Presentation on CRZ Notification, 2011 was made before the Authority by the Member Secretary highlighting the salient features of the said notification and the powers and duties of the Authority in enforcing the provision of the notification, 2011. 16.2 Confirmation of the proceedings of the previous KSCZMA meeting held on 08.07.2016. The Proceedings of the previous KSCZMA meeting held on 08.07.2016 are read out and the proceedings were confirmed as there were no comments received from the members. 16.3 Action Taken Report on the proceedings of the previous KSCZMA meeting held on 08.07.2016. Action Taken Report at annexure -1 was perused and the Authority noted the action taken. 16.4 Status of Preparation of State Coastal Zone Management Plan : It was brought to the notice of the Authority that, preparation of Coastal Zone Management Plan (CZMP) as per CRZ Notification, 2011, has been awarded to the National Center for Sustainable Coastal Management (NCSCM), Chennai for Rs. 1,93,43,058/- on 02.11.2016. further it is also brought to the notice of the authority that the validity of approved CZMP as per CRZ Notification 1991, has been further extended up to 31 st July 2017 vide Notification dated 23.02.2017 of MoEF, & CC Government of India, New Delhi.

16.1 A Brief Presentation on CRZ Notification, 2011.

Presentation on CRZ Notification, 2011 was made before the Authority by

the Member Secretary highlighting the salient features of the said notification

and the powers and duties of the Authority in enforcing the provision of the

notification, 2011.

16.2 Confirmation of the proceedings of the previous KSCZMA meeting held

on 08.07.2016.

The Proceedings of the previous KSCZMA meeting held on 08.07.2016 are

read out and the proceedings were confirmed as there were no comments

received from the members.

16.3 Action Taken Report on the proceedings of the previous KSCZMA

meeting held on 08.07.2016.

Action Taken Report at annexure -1 was perused and the Authority noted

the action taken.

16.4 Status of Preparation of State Coastal Zone Management Plan :

It was brought to the notice of the Authority that, preparation of Coastal

Zone Management Plan (CZMP) as per CRZ Notification, 2011, has been

awarded to the National Center for Sustainable Coastal Management (NCSCM),

Chennai for Rs. 1,93,43,058/- on 02.11.2016. further it is also brought to the notice

of the authority that the validity of approved CZMP as per CRZ Notification

1991, has been further extended up to 31st July 2017 vide Notification dated

23.02.2017 of MoEF, & CC Government of India, New Delhi.

16.5 Online Submission of applications for CRZ clearance and Monitoring of

CRZ Clearances

It was brought to the notice of the Authority that, the Ministry of

Environment, Forest and Climate Change, Government of India has launched a

portal for online submission of applications for CRZ Clearances on 06.03.2017.

The NIC division of MoEF & CC, Government of India is organizing a workshop

in this regard on 20th March 2017 at Indira Paryavaran Bhavan, New Delhi. In

future the applications seeking CRZ clearances shall have to be received online

and processed accordingly by KSCZMA. The Authority noted the same.

The Authority suggested to send Sri. Rajanna, Scientific Officer to attend the

workshop on 20th March 2017 at New Delhi.

16.6 New Proposals

16.6.1 Request for issue of CRZ Clearance from Assistant Executive Engineer,

PWD Dept, Udupi for Improvement work to Hejamadi Kodi Fisheries Road

under National Cyclone Risk Mitigation Project (NCRMP) in Udupi Taluk

and District (FEE 281 CRZ 2016)

1. Name of the Project Improvement work to Hejamadi Kodi Fisheries Road under National Cyclone Risk Mitigation Project (NCRMP).

2. Name of the Applicant Assistant Executive Engineer, PWD Dept, Udupi Sub-division.

3. Location of the Project Village/Town, Taluk, Dt.

Hejamadi Kodi, Udupi Taluk and District.

6. CRZ Classification NDZ and outside the NDZ of CRZ-III (as per the CZMP approved 1996).

7. Project Cost Rs. 171 Lakhs

8. Activities proposed • Total length of the road project is 1.40 KM.

• CRZ clearance has already been issued for a length of 0.66 KM from P2 to P3,

• Now they have requested CRZ clearance for P1 to P2 and P3 to P4 for a balance length of 0.74 KM.

Notification, 2011, construction of

dispensaries, schools, public rain shelter,

community toilets, bridges, roads, provision of

facilities for water supply, drainage, sewerage,

crematoria, cemeteries and electric sub-station

which are required for the local inhabitants are

permitted activities.

10. The details of recommendations of the District Coastal Zone Management Authority (DCZMA)

The subject was placed before the DCZMC, Udupi on 16.09.2016 and the DCZMA has recommended the project.

12. Whether issue of clearance is within the scope of SCZMA or NCZMA? Specify relevant rules.

Issue of clearance is within the scope of SCZMA. As per para 8 III CRZ - III, (iii) (j) and para 8 III CRZ-III B (viii) of CRZ Notification, 2011 the above activity is permissible.

The Authority after discussion and deliberations decided to issue CRZ clearance

for the improvement work to Hejamadi Kodi Fisheries Road from P1 to P2 and P3 to P4

for a balance length of 0.74 KM by the Assistant Executive Engineer, PWD Dept.

Mangalore, as per the recommendation of the DCZMC, under para 8 III CRZ - III, (iii) (j)

and para 8 III CRZ-III B (viii) of CRZ Notification 2011, with the following conditions:

1. Waste materials such as mud bitumen etc should be properly disposed in a

scientific manner and it should not be dumped in water bodies.

2. The sand from the CRZ area should not be extracted and used for this purpose.

The project proponent should source the material required from authorized

quarry only.

3. Mangroves if any in the adjacent area should not be disturbed.

The existing corridor is 25 M wide all through, the existing intake point is 1430 M inside the sea and the outfall point is 670 M from HTL. Due to operational constraints faced in the sea water intake system of the existing phase -1 sea water intake system will be designed to cater both phase I & II water requirements up to sea water intake pump house.

• Seawater requirement for existing 2x600 MW units are 10,000 M3/Hr which is met from Arabian Sea.

• For existing unit 87.6 MCM/year sea water is require. After expansion to 2800 MW, total intake & outfall of Sea water shall be 213.6 MCM/year & 175.2 MCM respectively.

• Proposed intake and outfall coordinates have been recommended by NIO after Modeling Studies.

• The 3 existing pipelines of 1.1 meter dia will be replaced with new pipelines of 1.4 meter dia for each of 2 intake pipelines and 1.2 meter dia for 1 outfall pipeline in the existing land corridor of 25 mts width.

CRZ clearance obtained from MoEF & CC, New

Delhi. As per Hazardous waste (Management

Handling) Rules, 2016, Molasses is not found in

the list of hazardous materials in the schedule.

brought to the notice of the Authority, Hon’ble NGT judgment in OA No. 111 of 2016

dated 27.02.2017.

The 17 proposals for removing sand bars submitted by the District Sand Monitoring

Committee has been placed before the Authority and it has been deliberated with respect

to the observations made by the Hon’ble NGT in its order dated 27.02.2017 , and OM’s

of the MoEF & CC dated 24.02.2011, 09.06.2011 and 08.11.2011. After the deliberation

and discussion the Authority observed the following:-

1. Seven Member committee has not been constituted as per OM of MoEF &

CC dated 08.11.2011, as provided in the OM, there should be two

representatives one each from local civil society and local fishing

community.

2. In the technical report submitted by the NITK, Surathkal, there was no

mention about the actual presence of sand bars, depth at which sand bars

are deposited and whether these sand bars are actually obstructing the

fishing vessels or not.

3. In the technical report of NITK, ‘Kudrus’ which are naturally formed

Islands have been proposed to be removed which is not allowed as per CRZ

Notification, 2011.

In view of the above the Authority decided to inform the applicant accordingly and

to get the revised proposals.

16.6.46 Appointment of Government Advocates to represent the State before

various courts at Mangalore, Udupi & Karwar district with respect to

violations cases:

The Members Secretary, brought to the notice of the Authority that number of

violations cases are pending for want of Appointment of Government Advocates to

represent the KSCZMA. Accordingly the opinion was sought form the Law

Department and the Law Department has given opinion high lighting the provisions

of the Karnataka Law Officers (Appointment of Conditions of Service) Rules, 1977,

as follows:-

1. If the case pertaining to encroachment in CRZ area is a civil case, the

administrative department may engage the services of the District

Government Pleader/Addl. D.G.P.s as the case may be

2. If the case is a criminal case, the administrative department will have to

engage the services of the Public Prosecutors and Assistant Public

Prosecutors to represent the State in view of Sec. 24 & 25 of Cr.P.C.

3. If the administrative department intends to engage the services of a Special

Counsel, the same is governed by Rule 30 of Karnataka Law Officers

(Appointment of Conditions of Service)Rules, 1977.

4. If the administrative department intends to appoint Special Counsel, then

as per Rule 30 (2), the administrative department may consult the Hon’ble

Advocate General if the appointment is in relation to a Civil Case and the

Director of Prosecution if the appointment is in relation to a Criminal Case.

5. The Department can appoint Advocates for the above purpose by way of

empanelment.

The Authority after discussion and deliberations decided to instruct the

concerned Regional Directors Mangalore, Udupi and Karwar to take action to

send the Panel of Advocates for approval of the Panel for appointing the

Advocates by the Authority.

It was also decided that the next meeting will be held on 05.04.2017 at Mangalore.

The meeting concluded with vote of thanks to the Chair.
