Notice to all Visitors and Traders

Please read and observe the following:

● Excessive dirty vehicles will not be allowed entry, therefore ensure vehicle is clean before arrival.

● All vehicles transporting livestock will be subject to a documentation check before entry to market site.

● All visitors and traders must ensure they wear clean clothing and footwear before entering market site.

● All visitors and traders using car park areas please use main entrance.

● Hauliers and farmers delivering livestock must disinfect their boots before and after loading or unloading.

● Livestock purchased or unsold will not be allowed to move unless an authorised “pass slip” has been issued by the main office.

● No livestock will be allowed to remain on the premises after a sale.

● Only staff, livestock hauliers, owners or their agents are permitted to load or unload livestock.

● Wash hands thoroughly when leaving pennage areas.

● Please observe our staff’s instructions at all times.

Rouge Sheep Society Special Sale RulesACCEPTANCE OF STOCK : THURSDAY 16TH AUGUST - 10.00AM - 5.00PM

INSPECTION OF STOCK: THURSDAY 16TH AUGUST - 1.00PM - 5.00PM1 All Pedigree Sheep to be sold in guineas.2 There will be an ‘Upset Price’ as follows - shearling and older rams 250gns, lamb rams 200gns,

ewe lambs 180gns.3 Commission will be deducted at the rate of 5% on all pedigree sheep sold.4 Any animal in the Sale Premises which are sold by private treaty after the Auction are subject to the

full commission on the price realised and all such transactions must be passed through the Auctioneers.

5 Transfer of registrations will be dealt with by the Society.6 All sheep will be identified with tags hung around their necks.7 Sheep will only be accepted into the market and penned for sale if they are accompanied by an

official Certificate of Official MV Status which has been correctly completed. This Certificate must be handed in when the animal/s arrive at the market.

8 All sheep forward for sale will be subject to an inspection by the society inspector. The decision of the inspector will be final and any animal failing inspection may be removed from the sale at the inspectors request if serious or allowed to be sold with the fault announced in the ring and the lot tag will be out lined in red.

9 No sheep to be presented while suffering from any contagious disease.10 The vendor shall be responsible for the correctness of identity, and all sheep must have official ear

tattoos, and ear tags to comply with current ministry regulations. Buyers shall have one hour following the end of the sale to lodge any faults or misrepresentations to the Auctioneers.

11 The purchaser must satisfy himself as to the soundness and correctness of his purchase within one hour of the conclusion of the sale.

12 All sheep must be presented for inspection before being penned for sale between 10.00am and 5.00pm on Thursday 16th August. All sheep will be subject to an inspection.

13 Please note - A representative will be on duty to collect and inspect all Maedi Visna Certificates.14 Any 2 shear or older female offered for sale must have had lambs registered with the Society during

the previous two years, and must be correct in the udder.15 All sheep to be sold in the appropriate class and in the owner's flock group.16 The Classes will be: i) Shearling Rams; ii) Lamb Rams; iii) Shearling Gimmers; iv) Ewe Lambs17 Sheep represented at Shows and Sales at one year old or older must be shorn bare after the 1st

January and before being presented at their first show of the current season. Rouge lambs are not to be faked in any way by carding comb, shears, etc., except to tidy up head,

throat and chest, square tails and take long ends off under the belly and around the legs. NO OTHER PART OF THE LAMB MAY BE TOUCHED.

Hair on faces and legs may be removed and the faces and legs may be washed and or lightly dressed with colourless oil, but may not be artificially coloured in any way. The use of hair removing substances is strictly forbidden.

18 All male sheep to have two correct testicles. No Rigs or Chasers to be shown or sold.19 No lambs to be born before 1st January. If born before this day they become shearling reaching the

1st January and must be tattoed with the appropriate letter.20 The vendors are responsible for taking their sheep to the sale ring and returning them to the pens

after being offered for sale.21 The Purchaser will not be entitled to a claim for consequential loss as a result of infertility or any

other reason.22 Errors and Omissions. The Auctioneers CAN ACCEPT NO responsibility for any errors or omissions

printed in this catalogue.23 Substitute entries will be accepted at this sale, but all information must be with the auctioneers one

week prior to the sale day. Substitutions will be restricted.

It is the vendors responsibility to ensure that all tattoo's and tags are legible. No animal will be accepted into the sale unless it can be correctly identified.

Conditions of SaleAll sheep are sold under the Conditions of Saleas displayed in the mart recommended by the

Livestock Auctioneers Market Committee for England and Wales.

The following is an extraction taken from the above:

PART VIII - SHEEP

Female sheep not described as in Lamb76 A female sheep which is not described in the catalogue or at the time of sale

as in lamb is warranted as not being in lamb.77 If within 14 weeks after the day of sale a female sheep warranted as

aforesaid proves to be in lamb, and within 14 weeks and 5 days after the day of sale, the purchaser gives to the auctioneer written notice supported by a certificate signed by a Slaughterhouse manager or a Veterinary surgeon or other competent person, that such female sheep has proved to be in lamb then, if the sheep lambs at a date which proves it to have been in lamb at the date of the sale, either the purchaser may return the sheep and her lamb, if any, to the vendor or, at the sole option of the purchaser, the vendor shall pay to the purchaser as and for ascertained and agreed liquidated damages, to cover all expenses, depreciation in value and other damages whatsoever, a sum equal to 25per cent of the purchase price of the sheep.

Female Sheep described as Correct78 All female sheep described in the catalogue or at the time of sale as correct

are warranted to be sound in mouth and udder.79 If any such sheep is proved to be unsound in mouth or udder, that is to say

is lacking any of the 8 broad teeth or has damaged or worn teeth or defective udder, and notice of such unsoundness is given by the auctioneers in writing within 5 clear days after the day of sale, supported by a certificate signed by a veterinary surgeon, then either the purchaser may return the sheep to the vendor, or, at the sole option of the purchaser, the vendor shall pay to the purchaser as and for ascertained and agreed liquidated damages, to cover all expenses, depreciation in value and other damages whatsoever, compensation at the rates set out in Appendix 1 (i) to these Conditions.

Female Sheep proving Barren80 If any female sheep, which was described in the catalogue or at the time of

sale as being in-lamb, proves not to have been in lamb at the time of sale and within 21 days after the day of sale the purchaser gives written notice to the auctioneers of his intention to return the animal, supported by a veterinary surgeon’s certificate that such sheep has proved not to have been in lamb, then the purchaser may return such sheep to the vendor.

Stock Rams, including Lambs81 Any ram sold for the figure stated in Appendix 1 (i) or more is warranted to

be capable of and effective at natural service. If any such ram is proved to be incapable of or ineffective at natural service and written notice to that effect, supported by a veterinary surgeon's certificate in the terms hereinafter mentioned, is given by the purchaser to the auctioneers within 14 weeks after the date of sale, then the purchaser may return the ram to the vendor, who shall, at the purchaser's option, replace the ram with another ram of equal value capable of stock-getting, or refund the purchase price of the animal together with such other costs and charges as the purchaser may be entitled to under these Conditions.

82 The veterinary surgeon's certificate shall certify: (a) that the ram's incapacity or ineffectiveness is not the result of injury,

accident or illness happening after the time of sale; (b) that the purchaser's female breeding stock has been found on

examination to be in normal breeding condition; and (c) that they are not responsible for the ram's incapacity or ineffectiveness.

NOTICE TO ALL VISITORS AND TRADERSPLEASE READ AND OBSERVE THE FOLLOWING

All visitors and traders on site will be responsible for ensuring that they and their employees or sub-contractors engaged by them comply with all legal requirements, including the Health and Safety At Work etc., Act 1974, The Management of Health and Safety At Work Regulations, The Provision And Use of Work Equipment Regulations, etc.

All visitors and traders will be responsible for ensuring that their operations in no way affect the integrity of the company or its fire, safety or security arrangements and in no way compromise the health and safety and welfare of other visitors to and or employees of Harrison & Hetherington.

Although it is the visitors and traders responsibility to ensure that plant, equipment and systems in work are safe, Harrison & Hetherington Limited reserve the right to ask any visitor or trader to leave the market for any breaches in the Health and Safety Rules and/or Regulations.

Vendors must inform Harrison & Hetherington Limited of any livestock due to attend the market whose temperament, behaviour or condition may call for additional precautions for its safe handling.

When loading or unloading livestock handlers must ensure that the dock and vehicle gates are securely fixed so as to prevent the escape of animals.

Traders are responsible for providing and maintaining suitable livestock handling equipment. They should ensure that livestock handlers are fit, experienced in livestock handling and familiar with the livestock in their charge.

Children must not be permitted in any area where they may be at risk from livestock or machinery.

In the case of bulls, during the period when the show/sale is open to visitors, bulls in stalls or pens should not be left unattended. If the handler is temporarily absent, arrangements should be made with another vendor, steward or member of Harrison & Hetherington staff to oversee the bull until the handler returns.

Handling of Livestock at shows and sales: Harrison & Hetherington Limited recommend that an adult person should accompany any junior person during the showing/sale of livestock in the ring and reserves the right to intervene at any point if, in the company’s opinion, the person showing the livestock is at risk in undertaking that activity.

Passageways must be kept clear at all times during the auction sale. PLEASE DO NOT STAND IN THE SALE RING ENTRANCE AND EXIT PASSAGES.

The auction ring man escapes and refuges must be kept clear at all times.

All portable electrical equipment supplied and/or used by visitors and traders must be safe and fit for the purpose and should have a valid portable appliance test certificate.

AUCTIONEER’S TERMS & CONDITIONS OF SALE

(Incorporating the Auctioneer’s Terms and Conditions as recommended by theNational Beef Association)

1. The biddings to be regulated by the Auctioneers and the highest bidder, subject to the Vendor’s reserve (if any), to be the purchaser. No bid shall be retracted and if any dispute should arise between two or more bidders, the Lot in dispute to be put up again and resold, or the Auctioneers may determine the dispute at their own discretion and their decision shall be final. The Auctioneers reserve the right to refuse the bid of any person without being called upon to give reason for such action.

2. The Purchaser to give his full name and dwelling place and pay for all Lots purchased immediately at the close of sale. No Lot or Lots shall be removed from the sale premises until paid for and a pass-out slip obtained from the Auctioneer’s clerk but each and every Lot shall immediately at the fall of the hammer be considered as delivered and be and remain in every respect at the absolute risk and expense of the respective purchaser or purchasers thereof and shall be removed from the sale premises at the purchaser’s expense. The right of property shall not pass until the full purchase price is paid.

3. Purchasers paying by cheque must be prepared, if required, to produce a banker’s reference. As a result of the Money Laundering Regulations (2003) the auctioneers are unable to accept cash payments in excess of nine thousand pounds sterling for any any single or linked purchase transaction.

4. All statements in the catalogue, or made by the Auctioneers at the time of sale, also the correct identification of the animals, are the entire responsibility of the Vendors. The Auctioneers take no personal responsibility for the correctness of such statements or identities.

5. All statements in the catalogue, or any made by the Auctioneers at the time of sale relating to any veterinary or other tests are to be taken as statements of fact only. No such statements shall guarantee the purchaser of any animal against loss arising from the subsequent reaction of such animal to any test administered after the sale and the Vendors shall not be liable in any way should this occur.

6. All stock is sold subject to the Conditions of Sale recommended for use at markets by the Livestock Auctioneers’ Markets Committee for England and Wales except in so far as these conflict with any Special Conditions applicable to the sale of pedigree stock, when the latter Conditions shall prevail.

7. Neither the Vendors nor the Auctioneers will be responsible for any accident or injury to persons or property, through fire or any other cause whatsoever, nor for any damage by animals prior to, during or after the sale.

8. No undertaking by the Auctioneers or their servants to take charge of any Lot or Lots after the sale or to forward them to their destination shall be held to impose upon the Auctioneers any legal obligation or vitiate any of these Conditions.

9. Inasmuch as the Auctioneers act as agents for a disclosed principal they shall not be considered personally responsible for any default on the part of either purchasers or Vendors and the remedy shall be against them only and not against the Auctioneers.

10. If these conditions are unfulfilled, the Vendors or Auctioneers shall have the power to resell the Lots, retaining any surplus and charging any deficiency and expense to the defaulter.

We may share the information with other members of our group and may make this information available to relevant media groups and other interested parties on request. We and other members of the group may contact you by telephone, e-mail, post or fax to inform you of products or services available. If you do not want to be contacted for marketing purposes or do not wish your information to be made available to any other parties please notify us in writing.
