Ap- parently official requests by the Board for a hir- ing exemption to backfill these positions have met with silence or an outright NO! As I have reported in prior columns, these 70+ vacancies (about ½ of which are in the Enforcement Unit) are preventing the Board from doing its job most effectively. This adversely impacts the legitimate licensed contractor and can cost you important contracts. This is NOT saving the State any money since the CSLB is fully funded by contractor’s applica- tion and renewal fees. Write, email, fax or call the Governor’s Office and ask why the CSLB is not being allowed to fill these important positions.

IMPORTANT NOTICES REGARDING CITY OFFICE CLOSURE DUE TO MANDATORY FURLOUGH

WelcomeThe LDT Bulletin is one way we are increasing communication between the City and our customers. These bulletins will also be located in our lobby area at 630 Garden Street. We hope you’ll find the contents of this issue useful. To subscribe to the City LDT Bulletin please send an email to: [email protected]________________________________________CITY OFFICES CLOSED DUE TO MANDATORY FURLOUGHMost City ADMINISTRATIVE OFFICES are closed due to an unpaid mandatory furlough for City employees on Wednesday, November 23rd. Offices will also be closed on Thursday, November 24th and Friday, November 25th due to the Thanksgiving Holiday.

Most City ADMINISTRATIVE OFFICES are also closed due to an unpaid mandatory furlough from December 19 through January 2, 2012. Offices will re-open on Tuesday, January 3, 2012. This includes the Community Development Department located at 630 Garden Street. As such, Zoning & Enforcement staff will not be able to prepare Zoning Information Reports during these furlough dates, and Building and Safety staff will not be available to accept or review plans for building permits.

ZONING INFORMATION REPORTS (ZIR’s) The Municipal Code requirement to obtain a ZIR prior to the close of escrow (SBMC Section 28.87.220) will remain in effect during this furlough. In order to accommodate the needs of the real estate community as best we can, we are committed to completing all ZIRs received by Thursday, December 8th, prior to the furlough. We will make every effort to complete additional ZIR applications received during the week of December 12th, but cannot commit to this at this time, as we don’t yet know the extent of our ZIR workload for that period.

While we cannot accept ZIR applications in person during the two-week furlough, agents may continue to mail them in and we will begin working on those applications when we return on Tuesday, January 3rd. If an escrow opens and closes during our two-week furlough, agents are still required to submit an application as soon as possible, either in the mail or in person once our office re-opens. We will waive the double “After the Fact” ZIR fee if valid escrow instructions are provided to verify the escrow opening and closing dates occurred during our furlough.

If you have any questions regarding the furlough period and how this relates to ZIRs, please call the Planning Counter at 564-5578.

BUILDING AND SAFETY PLAN CHECK AND INSPECTIONS While there will not be Building and Safety counter staff available to accept or review plans during the furlough, there will be limited Building and Safety inspection staff available Monday through Thursday, the week of December 19th and Tuesday through Friday, the week of December 26th. Building and Safety inspection staff will NOT be available for inspections Monday, January 2, 2012 but will resume normal business hours Tuesday, January 3, 2012. Use the inspection request line as you normally would, by calling 564-5492.

We ask that, if an inspection can be postponed until after the first of the year, please do so.

FIRE PREVENTION Fire Prevention Staff will be on duty Monday through Thursday the week of December 19th and Tuesday through Friday, the week of December 26th. Staff will NOT be available Monday, January 2, 2012 but will resume normal busi-ness hours Tuesday, January 3, 2012. Please contact them at 564-5702.

DONT GET CAUGHT IN THE CRUSH

Crushing accidents occur when the body or any part of the body is squeezed between two moving objects or caught between one moving and one stationary object. Minor crushing accidents can cost workers in many ways, in pain, disability, and the loss of a job. Major crushing accidents can even cost a life.

There are some simple things workers can do to lessen their chance of experiencing crushing injuries. The first, and most important thing, is for workers to know when they are placing themselves or any of their body parts in a situation of possible injury.

Workers must always be aware of where they are in relation to moving equipment around them. When in these situations, workers must allow enough room to compensate for equipment failure or operator error. Workers should stay within the equipment operators vision at all times.

Workers should make it their business to stay out from under any load to avoid the possibility of being crushed from above. "If its in the air, its dangerous." Employers should never permit a load to be raised, lowered, or swung over a workers head. It is also the workers responsibility to shut-off, lock-out, or tag-out all energy sources, and to test to assure that they are dead, BEFORE attempting to work on or clear equipment capable of any movement or activation.

Workers are the most important pieces of equipment in the workplace; make sure they are kept safe and in good operating condition.

Los accidentes por aplastamiento ocurren cuando un cuerpo, o cualquier parte del mismo, quedan atrapados entre dos objetos móviles, o cuando quedan atrapados entre un objeto móvil y un objeto fijo. Los accidentes por aplastamiento leve pueden costarle a los trabajadores en muchas maneras - dolor, incapacidad o la pérdida del empleo. Kalb’s Q & A for ContractorsBy David Kalb, Capitol Services, Inc.

There was a lot of news for California contrac-tors coming from the latest CSLB meeting. New regulation may extend the definition of who is a ‘contractor’ and those waiting for LLC licens-ing now have a date certain to apply. We begin with a contractor’s question that ‘qualifies’ as un-usual…

Q: I have a client who is the sole Officer of a com-pany that is going out of business due to some problem projects. My client is NOT the Qualifier for the company; however, he has his own Class “B” license. The company may file for bankruptcy (BK) protection but my client wants to be able to start a new company using his own license. Is there any need for him to disassociate as an Of-ficer of the current company?

A: The only reason would relate to his current licensing issues. If his present license ends up with a judgment or any disciplinary action, it could impact your client’s ability to secure a new license (until the problem is resolved). If his new license was already issued, and the present li-cense was suspended, the new license could be threatened with an “associated License suspen-sion”.

The BK would likely resolve this but it adds one more layer to the process. If your client is off the license prior to any judgment, he can likely avoid this “associated” problem. Of course, the CSLB still retains jurisdiction over the contractor and could pursue him regarding the ‘problem’ proj-

ects.

Q: I was surfing the Internet and came across your web site and many of your prior columns. It was funny being told when I called your of-fice that you were out all afternoon “attending a Contractors Board meeting”. This was after I had been watching the CSLB meeting streaming live for about 20 minutes.

My call was prompted by the Board’s brief men-tion of proposed legislation to regulate or license construction managers. This item went by very quickly. What can you tell me about the Board’s reasoning and discussion?

A: This is one of several legislative proposals dis-cussed by the CSLB on December 6th at their bi-monthly meeting. Code Section 7026.1 de-fines the term “contractor”. An Appellate Court decision in 2009 found that someone acting in the capacity of a construction manager is not re-quired to be licensed as a contractor. Therefore, to address what the Board views as overruling their related 2008 ‘Precedent-setting Decision’ they’re proposing to add Section (f ) which would expand the definition of a contractor by adding: “provides a bid for a residential construction project; arranges for and sets up work schedules for subcontractors and maintains oversight of the project”. This would relate to home improve-ment contracts.

A second legislative proposal will seek to amend

7026.1. According to the Board’s Staff report, “It has become commonplace for contractors – li-censed and unlicensed –to attempt to circum-vent Contractors License Law and Public Con-tract Code requirements by asserting they are not subject to licensure as contractors because they are ‘Renters of Operated Equipment’”. An example would be a business that provides trac-tors, backhoes, or graders with a full crew to op-erate the equipment.

The proposed language would expand the defi-nition of a contractor to include “vendors of op-erated equipment that exercise direction and control of work covered by this chapter”.

While on the subject of the CSLB meeting, there is BREAKING NEWS regarding Limited Liabil-ity Company (LLC) licensing. The Board has an-nounced that LLC applications should be avail-able on December 27th, four days prior to the statutory deadline. As I expect a rush, anyone interested in more information or assistance with newly created LLC applications should call me now.

Setting Up a Tailgate/Toolbox Safety Meeting Tailgate or Toolbox safety meetings are 10-15 minute on-the-job meetings held to keep employees alert to work-related accidents and illnesses. Tailgate/toolbox safety meetings have proved their worth by alerting employees to workplace hazards, and by preventing accidents, illnesses and on-the-job injuries. Why Have Them?

In both the tunneling and construction industries, tailgate safety meetings are required by Title 8, Sections 8406 and 1509 of the California Code of Regulations.

While tunneling and construction are the only industries that specifically require tailgate safety meetings, all California employers must have a safety program that includes employee training in safe work practices.

Tailgate/toolbox safety meetings can be used to address actual problems on the job or in the shop. The supervisor leading the meeting can draw on the experience of workers, and use that experience to remind all employees –especially newer ones – of the dangers of working with particular kinds of machinery, tools, equipment and materials. What to Talk About?

Talk about work practices, machinery, tools, equipment materials, attitudes, and anything else that may cause or contribute to a work-related accident or illness. Keep the topic relevant to the job or tasks at hand.

An excellent source for construction related topics is the publication Cal/OSHA Pocket Guide for the Construction Industry. Supervisors can choose individual sections or topics and relate them to their specific site requirements. Copies can be ordered from the Division of Occupational Safety and Health.

Choose a topic you think needs safety review. If you notice that spills aren’t being cleaned up promptly, discuss it. If there has been an accident or a near-accident on the job, talk about it. What happened? Where did it happen? How can it be prevented from happening again? Encourage employees to suggest topics. They often know best - what and where the dangers are. How to Run a Good Meeting 1. Hold the meeting on the job, preferably where everyone

can sit and relax. 2. Hold meetings at the beginning of shift or after a break. 3. Choose the topic carefully. Topics should be about health

and safety problems on the job. Research the problem before the meeting. For machinery, consult the manufacturer’s operations manual. For handling toxic substances, get a copy of the material safety data sheet. Your company’s insurance carrier is another good source

of information. Cal/OSHA also supplies a wide range of printed material on worksite safety and health.

4. Don’t choose too broad a topic. 5. Encourage employee participation - keep your meeting

short. Sample Topic for Tailgate/Toolbox Safety Meetings:

Why are guards left off machines? Guards are placed on machines to prevent workers from

contacting moving parts. They are required by Cal/OSHA regulations.

Many California workers are killed or injured every year because guards are removed and not replaced.

Why are guards left off? Ask the group to give reasons. Some common ones are:

♦ I didn’t have time to replace the guard. ♦ I wanted to make sure the machine was working okay. I

just never got around to replacing the guard. ♦ I put on a new drive and the old guard didn’t fit. ♦ I had to remove the guard to adjust the machine. ♦ I couldn’t work with the guard on. It slowed me down. ♦ Listen I’ve run these machines for years without guards

and I’ve never been hurt. These excuses have been given countless times. After the

accident has happened, the guard is replaced and strict rules are enforced. Of course, it’s too late for the victim. The purpose of meeting on this topic is to make sure rules are enforced before an accident can happen.

Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.
