On September 28, 1994, New Orleans Division SAC Gallagher, ASAC Knowlton, and SSA~ Ibriefed the new U.S. Attorney (USA) on the O'Neal Moore case, among other matters. The USA was advised that we were awaiting AUSA ~ Ireview. In addition, New Orleans stressed the urgency of moving forward on this matter quickly and indicated that prosecution of this matter would generate a great deal of media attention. Finally, New Orleans advised that if the USA's office did not wish to pursue this matter, we had been advised by the District Attorney's Office where the murder occured that they would take the case forward if we had anything to help towards a murder conviction.

r-----1 advised that he has done all the demolition and destructl~arious containers and removal of large steel objects from the GAYLORD~TION' formerly known as the CROWN ZELL~RBACH CORPORATION. was advised he was specific~lly being questioned in regar 0 he removal of two large sulf~ric acid taUks frQrn the CROWN ZELLERBACH CqRPORATION in the early 19805. L Jstated that if anything was ever remove~ frgIDlthe paper mill, I lis the one who would have done it. L recalled removing two of these larger tanks and stated that before any tank is removed and cut up. for scrap metal, the tank is totally disconnected from its existing structure and is allowed to sit out for anywhere from one to two months to allow all toxic fumes to esc from the tan ce the tank is . thoroughly drained, will cut up the tank into approximately our ee y e t sections of metal that are then sold for scrap metal by company.

7:55AM - Federal

o ou~s~ana. Wh~le b3 su Jec was opening the front door he was observed to be on the telephone. He was clearly heard stating "I'll call you right backll and then hung up the phone.

8:15AM - Subject exits room #157 and enters his vehicle (1993, Chevrolet Blazer, grey in color, LA handicap tag 114187 ).

8:16AM - SUbject drives his vehicle across parking lot to a DENNY'S RESTAURANT, exits his vehicle and enters the restaurant.

9:05AM - SUbject exits DENNY'S RESTAURANT and enters his vehicle moving items from the front seats to the rear seats.

9: 07AM - Chrysler ( I white in color I drives up in parking lot and sfops near sUbjects vehicl-e-.""'lT~h~e-"" unsub driver of this vehicle hands a white bag out the window to b6

b · SUbject then gets into the lb'7Csu )ect who places it in his vehicle. white Chrysler occupying the front passenger seat. The vehicle leaves the parking lot and proceeds over the Crescent City Connection on Rt90. Driver of this vehicle is a white male, approximately 55 years old, heavy·set with partially bald head.

9:13AM - Immediate surveillance on white Chrysler ended due to its being lost in traffic at a location where road construction was taking place.

9:25AM - Surveillance of subjects vehicle continued in DENNY'S RESTAURANT parking lot.

12:10PM - White Chrysler leaves the parking lot with previously described unsub driving.

12:12PM - Subject enters his vehicle and proceeds out of parking lot and enters onto Rt#90 North.

12:20PM - Vehicle proceeds to Rt#lO East

12:S2PM - Vehicle' exits Rt#10 onto Gause Blvd and stops at a RACETRAC convenience store where he purchases ice. Vehicle reenters Rt#lo east and proceeds to take Rt# 59.

1:03PM - Vehicle leaves Rt# 59 onto Rt# 11. Vehicle pulls off to the side of the road at the top of the exit ramp for a short period of time then makes a left turn. vehicle proceeds to the BOGALUSA, LA area by way of Rt#21.

1:40PM - surveillance ended and handed over to other surveillance units.

5.} Since the fW came forth with the information concerning~ alleged involvement, the New Orleans Division has focused primarily on attempting to corroborate the information that' ~has provided in the consensuallyrecorded conversations. It should be noted that the New Orleans Division is also concerned that possibly~ 'wants people to believe that he is responsible for the shooting and possibly could not have done the shooting. Everything that! , has mentioned in the consensually recorded conversations is primarily of general public knowledge. Evidence that has been independently corroborated is the fact that a sulfuric acid vat did exist at ;he CiOWN ZELLERBACH PAPERMILL and ~ and r ...J had access to this acid vat. c:::::::::::::: men~ioned tha ERNEST RAY McELVEEN acted as a decoy for this sh90ting. It is a documented fact that McELVEEN was stoppedwithin an hour of the shooting in a pickup truck that matched lb6the description of the one used in the shooting of the deputies. lb7CMcELVEEN's reaction, according to FD-302 1 s from 1965, reflect lb7Dthat McELVEEN was quite nervous, vomited, and immediately requested a lawyer. No evidence to support an indictment could be obtained against McELVEEN. McBLVEEN is a known racial bigotand is very proud of this fact. McELVEEN recently supportedDAVID DUKE in his bid for governor of Louisiana.

~~~~Ihas stated that several types of calibers of ammunition had been utilized in the shooting of the deputies.Five (5), 30.06 caliber shell casings were recovered from the scene and are in the custody of FBI New Orleans at this time. According to FBI Laboratory experts, the shell casings reflect that the weapon utilized in the shooting was possibly of a foreign make. ~ ~states th~t he did have a weapon of foreign make and 1£ was obtained from HOWARD LEE (deceased), who had been convicted of selling weapons illegally in Federal Court in the 60's. ! The initial investigation into the captioned matter began on 6/2/65 following the shooting of Deputy Sheriffs O'NEAL MOORE and DAVID CREED ROGERS at approximately 10:15 p.m. in Varnado, Louisiana. ROGERS and MOORE were the first black deputies to be employed by the WASHINGTON PARISH SHERIFF'S OFFICE. Both deputies were patrolling the Washington Parish area at the time they were shot. The deputies were traveling on Main street in Varnado in their police vehicle. When the police vehicle crossed a set of railroad tracks on Main street, a black chevrolet pickup truck passed them on the railroad tracks. Two individuals appeared from the bed of the pickup truck and opened fire on the two deputies. It is believed there were two occupants in the back of the truck along with one occupant driving the vehicle. MOORE was killed instantly, sUffering a fatal wound to the head, while ROGERS sustained injuries from the gunshots and the sUbsequent auto accident in which the patrol vehicle struck a large oak tree. ROGERS subsequently lost vision in his right eye, resulting from this incident. ROGERS remained on the police force and retired in the late 1980s as a captain.

Extensive investigation was initially conducted in this matter by New Orleans FBI. Although numerous subjects were developed during the course of this extensive investigation, the Bureau failed to identify individuals responsible for the killing of MOORE and the wounding of ROGERS.

In January, 1989, the case was reopened by the New Orleans Division. After reviewinq approximately 40 volumes of the 1965-1967 investigation, numerous individuals were reinterviewed with limited information being developed. shooting had been obtained from HOWARD LEE. New Orleans contacted the spouse of LEE who advised that HOWARD LEE had recently passed away. The interview did confirmed that LEE was arrested and convicted by Federal authorities in the 1960s for the illegal selling of weapons.

Due to the fact that the captioned matter has attracted national media attention, many of the incidents that would be singUlar in nature were pUblic information and were b6 mentioned in numerous TV and newspaper reenactments of the b7C incident. New Orleans's analysis of the consensual recordings b7D does not reveal any item singular in nature that would be case specific that could further corroborate I ~confession as being true in nature. It shOUld be noted that McELVEEN WaS arrested on the night of the shootingin Tylertown, Mississippi, which is about. 40 minutes from the scene of the shoot,inq. McELVEEN was arrested driving erratically in a 1955 Chevrolet pickUp truck which matched the description of the vehicle utilized in the shooting of the two deputies. McELVEEN was arrested and charged by state authorities with the murder and was subsequently released on a $25,000 bond which was posted by relatives and friends. McELVEEN was a known member of the local chapter of the KKK. No Federal charges were even brought against McELVEEN, and the state charges, after approximately two years, were withdrawn by the Washington Parish District Attorney's Office due to inSUfficient evidence. McELVEEN did make a few spontaneous·remarks to the effect that he was afraid that once the people in Bogalusa found out he was arrested, they would kill him. While in custody, McELVEEN was also extremely nervous and vomited several times during his incarceration and requested

an attorney immediately. McELVEEN was employed at the time of the shooting by CROWN ZELLERBACH and is presently still employed at this company.

I Ihad given telephone number lias her contact number when she provided the above information to New Orleans on 9/28/94. She had stated that she would be returning to the lower 48 in mid-October 1994 and that she would recontact the FBI and provide the diary.

By March, 1995, she had not made contact and the lead for Anchorage was set. Repeated efforts to contact her at the above telephone number met with negative results. The telephone number had an answering machine and messages were left to contact the Anchorage lead Agent.

On June 30, 1995, a f~meleF rhO refused to identify herself, called and stated thatiwoul~ be out of the State of Alaska for one and a half years. This person would not give a contact telephone number or a forwarding address. They did agree to forward the message tol Ito contact the Anchorage FBI.

It is the opinion of the New Orleans Division that the evidence obtained in this investigation be reviewed by the St. Tammany District Attorney's Office which handles the Washington Parish area of Varnado, Louisiana. It appears that New Orleans has exhausted all known investigative techniques and all leads have been covered to date.

As the Bureau is aware, J lhas admitted to being a shooter in the 1965 shooting on tlie several consensually recorded and CCTV conversations. A small portion ofr Iadmissions have been corroborated, but nothing of singular in nature admissions can be corroborated. The District Attorney of St. Tammany Parish has shown and expressed an interest in possibly reviewing the evidence obtained by the FBI to date.

Since all investigative efforts concerning this investigation have been exhausted, this matter is going to be considered closed by the New Orleans Division.

CASE SYNOPSISIEXAMINER CONCLUSION

Victims were attacked at Varnado, La. on 6/2/65, by several unknown subjects and Deputy Moore was killed while Deputy Moore survived. Both victims were the first black deputy sheriffs hired in the state of Louisiana and the attack ~as thought to have been carried out by Ku Klux Klan members. The FBI conducted an extensive investigation into this matter and no serious suspects were developed, however, the case was reopened on new information several years ago.

This case was first opened in 1965 after members of the Ku Klux Klan allegedly ambushed a patrol car and killed a black deputy sheriff in Louisiana. Another black deputy in the same patrol car suffered permanent injuries. The case was subsequently re-opened af~r information surfaced that a former Klan member,' J was heard bragging about his involvement ~n the shooting .

admissions were seni to :~ FBI lab for psychological tests. The results showed that was boasting about his participation in the incident and that his statements lacked credibility.

This case was first closed in 1970 after the statute of limitations expired. 1 This case has been re-opened several times after new leads have surfaced, most recently in 1992. The FBI has concluded its investigation and was unable to gather sufficient evidence to support a prosecutable case. Therefore, we should again close this case until such point in time that we have new leads which warrant further investigation. AUSAJ was informed of the Criminal Section's planned closing of ~E~h~1~S~---matter and had no objection. However, ~ ~ who has been working on this case for several years, indicated that the file will remain open in his office.

B.ut in the Moore case, leads have dried up, wit· lesses have died, and justice begins to seem more antasy thall reality. It's not even clear what evidence till exists. Champagne says the FBI picked up all the vidence about a year ago and "it was a pretty good ·ite of stuff." Because the case Is unsolved, the FDl D ~Police will not release their reports. I

Yet another problem is money, Champagne says. The district attorney's office is not by nature an investigative body, he says, and does not have the resources or manpower to cha&e down a 33-year-old' unsolved murder case. Blit if they received help from ·an outside source, such as Attorney Generat Richard Ieyoub, they'd welcome it-and the chance to bring Moore's murderer to trial. .

If the Washington Parish DA wants to reopen the case, and has new evidence or witnesses, the attorney general's'office would help, says Pam Laborde, an leyoub spokeswoman.

His name comes up publicly about on~ a year - dUring African~American ,History Month. Dredging up this crime would be dredging up a past many Bogalusans would prefer to forget.

On the same date. SAI lcontacted the previous case ~gent, SSAr ~ who advised that the Washington Parish DisErict Attorney's Office 'records regarding this matter were located in the basement of the District Attorney's Of rice in Franklinton, Louisiana and were copied but the originals remained in the custody of the District Attorney's Office. He advised that all physical evidence regarding this matter, such as bullet casings, etc, was seized by the FBI.

On 6/7/00, SSA ~ I met with FADA Gascon and provided him with copies of Exhibits 1B30, 1B32, lB33, 1834, IB35, IB36, and related verbatim transcripts. FADA Gascon signed an FD-597, accepting custody of duplicate copies of these recordings and transcripts .. FADA Gascon stated that his office would review these recordings and would be in contact with the FBI and/or United States Attorney's Office, concerning any additional information that be requested .
