Subject: Newark Unified School District Playground Improvements

Dear Ms. Rios:

Thank you for the opportunity to provide Vanir with this proposal to support playgroundimprovements at four elementary schools within the Newark Unified School District. BKF willprovide a site assessment and design drawings for use in bidding of the improvements generallydescribed in the attached scope of work.

SCOPE OF SERVICES

TASK 1: Site Assessment1.1 Site Review: BKF will visit each of the schools and perform a review of pavement

conditions, surface feature, and general drainage patterns. We will not complete afield geotechnical review of soil conditions or complete cores of the pavement todetermine thickness.

1.2 Recommendations: BKF will summarize our findings from the field investigation andprovide recommendations in a narrative format.

1.3 Meetings: We will attend one meeting in the field during the site review.

TASK 2: Construction Documents2.1 Base Plans: We assume there are no electronic topographic drawings in CAD format for

the schools. BKF will develop base drawings using aerial photographs integrating sitefeatures found in our site assessment.

2.2 Documents: BKF will provide the following documents for use in the planning submittal.A. Plans:

i. Bunker Elementary Site Paving, Drainage, and Striping Planii. Lincoln Elementary Site Paving, Drainage, and Striping Planiii. Snow Elementary Site Paving, Drainage, and Striping Planiv. Musick Elementary Site Paving, Drainage, and Striping Planv. Construction Details

B. Specifications: GeneralC. Submittals: BKF will submit a draft and final version of the plans and

specifications.2.3 Approval: We assume this work does not require DSA review of approval. Vanir will

submit the plans to each school for review. BKF will submit a plan to the San FrancisocPublic Utility Commission for work at Bunker Elementary School.

2.4 Meetings: BKF will attend two (2) coordination meetings.

TASK 3: Construction Administration Support3.1 Site Observation Visits / Scope of Work Clarifications: BKF will visit the site to provide

clarification of the consultant’s design intent for the contractor, construction manager,or owner. We have allocated fee for two (2) site visits.

3.2 Submittal Review: The team will review and return submittals for those items includedin our scope of work.

3.3 Requests for Information: BKF will respond in writing to written requests forinformation within two (2) business days.

3.4 Punch List: Near the completion of construction, BKF will visit the site to observe theproject. We will provide a written summary of any elements that are variance with theconstruction documents.

COMPENSATIONBKF proposes to provide the services for a total of $16,500 on a time and materials not to exceedbasis. A summary of the fee allowance per task includes:

BKF shall have noother obligations or responsibilities for the project except as agreed to in writing, or as providedin this agreement. BKF’s services shall be provided consistent with, and limited to, the standardof care applicable to such services. BKF shall provide its services consistent with theprofessional skill and care ordinarily provided by consultants practicing in the same or similarlocality under the same or similar circumstances.

EXHIBIT A - ASSUMPTIONS AND SCOPE QUALIFICATIONS

BKF has made the following assumptions and scope qualifications in the preparing this proposal:

1) Permits: No permits are required for this project except for an encroachment permit fromthe City of San Francisco Public Utilities Commission.

2) Environmental Document: Environmental documentation is not required.

3) Topographic Survey: A detailed topographic survey is not required – all information willbe general in nature with the intent of, “field fitting.”

4) Fee: The owner will pay all application fees.

5) Schedule: Our fee assumes we will complete the work as outlined in the attacheddocument.

Ramp areas around portables are to only receive a seal coat.  These areas are not to be altered. 

Bunker Elementary, 6071 Smith Ave., Newark 

1. Removal and replacement area is as shown on the attached Bunker Elementary aerial map, Map #1. 2. Playground area: Grind out top 2”, compact existing, replace with new asphalt, and apply seal coat/fog coat.  

Playground is considered any area not marked as a fire lane. 3. Fire lane: Grind out top 4” by 20’ wide, compact existing, replace with new asphalt, and apply seal coat/fog coat. 

Fire lane location shown on attached Map #1. 4. Volleyball pole and striping to be relocated to the southern end of yard per attached Map #1. 5. Kickball court striping to be relocated to the south at the location of volleyball courts.  See attached Map #1. 6. All striping to be re‐striped as is with the exception of the volleyball and kickball courts which are per items 4 

and 5 above. 7. ADD ALT 1: Provide and install 2”x6” header board along lawn and asphalt transition at western edge of play 

yard.  Please note there is irrigation located in vicinity, within a foot off the edge of the existing asphalt.  May require relocating irrigation.  Will need to replace landscaping removed during header board install. 

8. ADD ALT 2: Replace all existing basketball court backboards and nets. Total of 3 full courts. 

Lincoln Elementary, 36111 Bettencourt Street, Newark, CA 

1. Removal and replacement area is as shown on the attached Lincoln Elementary aerial map, Map #2, #2B. 2. Playground area: Grind out top 2”, compact existing, replace with new asphalt, and apply seal coat/fog coat.  All 

areas that are not considered the Fire lane. 3. Fire lane: Grind out top 4” by 20’ wide, compact existing, replace with new asphalt, and apply seal coat/fog coat. 

Fire lane location shown on attached Map #2. 4. Install new basketball pole, backboard, and net to complete a full basketball court at the eastern corner of the 

site where a single half court is located.  Basketball pole, backboard, and net provided by District.  See attached Map #2. 

5. Remove tetherball pole and replace with “funnel ball” structure.  Structure provided by District. 6. All striping to be re‐striped as is with the exception of the basketball court located between the portables and 

play structure at the eastern corner of the site.  See Map #2. 7. Kinder area and outside lunch area (“small equipment” work area).  

a. Remove and replace as per item 2 above.  Area around portable ramps to only have seal coat/fog coat applied.  Do not alter portable ramps.  See Map #2B.   

b. Remove tree stump to the south of the portables, compact, pave, and apply seal coat/fog coat.  See Map #2B. 

c. Build planter box around the two trees in the outside lunch area to avoid necessity to touch/alter trees roots.  Planter box perimeter to be potential seating for children.  Allow for 2‐3 inch gap at bottom between trees to allow for drainage of area to DI.  (Will need a sketch) 

8. ADD ALT 1: replace grass patch to the east of the MPR building with baserock and aphalt.  See Map #2 for location. 

a. Provide separate cost for removal and disposal of dirt.  District to provide testing for disposal profiling. 9. ADD ALT 2: Provide and install 2”x6” header board along all lawn and asphalt transitions.  Please note there may 

be irrigation located in vicinity.  May require relocating irrigation.  Will need to replace landscaping removed during header board install.

We would like to note that the proposed fee is inclusive landscape architect services for assessment, design, and review of play structures, striping, planting, and irrigation: Task 1 – Site Assessment

1. Perform a site visit at each of the four campuses to review existing pavement conditions, existing site features, existing site drainage patterns and systems, and existing irrigation in proximity of the project area.

2. Based on the site visit and a review scope goals with the client, provide a written narrative describing the findings and anticipated scope of work to achieve said goals.

3. It is assumed the requested site meeting in the RFQ will occur concurrently with the site visit.

Proposed Fee Task 1: $6,230 Task 2 – Construction Documents Base Plans We will require a topographic survey of each of the project areas in order to perform our design for the project, including pavement removal limits and playground layout and striping. This will ensure that proper elevations and slopes are maintained, in addition to providing an accurate area of work to be bid. Topographic Survey: We will have an aerial survey prepared of each of the subject campuses as shown on the attached exhibits. The aerial survey will provide an existing base plan with lines and elevations to

the nearest tenth of a foot, and one foot contour intervals. At this point, the survey can be used for additional layout planning. To complete the survey, we will perform fill in ground survey work, which will accurately locate trees, utility vaults, manholes, inlets, play structures, and edge of pavement shots. Invert elevations of on site gravity storm sewer systems will be determined where feasible. Accuracy will be to the nearest hundredth of a foot, which is required for final design work. Underground utility location services are excluded from our fee. Utility locations will be determined based on visible surface data, and information from as-built (old design drawings) for each campus. For Bunker Elementary School, Record Boundary information will be gathered to determine the location of the City of San Francisco 80 ft Right of Way that crosses the campus and compiled into the survey.

Proposed Fee Topographic Survey: $36,000 Construction Documents: Utilizing the topographic survey, we will prepare the following construction drawings. It is assumed that all four campuses will bid as one project (i.e. one set of plans for the four schools):

1. Site Demolition Plan (One for Each Campus): This plan will show limits of pavement removal, d removal of any landscape features, and removal of playground structures.

2. Horizontal Control Plan (One for Each Campus): This plan will show dimensioning of the proposed playground striping, new pavement limits, and locations of new playground play structures.

3. Grading, Drainage, & Utility Plan (One for Each Campus): This plan will show lines, grades, surface slope, and surface drainage courses for the proposed improvements. In addition, if any additional storm drain utilities are required, they will be shown on this plan.

4. Legend, Notes, & Details (Composite for Project): This plan will show details for paving, headerboards, curbs (if necessary), and inlets and trenching, if applicable.

5. Landscape Material and Detail Reference Plan (One for Each Campus) 6. Landscape Construction Details (Composite for Project): This plan will show details for

basketball posts, goal and striping, volley ball, funnel ball, planter box, and similar. 7. Landscape Irrigation Plan (One for Each Campus): Plan to show adjustment and

relocation of irrigation heads displaced by construction. 8. Landscape Planting Plan (One for Each Campus): Plan to show new plants and turf

displaced by construction. 9. Irrigation and Planting Details (Composite for Project)

Add alternates are included in the design, but will be noted on the plans as alternates as directed by District. In addition to the plans, we will provide technical specifications in CSI 2004 format pertaining to the work that will be performed. Sections pertaining to the contractual matters between the District and Contractor shall be by others. Per the RFP, there will be two submittals for the project; a draft submittal and a final submittal. The two submittals will be provided as requested.

Jurisdictional Approvals: Given the nature of the work, it is our experience that DSA review and approval of the work anticipated is not required. The play structures will use standard, pre approved DSA structures, and paving maintenance does not require review. We contacted the City of San Francisco Department of Public Works, and they will not require an encroachment permit for work within the Right of Way that crosses the Bunker Elementary School Site. As such, it is our initial opinion that a permit will not be required. We would suggest that no structures be placed within the ROW, however. Meetings: Time for two coordination meetings with the consultant team is included.

Proposed FeeTask 2 (exclusive of topographic survey): $29,035

Proposed Fee Task 2 (inclusive of topographic survey): $65,035 Specific exclusion include, but are not limited to: engineer’s estimates for construction, structural design for any retaining walls over 3 feet in height, geotechnical engineering services, any work to building structures, utilities other than storm drain, erosion control design (summer construction schedule), Construction General Permit (CGP (SWPPP, NOI, etc)) support (the pavement work is considered maintenance and therefore exempt), and time to attend public meetings.. Task 3 – Construction Administration Support

1. Consultant will attend a pre bid meeting, which will include walking each of the sites with the District and invited contractors.

2. Consultant will attend a pre construction meeting with the District and the selected contractor to clarify any items prior to the start of construction.

3. Consultant will review submittals as request for materials associated with our scope of services. 4. Consultant will respond to RFIs in writing within two business days of receipt of the RFI. 5. Consultant will visit each site at the end of the project to observe the constructed improvements

and will provide a punch list of any outstanding items observed.

Proposed Fee Task 3: $7,560 The total proposed fee for all services, inclusive of performing the topographic surveys, is $78,825. We propose to provide our services on a fixed fee basis. Billing would be done on a Task and percentage completion basis. Change memos for additional services, if required, will be provided to the District for approval prior to performing services. Schedule Per our discussion, the schedule of having all documents complete by the end of February 2014 is unrealistic, and in our opinion unnecessary given the construction schedule. We offer the following proposed design schedule:

Assumptions / Limitations – continued: 4. Assessment of ADA/CBC site accessibility is excluded from this scope of services. Should there

be need for ADA/CBC site accessibility assessment and any subsequent surveying or engineering, it will be done as Additional Services

5. It is assumed that the contractor shall provide all field measurements as necessary for replacement of playground striping and marking and therefore precise measurement by Lea & Braze Engineering is excluded from this scope of services.

6. It is assumed that City of Newark review will not be needed, and that response to City review or planchecks will not be needed; and therefore are excluded from this Scope of Services.

7. Pavement overlay is not considered site disturbance as would apply for a CA State SWPPP (for disturbed site area of one acre or more), City C.3 stormwater management documents (for new or replaced pavement of 10,000 sq. ft. or more) or Green Building Code requirements; and therefore are excluded from this Scope of Services.

8. In order to allow only pre-qualified contractors to bid on the project, Lea & Braze Engineering and the Client agree to limit the number of bidders to three (3) contractors selected to bid.

9. The Client shall handle the bid process and Lea & Braze will provide support to respond to contractor’s RFIs.

ENGINEERING SERVICES - EXHIBIT “A” _________________________________________________________

General Provisions Client and Consultant agree that the following provisions shall be part of this agreement:

1) Client and Consultant agree to cooperate with each other in order to fulfill their responsibilities and obligations under this agreement. Both Client and Consultant shall endeavor to maintain good working relationships among members of the project team.

2) This agreement shall be governed by and construed in accordance with the laws of the State of California. 3) If a required retainer or deposit is not received within 72 hours of the receipt of signed Client approval, services may be

delayed. 4) Client agrees that if Client requests services not specified in the scope of services described in this agreement, Client will pay

for all such additional services as extra services in accordance with Consultant’s billing rates utilized for this agreement. 5) Adoptions of Codes and Ordinances by reviewing agencies, including changes in interpretation of such by reviewing

agencies, may require revised or additional services by Consultant which shall be billed at current billing rates. Consultant shall notify the Client in writing of changes in review process because of changes in application by reviewing agencies or changes in reviewing agency personnel if additional costs are caused thereby.

6) All fees and other charges due Consultant will be billed upon the completion of work for submittal to reviewing agency (or a percentage thereof), or at periodic intervals; and shall be due at the time of billing unless specified otherwise in this agreement. Invoices shall be due upon receipt. Late charges of one and one-half percent (1.5%) per month are assessed if payment is not received within thirty (30) days. Termination of services requires written notification. Work stopped in progress will be billed based on time basis, plus any associated reimbursable expenses. If invoices become past due over sixty (60) days, from receipt by Client, Lea & Braze Engineering, Inc. shall have the unilateral and unequivocal right to suspend performance of services without liability for delay or for consequential or other damages which may result from such suspension.

7) Client agrees that all reports, plans, specifications, field data and other documents, including such in electronic media, which are prepared by Consultant shall remain the property of the Consultant and may be used by the Consultant. Upon payment of all outstanding fees Client shall be entitled to use of final plans and specifications unless Client is in default of this agreement.

8) Client agrees to not use or allow to be used by other parties plans and specifications which are not final and which are not signed and sealed by Consultant, and to not allow other parties to modify plans and specifications prepared by Consultant.

9) Client agrees that if this agreement is terminated prior to completion of final plans Client releases Consultant from all liability for services performed.

10) If Consultant is not retained to provide construction-phase services for the project Client assumes all responsibility for interpretation and construction observation, and Client assumes full responsibility, for any and all claims arising from modification, clarification, interpretation and changes to the plans except for claims arising from the sole negligence of the Consultant. Client shall indemnify and hold harmless Consultant from such claims.

11) In no case shall the Consultant be responsible for job site conditions or safety. 12) If Client is not the Owner of the property on which the project is designed, a Preliminary Lien Notice shall be mailed to the

Owner upon commencement of work by Consultant. 13) Client shall pay for additional or revised insurance or liability by the Client should such be requests be made by Client. 14) Quantity estimates provided by Consultant are estimates only. The Client shall require Contractor and Subcontractors to

independently confirm quantities which may affect their costs or work, and notify Consultant if discrepancies are evident. 15) Client agrees to have Contractor and Subcontractors examine plans and specifications and notify Consultant of field

conditions which require clarification or modification of plans in a timely manner. 16) In the event the parties to this Agreement are unable to reach a settlement of any dispute arising out of this Agreement or

related to the services under this Agreement, then such disputes may, with the consent of both parties, be settled by binding arbitration in accordance with the Construction Industry Arbitration Rules of the American Arbitration Association or such other arbitration rules as the parties may choose. In any such arbitration, the laws of the State of California shall apply.

17) Client agrees to limit the liability of Consultant, its principals, employees and sub-consultants, to Client and to all contractors and subcontractors on the project, for any claim or action arising in tort, contract, or strict liability to the sum of $50,000. Client and Consultant acknowledge that this provision was expressly negotiated and agreed upon.

environmental reports (E.I.R or other.), geologic or geotechnical engineering services; joint trench design (gas and electrical); shoring design; landscape design; tree protection; private water or sewer systems; dewatering plans; off-site or utility main improvements plans; story pole construction; contractor’s plans for traffic or dust control and safety; operations and maintenance plans or services; and fire protection systems.

2) Revisions or additional work due to unforeseen changes in local or state requirements, or ordinances effective after the date of preparation of this Quotation for Engineering Services.

3) Revisions resulting from either incomplete or inaccurate base information (by others). 4) Preparation of Plans or Documents for other than the Newark Unified School District. 5) Preparation of Plans or Documents for review by the City of Newark, other Municipal Districts, State, or Federal

agencies. 6) Submittals and associated municipal fees or charges.

Subject: Newark Unified School District Playground Improvements

Dear Ms. Rios:

Thank you for the opportunity to provide Vanir with this proposal to support playgroundimprovements at four elementary schools within the Newark Unified School District. BKF willprovide a site assessment and design drawings for use in bidding of the improvements generallydescribed in the attached scope of work.

SCOPE OF SERVICES

TASK 1: Site Assessment1.1 Site Review: BKF will visit each of the schools and perform a review of pavement

conditions, surface feature, and general drainage patterns. We will not complete afield geotechnical review of soil conditions or complete cores of the pavement todetermine thickness.

1.2 Recommendations: BKF will summarize our findings from the field investigation andprovide recommendations in a narrative format.

1.3 Meetings: We will attend one meeting in the field during the site review.

TASK 2: Construction Documents2.1 Base Plans: We assume there are no electronic topographic drawings in CAD format for

the schools. BKF will develop base drawings using aerial photographs integrating sitefeatures found in our site assessment.

2.2 Documents: BKF will provide the following documents for use in the planning submittal.A. Plans:

i. Bunker Elementary Site Paving, Drainage, and Striping Planii. Lincoln Elementary Site Paving, Drainage, and Striping Planiii. Snow Elementary Site Paving, Drainage, and Striping Planiv. Musick Elementary Site Paving, Drainage, and Striping Planv. Construction Details

B. Specifications: GeneralC. Submittals: BKF will submit a draft and final version of the plans and

specifications.2.3 Approval: We assume this work does not require DSA review of approval. Vanir will

submit the plans to each school for review. BKF will submit a plan to the San FrancisocPublic Utility Commission for work at Bunker Elementary School.

2.4 Meetings: BKF will attend two (2) coordination meetings.

TASK 3: Construction Administration Support3.1 Site Observation Visits / Scope of Work Clarifications: BKF will visit the site to provide

clarification of the consultant’s design intent for the contractor, construction manager,or owner. We have allocated fee for two (2) site visits.

3.2 Submittal Review: The team will review and return submittals for those items includedin our scope of work.

3.3 Requests for Information: BKF will respond in writing to written requests forinformation within two (2) business days.

3.4 Punch List: Near the completion of construction, BKF will visit the site to observe theproject. We will provide a written summary of any elements that are variance with theconstruction documents.

BKF shall have noother obligations or responsibilities for the project except as agreed to in writing, or as providedin this agreement. BKF’s services shall be provided consistent with, and limited to, the standardof care applicable to such services. BKF shall provide its services consistent with theprofessional skill and care ordinarily provided by consultants practicing in the same or similarlocality under the same or similar circumstances.

EXHIBIT A - ASSUMPTIONS AND SCOPE QUALIFICATIONS

BKF has made the following assumptions and scope qualifications in the preparing this proposal:

1) Permits: No permits are required for this project except for an encroachment permit fromthe City of San Francisco Public Utilities Commission.

2) Environmental Document: Environmental documentation is not required.

3) Topographic Survey: A detailed topographic survey is not required – all information willbe general in nature with the intent of, “field fitting.”

4) Fee: The owner will pay all application fees.

5) Schedule: Our fee assumes we will complete the work as outlined in the attacheddocument.

Ramp areas around portables are to only receive a seal coat.  These areas are not to be altered. 

Bunker Elementary, 6071 Smith Ave., Newark 

1. Removal and replacement area is as shown on the attached Bunker Elementary aerial map, Map #1. 2. Playground area: Grind out top 2”, compact existing, replace with new asphalt, and apply seal coat/fog coat.  

Playground is considered any area not marked as a fire lane. 3. Fire lane: Grind out top 4” by 20’ wide, compact existing, replace with new asphalt, and apply seal coat/fog coat. 

Fire lane location shown on attached Map #1. 4. Volleyball pole and striping to be relocated to the southern end of yard per attached Map #1. 5. Kickball court striping to be relocated to the south at the location of volleyball courts.  See attached Map #1. 6. All striping to be re‐striped as is with the exception of the volleyball and kickball courts which are per items 4 

and 5 above. 7. ADD ALT 1: Provide and install 2”x6” header board along lawn and asphalt transition at western edge of play 

yard.  Please note there is irrigation located in vicinity, within a foot off the edge of the existing asphalt.  May require relocating irrigation.  Will need to replace landscaping removed during header board install. 

8. ADD ALT 2: Replace all existing basketball court backboards and nets. Total of 3 full courts. 

Lincoln Elementary, 36111 Bettencourt Street, Newark, CA 

1. Removal and replacement area is as shown on the attached Lincoln Elementary aerial map, Map #2, #2B. 2. Playground area: Grind out top 2”, compact existing, replace with new asphalt, and apply seal coat/fog coat.  All 

areas that are not considered the Fire lane. 3. Fire lane: Grind out top 4” by 20’ wide, compact existing, replace with new asphalt, and apply seal coat/fog coat. 

Fire lane location shown on attached Map #2. 4. Install new basketball pole, backboard, and net to complete a full basketball court at the eastern corner of the 

site where a single half court is located.  Basketball pole, backboard, and net provided by District.  See attached Map #2. 

5. Remove tetherball pole and replace with “funnel ball” structure.  Structure provided by District. 6. All striping to be re‐striped as is with the exception of the basketball court located between the portables and 

play structure at the eastern corner of the site.  See Map #2. 7. Kinder area and outside lunch area (“small equipment” work area).  

a. Remove and replace as per item 2 above.  Area around portable ramps to only have seal coat/fog coat applied.  Do not alter portable ramps.  See Map #2B.   

b. Remove tree stump to the south of the portables, compact, pave, and apply seal coat/fog coat.  See Map #2B. 

c. Build planter box around the two trees in the outside lunch area to avoid necessity to touch/alter trees roots.  Planter box perimeter to be potential seating for children.  Allow for 2‐3 inch gap at bottom between trees to allow for drainage of area to DI.  (Will need a sketch) 

8. ADD ALT 1: replace grass patch to the east of the MPR building with baserock and aphalt.  See Map #2 for location. 

a. Provide separate cost for removal and disposal of dirt.  District to provide testing for disposal profiling. 9. ADD ALT 2: Provide and install 2”x6” header board along all lawn and asphalt transitions.  Please note there may 

be irrigation located in vicinity.  May require relocating irrigation.  Will need to replace landscaping removed during header board install. 

10. ADD ALT 3: Replace all existing basketball court backboards and nets. Total of 6 half courts
