theNewLaw(3012-c) Section80-1.1oftheCommissionersregulationsspecificallyexcludespupilpersonnelservicesfromthedefinitionofclassroomteachingservices;therefore,schoolpsychologistsandschoolsocialworkers
whoarepupilpersonnelserviceprovidersarenotcoveredbythenew
law. Ateacherperforminginstructionalsupportservicesformorethan
40%ofhis/hertimewillalsonotbeincluded. AlicensedspeechlanguagepathologistunderTitleVIIIofthe
EducationLawthatisnotacertifiedteacherundertheCommissionersregulationsanddoesnotprovideinstructionalservicesisnotconsideredaclassroomteacher.
Substitutes,long-termorotherwise,arenotcoveredby3012-c. Acertifiedlibrarianwhoisnotateacherofrecordisnota"classroom
teacher"andthereforewouldnotneedtobeevaluatedunderEducationLaw3012-c.However,ifacertifiedlibrarianisateacherofrecord,he/shewouldbeconsidereda"classroomteacher"andthereforemustbeevaluatedunderEducationLaw3012-c.
