    SANBERNARDINOCITY CHARTERPREAMBLE.

    We, the citizens of San Bernardino, do hereby establish this Charter to promoteeconomic,environmental,and cultural prosperi ty throughout ourcommunity; to enable ourcitygovernment to meet the needs of the peop le effectively and efficiently; to provide foraccountability and ethics in publ ic service; and to ensureequal i ty of opportunity for everyresident.

    ARTICLEI.NCORPORATIONAND SUCCESSION.Sec. 100. Name and Boundaries.

    The municipal corporat ion nowexisting and known as the City of San Bernardino shallremain and continue as a munic ipa l corporat ion under its samename The boundaries of the Cityshall be the boundaries as established at the time this Charter is adop ted , oras the boundariesmay be changed thereafter in the mannerauthorized by law. (A mapof the existing boundaries isincluded inthe appendix .)Sec. 101. Succession to rights,property,and liabilities.The City shall remain vested wth all r ights and pr iv i leges of every kind and naturevested in the City at the time this Charter is adopted. The City shall continue to own,possess,and control all property of everykind and nature owned,possessed, orcontrolled by the City atthe time this Charter is adopted. The adopt ion of this Charter shall not abrogate , limit,orotherwise affect any existing debt,obligation,contract, awsuit,orother liability onbehalf of oragainst the City.

    ARTICLE II. POWERS OF CITY.Sec. 200. Generally.

    The City shall have all powers and r ights possible for a charter city to have under theconstitution and laws of the State of California as fully and completely as t hough t hey werespecifically enumerated in this Charter, subject only to the limitations contained in this Charter.The City shall have the power to make and enforce all laws and regulations regarding munic ipa laffairs, subjec t only to such restrictions and limitations that may be provided in this Charter orthe Constitution of the State of California. The City shall have the power and may act pursuantto any procedure established by state law, unless a different procedure is established by thisCharter or by ordinance of the City. The powers and r ights of the City shall be construedliberally and in favor of the City,and the enumeration of any par t icu lar power or r ight in this

    The City may exercise any of its powers or per form any of its functions. and maypart icipate in the f inancing thereof, ointly orin cooperation, by contract orotherwise,wth anyone ormorecities,counties, states, foreign countries orcivil divisions oragencies thereof,ortheUnited States orany of its agencies.

    ARTICLEIII. LEGISLATIVEBRANCH.Sec. 300. CommonCouncil.

    There is hereby created the Common Council to exercise the powers provided for theCommon Council in this Charter. The Common Council shall be compr ised of seven ( 7) electedoffices, the members of which shall be elected from wards by the voters in the ward, in themannerprovided in this Charter.Sec,301. Creationof Wards.

    The City shall be divided by ordinance into seven(7) wards,designated as First Ward,Second Ward, Third Ward, Fourth Ward, Fifth Ward, Sixth Ward, and Seventh Ward. Theboundaries of the wards shall be reviewed at least every ten (10) years upon completion of thefederal decennial censusormoref requently as may be determined necessary. Boundary changesshall not be made morethan oncein any two (2) year per iod norwthin ninety ( 90) days of anygeneral municipal election. The boundaries of each ward shall be adjusted by the CommonCouncil as necessary to provide for substantially equal numbers of residents in each ward.Boundary adjustments during the termofanymember of the Common Council shall not result inthe loss of any member'sl i g i b i l i t y tohodoffice during such t e r m .Ins t a b l i s h i n goc h a n g i n gtheo u n d a r i e s ofthewads,o n s i d e r a t i o n s h a l l bei v e n , b u t isnoi m i t e d , tothefollowing factors: ontinuity,inegrityo h e s i v e n e s s ,ando m p a c t n e s soe r r i t o r y ; andgeneralt o p o g r a p h y andg e o g r a p h y .     Except as otherwise provided in this Charter, all powers of the City are vested in theCommon Council. All legislative power of the Common Council shall be exercised byordinance orresolution, subject to the approval of the Mayor as set forth in this Charter. Allother powers of the Common Council may be exercised by order or resolution, where notinconsistent wth this Charter orordinances of the City,and subject to the approval of the Mayoras set forth in this Charter. Upon the affirmative vote of at least five ( 5 ) members of theCommon Council, the Common Council may make formal investigations into the affairs of theCity,orthe conduct of any city department,office,agency,board,orcommission by compel l ingthe attendance and tes t imony of city employees, officers,orother persons,orby compelling theproduction of documents orevidence, Upon the affirmative vote of at least five ( 5 ) members ofthe Common Council,the Common Council may issue subpoenas in the nameof the City,whichshall be attested to by the City Clerk. Disobedience of a subpoena issued by the CommonCouncil shall constitute a misdemeanor and shall be punished in the samemanneras violationsof this Charter arepunished.Sec. 305. Ordinances,resolutions,and orders.

    No order, except to adjourn for lack of quorum orcompe l the attendance of a quorum,and no ordinance,orresolution,shall be valid unless it receives the affirmative vote of at leastfour (4) members of the Common Council.

    A. Procedures. E x c e p t as expressly provided in this Charter, the requi rements forthe introduction, consideration, adoption, and effective date of ordinances, including allpublication and notice requirements , shall be g o ve rn ed b y state law,

    B. Approval by Mayor. E x c e p t as expressly provided in this Charter,noordinance,resolution,ororder shall take effect wthout the approval of the Mayor. For orders,the approvalof the Mayor is presumed unless at the meet ing at which the order is passed, the Mayorannounces disapproval and the reasons therefor. All ordinances and resolutions must besubmitted in final form to the Mayor for approval.     D. Approval and override in Community Development Commission. When,pursuant to state law, the Mayor and Common Council have designated themselves as theCommunity Deve lopment Commission of the City, he Mayor shall have the power of approvalof all orders and resolutions of the Commission, in the samemanneras the Mayor has in theCity,subject to the power of the Commission to override any disapproval, n the samemannerasthe Common Council has inthe City.

For ordinances and resolutions,the date of final adoption shallbe deemed the earlier of the date of app rova l by the Mayor,orthe date when the time for theMayor's i s a p p r o v a l e x p i r e s , orthe date theMayors disapproval is o v e r r i d d e nbytheo m m o n Council .     ARTICLE VII. CITY TREASURER.

    Sec. 700. The City Treasurer.There is hereby created the posit ion of City Treasurer. The procedures for appoin t ing

    and the qualifications for the City Treasurer, and the duties, responsibilities,and functions of theCity Treasurer, shall be established, defined, and altered by ordinance of the City.     ARTICLEVII.VACANCIES.Sec. 800. Vacancies and forfeiture of office.

    An elected office shall become vacant upon the occurrenceof any of the following: anevent that causes a vacancy of public office as provided in the Government Code of the State ofCalifornia, removal of the incumbent from the office in any manner authorized by law, orforfeiture of the office. An elected officer shall forfeit the office ifthe elected officer lacks atany time during the term of office the eligibility requirements for the office established by thisCharter orby law,orthe elected officer accepts orretains another elected office oremploymentas prohibited by this Charter or by law. The existence of a vacancy shall be declared byresolutionof the Common Council stat ing the reasons for the vacancy,and the vacancy shall befilled in the mannerprovided in this Charter.Sec. 801.     ARTICLEXV. PLANNINGCOMMISSION.

    Sec. 1500. Creation.There is hereby created the Planning Commission for the City. The mannerin which,thetimes at which, and the terms for which the members of the Planning Commission shall beappo in ted , their qual i f icat ions and the number which shall constitute the Planning Commissionshall be established by ordinance of the City.Sec. 1501. Powers.

    The Planning Commission shall exercise the powers delegated to a planning commissionby state lawand by ordinance of the City,where not inconsistent wth this Charter,

    ARTICLEXVI. CHARTERREVIEWCOMMITTEE.Sec. 1600. Creation.

    In January 2010, and in January every ten ( 10) years thereafter, aCharter ReviewCommittee shall be appoin ted in accordance wth the procedures established for appointmentsunder Article XI of this Charter. The members shall serve ona voluntary basis and wthoutcompensat ion. The Mayor and Common Council may appoint a Charter Review Committeemoreoften,ifthey deem it necessary.Sec. 1601. Duties and procedure.

    The Charter Review Committee shall, after study and holding public meetings,recommend to the Common Council any amendments to the Charter for p lacement onthe ballotat the next general munic ipal election. The final recommendations of the Charter ReviewCommittee shall be presented to the Common Council no later than the first meet ing of theCommon Council in February in the year following the appoin tment of the Charter ReviewCommittee. The Common Council shall receive the recommendations of the Charter ReviewCommittee prior to the last day to p lace measuresonthe ballot for the nex general municipalelection.

    ARTICLEXVII. SALARY COMMITTEE.

    Sec. 1700. Creation.In January 2002,and in January of every two (2) years thereafter,the Mayor shall appoin t

    a Salary Committee consisting of seven(7) members, subject to confirmation by the CommonCouncil. No person shall be appointed to the Salary Committee while serving as anofficer oremployee of the City,norwthin two ( 2) years after holding such a posit ion. Members of theSalary Committee shall serveon a voluntary basis.

    Sec. 1701. Duties and procedures.The Salary Committee shall study and hold publ ic meet ings onthe issue of the totalcompensat ion for each elected official of the City. Not later than ninety ( 90) days before theend of the fiscal year, the Salary Committee shall make a recommendation to the CommonCouncil concerning the total compensat ion, including salary and benefits, for each electedofficial of the City. The Common Council shall adopt ordisapprove the recommendation of theSalary Committee prior to the end of the fiscal year. The Common Council shall have no powerto alter,amend,orotherwise change the recommendation of the Salary Committee,Sec. 1702. Effective date of changes incompensation.Ifa change in the total compensat ion for anelected official is adopted by the CommonCouncil,such change shall not take effect until after the next election for that elected official.

    ARTICLEXVII. CITIZENADVISORY COUNCILS.Sec. 1800. Enabling clause.

    Each member of the Common Council may create a Citizen Advisory Council wthinhisor her ward. The composit ion of a Citizen Advisory Council shall be determined by theCouncilmember, but the composi t ion should reflect the diverse interests wthin theCouncilmember'sard.     Sec. 2004. Independent audit.After the commencement of each fiscal year, he Mayor,wth the consent of the CommonCouncil,shall employ a qualified certified public accountant,who has nopersonal interest,directorindirect, in the fiscal affairs of the City orany of its employees orofficers. The accountantshall per form anannual audit of the books, financial records. and related documents of the Cityin accordance withgenerally accepted auditing standards for public agencies, and shall have free

    access to the books,records, inventories,and reports of all officers and employees who receive,handle,ordisburse publ ic funds,and such other officers,emp loyees, dep ar tments ,oragencies asthe Common Council may direct. As soonas pract icable after the end of the fiscal year,a finalaudit and management report shall be submitted by the accountant to the Mayor and CommonCouncil,and shall be available thereafter for public review and inspect ion.

    ARTICLEXX.TRANSITION.Sec. 2100. Adoption date and operative date.

    As used in this Charter, the term Adoption Date means the date upon which thisCharter is filed in accordance wth state law,and the term Operative Date means the date ofJuly 1,2001,except as otherwise prov ided in this Charter.Sec. 2101. Officers,employees,boards,and commissions.E x c e p t as prov ided in this section, all officers, employees, and persons serving onanyboard orcommission of the City on the Adoption Date shall continue to per form the duties oftheir respective offices,employments , and appo in tments wthout interruption and under the sameterms and conditions until provisions have been made otherwise in accordance wth this Charteroruntil the election,employment,orappointment of their successor.

    A. City Attorney and City Treasurer. Upon the Adoption Date, the personsserving in the elected offices of the City Attorney and the City Treasurer asestablished by the previous charter,shall serve,respectively,as the appointed CityAttorney and the appointed City Treasurer as established under this Charter,untila person is appoin ted to such office in accordance with this Charter,orthe officeis vacated,orthe Operat ive Date,whichever is earlier.

    B. Park and Recreation Commission.     Sec. 2104. Previous personnel system.Until the Operat ive Date, the provisions of sections 246 through 261 of the previousCharter as t hey existed immediate ly prior to the Adoption Date, and any ordinances, rules, orregulat ions adopted pursuant thereto, shall continue in full force and effect except as the same

    may hereafter be changed by amendment thereof in the manner provided by law. After theOperat ive Date orthe earlier adopt ion of the ordinance required in Article XIX of this Charter,said sections, and any ordinances, rules, or regulat ions adopted pursuant thereto, shallimmediate ly cease to have any force oreffect. The adopt ion of this Charter shall not affect anye m p loy ee g r ie v an c e proceeding oraction that has been commenced prior to the Adoption Date.Sec. 2105. Safety Employees'Salaries.The provisions of Section 186 contained in the previous Charter as it existed immediate lyprior to the Ad o p t io n Date,and any ordinances, rules,or regulat ions adopted pursuant thereto,shall continue in full force and effect. These provisions shall immediate ly cease to have anyforce and effect upon adopt ion and implementat ion of SB402 or similar binding arbitrationactions from the State, and the expiration of the current labor contracts. In the event SB402 orsimilar legislation is repealed, the City of San Bernardino shall maintain in effect the rules andregulat ions contained in SB402 orany similar binding arbitration action from the State.Sec. 2106. Previouscharter sections treated as ordinances.

    The following sections of the previous charter,as they existed immediately prior to theAdoption Date,shall be treated as ifenacted by ordinance, and may be amended, repealed, orrep laced by ordinance after the Adoption Date.     Sec. 2107. Effectiveness and repeal offormer charter.Upon the Adoption Date, the provisions of this Charter shall be in full force and effect

    under the law. The former Charter is hereby repealed except that ( I) Charter Section 41 is notrepealed orotherwise amended by this Charter,and said Charter Section 41 shall continue in fullforce and effect in this Charter numbered as Section 2003, (System for Assessment, Levy,andCollection of Taxes); ( 2) Charter Section 134 and Charter Sections 160 through 171, inclusive,are not repealed norotherwise amended by this Charter and said Charter Section 134 and CharterSections 160 th rough 171, inclusive, shall continue in full force and effect in this Charternumbered as Sections 1200 through 1212, inclusive, in Article XII (Water Department); and ( 3 )Charter Sections 190, 191 and 192 are not repealed norotherwise amended by this Charter andsaid Charter Sections 190, 1 91 and 192 shall continue in full force and effect in this Charternumbered as Sections 1400, 1401 and 1402 in Article XIV.Sec. 2108. Eliminationof transitionprovisions.

    In the event the sections of this article become obsolete in the judgment of the CityAttorney,by virtue of the comple t ion of all actions required under the section, the section shallbe deemed expi red and the City Clerk shall secure removal of that section from the next printingof the Charter.

    ARTICLEXXU. MISCELLANEOUS.

    Sec. 2200. Oathof office.Every officer of the City, appointed orelected, before entering upon the duties of theoffice,shall take the oath of office as provided for in the constitution of this state, and shall file

    the same with the City Clerk.Sec. 2201. Official bonds.

    Officers and e m p lo ye e s s ub je ct to group or individual bonds to insure the faithfulper formance ofofficial duties shall be determined by ordinance of the City. The ordinance shallfix the amount of such bonds,and shall provide for the payment of the premium of such bondsby the City.Sec. 2202. Conflicts of interest and ethics.

    Regulat ions governing conflicts of interest and ethics applicable to officers, employees,members of boards and commissions, and candidates for elected office of the City may beestablished by ordinance of the City. Unless otherwise required by law, the City shall not berequired to negotiate ormeet and confer wth officers, employees, or employee organizat ionsregarding the adopt ion orrevision of such regulat ions.

Prohibition against holding other office orcity positions.E x c e p t where authorized by law, noelected officer of the City shall hold any otherelected public office during the term for which the person was elected to office, No electedofficer shall hold any other munic ipal office orhold any office oremployment , the compensat ionof which is paid wth funds of the City,while serving as anelected officer of the City.
