CHAPTER 1What are these practice standards and good practice guide for?
When a child or young person becomes ‘looked after’ by their local authority and is placed with a kinship carer (a family member or close friend), a foster carer, placed in a residential home, placed at home with parents, or placed for adoption, then the child or young person must have an ‘independent reviewing officer’ appointed. The IRO is independent of the child or young person’s social worker and has certain responsibilities set out in the Welsh law covering children and young people who are looked after.
These practice standards and good practice guide set out, in detail, the ways in which the IRO should monitor and review and support the child or young person’s care and support plan. It also sets out the responsibilities a local authority has in ensuring the IRO is able to carry out their work.
Why do we have independent reviewing officers? – The IRO as the ‘guardian of the care plan’Before2004localauthoritiesdidnothaveastatutorydutytoprovide an independent oversight of a looked after child or youngperson’sreview.Practicevaried,withteammanagersforthe child’s social worker or invited team managers from another teamchairingthereview.Someauthoritieshad,atanearlystage,introducedtheelementofindependencewithreviewingofficers.In2002TheHouseofLords(nowtheSupremeCourt)lookedatacasewhereacareplan,putforwardtothecourtattheendofcareproceedings,hadnotbeenadheredto.TheHouse of Lords considered whether the court may have powers to monitor a child or young person’s care plan once a care order hadbeenmade.Theycametotheconclusiontherewerenosuchgeneralpowerstooverridealocalauthority,butthatalocalauthoritycouldbechallengedundertheHumanRightsAct1998(forabreachofarticle8oftheEuropeanConventiononHumanRights–therighttoaprivateandfamilylife).Butthequestionremained:whowouldbeabletotakeonthatchallengeonbehalfofthechildoryoungperson?
AsaresponsetothiscaseandsincetheChildrenAct2004,alocalauthorityhasadutytoappointanIRO,inthefirstplaceto‘monitortheperformanceofthechild’sreview’and,intheeventofabreachofthechildoryoungperson’shumanrights,toreferthe child’s case to Cafcass Cymru. Since the implementation of theSocialServicesandWell-being(Wales)Act2014in2016,the duty now extends to monitoring the child’s whole case, not just their review.
The status of this guideThe role and functions of the IRO and the local authority in relationtocareplanningaresetoutin:
1) Primary legislation:theSocialServicesandWell-being(Wales)Act2014setsout,insections99-102,threemainfunctions.Thesearelookedatindetailinchapters5,6and7.Primarylegislationmustbeadheredto.
2) Secondary legislation:theCarePlanning,PlacementandCaseReview(Wales)Regulations2015,regs38–44,53–54,set out the detail of the IRO’s role in relation to the three main functions.Secondarylegislationmustalsobeadheredto.
3) Code of Practice:theSocialServicesandWell-being(Wales)Act2014,Part6CodeofPractice,nowinitssecondversion,April2018,paragraphs364–394,elaborateontheregulationsandexplainwhatmustbedoneandwhatmayorshouldbedoneinrelationtotheroleandfunctionsoftheIRO. When the Code of Practice states that something must bedone,thentheIROorlocalauthorityhasnochoicebuttofollowtheCode.WheretheCodestatesthatsomethingmay,orshouldbedone,then,althoughtheIROandlocalauthoritymusthaveregardtotheCode,theyarenotactingunlawfullyif they do not adhere to the guidance set out.
Why is there a need for practice standards and a good practice guide when there are three layers of law and guidance already covering the role and functions of the IRO? Because this is acomplicatedareaoflawandpractice,concerningthelivesandfuturesofsomeofthemostvulnerablepeopleinourcommunity,requiringamoredetailedguide,bothfortheIRO’sthemselves,forchildrenandyoungpeople’ssocialworkersandtheirmanagersandfor‘corporateparents’,thatistheseniormanagersandelectedmembers(councillors)foreachlocalauthority.

Thisguideitselfhastwodifferentbutinterlinkedparts:
1) Practice standards:thesearestandardsbywhichalocalauthorityisinspectedbytheCareInspectorateWales(CIW).An inspection will take account of the standards and see if the localauthorityismeetingthem.Theyarenotstatutorybasedstandards,astheyarenotcontainedintheAct,RegulationsorCodeofPractice,buttheyarestandardsendorsedbytheWelshGovernmentandtheywillassistIRO’s,localauthoritiesand inspectors in achieving and maintaining the highest possiblestandardsinsupportingouryoungpeopleincare;
2) Good practice guide: this guide again has no statutory authoritybutsetsout,forallthoseconcernedwiththechildoryoungperson,howtoachieveandmaintainthesehighstandards.
Who are these practice standards and guidance for? Theyarefor:
IRO’s and their managers,whoneedtoknowofthebestpracticeavailableinordertoundertaketheirroletothebestoftheirability;
Children and young people’s social workers and their managers,whoneedtobeclearabouttheirownroleinexercisingparentalresponsibility,eitherunderthetermsofacareorderorinterimcareorder,orusingtheauthoritygrantdtothembybirthparentswhenthechildisaccommodatedunders76SSWB(W)A.Socialworkersalsoneedtoknowwhattoexpectfrom the IRO in terms of involvement with the child or young person’scase;
Corporate parents,theexpressionusedforthecollectiveresponsibilityalocalauthorityhastowardsachildoryoungpersonwhoislookedafter,includingelectedmembers(councillors),seniorofficers,allrelevantemployeesandpartneragencies.
The courts and Cafcass Cymru,sothattheymayhaveaclearunderstandingofwhattoexpectfromanIROduringthecourseofpublicchildcarelawproceedings.
Thepeopleitconcernsare:
• The child or young person,themostimportantpersonintheprocess.Chapters5,6and7haveideasastohowtomaketheroleoftheIRO,bothonamonitoringbasisandduringthereviewprocess,relevantandusefultotheyoungperson,facilitating and encouraging participation and taking into accounttheyoungperson’sownviews,wishesandfeelings;
• The child/young person’s birth parents and extended family,whowillneedtobeinvolvedinthereviewingprocess,havetheirownparentalresponsibilityacknowledgedandrespectedandtheirownviews,wishesandfeelingslistenedto;
• The child/young person’s prospective adoptive parents(ifthechildisplacedforadoption);
• The child/young person’s foster carers,whoshouldberegardedasprofessionalswithinthecontextofareview;
• The child/young person’s key workerifinresidentialcare;
• Other people important to the child/young person(forexampleeducation,healthandstatutoryadvocacyprovidersforlookedafterchildrenandyoungpeople).
Notethattheterm‘child’scase’isusedasitreflectsthewordingintheprimarylegislation(the2014Act).However,thetermdoesnotreflecteitherthespiritoftheActorthesestandardsanditisonly used where necessary.

There are many people involved in a child or young person’s life. When that young person becomes looked after by a local authority then that number increases greatly. The purpose of these standards and guidance is to keep the young person at the centre of all planning.
Thereareanumberoflegalframeworkswhichapplytoachildoryoungpersonwhobecomeslookedafterandtheseframeworkshelp to ensure that they remain the most important person in theprocess:
1) Thewell-beingoutcomessetoutintheSocialServicesandWell-being(Wales)Act2014.
Well-being outcomes for children and young people:
• Protectionfromabuseandneglect
• Promotion of physical and mental health and emotional well-being
• Promotionofphysical,intellectual,emotional,socialandbehaviouraldevelopment
• Maintenanceordevelopmentoffamilyorothersignificantpersonal relationships
• Involvementineducation,trainingandrecreationactivities
• Development and maintenance of social relationships and involvement in the local community
• Socialandeconomicwell-being(includingnotlivinginpoverty)
• Livinginsuitableaccommodation
The IRO and local authority must take account of the IRO’s role in taking forward these personal outcomes for the individual child or young person.
2) TheUnitedNationsConventionontheRightsoftheChild.TheUNCRCispartofWelshlawandarticle12,‘Childrenhavetherighttosaywhattheythinkshouldhappen,whenadultsaremakingdecisionsthataffectthem,andtohavetheiropinionstakenintoaccount’,iscentral.
The Children and Young People’s National Participation Standards are referred to with each standard. They are set out,onthefollowingpage,infull.
3) TheEuropeanConventiononHumanRights.ThisConventionisalsopartofourWelshandUKlawandarticle6(therighttoafairtrial)andarticle8(therighttoaprivateandfamilylife)apply throughout these standards.
4) Wheneverafamilycourt,oradoptionagency,considersachild then the principles set out in s1 Children Act 1989 or s1AdoptionandChildrenAct2002apply.

Reviews where there is authority to place for adoptionOnceachildbecomesthesubjectofaplacementorderoroncetheirparentshaveconsentedtotheiradoption,thereviewingdutiessetoutintheSSWB(W)AnolongerapplyandnewdutiesaresetoutintheAdoptionAgencies(Wales)Regulations2005.These regulations are replicated in Chapter 8 of this guide. Althoughthechildremainslookedafter,theplacementorderchanges the focus of the review. During reviews held under the AA(W)R,theadoptionplanandadoptionsupportplan,ratherthanthePart6careandsupportplan,willbereviewed.Thesereviewing arrangements continue throughout the placement with prospective adoptive parents and until the adoption order is made.

• IRO’scouldbemorecreativeabouthowtheyundertakereviews(theyneedtogivegreaterthoughttotheuseoftechnology).Someyoungpeoplethinkthereis,forexample,the potential to use skype for people to link into the part of themeetingthatwasrelevanttothem;
• YoungPeopleshouldreceiveclearfeedbackafterthemeetingaboutwhatwasagreed(evenifitisnotwhattheyhadhopedfor).Someyoungpeoplefeeltheyshouldhavetheminutes,butunderstandthattheycannotnecessarilyhaveaccesstoinformationthatisaboutsomeoneelse, e.g.thebirthparent(s);
• Ifthereistobeameeting,youngpeoplewantaviewonwhoshouldbepresentandforwhat.Iftheycompleteconsultationdocuments,pre-review,theyneedtoberelevanttotheyoungpeople’ssituationandshouldbeclearonwhatcan orcannotbeconsidered,e.g.contactwithbirthfamily;
• Youngpeoplewantaviewonwhereameeting(ifthereistobeone)shouldbe.Theyareparticularlyuncomfortablewithmeetingsbasedinschool;
• Young people should understand what an advocate is and have the chance to have one to support them.

CHAPTER 3Defining the role of the IRO – What does an IRO do?
There can be confusion around what an IRO must, should or may do. Later chapters go into the detail of the role but this chapter aims to make clear what the IRO has the power to do and what they do not have the power to do. The young person needs to know, when they meet or speak with their IRO and/ or attend a review meeting, what the IRO’s relationship is with their social worker and the social worker’s manager; who has the final say when a decision has to be made?

383:TheindependenceoftheIROisessentialtoenablethemtoeffectivelychallengepoorpractice.TheCPPCR(W)RegulationsdonotprescribethepositionofIRO’swithintheresponsiblelocalauthoritybuttheydoprescribeminimumlevels of independence.
384:TherearespecificcategoriesofpersonsthatthelocalauthoritymaynotappointtocarryouttheIROfunction(Reg54(3)0ftheCPPCR(W)Regulations).Theseare:
• A person involved in preparing the child’s care and support plan or the management of the child’s case
• The child’s social worker or personal adviser
• The representative of the local authority appointed to visit the child
• Apersonwithmanagementresponsibilitiesforanyoftheabove
• A person with control over the resources allocated to the case.
TheIROisemployedbythelocalauthority,buthis/herstatutory role is independent of the local authority. In order to maintain independence all those managing and supporting theIROandtheIROhim/herselfneedtoworkinawaythatprotects and promotes that independence.
ItisimportanttoensurethatallcommunicationbetweentheIROandanyoneactingonbehalfofthelocalauthority(socialworker/teammanager/servicemanager/headofservice)isconductedinaformalwayandproperlyrecorded.SomeIROteamsandsocialworkteamssharethesame,oradjacent,officespace.Underthesecircumstances,extremecautionshouldbeexercisedinensuringthatcommunicationis kept on a professional level and always recorded. There isnoplaceforaninformal‘chat’asthismaycompromisethe independence of the role or at least appear collusive to childrenoryoungpeopleorbirthparents.
IRO’sandsocialworkersalsoneedtothinkabouthowthechildoryoungperson,theirfamilyandcarersmayperceivetheindependenceofanIROif,forexample,theybotharrivetoareviewmeetinginthesamecar,orappeartobeveryfriendly with each other.
3) TheroleoftheIROcarrieswithitpersonal responsibility for carryingouthisorherfunctions.Inacasein2012,A&SvLancashireCC[2012]EWHC1689(Fam)itwasclarifiedthattheIROmaybeheldpersonallyresponsiblefor:
a) Identifyingifachildoryoungperson’shumanrightsarebeinginfringed;
b) EnsuringthatthelocalauthorityactsupontherecommendationsoftheLACreview;
c) ReferringtoCAFCASSifthechild/youngperson’shumanrightsareinfringedorsignificantrecommendationsofthereview are not acted upon.
Personalresponsibilitycarrieswithitthepossibilityofbeingpersonallyliablefordamages(compensation)tobepaidthechildiftheIROisheldtobeinbreachofhis/herstatutoryduties.
4) TheIROhasarolein asacorporateparent(seeChapter4ofthesestandardsandpara369ofthePart6CodeofPractice).
HOW THE STANDARDS ARE SET OUTThe Standards (highlighted in purple) are set out in the following four chapters. Chapter 4 covers the IRO’s role in relation to corporate parenting. The monitoring process is discussedinChapter5;monitoringreferstothecontinuingprocessofmonitoringthattakesplaceinbetweenthereviewingprocess. Chapter 6 looks at the formal reviewing process and Chapter7dealswiththespecificresponsibilitiestheIROandresponsibleauthorityhaveinascertainingthechild/youngperson’sviews,wishesandfeelings.Alistofthestandardsissetoutonthefollowingpage:

8) a)EachlocalauthorityhasadisputeresolutionprocesswhichdetailshowsignificantconcernsraisedbytheIROregardingachildoryoungperson’scareplanwillbedealtwith.
b)TheIROensuresthat,iftherearesignificantconcernsinrelationtoachildoryoungperson’scareplan,theyarebroughttotheattentionoftheappropriateseniormanager in a clear and timely way.
9) ThelocalauthorityensuresthattheIROhasaccesstotimelylegaladvicethatisindependentofthelocalauthority,ifdeemednecessarybytheIRO,atthethirdstageofthedispute resolution process.

In Swansea the IRO manager attends monthly senior performancemeetingstofeedbackonthemesandqualityissues.

If the 5 working day deadline cannot be met, then there should be a response within 10 working days at the latest.

9. The local authority ensures that the IRO has access to timely legal advice that is independent of the local authority, if deemed necessary by the IRO, at the third stage of the dispute resolution process
Legaladviceprovidedunderthisstandardneedstobeindependentofthelocalauthority’slegaldepartment,whose clients are the child care social worker and managers. Thereisapotentialconflictofinterestforlocalauthoritylawyerswithinthehomeauthorityinadvisingbothsocialworker and IRO.
LegaladvicemaynotbesoughtfromtheWelshGovernment CAFCASS Cymru legal department as their clientisCAFCASSCymru.Again,therefore,thereisapotentialconflictofinterest.
TheIROneedstobeabletoaccesstheirownlegaladvice,atthethirdstageofthedisputeresolutionprocess,wherethey are involving the head of service.
It is for the local authority to decide how to make legal adviceavailabletotheIRO.Manylocalauthoritieshaveestablishedreciprocalarrangementswithoneortwoneighbouringauthorities.Otherlocalauthoritiesmakearrangementsforprivatepracticesolicitors(withexperienceinpublicchildcarelaw)tobeavailable.

13.11 The IRO should ensure that when a review is undertakenundertheAdoptionAgencies(Wales)Regulations2005,whenachildhasbeenplacedwithprospectiveadoptiveparents,allparticipantsunderstand that the prospective adoptive parents haveacquiredsomeparentalresponsibility,butthe child remains looked after until such time as an adoption order is made.
13.12 An adoption review should provide an opportunityfortheplacementtobescrutinisedandappropriatelychallenged,inlinewiththerequirementsofs37(7)AA(W)R2005.
13.13 An adoption review should consider a chronology of significanteventsforthechild,sincebeingplaced,includinganyharmthechildmayhavesuffered,howevercaused,andtheongoingsupportneedsofthe child and prospective adoptive parents.
