This information is provided for guidance and consideration for applicants and licensees in meeting the requirements under Act 16: Pennsylvania Medical Marijuana Program (2016.)

TSE provides services to applicants and licensed business facilities under the Pennsylvania Medical Marijuana Act (Act 16,) established on April 17, 2016.

The PA Department of Health shall oversee the program, including by developing rules, inspecting medical marijuana businesses, processing applications, and issuing patient ID cards and business licenses. The law also creates various boards and involves other state level agencies charged with implementing, and overseeing the act. The PA Department of Health may promulgate rules based on various findings and reports from internal as well as external sources.

Among the regulations, specifically PA Title 28, Part IX, Chapter 1161, Sec. 31 specifically list the surveillance and security requirements set forth by the Commonwealth of Pennsylvania. Though not currently required by law, it is recommended to establish physical security measures by way of trained and certified officers. This will enhance your business plan and model, may be required by your insurer, and may also make your business eligible for insurance discounts.

If you are planning on applying for a license/permit issued by the Commonwealth of PA; you must submit a comprehensive business plan. Part of this plan is relating to security and surveillance.
