additional budget allocation of up to $6,000.00 was approved. This amount will be charged against the OMB Defence Account of the Planning Department Operating Budget.

In January, 2014 Planning staff verbally committed to providing the public with the Terms of Reference for the additional analysis and modelling to be completed by AMEC and that Terms of Reference and the report would be released in advance of the March 3, 2014 public meeting for the Swap/Exchange Process.

CURRENT SITUATION:

Township staff continues to work with our Planning consultants (MHBC Planning) and Servicing Consultants (AMEC) to ensure that their recommendations are current as a result of input that has been received through the Open House process (October, 2013) and the first public meeting of January 13, 2014.

On the basis of the consultant’s background reports, staff have proposed two draft official plan amendments that include Staff’s current preferred swap/exchange lands (OPA #37) and the model policies in order to comply with the Places to Grow policy and Regional Policy (RRPA 2-2009) (OPA #38).

Staff held a first formal Public Meeting on January 13, 2014 at the start of the Planning, Building and Environmental Committee meeting to provide an opportunity for comments to be received from all agencies, the affected property owners and the public. The “draft” official plan amendments and the supporting consultant reports were posted on the Township website under the Swap/Exchange button for all interested parties to review.

The process has also included a commitment to a second public meeting that will be held on March 3, 2014, prior to determining if these proposed official plan amendments should be finalized for consideration by Township Committee and Council. Once documents are approved, they will need to be forwarded to the Region for final approval. Township staff are working closely with Regional staff and consultants in order to ensure that the process is in keeping with understanding of each party of the Minutes of Settlement.

FINANCIAL IMPLICATIONS Any financial updates will be discussed in the future Recommendation Report. INTERDEPARTMENTAL COMMENTS Additional documentation, if any, will be released in another Technical Report for the March 3, 2014 Public Meeting.

Further to our recent discussions, and as now authorized by Township Council, through theapproval of Report PD-133-13, I hereby advise as follows:

To undertake additional work, including the modeling if necessary, to assess theserviceability of lands lying to the west of the existing urban boundary of Smithvilleand to undertake a cost assessment of the servicing of those lands west of theexisting urban boundary of Smithville in comparison to other lands considered in theWater and Wastewater Servicing study prepared by AMEC dated June 2013.

A copy of PD-133-13 is attached to this letter. The report includes recent correspondence fromparticipants with an interest in our swap/exchange process. I further understand that additionalwork is being completed by Scott Llewellyn on behalf of Phelps Homes Ltd. To date, I have notreceived this additional research.

If at all possible, this additional work should be completed prior to the end of January 2014.

Dear: Mr. Brian Treble, Director of Planning,

Re: Official Plan Amendments for Swap/Exchange Process (Official Plan Amendment Number 37)

On behalf of our client, we are submitting this letter and schedules in order to respond to the technicalstudies prepared in order to support the Official Plan Amendments for Swap/Exchange within the Townof Smithville. Our client owns the lands south of Alma Acres immediately south of the current urbanboundary lines.

The Township of West Lincoln has appealed the growth allocations to West Lincoln in order to providefor progress, continued prosperity and growth within the Township. Through this appeal, the Townshiphas been moving forward with various strategies to incorporate more land into the urban boundary forthe Village of Smithville. An agreement was made to swap urban/developable lands from other areas ofthe Township out of the urban boundary in exchange for adding lands into the Smithville urbanboundary. It is understood that approximately 60 hectares of new land will be incorporated into theurban boundary for Smithville.

As part of the process in determine which lands what lands are most appropriate to be added into theurban boundary, the Township of West Lincoln has commissioned AMEC Environment & Infrastructureto complete a comprehensive water and wastewater servicing study for the village of Smithville. Thepurpose of this report is to complete a review of the existing urban services within the community todetermine the most efficient areas within the Village that can be added to the urban boundary. It isbased on this report that the Township has prepared the draft Official Plan Amendment outlining theproposed lands to be included within the urban boundary expansion. It is based on the draftamendment that we submit these comments in relation to our client’s property.

Our client’s property is located immediately along the edge of the urban boundary, along Shurie Roadand Cherry Avenue. The lands are part of a larger parcel of land extending north to Townline Road. Thelands between Townline Road and Cherry Avenue are located within the urban boundary and have sincebeen developed for residential uses and are known as Alma Acres.

UCC believes that a portion of the lands located immediately south of Alma Acres, adjacent to theexisting urban boundary should be included in the urban boundary through the swap/exchange processinitiated under OPA No. 37. Our recommendation would be that approximately 6.55 hectares of land,

south of the urban boundary, adjacent to Alma Acres (see the attached Alma Urban Boundary)

Smithville Plan attached) be included in the urban boundary based on the following criteria:

Based on our review of the AMEC report and our familiarity with the property and the existing

services, any urban boundary expansion within the Village of Smithville would trigger an

upgrade to the Smithville Sewage Pumping Station. An upgrade to the existing pumping station

would provide the servicing capacity for the proposed 6.55 hectares of lands south of Alma

Acres. Including the 655 hectares would not trigger any further upgrades, above what is already

recommended within the AMEC report (Community of Smithville, Water and Wastewater

Servicing Study, June 2013) ensuring no additional cost to the Region/Township. The

development area as proposed has been chosen based on the fact that it can be serviced by

gravity only, no additional pumps etc. would be necessary.

2. The municipal services in Alma Acres were designed in such a way as to provide for future

growth, further south upon such time as the urban boundary expands. There are stub streets

and services located at the southern terminus of Alma Drive and Shurie Road, which we believe

was and still are planned to be extended south to service the subject lands. All of the

underground services and roads within Alma Acres have been engineered in order to provide for

a future south development expansion. In ensuring the Township remains sustainable into the

future, it is wise to make the most efficient use of the existing services, such as the existing

services within Alma Acres, rather than expanding the boundary to areas where municipal

services do not exist or that need to be upgraded to accommodate the expansion.

3. The proposed property is adjacent to the existing urban boundary and is a logical extension of

an existing subdivision and services. The proposed property is currently being used for

agricultural, cash crop uses. There are no existing and/or operating livestock farms located

within the vicinity of the subject lands. The surrounding land uses include agricultural, cash crop,

rural residential and decommissioned sewage treatment lagoons. The proposed urban boundary

expansion would have the following impact on the existing adjacent land uses:

a. North — existing subdivision. The proposed urban boundary expansion will link into the

stubbed streets and services providing for an efficient use of the existing urban

boundary lands. The proposed use of low density residential subdivision on the subject

lands is compatible with the existing subdivision to the north and therefore would have

not negative impact on the existing land uses.

b. West — existing rural/agricultural — The existing land uses on the West side of Shurie

Road are predominantly rural agricultural and rural residential. Similar land uses has

sustained over time adjacent to the existing Alma Acres Subdivision, It is believed that

with the inclusion of the subject lands into the urban boundary expansion, the existing

rural uses will continue with minimal impact.

c. South — existing rural/agricultural — The existing land uses to the south of the property

are similar to the uses west of the property. The expansion of the urban boundary to

accommodate the proposed lands would not negatively impact the existing land uses to

the south.

d, East former sewage lagoons The former sewage lagoons are located to the east of

the proposed property. The sewage lagoons have been previously decommissioned and

the Region does not intend to reinstate the use of these lagoons. The Lagoons are

inactive and therefore do not pose any negative impacts or trigger any regulatory

setback requirements to any proposed urban land uses.

4. The proposed land area of 6.55 hectares of land does not include all of the Alma land holdings,but is a small and logical portion of it. The area of lands that could be serviced by gravity only isproposed to be included as it will have the lease impact on the existing overall servicing andfunctioning of the Village. This area of land is believed to be minimal in terms of the overallamount of land that is proposed to be swapped. Including this small area of land within theswap/exchange will not inhibit or prevent other areas under consideration to be included withinthe urban boundary as well.

In summary, it is our opinion that the lands located south of Alma Acres, approximately 6.55 hectares ofland be considered as a natural extension of the urban boundary. The lands are adjacent to the existingurban boundary, where roads and services have been stubbed and designed for future extensions,adding the proposed area will not trigger any further upgrades or pumps in order to be serviced,including this area does not have any negative land uses impacts on the existing adjacent properties anda small enough area so as not to preclude other areas to be considered under this swap/exchangeprocess. Including this land will also contribute to the Town in meeting its growth targets including jobsand people. The attached report prepared by Jason Schooley, P.Eng. further substantiates the minimalservicing requirements if the subject lands were to be included within the urban boundary providingassurances that a decision to include/swap the subject lands into the boundary would be of minimalfinancial impact on the municipality in the long-term.

INTRO1)UCTION

The following is a review of the serviceability of the proposed urban boundaryexpansion ol the lands south

of the Alma Acres developrnentarea. This review included the analysis of the sanitary sewage system,

water system and the stormwaler management requirements for theproposed development area. The

analysis of the proposed area is preliminary and is meant to show the preliminary functional design. The

lollowing sections outline three components (water, sewage and stormwater management) ol the future

servicing requii-emcnts and capacities of the existing systeni. The Water and Wastewater Servicing Study

The subject lands were considered in the design of Alma Acres. where a roadway stub connection was

provided at the south limit olAlma Drive with lull servicing (sanitarx-. water and storm) also at this location.

WATER SYSTEM

The study area is supplied with watermains from the north to south, with a 2(X)mm diameter watertnain

crossing Twenty Mile Creek adjacent to Anderson Creseentand a 150mm diameter watermain from the

west on Townline Road. The lands north of the proposed urban houndaryexpansion are all serviced with

a 150mm diameter watermain.

In the new development area, a I 50mm diameter watermain loop will he provided in the northern portion

of the development area and connect back into Shurie Road. This new loop of 150mm diameter watennain

will supply the new development area with adequate water supply.

SANITARY SEWERS SYSTEM

The study area is provided sanitary drainage through the existing sewers on Shurie Road, Alma Drive and

‘lownhne Road. These minoreollector sewers ultimatelydrain to asingle sewercrossingTwenty Mile

Creek north of Anderson Crescent. Theexisting sewers immediately north of this development and to

Townline Road are 2(X)mm diameter sewers. At the intersection of the east leg of Anderson Crescent and

Townline Road. the sanitary sewer increases to a 250mm diametersewer, which continues northerly across

Twenty Mile Creek and continues to the Smithville Sanitary Pumping Station.

It is proposed toconnect the proposed sanitary sewers to the southern limits of the existing sewers on

Shurie Road and Alma Drive. We have prepared and enclosed a sanitary design sheet showing the

capacities of the existing sewers and that each future connection will have capacity for new development

area.

The proposed central areas of PR I and PR2 shall have gravity service to the existing systems.

The existing capacityof the 250mm diameter sanitary sewer from Townline Road and Anderson Crescent

is 27.74 Us and the proposed flow is 26.65 Us. The proposed flow includes both dry weatherand wet

flow conditions, where dry weather flow is the domestic flow and the wet weather flow is thepossible

infiltration amount. The infiltration flow amount is 7.70 Us. and represents 29% of the sewage flow.

STORMWATFR MANAGEMENT

The subject lands drain toTwentv Mile Creekaid wouldcontinue to this watershed. As the subject lands

and all ofSmithville are located in the lowerportions of the Twenty Mile Creek. stormwaterquantity

control is not considered necessary. This watercourse system has fish habitatclassifications as heing

Critical (Type I)and would require MOE Enhanced storniwater protection. For the easterly 6.5 hectare

development area, an oil/grit separator system would be designed to provide 80% TSS removal for the

subject lands.

The lands west of Shuric Road, would most likelyhe a private development (condominium) and on-site

stormwater management practices would he prepared before discharging southerly to the North Creek.
