    SECTION101.SHORTTITLE.Thistitlemaybecitedasthe"PublicSafetyandSecondAmendmentRightsProtectionActof2013".SEC.102.FINDINGS.Congressfindsthefollowing:(1)Congresssupports,respects,anddefendsthefundamental,individualrighttokeepandbeararmsguaranteedbytheSecondAmendmenttotheConstitutionoftheUnitedStates.(2)Congresssupportsandreaffirmstheexistingprohibitiononanationalfirearmsregistry.(3)CongressbelievestheDepartmentofJusticeshouldprosecuteviolationsofbackgroundcheckrequirementstothemaximumextentofthelaw.

    (4)TherearedeficitsinthebackgroundchecksysteminexistencepriortothedateofenactmentofthisActandtheDepartmentofJusticeshouldmakeitatopprioritytoworkwithStatestoswiftlyinputmissingrecords,includingmentalhealthrecords.(5)CongressandthecitizensoftheUnitedStatesagreethatinordertopromotesafeandresponsiblegunownership,dangerouscriminalsandtheseriouslymentallyillshouldbeprohibitedfrompossessingfirearms;therefore,itshouldbeincumbentuponallcitizenstoensureweaponsarenotbeingtransferredtosuchpeople.SEC.103.RULEOFCONSTRUCTION.Nothinginthistitle,oranyamendmentmadebythistitle,shallbeconstruedto-(1)expandinanywaytheenforcementauthorityorjurisdictionoftheBureauofAlcohol,Tobacco,Firearms,andExplosives;or

    (2)allowtheestablishment,directlyorindirectly,ofaFederalfirearmsregistry.SEC.104.SEVERABILITY.Ifanyprovisionofthistitleoranamendmentmadebythistitle,ortheapplicationofaprovisionoramendmenttoanypersonorcircumstance,isheldtobeinvalidforanyreasoninanycourtofcompetentjurisdiction,theremainderofthistitleandamendmentsmadebythistitle,andtheapplicationoftheprovisionsandamendmenttoanyotherpersonorcircumstance,shallnotbeaffected.SubtitleA-EnsuringThatAllIndividualsWhoShouldBeProhibitedFromBuyingaGunAre

    thattheinformationavailabletosuchofficialdoesnotindicatethatpossessionofafirearmbytheunlicensedtransfereewouldbeinviolationofFederal,State,orlocallaw;"(B)thetransferismadebetweenanunlicensedtransferorandanunlicensedtransfereeresidinginthesameState,whichtakesplaceinsuchState,if-"(i)theAttorneyGeneralcertifiesthatStateinwhichthetransfertakesplacehasineffectrequirementsunderlawthataregenerallyequivalenttotherequirementsofthissection;

    incidentsofmassviolence;(C)theroleoffamiliesandtheavailabilityofmentalhealthandotherresourcesandstrategiestohelpfamiliesdetectandcountertendenciestowardmassviolence;(D)theeffectivenessanduseof,andresourcesavailableto,thementalhealthsysteminunderstanding,detecting,andcounteringtendenciestowardmassviolence,aswellastheeffectsoftreatmentsandtherapies;(E)whethermedicaldoctorsandothermentalhealthprofessionalshavetheability,withoutnegativelegalorprofessionalconsequences,tonotifylawenforcementofficialswhenapatientisadangertohimselforothers;(F)thenatureandimpactofthealienationoftheperpetratorsofsuchincidentsofmassviolencefromtheirschools,families,peergroups,andplacesofwork;

    (G)therolethatdomesticviolenceplaysincausingincidentsofmassviolence;(H)theeffectofdepictionsofmassviolenceinthemedia,andanyimpactofsuchdepictionsonincidentsofmassviolence;(I)theavailabilityandnatureoffirearms,includingthemeansofacquiringsuchfirearms,andallpositiveandnegativeimpactsofsuchavailabilityandnatureonincidentsofmassviolenceorinpreventingmassviolence;(J)theroleofcurrentprosecutionratesincontributingtotheavailabilityofweaponsthatareusedinmassviolence;(K)theavailabilityofinformationregardingtheconstructionofweapons,includingexplosivedevices,andanyimpactofsuchinformationonsuchincidentsofmassviolence;(L)theviewsoflawenforcementofficials,religiousleaders,mentalhealthexperts,and
