Yardage: Cattle that are notpicked up within one week following the sale will be charged $5.00/day.Kelly Cattle Company will be held harmless for any death loss thatoccurs if a bred that has been sold calves on our farm. Buyer remainsresponsible for payment of said bred heifer. Identification: It shall bethe obligation of the seller to determine that each animal sold carries areadable tattoo or brand. Registration and Transfers: All lots listed asregistered will be transferred after settlement has been made. It is truly gratifying to see the samefaces on the seats every year buying cattle because of the impact these breds and bulls are making in buyers’ programs. We work hard toproduce genetics that will be profitable in your own herds.

We have one simple goal here and that is to raise high quality cattle. The priorities for our cow herd are fleshing ability; soundness, fertili-ty and when you combine those traits with muscle, body and look you have something that will be profitable for years to come. We strive toprovide you with predictable, maternal bred genetics that are versatile in their kind and add to your operations bottom line. These are cattlethat have worked for us and for our customers.

We welcome Dave and Stacey Mente to the sale this year as they have consigned a nice group of breds from past Right Directionfemales. These females are a true testament to how well a Right Direction bred can work for you.

Breeding GuaranteeBulls: All bulls are guaranteed to be breeders. Bulls less than twelve (12)months of age, provided they have been properly cared for, are in goodhealth and have not been noticeably injured since the sale, must be sementested before being turned out with females or before reaching 15 monthsof age, whichever occurs sooner. If any bull is reported as a nonbreeder,the buyer must first comply with the following requirements: A) Purchasermust notify the seller of his dissatisfaction in writing within 4 months ofsale date; and/or B) Purchaser may return the animal to the seller’s farm, atthe purchaser’s expense, if in good condition and accompanied with ahealth certificate indicating that the animal is free from infectious and con-tagious disease. Seller is entitled to 1 month of trial following return of theanimal, at which time he will have opportunity to determine the animal’sbreeding ability. If at the end of 1 month, the seller is unable to prove theanimal a sound breeder, the seller shall have the option to replace the ani-mal with another of similar quality or refund the purchase price. Females:All females are guaranteed to breed. In order to hold the seller liable to thisguarantee, the buyer must first comply with the requirements and proce-dures set forth. Exercising options for adjustments. The buyer must notifythe seller of their dissatisfaction with an animal in writing within six monthsof the sale date. In the event an animal is claimed to be a nonbreeder, thebuyer may return the animal to the seller’s farm, at the buyer’s expense, ifin good condition and is accompanied with a health certificate indicatingthe animal is free of infectious and contagious disease. The seller is thenentitled to two-month trial following return of the animal at which time hewill have the opportunity to determine the animal’s breeding ability. If atthe end of two months the seller is unable to prove the female a sound

breeder, the seller shall have the option to replace the female with anotherof similar quality or refund of purchase price. Open Female Guarantee: If afemale sold as “open” proves to be with calf, the buyer may return thefemale to the farm of the seller for a refund of full purchase price or foranother animal of similar quality. Bred Female Guarantee: If a female issold under the conditions safe-in-calf and she proves not to be pregnant,the buyer may receive service of the bull to which she was previouslyserved if available or service of another bull of the buyer’s choice owned bythe seller, except in the case such female proves to be a nonbreeder. If afemale is sold as “pasture bred” and proves not to be safe-in-calf, the buyermay return the female to the farm of the seller at the purchaser’s expenseto be served to the bull previously used, if available, or to any bull madeavailable by the seller and agreed upon by the purchaser. In all cases, anytransportation expense shall be the expense of the buyer. Exception toGuarantee: Bred females sell guaranteed safe-in-calf the day of the saleand for ten days following the sale. In cases where the animal is fitted andshown for exhibition or is subjected to any hormonal or surgical reproduc-tive techniques after the sale, guarantee is null and void and the terms ofthe breeding guarantee, if any, should be such as is agreed upon separatelyby the buyer and seller in writing. The aforementioned terms and condi-tions shall constitute a contract between the buyer and seller of each ani-mal sold under these terms and shall be binding upon both. Animals resoldfollowing sale purchase constitute a separate transaction and the privilegesand obligations of the original two parties connected thereto are not cov-ered by the terms and conditions of this sale.
