PLEASE NOTE THE FOLLOWING Pet Policy: PETS ALLOWED (ALL Dogs must be small AND licensed. They must be

registered with building superintendent for a one-time $100 registration fee).

Maximum Financing will be permitted up to 90% of the purchase price(down payment cannot be lower than 10% of purchase price)

Interview: All applicants/occupants age 18 and over must be present at the Board interview

Insurance: New residents are required to obtain liability and property insurance with fire and water damage coverage equal to the value of the entire contents of the apartment; the policy must specifically insure a cooperative apartment (not a rental apartment)

Fees: all fees must be submitted in the form of money order or certified check

Applications: all incomplete applications will be returned to sender. Do not bind or staple applications together. Binder clip or rubber band is required

Processing Time Frame: processing of your application takes approximately 3-4 weeks Additional Information: If this application is accepted, the applicant will NOT, without the prior

written consent of the Board: Pledge or create a security interest in the shares and Proprietary Lease for the

apartment; Make any structural alterations to the apartment; Sublease the apartment WITHOUT Board Approval Permit any person to reside in the apartment who is not so authorized by the

Proprietary Lease; Use the apartment for other than residential purposes; Violate any provision of the Proprietary Lease, By-Laws or House Rules.

Move in/out: Both seller and purchaser must adhere to the co-op’s policy regarding moving in and out. Move in/out security deposits are refundable only after the move is complete, the House Rules have been adhered to, and no damage has been done to any part of the building. Moves are allowed Monday-Friday 9:00 am to 5:00 pm. NO WEEKEND OR HOLIDAY MOVES.

Property of Application: the original application and all submitted documents become the property of the cooperative/condo corporation. if the application is approved, the original application will not be returned for any reason. in the event an application is denied, the original application will be returned if requested in writing within 30 days of issuance of the denial letter

Power of Attorneys: if the seller or buyer are being represented by a POA (power of attorney representative), please make sure to include a copy of the POA within the submission along with a full force affidavit if the POA was issued over 12 months ago (please contact your attorney for further details).

Estate Sales: SELLERS MUST provide copies of death certificate and Letter of Testamentary indicating that they are the Executor of apartment and is authorized to sell the unit.

It should be noted that upon submission, the original application and all submitted documents become the property of the Cooperative Corporation. If the application is approved, the original application will not be returned for any reason. In the event an application is denied, the original application will be returned if requested in writing within 30 days of issuance of the denial letter.

Authorization to Expedite Application

I am aware, as is stated in the Resale and Sublease application agreement; it takes

approximately 3 to 4 weeks for the Managing Agent to process, once the application is

accepted as complete.

However, I am under a time constraint and I am requesting the Managing Agent

expedite the processing of my application. I am aware the expediting of my

application only provides the application will be processed by the Managing

Agent within 72 hours of receipt of receiving my completed application, and

forwarded to the Board of Directors for consideration.

I am aware that the expedite fee does not expedite the Board of Directors review of my

application, nor does it guarantee approval by the Board of Directors.

When an update is available, we will contact your point person, which we recommend should be your Real Estate Broker, or in the absence of a Broker your Attorney. MOVE-IN/MOVE-OUT AGREEMENT (English Version)

The undersigned hereby agree to comply with the provisions of the Rules and Regulations of the Saxony Towers Realty Corp. in the delivery (Move-In) or the removal (Move-Out) of furniture, furnishings, and personal property from the apartment identified below. In addition, the undersigned agrees to the following policy and procedures established by the Board of Directors:

1. The payment of the following fees at the time of scheduling and in advance of the Move-In:

a. By certified check, bank, check or money order, the amount of Five Hundred

($500.00) Dollars, payable to Saxony Towers Realty Corp., as a Security Deposit for the Move-In, which shall be refunded to the under signed, subject to the condition as hereafter provided.

b. By certified check, bank check or money order, the amount of Five Hundred

($500.00) Dollars, payable to Saxony Towers Realty Corp. as a Security Deposit for Move-Out, which shall be refunded after final inspection by the Superintendent/Management that no damage has occurred during the move.

2. The date of the Move-In or Move-Out from the apartment must be scheduled with

building superintendent, Sokol at 718-803 0638 one week in advance. It is understood that the total amount of the Security Deposit shall be forfeited if the resident fails to do the following: a. Schedule the Move-In or Move-Out of property with the Superintendent’s Office

(or arranges for the delivery or removal of property from the apartment at other than the time scheduled.

b. Moving in/out of the building must be done on weekdays ONLY between

the hours of 9:00 a.m. and 5:00 p.m. ALL MOVES MUST BE COMPLETED BY 5:00 P.M. NO EXCEPTION WILL BE MADE.

3. Any carrier engaged for the delivery or removal of property shall be advised to

comply with the instructions of the Building Staff assigned for the monitoring and supervision of the Move-In or Move-Out.

4. In addition, a Certificate of Insurance from your moving company for

Workmen’s Compensation and Public Liability Insurance in the amount of $500,000 property damage and $500,000/$1,000,000 bodily injury must be provided to the Managing Agent. The certificate must name Saxony Towers Realty Corp. and John B. Lovett & Associates, Ltd. as Additional Insured.

5. The undersigned shall be responsible for damages caused in the common elements

of the Saxony Towers Realty Corp. during the process of the Move-In or Move-Out.

6. The cost for repairs and replacements for damages to the common elements caused by and during the Move-In or Move-Out shall be deducted from the amount of the

Security Deposit. The amount of the cost for any repairs and replacements resulting from the damages attributed to the Move-In or Move-Out from the apartment shall be the sole determination of the Managing Agent which shall be based upon prevailing costs for similar repairs and replacements.

7. It is further understood that the amount due or payable to the undersigned from the

TO: All Resident Shareholders and Renters English Version Non-Resident Shareholders of Saxony Towers FROM: Josh Markewich Co-Op Board President DATE: January 7, 2010 RE: QUALITY OF LIFE AND RULES INFRACTIONS AT SAXONY TOWERS REALTY CORP. ______________________________________________________________________ Due to recent noticeable increases in infractions of the rules and regulations of Saxony Towers which negatively impact the quality-of-life of all residents, as well as causing more work for the Superintendent, Property Manager, and staff, it is necessary to issue this memo as both a reminder and a warning to all shareholders, renters, of the Co-Op. It is important to understand that it is a privilege, not a right, to own or rent an apartment at Saxony. Those who violate the rules forfeit their privilege of living and/or owning an apartment here. Unfortunately, all it takes is a few residents violating the rules to lower the quality-of-life for the majority of residents who follow the rules. Below I have listed some of the more frequently violated rules and regulations. The Board, Superintendent, and Property Manager will vigorously enforce these rules. Anyone who is caught violating them, or whose tenants, family members, and/or visitors are caught violating them will be subject to one or more of the following: A fine of $250 per infraction, loss of privileges such as use of the laundry room, and/or eviction proceedings. I thank everyone for their cooperation. Please report any infractions that come to your attention to the Super or Property Manager for further action.

LOITERING- Loitering and hanging out in the lobbies, hallways, or stairways within the buildings and on the entrance porches or entrance walkways that are within the Co-Op's property is strictly prohibited. Loitering means that you are spending more than a short and reasonable amount of time there for appropriate purposes such as waiting for a cab or a delivery. If you are just there to hang out, you are violating the Co-Op's rules. The playground is available during designated hours if you wish to spend time outside on Saxony Towers property.

LAUNDRY ROOMS- Carts are not allowed to be removed from the laundry rooms for any reason, including bringing laundry to or from your apartment. Carts can only be used for CLEAN laundry. You must remove your laundry from the machines within 5 minutes after it has finished.

MOVING IN, MOVING OUT, BUYING, SELLING, RENTING APARTMENTS- The rules for these subjects have been covered in detail in a separate memo distributed with this memo and they are now and will continue to be strongly enforced.

DOGS- As per the updated House Rules dated January 2008, the only dogs allowed in the Co-Op are dogs who lived here before that date. Those dogs must be licensed with the City and registered with the Co-Op. All dog owners must clean up any mess their dog makes on the Co-Op property, keep the dog's noise to a reasonable level, and bring the dog outside or back inside THROUGH THE BASEMENT ONLY, NOT THROUGH THE LOBBY. In addition, all dogs must be leashed at all times while on Co-Op property. If you brought a dog here to live with you after January 2008 and it comes to our

attention, or if you bring a dog here in the future, you will be told to get rid of the dog immediately. Any exceptions to this policy must be approved by the Co-Op Board. This policy may be unfortunate, but it was caused by people who failed to control or clean up after their dogs.

LARGE PACKAGES, FURNITURE, SHOPPING CARTS, BICYCLES, ETC...- These items must be delivered or brought in by residents through the basements only, not through the lobby. In the event that a large item doesn't fit in the elevator and therefore needs to be brought in through the lobby and carried up the stairs, the Superintendent must be informed first and he must be there to monitor the situation.

GARBAGE DISPOSAL- All regular garbage must be bagged and dumped down the compactor chutes on each floor. All recyclables and other garbage that is too large for the chutes must be brought down to the basement garbage rooms and placed in the appropriate garbage can or floor area. Garbage is never to be left in the compactor rooms or in the hallways. If you need assistance disposing of your garbage for any reason, please contact the Superintendent.

LOUD NOISE AFTER 11:00 P.M.- Loud and disturbing noise should not be made in excess at any time of the day or night, but after 11:00 P.M. it is strictly prohibited. This includes noise from parties, loud music, use of loud appliances such as vacuum cleaners, and all other sources of excessive noise.

APARTMENT RENOVATIONS- Apartment renovations are only permitted to take place between 9 to 5 Monday through Friday, not including legal holidays. All renovations must be done by a licensed and insured contractor and you must put down a $500 refundable deposit. The Super or the Property Manager will give you a form for you and your contractor to prepare, and the work may not start under any circumstances before the Property Manager gives the final approval.

VANDALISM AND DESTRUCTION OF PROPERTY- Vandalism of any part of Saxony Towers' property, graffiti, destruction of property, and/or tampering with property such as the security cameras is strictly prohibited.

GARAGE SPACES- One vehicle per space is permitted in the garage. Storing anything else in your parking space is prohibited.

OBJECTS ON FIRE ESCAPES- It is against the law to store any objects on the fire escapes, even temporarily, and the Co-Op can get fined if this happens. You may not place any objects on the fire escapes, including but not limited to plants and flowers, cleaning supplies, toys, drying clothes, etc...

Es necesario publicar este memorandum, como recordatorio y como advertencia para todos los residentes, accionistas y arrendatarios de la cooperativa.

Es impotante entender que este es un previlegio, no un derecho a poseer o alquilar un apartamento en Saxony Towers. Aquellos que violen las reglas pierden este privilegio de vivir o poseer un apartamenro aqui lamentablemente algunos residentes violan estas reglas y bajan la calidad de vida de las personas que si cumplen con estas abajo tengo una lista de algunas de las mas frecuentes violaciones a las reglas. La junta directiva, el gerente de propiedad y el superintendente, haran cumplir energicamente estas reglas. Alguien que sea sorprendido violandolas, miembros, arrendatarios, familiars o amigos invitados sera sujetos a uno o varios de lo siguiente. Una multa de $250.00 dolares por infraccion, perdida del privilegios como el uso de el lavadero, y/o procedimiento de desahucio. Agradezco a cada uno por su cooperacion. Por favor reporte cualquier infraccion al gerente de propiedad (Property Manager) o al superintenente para futura accion.

HOLGAZANEANDO - la Holgazanería y colgar en los vestíbulos, vestíbulos, o escaleras dentro de los edificios y en los pórticos de entrada o pasajes peatonales de entrada que son dentro de la propiedad de la Cooperativa son estrictamente prohibidos. La holgazanería significa que usted gasta más que una cantidad corta y razonable del tiempo allí para objetivos apropiados como la espera de un taxi o una entrega. Si usted debe andar allí sólo, usted viola las reglas de la Cooperativa. El patio está disponible durante horas designadas si usted desea pasar el tiempo fuera para la propiedad de Saxony Towers.

CUARTOS DE LAVADO DE ROPA - no se permite que Carros sean quitados de los lavaderos por cualquier razón, incluso traer o tomar su ropa a su apartamento. Los carros sólo pueden ser usados para el lavado de ropa LIMPIO. Usted debe quitar su lavado de ropa de las máquinas dentro de 5 minutos después de que esto ha terminado.

MOVIENDO, COMPRANDO, VENDIENDO, Y ALQUILANDO APARTAMENTOS - las reglas para estos sujetos han sido cubiertas detalladamente en una nota separada distribuida con esta nota y ellos son ahora y seguirán siendo fuertemente hechos cumplir.

PERROS - Según las Reglas de Casa actualizadas dataron el enero de 2008, los únicos perros permitidos en la Cooperativa son perros quién vivió aquí antes de aquella fecha. Si usted trajera un perro aquí para vivir con usted después del enero de 2008 y esto viene a nuestra atención, o si usted trae un perro aquí en el futuro, le dirán deshacerse del perro inmediatamente. Cualquier excepción a esta política debe ser aprobada por la junta Cooperativa. Esta política puede ser desafortunada, pero fue causado por la gente que dejó de controlar o limpiar después de sus perros.

PAQUETES GRANDES, MOBILIARIO, CARRITOS, BICICLETAS, ETC. ...-estos artículos deben ser entregados o hechos entrar por residentes por los sótanos sólo, no por el vestíbulo. DISPOSICIÓN DE BASURA - Toda la basura regular debe ser empacada y vertida abajo las tolvas de compresor en cada piso. Todo recyclables y otra basura que es demasiado grande para las tolvas deben ser bajados a los cuartos de basura de sótano y colocados en el cubo de la basura apropiado o área total. La basura nunca debe ser dejada en los cuartos de compresor o en los vestíbulos. Si usted necesita la ayuda que elimina su basura por alguna razón, por favor póngase en contacto con el Superintendente.

RUIDO FUERTE DESPUÉS 11:00 P.M.-que el ruido Fuerte e inquietante no debería ser hecho en el exceso en cualquier momento del día o noche, pero después de la once de la noche es estrictamente prohibido. Este incluye el ruido de partidos, música fuerte, el uso de aplicaciones fuertes como aspiradoras, y todas otras fuentes del ruido excesivo.

RENOVACIONES DE APARTAMENTO - sólo se permite que renovaciones de Apartamento ocurran entre 9 a 5 de lunes a viernes, no incluso vacaciones legales. Todas las renovaciones deben ser hechas por un contratista autorizado y asegurado y usted debe dejar un depósito reembolsable de 500 dólares. El Súper o el Gerente de Propiedad le darán una forma para usted y su contratista para prepararse, y el trabajo no puede comenzar en ninguna circunstancia antes de que el Gerente de Propiedad dé la aprobación final.

VANDALISMO Y DESTRUCCIÓN DE PROPIEDAD - Vandalismo de cualquier parte de propiedad de Saxony Towers, graffiti, la destrucción de propiedad, y/o manipulación de la propiedad como las cámaras de seguridad son estrictamente prohibidos.

ESPACIOS DE GARAJE - Un vehículo por espacio es permitido en el garaje. El almacenaje de algo más en su aparcamiento es prohibido.

Lead Warning Statement

Every purchaser of any interest in residential real property on which a residential

dwelling was built prior to 1978 is notified that such property may present exposure to lead from lead-based paint that may place young children at risk of developing lead poisoning. Lead Poisoning in young children may produce permanent neurological damage, including learning disabilities, reduced intelligence quotient, behavioral problems, and impaired memory. Lead poisoning also poses a particular risk to pregnant women. The seller of any interest in residential real property is required to provide the buyer with any information on lead-based paint hazards from risk assessments or inspections in the seller’s possession and notify the buyer of any known lead-based paint hazards. The Cooperative makes no representation that any alterations to the Premises is, or was, approved by the Cooperative.

I/we agree that, in the event that there are or were any illegal or improper alterations to the Premises, or if there are repairs otherwise needed to the Premises necessitated by the conduct of the Transferor or former owners of the Premises, the correction of and the cost of such correction(s) and/or repair(s) shall be borne solely by the Purchaser.

agreements provided by the Transferor or former owners of the Premises to the cooperative to perform alterations to the Premises (the “Alteration Agreement”). In order to induce the Corporation to consent to, and register on the records of the Corporation, the transfer of the Shares and Lease to the Premises to the undersigned, for good and valuable consideration, the receipt and sufficiency of which consideration is hereby acknowledged, the Seller hereby assigns and the Buyer ASSUMES AND AGREES TO PERFORM AND OBSERVE all the terms, covenants and conditions of the Alteration Agreement as if they were a signatory thereto.
