theodore B. Olson’s law firm,Gibson Dunn LLP, was representing Microsoft, so the appearance of impropriety was tooapparent. Either way, he was conflicted and did the right thing by recusing himself.

But then a year later, in Leader v. Facebook, Justice Roberts was totally silent about hisconflicts of interest. Arguably, his conflicts were much worse given his significantinvestments in Facebook and related companies in addition to his close personal ties toOlson and Hungar and Facebook law firm, Cooley Godward LLP.

Oh what tangled webs we weave . . .

Facebook patent infringement casefirst came to our attention after learningthat the trial judge, Leonard P. Stark, U.S.District Court of Delaware, ignored his jury’sadmission that they had no evidence tosupport their on-sale bar verdict, but thejudge supported it anyway.

The judicial misconduct has deterioratedfrom there, replete with two of the threejudges on the Federal Circuit appeal panel,Judges Alan D. Lourie and Kimberly A.Moore, holding Facebook stock that theydid not disclose to the litigants, and latertried to excuse through a quick motionslipped in at the last minute by the Clerk ofCourt, Jan Horbaly, and his close friends atThe Federal Circuit Bar Association. (The DCBar subsequently revealed that Mr. Horbalyis not licensed to practice law inWashington D.C.)

The judges ignored shocking new evidencethat Mark Zuckerberg withheld 28 harddrives of 2003-2004 evidence from LeaderTechnologies that could prove actual theft(and therefore claims even more seriousthan infringement). In addition, Facebook'sappeal attorney, Thomas G. Hungar ofGibson Dunn LLP, has close personal ties tojust about every judicial player in this story.The misconduct appears to reach into theU.S. Patent Office through abuse of thereexamination process by Facebook. We willstay focused on Leader v. Facebook untiljustice is served, but we also welcome newsand analysis of intellectual property abuse inother cases as well.

Judge Leonard P. Stark, U.S.District Court of Delaware, trialjudge in Leader Techs, Inc. v.Facebook, Inc., 770 F. Supp. 2d 686(D.Del. 2011). Judge Stark heardhis jury foreman admit that thejury made the on-sale bar decisionwithout any evidence other thanspeculation, and yet he supportedthat verdict anyway. Just monthsbefore trial, Judge Stark allowedFacebook to addthe on-sale barclaim after theclose of all factdiscovery andblocked Leaderfrom preparing its defenses to thisnew claim. Judge Stark allowedthe claims despite Leader'sprophetic argument that theaction would confuse the jury andprejudice Leader. (Read Leader'sMay 20, 2010 motion here.) He alsopermitted the jury to ignore thePfaff v. Wells Electronics, Inc. testfor on-sale bar, even afterinstructing the jury to use it. (Seethat JuryInstruction No. 4.7here.) He alsocontradicted hisown instruction toLeader to answerInterrogatory No. 9 in the presenttense (2009), then permitted thejury to interpret it as a 2002admission as well. See his Sep. 14,2009 Order. Judge Moorestood to benefit financially fromundisclosed holdings in Facebook.See disclosure of substantialholdings in Facebook andFacebook-related stocks. JudgeMoore failed tofollow the long-held precedentfor testing on-salebar evidence inPfaff v. WellsElectronics, Inc.—an evident andintentional omission coming from aformer patent law professor. Afterdebunking all of Facebook'sevidence on appeal, Judge Moorecreated new argument in thesecrecy of chambers to supportFacebook and prevent the on-salebar verdict from being overturned—a clear breach of constitutionaldue process.

Judge Evan J. Wallach, U.S. Courtof Appeals for the Federal Circuit,member of the three-judge panelin Leader Techs v. Facebook, Inc.,678 F.3d 1300 (Fed. Cir. 2012).Judge Wallach is not a patentattorney. This begs the questionas to why a judge with noknowledge of patent law wasassigned to the case. Wouldanyone ask a dentist to performbrain surgery? The Federal Circuitwas specially formed to appointpatent-knowledgeable judges topatent cases. There is noevidence so far in the judicialdisclosures that Judge Wallachholds stock in Facebook, althoughwhen he was asked on a motion todisclose potential Facebookholdings and other conflicts ofinterest, he refused along withthe other judges. JudgeWallach also failed to police hiscourt’s violation of Leader’s Fifthand 14th Amendmentconstitutional right to dueprocess when he participated inthe fabrication of new argumentsand evidence for Facebook in thesecrecy of judge's chambers afterhe had just invalidated Facebook’ssole remaining item of evidence(using disbelieved testimony asostensible evidence of anopposite). Judge Wallach alsofailed to police his court when hefailed to apply the SupremeCourt's Pfaff v. Wells Electronics,Inc. test for on-sale bar evidence,which included even the FederalCircuit’s own Group One v.Hallmark Cards, Inc. test—a testwhich Judge Lourie should haveadvised Judge Wallach to followsince Judge Lourie helped writethat opinion. Clerk of Court Jan Horbaly, U.S.Court of Appeals for the FederalCircuit, clerk who signed all theopinions in Leader Techs v.Facebook, Inc., 678 F.3d 1300 (Fed.Cir. 2012).
