Background

Section 1231 of the John Warner National Defense Authorization Act for Fiscal Year 2007 (Public Law 109-364), requires the Secretary of Defense to submit an annual report to Congress on foreign military sales (FMS) and direct sales to foreign entities of significant military equipment manufactured in the United States during the preceding calendar year. The report is to identify for all sales of significant military equipment in excess of $2,000,000: (1) the nature of the equipment and the dollar value of the sales; (2) the country to which the equipment was sold; and (3) the manufacturer of the equipment and the State in which the equipment was manufactured. The law defines the term “significant military equipment” as having the meaning given the term in section 47(9) of the Arms Export Control Act (22 U.S.C. 2794(9) note).

The information requested by section 1231 is not stored in a single data base. The

Department of Defense is able to obtain and report information on FMS only. Information on direct commercial sales is available only through Department of State’s Licensing Division. FMS Purchases

1. FY 2006

Fifty-three countries procured significant military equipment (SME) that exceeded $2,000,000 through the FMS system in FY 2006. The total value of these purchases was $3,912,001,805. These purchases were made through the Air Force, Army, and Navy. A detailed breakout of the purchases by military department, contract number, manufacturer, dollar value, type of hardware and state of performance is set forth in attachment 1. 2. FY 2007

Fifty countries procured significant military equipment (SME) that exceeded $2,000,000 through the FMS system in FY 2007. The total value of these purchases was $5,114,390,826. These purchases were made through the Air Force, Army, and Navy and Marine Corps. A detailed breakout of the purchases by military service, contract number, manufacturer, dollar value, type of hardware and state of performance is set forth in attachment 2.

Direct Commercial Sales 1. FY 2006 The United States State Department authorized $5,296,745,444 in direct commercial sales of reportable SME to 43 countries in FY 2006. A detailed breakout of the purchases by dollar value, and type of hardware is set forth in attachment 3. 2. FY 2007 We are still awaiting State Department’s input on the direct commercial sales authorized for FY 2007. A supplemental report will be submitted when we receive the data.
