The State Board of Architectural and Engineering Examiners adopted the followingproposed rules at the February 11, 2016 regularly scheduled meeting. These ruleswere filed with the Secretary of State on October 28, 2016, and became effective on January 26, 2017.

Rule 0120-01-.03 was amended to provide clarification on the correct•use of the titles “engineer,” “architect,” or “landscape architect” byindividuals registered in other jurisdictions. Rule 0120-01-.11 Education•and ExperienceRequirements – Architectwas amended to state thatthe Board “may” (rather than“will”) utilize the “Table ofEquivalents” contained inAppendix “A” to Circular ofInformation No. 1, publishedin July 1983 by the NationalCouncil of ArchitecturalRegistration Boards(NCARB), in evaluating anapplicant’s education andexperience. This change wasmade to resolve a possibleconflict between the rule andthe changes to the InternDevelopment Program (nowknown as the ArchitecturalExperience Program) thattook effect on June 29, 2016.Rule 0120-01-.25 Renewal•of Registration was amendedto incorporate the Board’spolicy regarding inactivestatus.Rules 0120-02-.07•Misconduct and 0120-04-.10 Professional Conductwere amended to add a newsubparagraph stating thatregistrants may be deemedby the Board to be guilty ofmisconduct for providingfalse testimony orinformation to the Board.Rule 0120-02-.08 Seals•was amended to define“original sheets,” to clarifythat the original cover orindex page(s) for designcalculations that aresubmitted for review shall besealed, and to incorporate theBoard’s “Multiple

to allow continuing educationcredit for patents granted (upto 10 PDH’s per biennium)and authoring acceptedlicensing examination items(up to 5 PDH’s per biennium)and to decrease the amountof time to earn continuingeducation credits after adeficiency is discovered from180 days to 90 days. Therules were also amended tostate that up to 10 PDH’s perbiennium may be claimed foreach published peer-reviewedpaper, article, or book, and amaximum of 5 PDH’s perbiennium may be claimed foreach published paper, article,or book that is not peer-reviewed. These changeswere made partly to bring therules into greater conformitywith the model regulationsadopted by NCARB and theNational Council ofExaminers for Engineeringand Surveying (NCEES).Rule 0120-04-.09•Registration withoutExamination, the“grandfathering” rule forregistered interior designers,is repealed. This rule appliedonly to persons who appliedfor registration prior toJanuary 1, 1994 (see T.C.A. §62-2-905), and is nowobsolete.

read these rules carefully, as they have recently been amended:

(2) The registrant shall not falsify or permitmisrepresentation of the registrant’s or theregistrant’s associates’ academic or professionalqualifications to a prospective or existing client oremployer. The registrant shall not misrepresent orexaggerate the registrant’s degree of responsibilityin or for the subject matter of present or priorassignments.

(a) It shall be the responsibility of each registrant to clearlyand appropriately state prior professional experienceof the registrant and/or the firm the registrant isrepresenting in presenting qualifications to prospectiveclients, both public and private. If a registrant usesvisual representations of prior projects or experience,all registrants whose seal appears on plans,specifications and/or contract documents must beclearly identified.

(b) A registrant who has been an employee of anotherdesign firm may not claim unconditional credit forprojects contracted for in the name of the previousemployer. The registrant shall indicate, next to thelisting for each project, that individual experiencegained in connection with the project was acquired asan employee. Additionally, the registrant shall providethe time frame in which the project was performed,identify the previous design firm, and describe thenature and extent of the registrant’s participation inthe project.

(c) A registrant who was formerly a principal in a firmmay legitimately make additional claims provided theregistrant discloses the nature of ownership in theprevious design firm (e.g., stockholder, director orofficer) and identifies with specificity the registrant’sresponsibilities for that project.

(d) A registrant who presents a project that has receivedawards recognition must comply with therequirements of this rule with regard to projectpresentation to the public and prospective clients.

(e) Projects which remain unconstructed and which arelisted as credit shall be listed as “unbuilt” or by asimilar designation.

The Board of Architectural and Engineering Examiners mayimpose civil penalties for misconduct violations related tomisrepresentation of one’s work or posting confidentialinformation about a client or a client’s project without the client’spermission. Registrants found in violation of the regulations maybe assessed a civil penalty ranging from $500-$1,000 for eachseparate violation. Keep in mind that each day of continuedviolation may constitute a separate violation (Rules 0120-02-.09and 0120-04-.11).

DESIGN ETHICSAND SOCIALMEDIA

The social media world consists of two main segments: socialnetworking and social media outlets. There are numerous typesof social media outlets available for individuals to access intoday’s world, including Facebook, Houzz, Pinterest, Twitter,Instagram, LinkedIn, Google+, Wikipedia and YouTube, just toname a few. Social networks allow an individual to connect withfriends and family or groups with the same interests, while socialmedia gives individuals the opportunity to upload and postvideos, quotes, pictures and links to other posts on a network.

When addressing this subject, two questions immediately presentthemselves:

• How can social media affect the practice of design?

• What ethical implications are involved with design and social media?

As design professionals, we are proud of our design projects, andsocial media is a great way to showcase these projects. But wemust also remember that photos of our projects are at thediscretion of the client or owner. As a professional, we mustalways have permission from the owner or manager, preferably inwriting, to take photos of the project. Secondly, one must alsohave express permission, preferably in writing, to post the photosto any type of website, social media or to be used in thepromotion of your firm. Finally, make sure that the client hasgranted use of their name on the project. Never use their name oraddress without express consent. The professional conduct rulefor registered interior designers (Rule 0120-04-.10) reads asfollows:

(5) The registrant shall not divulge any confidentialinformation about the client or the client’s project,or utilize photographs or specifications of theproject without the express permission of the client;provided, however, this provision shall not apply tothose specifications, drawings or photographs overwhich the designer retains proprietary rights or thedesigner is required by law or in connection with aninvestigation by the Board to furnish.

Another consideration with social media is giving credit to allmembers of the design team. As a professional, if you have teamedwith another design professional, they must be given credit as partof the design team. This issue is addressed in Rules 0120-02-.06(2) (cited below) and 0120-04-.10(11). All registrants should

DESIGN ETHICS AND SOCIAL MEDIA continued from page 3Finally, registrants should also advise non-registrants in theiroffice to beware of using titles on social media that either state orimply that they are registered architects, engineers, landscapearchitects, or interior designers. Public use of such titles prior toregistration violates Tenn. Code Ann. §§ 62-2-102(a), 62-2-103,62-2-105(c), and 62-2-903, and could result in the assessment ofcivil penalties.

Although social media is an excellent tool for designprofessionals, it must be used properly. In the world of socialmedia, a single act can have far-reaching ethical consequences.Think before you post!

UPDATENATIONAL COUNCILThe Tennessee Board of Architectural and EngineeringExaminers is an active member of the followingnational regulatory councils: the National Council ofArchitectural Registration Boards (NCARB), theNational Council of Examiners for Engineering andSurveying (NCEES), the Council of LandscapeArchitectural Registration Boards (CLARB), and theCouncil for Interior Design Qualification (CIDQ). Thenational councils assist member boards by developinguniform national examinations and model laws andregulations, among other responsibilities. Followingare updates on significant activities of the nationalcouncils over the past year:

NCARBThe Intern Development Program (IDP) has been overhauled•and renamed. Now known as the Architectural ExperienceProgram (AXP), the revised experience program for aspiringarchitects consists of six broad practice-based areas thatcorrespond with the six divisions of the new licensing exam,Architect Registration Examination® (ARE®) 5.0. This updateis one of several NCARB has made to its experience programover the past few years, namely: streamlining the number ofrequired hours from 5,600 to 3,740; the ability to reportexperience beyond six months and up to five years; acceptingAXP credit for paid academic internships; and enablinglicensure candidates to earn AXP credit after high school andregardless of a project’s duration. For more information onNCARB’s experience program, visit www.ncarb.org/experience. After four years of development, the latest version of the•Architect Registration Examination® (ARE®), ARE 5.0,launched on November 1, 2016. To adapt to changes in theprofession, ARE 5.0 content has been restructured into sixdivisions organized around architectural practice and theprogression of a typical project: Practice Management, ProjectManagement, Programming & Analysis, Project Planning &Design, Project Development & Documentation, and

Construction & Evaluation. NCARB will continue to administerARE 4.0 until June 30, 2018. This 20-month period of dualdelivery will enable current candidates to finish the exam in away that best suits their needs. For more information aboutARE 5.0 visit www.ncarb.org/ARE5. At the 2016 NCARB Annual Meeting, delegates voted to•approve a Mutual Recognition Arrangement with Australia andNew Zealand, enabling U.S. architects to earn reciprocallicenses abroad. The Tennessee Board voted to sign theArrangement at the October 2016 Board meeting, and theArrangement became effective on January 1, 2017, after it wasaccepted by a majority of NCARB Member Boards.Delegates at the 2016 NCARB Annual Meeting also made•several changes to NCARB’s official documents, incorporatingupdates to the ARE and the AXP. In addition, delegatesapproved resolutions to provide emeritus status for retiredarchitects and added new provisions to registrationrequirements for military personnel.The Broadly Experienced Architect (BEA) and Broadly•Experienced Foreign Architect (BEFA) programs have beenreplaced with new alternatives to the NCARB certificationrequirements. Effective June 29, 2016, AXP and NCARB Certificate fees were•simplified and reduced. The total cost of the ARE has also beenreduced with the launch of ARE 5.0. The total cost of ARE 5.0(six divisions) is $1,260, versus $1,470 for ARE 4.0 (sevendivisions).NCARB launched an alternative path to licensure for•experienced professionals on June 29, 2016. Under the AXP,aspiring architects can earn full credit for experience reportedwithin eight months, and half credit for experience beyondeight months and up to five years. This new option opens thedoor for those with experience beyond five years to seeklicensure through submission of an e-Portfolio.

The Tennessee Department of Commerce and Insurancerecently implemented a new licensing system, dubbedthe Comprehensive Online Regulatory and Enforcement(CORE) system. One of the most exciting features of this newsystem is the new online licensing services system(http://core.tn.gov/). CORE provides consumers with thecapability to apply for licenses, renew licenses, change addresses,request duplicate licenses, among other features, and is asignificant improvement over the old online renewal system.

The benefits of the new online system include:

24/7 service•All major credit cards and e-checks are accepted•There are no additional processing fees (say goodbye to the •

Internet convenience fee!)The system is more secure (an Individual/Organization •

number provided on the renewal letter or the last four digits of a Social Security Number is required to create an account)

Retired registrants may now renew online•The system allows online applications •

As a result of these enhancements, the Board discontinued mailingpaper renewal forms to registrants in November 2015. In lieu of arenewal form, registrants now receive a letter notifying them thatthey are eligible to renew online. As in the past, renewal noticesare mailed out approximately two (2) months prior to theregistration expiration date. If you are not sure when yourregistration expires, you may verify your registration expirationdate online at http://verify.tn.gov/. Registrants may still requesta paper renewal form using an automated phone system(instructions are provided on the renewal notification).

In order to renew online, you will first need to register a newaccount. Once you have logged in to your new account, choose theappropriate board or commission, and use the followinginformation to access your license:

computer-based Principles and Practice of Engineering (PE)exam price at $375, and the Fundamentals of Engineering (FE)exam price at $175 (a $50 reduction), effective January 2018.Motions also passed to adopt position statements onsustainability and remote sensing technologies and to make funding changes for NCEES meetings.A motion that would have added language to the Model Law•and Model Rules for structural engineers parallel to that ofprofessional engineers and professional surveyors failed at the 2016 Annual Meeting.The PE exams will transition to a computer-based format•beginning in 2018, starting with the Chemical and Nuclearexams. Other exams will follow until all have been transitionedin about 2023.

CLARBCLARB is working to update and improve their Model Law.•Proposed revisions will be presented for adoption at the 2017Annual meeting.CLARB conducted a global task analysis of the practice of•landscape architecture in 2016, which is used to determinecontent for the Landscape Architect Registration Exam.Landscape architects from 58 countries responded to the task analysis survey.

CIDQ Thomas Banks, CAE FASID, has been hired as the new•Executive Director of CIDQ. Mr. Banks, who has most recentlyserved as Vice President at ForrestPerkins, a leader in luxuryhotel, resorts and multi-residential projects, was ChiefOperating Officer and Deputy Executive Director of theAmerican Society of Interior Designers (ASID) from 1998-2014.A new pathway to NCIDQ certification has been developed for•educators in which teaching counts for up to 50% of therequired experience.Fourth year senior students are now eligible to apply and take•the Interior Design Fundamentals Exam (IDFX).Effective in 2017, the testing windows for the IDFX and Interior•Design Professional Exam (IDPX) have been expanded to lastthe entire months of April and October.The Practicum exam will be transitioned to a computerized•format in fall 2017, and will also adopt a month long testingwindow at that time.The Alternative Application Review Program (AARP) has been•developed to provide an alternate path to NCIDQ certificationfor broadly experienced interior designers who do not qualifyunder the standard routes.The number of NCIDQ examination candidates continues to•increase, and the total number of NCIDQ certificate holdersnow exceeds 30,000. �

The Tennessee General Assemblyrecently made changes to statuteswhich may impact you as a holder of alicense with the Board. These newchanges set out in the following PublicChapters specifically amend theTennessee Code Annotated as set forthbelow.

Public Chapter No. 610 extends the Boardof Examiners for Architects and Engineersuntil June 30, 2020, and establishes aminimum attendance requirement for boardmembers to fifty (50%) percent of actuallyheld meetings. This law became effective onMarch 22, 2016. A copy of the new law isavailable for review on the website of theTennessee Secretary of State here:http://share.tn.gov/sos/acts/109/pub/pc0610.pdf

Public Chapter No. 838, makes severalclean-up amendments to the laws of theDivision of Regulatory Boards. This billspecifically amends Tennessee CodeAnnotated section 62-2-304, by the addition

of section (b), which allows the Board toaccept reciprocity for a registered architect ifthey hold an NCARB certification when therequirements of their home jurisdiction arenot equivalent. This law became effective onJuly 1, 2016. A copy of the new law availablefor review on the website of the TennesseeSecretary of State here:http://share.tn.gov/sos/acts/109/pub/pc0838.pdfPublic Chapter No. 1053, known as the“Right to Earn a Living Act,” requires that onor before December 31, 2016, each statelicensing authority (state board, commission,council or committee) submit all existing orpending regulations to the chairs of theGovernment Operations Committees and thatthe committees perform a study of allsubmitted regulations and, at their discretion,conduct a hearing regarding any suchregulation. During the review of the entryregulations, the committees shall considerwhether an entry regulation is not required bystate or federal law, is unnecessary to protect

the public health, safety or welfare, has thepurpose or effect of unnecessarily inhibitingcompetition or arbitrarily denying entry intothe profession, if such regulation could beaccomplished by less restrictive means or ifthe regulation is outside the scope of thelicensing authority’s statutory authority. If aregulation meets one of those factors, thecommittees may disapprove of the regulationand request that the authority amend orrepeal it. If the licensing agency does notinitiate compliance with the committees’request within ninety (90) days or does notcomply within a reasonable amount of time,the committees may then vote to request thatthe General Assembly suspend all or part ofthe agency’s rulemaking authority. BeginningJanuary 1, 2018, each licensing authoritymust submit all new entry regulations to thecommittees prior to a “Sunset” hearing beingheld. This Act took effect upon passage, April28, 2016. The Board’s annual grant awards helpsupport and foster greater interest in the fields of architecture, engineering,landscape architecture, and interior designamong Tennessee students. Since theprogram’s inception in 2002, the Boardhas awarded over $3.2 million that may be used by universities to purchasecomputers for students, laboratory orinstructional equipment, library resources,or to pay intern development program feesor examination fees for students inaccredited programs. Funding is providedfrom the Board’s revenues or reservefunds.

“Education is the foundation fordeveloping the knowledge and skillsneeded to practice the designprofessions and to protect the public’shealth, safety, and welfare,” said BoardExecutive Director John Cothron. “TheBoard welcomes the opportunity toassist in the education of architecture,engineering, landscape architecture,and interior design students across allof Tennessee.”

The following universities willreceive funding:

• Christian Brothers University—$14,738 to the School of Engineering.Funds will be utilized to purchase triaxialtesting equipment for soils, electronicslaboratory hardware, and a computer withsoftware.• Lipscomb University—$13,691 to theCollege of Engineering. Funds will beutilized to pay Fundamentals ofEngineering (FE) examination fees forstudents and to purchase a bench top hole

saw tube and pipe notcher, a circuit boardprinter, and a shop hydraulic press. TheFE exam is typically the first step in theprocess leading to licensure as aProfessional Engineer (PE), and may betaken by students in the senior year of anengineering curriculum.• Middle Tennessee StateUniversity—$3,000 to the College ofBehavioral and Health Sciences for theinterior design program. Study of the Professional Privilege Tax

Public Chapter 1024 directed theTennessee Advisory Commission onIntergovernmental Relations (TACIR) toconduct a study of the professionalprivilege tax and to report this study to theSpeakers of the Senate and House ofRepresentatives, and the Chairs of theFinance, Ways and Means Committees ofboth houses by January 1, 2017. The studyexamined: (1) The history of theprofessional privilege tax in this state; (2)the intent of the professional privilege tax;(3) other states' laws imposing aprofessional privilege tax or similar tax;and (4) alternatives for eliminating orphasing out the professional privilege tax.This law became effective on April 28, 2016.The TACIR report is available online athttps://www.tn.gov/assets/entities/tacir/attachments/2016_ProPrivilegeTax.pdf.

Notification of Privilege Tax Due

P u b l i c C h a p t e r 1 0 1 0(http://share.tn.gov/sos/acts/109/pub/pc1010.pdf)requires the Department of Revenue to notifytaxpayers by mail or e-mail of the amount ofprofessional privilege tax owed, the duedate and any electronic filing or paymentrequirements. This notification must bemade on or before May 1 of each year. Thislaw became effective on July 1, 2016.

New Tax Filing Website Launched

The Tennessee Department of Revenuelaunched a new tax filing website calledTNTAP, or the Tennessee Taxpayer AccessPoint, in March 2017. Taxpayers may file the$400 professional privilege tax, due each yearby June 1, using the new website. TNTAPoffers many convenient features, including anaccount number online search, online goodstanding verification, and printable receipts ofpayment. The FE exam is now offered in a computer-based formatthroughout the year at Pearson VUE test centers. Applicants forthe FE exam no longer apply to the Tennessee Board forauthorization to sit for the FE exam. Applicants now register forthe exam directly with NCEES at www.ncees.org and then applyto the Tennessee Board for Engineer Intern certification afterpassing the exam.

• Principles and Practice of Engineering (PE) and Structural Engineering (SE) Examinations —

PE and SE exam applicants must first apply to the TennesseeBoard for authorization to sit. The application deadline for newapplicants for the spring PE/SE exams is December 1. The falldeadline is June 15. All supporting documents (references,transcripts, etc.) are due in the Board office within thirty (30)days after the application deadline. To facilitate scheduling of the exams, retake requests should bereceived by the Board office by February 1 for the spring exam and byAugust 15 for the fall exam. Registrants wishing to take other examdisciplines must submit an application to add an exam discipline(available at the Board’s website) by January 1 for the spring examand by July 15 for the fall exam. All exam fees are now paiddirectly to NCEES when reserving a seat for the exam.

As a registrant, am I required to report violationsof the laws and rules to the Board?

Yes. Rule 0120-02-.02(3) states, “A registrant possessingknowledge of a violation of T.C.A. Title 62, chapter 2, orthis chapter, shall report such knowledge to the Board inwriting and shall cooperate with the Board in furnishingsuch further information or assistance as it may require.”

How long am I required to maintain continuingeducation records?

Rules 0120-02-.02(4) and 0120-05-.10(3) requireregistrants to maintain continuing education records for a period of four (4) years, and to provide such records tothe Board for audit verification purposes within thirty(30) days of the Board’s request. �
