Proceedings of the 10 th meeting of Karnataka State Coastal Zone Management Authority (KSCZMA) held on 11 th August, 2015 at Deputy Commissioner Office, Udupi under the Chairmanship of Additional Chief Secretary to Government, Department of Forest, Ecology and Environment. Members present: As per the list enclosed. The Chairman welcomed the members present. All the files were placed before the Authority for perusal and the subjects were deliberated as per the Agenda. 10 .1: Confirmation of the proceedings of the previous KSCZMA meeting held on 28.05.2015. The proceedings of the previous KSCZMA meeting held on 28.05.2015 were read out. The proceedings were confirmed as there were no comments or amendments received from the members. 10.2: Action Taken Report on the proceedings of the previous KSCZMA meetings held on 28.05.2015. (Annexure-1). Action Taken Report at Annexure – I was perused and the Authority noted the Action Taken. 10.3 Ratification of provisional NOC issued by the Regional Directors (ENV) with the approval of the DCZMCs. The KSCZMA during the meeting held on 11.06.2014 had taken a decision to authorize the Regional Directors (Env) of the coastal districts to issue provisional NOC for construction/re-construction/repair of dwelling units in CRZ II and CRZ-III (200m – 500 m) and outside the CRZ limits with the approval of the concerned DCZMCs and then to submit proposal for ratification of the action taken. A detail procedure in this regard have been issued vide the Government letter No. FEE 236 CRZ 2013, dated 18.08.2014. Accordingly, the Regional Directors (Env) of the coastal districts have submitted proposals for ratification of the provisional NOC issued. The details of proposals on which provisional NOC have been issued by the Regional Directors (Env), Udupi and Uttara Kaannda districts subject to ratification are enclosed as Annexure – II, and Annexure – III respectively. The Authority reviewed the provisional NOCs issued by the Regional Directors, Udupi and Uttara Kannada Districts and after discussion the Authority decided to accord ratification for the action taken by concerned RDs. Further, the Authority decided to issue Proper CRZ NOC for the proposals listed in Annexure – II, and Annexure – III

The proceedings of the previous KSCZMA meeting held on 28.05.2015 were read out. The proceedings were confirmed as there were no comments or amendments received from the members.

10.2: Action Taken Report on the proceedings of the previous KSCZMA meetings held on 28.05.2015. (Annexure-1).

Action Taken Report at Annexure – I was perused and the Authority noted the

Action Taken.

10.3 Ratification of provisional NOC issued by the Regional Directors (ENV) with the

approval of the DCZMCs.

The KSCZMA during the meeting held on 11.06.2014 had taken a decision to

authorize the Regional Directors (Env) of the coastal districts to issue provisional

NOC for construction/re-construction/repair of dwelling units in CRZ II and CRZ-III

(200m – 500 m) and outside the CRZ limits with the approval of the concerned

DCZMCs and then to submit proposal for ratification of the action taken. A detail

procedure in this regard have been issued vide the Government letter No. FEE 236

CRZ 2013, dated 18.08.2014. Accordingly, the Regional Directors (Env) of the coastal

districts have submitted proposals for ratification of the provisional NOC issued. The

details of proposals on which provisional NOC have been issued by the Regional

Directors (Env), Udupi and Uttara Kaannda districts subject to ratification are

enclosed as Annexure – II, and Annexure – III respectively.

The Authority reviewed the provisional NOCs issued by the Regional Directors,

Udupi and Uttara Kannada Districts and after discussion the Authority decided to

accord ratification for the action taken by concerned RDs. Further, the Authority

decided to issue Proper CRZ NOC for the proposals listed in Annexure – II, and

Annexure – III

10.4: CRZ Clearance for construction/re-construction of residential & non residential

buildings in CRZ – I, II & III

Area. – Udupi District

10.4.1 Request for issue of NOC to Sri. Narayana Shriyan S/o Giriya Marakala for re-construction of residential house at Sy. No. 249/9A2A1 of Kodavoor Village, Udupi District (FEE 177 CRZ 2015).

Sri. Narayana Shriyan S/o Giriya Marakala has requested NOC for re-construction of residential house at Sy. No. 249/9A2A1 of Kodavoor Village, Udupi District. The Regional Director (Environment) has inspected the proposed site and reported that the project site is at a distance of 60 m from HTL of River. It is classified as CRZ-I. As per approved CZMP 1996 area between HTL of River to 150 m or width of creek whichever is less is classified as CRZ I.

The Regional Director (Environment) has submitted application in the prescribed format, survey sketch of site, draft digitised CRZ map showing the area of proposed re-construction, photos of old house, 1989-1990 year tax assessment extract, RTC, approved CZMP sheet and proceeding of DCZMC meeting held on 22.04.2015. The building is said to be around 291 sqm plinth area. The DCZMC recommended the proposal for issue of NOC in the meeting held on 22.04.2015. As per the provisions under the para 3(i)(e) reconstruction, repair works of dwelling units of local communities especially fisher folk is allowed in accordance with local town and country planning regulations.

The Authority after discussion and deliberations decided to issue NOC for

Reconstruction, as per the recommendation of the DCZMC.

10.4.2 Request for issue of NOC to Smt. Marli Poojarthy W/o Narayana Poojary for re- construction of residential house at Sy. No. 21/1AP1 of Paduvari Village, Udupi

District (FEE 175 CRZ 2015).

Smt. Marli Poojarthy W/o Narayana Poojary has requested NOC for re-construction of residential house at Sy. No. 21/1AP1 of Paduvari Village, Udupi District. The Regional Director (Environment) has inspected the proposed site and reported that the project site is at a distance of 60 m from HTL of Sea and 30 m from River HTL and is classified as CRZ III. As per approved CZMP 1996 area between HTL of sea to 500 m & 150 m from River is classified as CRZ-III.

The Regional Director (Environment) has submitted application in the prescribed format, survey sketch of site, draft digitised CRZ map showing the area of proposed re-construction, photos of old house, 1989-1990 year tax assessment extract, RTC, approved CZMP sheet, certificate from Paduvari Grama Panchayath for change of door no. dated 17.07.2014 and proceeding of DCZMC meeting held on 22.04.2015. The building is said to be around 1054 sqm plinth area. The DCZMC recommended the proposal for issue of NOC in the meeting held on 22.04.2015.

The Authority after discussion and deliberations decided to issue NOC for

Reconstruction as per the recommendation of the DCZMC.

construction of residential house at Sy. No. 119/6BP2 of Uppunda Village, Udupi District (FEE 181 CRZ 2015).

Sri. Narayana Kharvi S/o Govinda Kharvi has requested NOC for re-construction of residential house at Sy. No. 119/6BP2 of Uppunda Village, Udupi District. The Regional Director (Environment) has inspected the proposed site and reported that the project site is at a distance of 49 m from Sea and 50 m from HTL of River & is classified as CRZ III. As per approved CZMP 1996 area between HTL of sea to 500 m & 150 m from River is classified as CRZ-III.

The Regional Director (Environment) has submitted application in the prescribed format, survey sketch of site, draft digitised CRZ map showing the area of proposed re-construction, photos of old house, 1984-1985 year tax assessment extract, RTC, approved CZMP sheet and proceeding of DCZMC meeting held on 22.04.2015. The building is said to be around 24X18 sqm plinth area. The DCZMC recommended the proposal for issue of NOC in the meeting held on 22.04.2015. The Regional Director (Environment) has inspected the proposed site and reported that the project site is at a distance of 170 m from HTL of Sea and 45 m from HTL of River. Width of the Creek is 35m & is classified as CRZ III. As per approved CZMP 1996 area between HTL of sea to 500 m & 150 m from River is classified as CRZ-III.

The Regional Director (Environment) has inspected the proposed site and reported that the project site is at a distance of 90 m from River and is classified as CRZ III. As per approved CZMP 1996 area between HTL of sea to 500 m & 150 m from River is classified as CRZ-III.

The Regional Director (Environment) has submitted application in the prescribed format, survey sketch of site, draft digitised CRZ map showing the area of proposed re-construction, photos of old house, 1990-1991 year tax assessment extract, RTC, approved CZMP sheet, certificate from Talluru Grama Panchayath for change of door no. dated 05.11.2014and proceeding of DCZMC meeting held on 25.06.2015. and Construction of residential house at Sy. No. 34/5B2 of Kundapura kasba Village, Udupi District. The Regional Director (Environment) has inspected the proposed site and reported that the project site is at a distance of 102 m from River and it is classified as CRZ-II.

The Regional Director (Environment) has submitted application in the prescribed format, survey sketch of site, draft digitised CRZ map showing the area of proposed construction, RTC, approved CZMP sheet and proceeding of DCZMC meeting held on 25.06.2015. The building is said to be around 500 sqm plinth area. The DCZMC recommended the proposal for issue of NOC in the meeting held on 25.06.2015. As per the provisions under the para 1(ii) CRZ shall apply to the land area between HTL to 100m or width of the creek whichever is less on the landward side along the tidal influenced water bodies that are connected to the sea.

The Authority after discussion and deliberations decided to issue NOC for

Conversion & Construction as per the recommendation of the DCZMC.

10.4.36 Request for NOC from Sri. Ramesh Koti S/o Chandu koti for re-construction of

No 154/6 of Uliyaragoli Village, Udupi Taluk, the Regional Director (Environment) has inspected the proposed site and reported that the project site is at a distance of 60 m from River and is classified CRZ III. As per approved CZMP 1996 area between HTL of sea to 500 m & 150 m from River is classified as CRZ-III.

The Regional Director (Environment) has submitted application in the

prescribed format, survey sketch of site, draft digitised CRZ map showing the area of proposed re-construction, photos of old house, 1989-90 year Tax assessment extract, approved CZMP sheet, sale deed copy and proceeding of DCZMC meeting held on 26.03.2013. The building is said to be around 600 Sqm. plinth area. The DCZMC recommended the proposal for issue of NOC in the meeting held on 16.06.2014.

10.5 Uttara Kannada District (Karwar)

10.5.1 Request for NOC from KSIIDC, Bangalore for development of Multipurpose, all weather Sea Port at Tadadi, Karwar, Uttara Kannada District, Karnataka on Public Private Partnership Basis (FEE 1066 CRZ 2014).

Managing Director, M/s. Karnataka State Industrial and Infrastructure Development Corporation Limited has seeking prior CRZ clearance of KSCZMA for their proposed Development of Multipurpose, all weather Sea Port at Tadadi, Karwar, Uttar Kannada District, Karnataka on Public Private Partnership Basis as per para No. 4.2 of CRZ Notification 2011.

The proposal was placed in the 7th KSCZMA Meeting held on 5th September

2014 and the following points were placed before the Authority:

1. The Government of Karnataka Vide G.O.No.IDD/78/ITS/2009 dated 09.12.2009 has accorded approval for the Development of Multipurpose, all weather Sea Port a Tadadi, Uttara Kannada District, Karnataka on Public Private Partnership basis with KSIIDC as nodal Agency. The port is being designed to initially handle about 34.25 MTPA of Cargo with final designed capacity of 62.360 MTPA.

2. The MoEF, GoI has examined the proposal and have issued the Terms of Reference vide their letter F.No.11-28/2011-IA.III dated 26.09.2011 and the validity of the TOR is extended upto 25.09.2014 vide letter F.No.11-28/2011-IA.III dated 02.19.2013.

3. The following studies have been completed for implementation of the project:

a) A detailed feasibility report by consortium of M/s. Prointec, Sprain and M/s. Mir Project & consultants;

b) Environmental Impact Assessment study report by National Environmental Engineering Research Institute, Nagpur. The KSIIDC has informed that the report is under finalization and only Executive summary is submitted.

c) Report on CRZ Demarcation of High Tide Line and Delineation of CRZ boundaries prepared by National Institute of Oceanography (through NEERI), Goa.

4. The KSIIDC vide letter dated 18.08.2014 has requested KSCZMA for approval for location of the Tadadi Sea Port in the CRZ and communicate the same to MoEF.

5. Application for CRZ Clearance as per Para 4.2 of CRZ Notification-2011 is not submitted. Further only filled up MoEF-questionnaire for environmental appraisal for ports and harbours and only executive summary of the EIA report (NEERI) is submitted.

6. This is a proposal within the CRZ area requiring waterfront and foreshore facility requiring CRZ Clearance under Para 4(f) of CRZ Notification-2011 and also requiring Environment Clearance from MoEF, GoI under Para 7(e) of EIA Notification-2006 with more than 5 Million TPA of cargo handling capacity. General conditions shall apply.

7. The following points are noted from the MoEF, questionnaire for environmental appraisal for ports and harbours as well as executive summary of the EIA report (NEERI):

i) Karnataka State Industrial and infrastructure Development Corporation Limited (KSIIDC) has proposed to develop a port at Tadadi. The port is to be constructed in the PPP (Public Private Partnership) mode on DBFOT (Design, Build, Finance, Operate & Transfer) basis. The port is being designed to initially handle about 34.25 MTPA of Cargo with final designed capacity of 62.360 MTPA.

ii) For development of port at Tadadi, the Karnataka Industrial Area Development Board (KIADB) had acquired a total of about 1416 acres of land in Hilalmakki, Yemmemadi, Midlagazzani, Hiregult, Morba, Torke villages.

iii) This is a minor port located at latitude 14032.40’ N and longitude 740 22.03’ E. The backwaters of the river have huge waterfront area, which make the location a natural harbour. At present it is a

fair weather lightrage fishing port situated on the estuary of the Aghanashini River at a distance of about 50km from Karwar, about 24km from Belekeri and approximately 35km from Honnavar.

iv) The Konkan Railway Line and National Highway (NH-66) pass very close to the port site. The nearest station on the Konkan Railway line is Ankola, which is at a distance of about 25km from Tadadi.

v) Tadadi port has been designed to have seven berths namely, Two berths each for export of iron ore and import of coal, two multipurpose berths for export of steel products and one multipurpose berth for general cargo and containers.

vi) The project is not connected to any inland waterway system. No polluting industries are located in the vicinity of port. There is not provision for dry dock. Three warehouses of 5000Sqm each planned. There is no housing facilities proposed inside the proposed port.

vii) 33% of the total area of the port is proposed for greenbelt. 6KLD of treated sewage from STP will be used for greenbelt.

viii) The area to be reclaimed is 10, 71,000Sqm. ix) Emergency response plan and contingency plan are yet to be

prepared. x) Aversa, Gokarna and Om beach are places of tourist importance

located around. xi) Fresh water source in the region is ground water.

8. Conclusions drawn by NIO, Goa in the report of demarcation of HTL

and Delineation of CRZ boundary for the proposed port:

• The entire purported property is engulfed by the Tadadi River water and is the part of the creek system and thus becomes the intertidal area.

• The entire plot boundary is covered with mudflat and contains environmentally sensitive and ecologically fragile areas as specified in the Coastal Regulation Zone notification and is classified as CRZ-I(B).

• The entire purported property is waterfront side of HTL and a setback line 150m is drawn parallel to the HTL configuration.

• The property contains mudflat, dense thick to sparse mangroves growth all round it.

• Extensive reclamation will have to be carried out for the project and infrastructure which in turn will affect the creek circulation pattern.

• Buffer zone of 50m were drawn for mangroves as per MoEF guidelines of 100 Sqm and the same is classified as CRZ-I(A).

• The area between 50m buffer zone and 150m set back line is classified as CRZ-III.

• The HTL may change if any of the existing morphological features are altered.

A preliminary presentation was made before the Authority by Sri. N.R.N.

Simha, Dy. General Manager, KSIIDC highlighting salient features of the proposed port. However, the Authority observed that the project proponent has not submitted the following prescribed documents seeking prior CRZ clearance to the KSCZMA in accordance with the procedure as per para No. 4.2 of CRZ Notification No. S.O. 19(E) dated 06.01.2011.

(a) Form-1 (vide Annexure-IV of the CRZ Notification-2011);

(b) Rapid EIA Report including marine and terrestrial component.

(c) Comprehensive EIA with cumulative studies for projects in the stretches

classified as low and medium eroding by MoEF based on scientific studies

and in consultation with the State Government.

(d) Disaster Management Report, Risk Assessment Report and Management

Plan;

(e) CRZ map indicating HTL and LTL demarcated by o n e o f t h e authorized Agency (as indicated in para 2) i n 1:4000 scale; (e) Project layout superimposed on the above map indicated at (e) above;

(f) The CRZ map normally covering 7km radius around the project site.

(g) The CRZ map indicating the CRZ-I, II, III and IV areas including other

notified ecologically sensitive areas;

(i) No Objection Certificate from the concerned State Pollution Control Boards or Union territory Pollution Control Committees for the projects involving discharge of effluents, solid wastes, sewage and the like.

After deliberation the Authority had deferred the subject with suggestion to

the project proponent (KSIIDC) to submit all the details/documents required as

above. Further it was also decided to obtain the report of the studies on Aghanashini

Estuary conducted by EMPRI or any other agency and place before KSCZMA for

further consideration.

Accordingly a letter has been communicated to the proponent vide letter No.

FEE 1066 CRZ 2014 dated 01.10.2014 and also authority has written a letter to the

Director General, EMPRI vide letter No. 1066 CRZ 2014 dated 02.12.2014 stating that

obtain the report of the studies on Aghanashini Estuary and submit.

The proponent have submitted the reply vide letter No.

GM/TP/KSCZ/383/2015-16 dated 26.05.2015.

The proposal was placed in the 10th KSCZMA Meeting held on 11th August 2015.

A presentation was made before the Authority by Managing Director,

KSIIDC, highlighting the salient features of the proposed port. During the

presentation, the Proponent has informed the committee that, there are three big

industrial townships are coming in Tumkur, Dharwad & Belagavi. The Karwar port

has limited scope for transportation of goods because of Seabird activities. Hence,

the above mentioned three industrial townships will utilize the services provided in

this port, which is both economical & beneficial.

During the public hearing, some of the NGO’s who are not locals have raised

objection against the proposal quoting the reason that, there is a proposal for

declaration of this area as Critically Vulnerable Coastal Area (CVCA). But the local

people and fishing folk have opposed the NGO’s objections and also they agreed for

the setting up of this project. The demands of the local fishing folks and villagers,

like protecting their fishing farming, extraction of bivalves, crabs, shrimps &

aquaculture should be protected and employment opportunity to be provided to

them.

The proponents have given assurance that, the existing fishing port using by

the fishing folk will not be disturbed and in turn will be improved and their

integrity will be protected. Also their livelihood will not be disturbed. The local

people will be provided employment. New Educational institutions will be opened

and the children and the local youth will be educated and trained. The existing mud

flats and mangroves will not be disturbed.

Also the proponent has informed that, in their budgetary provision, they have

included development of infrastructure facilities within the villages like roads,

transportation, communication, etc., setting up of primary schools for the local

villagers, arranging regular medical checkup, supply of drinking water, starting an

Industrial Training Institute for the local youths etc.,

The proponent has submitted all the information sought by the authority

during the earlier meeting. The mitigation measures suggested by the proponent are

agreeable to the authority. The authority has satisfied with the presentation and

clarifications given by the proponent for the queries raised by the members of the

authority. Report of the studies on Aghanashini Estuary conducted by EMPRI is

awaited.

The authority after deliberation, decided to recommend the proposal to MoEF for clearance.

10.5.2 Request of NOC to Smt. Mamata Manjunath Moger, for re-construction of residential unit at Sy. No. 21/3 of Heble Village, Bhatkal Taluk, Uttara Kannada District (FEE 244 CRZ 2015).

Smt. Mamata Manjunath Moger has requested NOC for re-construction of residential house at Sy. No. 21/3 of Heble Village, Bhatkal Taluk Uttara Kannada District. The Regional Director (Environment) has inspected the proposed site and reported that the project site is at a distance of 160 m from Sea and is classified as CRZ III. As per approved CZMP 1996 area between HTL of sea to 500 m & 150 m from River is classified as CRZ-III.

The Regional Director (Environment) has submitted application in the

prescribed format, survey sketch of site, draft digitised CRZ map showing the area of proposed re-construction, photos of old house, 1986-1987 year tax assessment extract, RTC, approved CZMP sheet, Site Inspection report, change in ownership letter and proceeding of DCZMC meeting held on 24.3.2015. The building is said to be around 325 sqm plinth area. The DCZMC recommended the proposal for issue of NOC in the meeting held on 23.05.2015.

10.5.3 Request of NOC from Smt. Kamala Narayan Moger for re-construction of Residential at Sy. No. 229/5 Mundalli Village, Bhatkal Taluk, Uttara Kannada

District (FEE 245 CRZ 2015).

As per approved CZMP 1996 area between HTL of sea to 500 m & 150 m from River is classified as CRZ-III.

The Regional Director (Environment) has submitted application in the prescribed format, survey sketch of site, draft digitised CRZ map showing the area of proposed re-construction, photos of old house, 2012-13 year Tax receipt, RTC, Certificate issued by PDO Letter, approved CZMP sheet, site inspection report, and proceeding of DCZMC meeting held on 24.3.2015. The building is said to be around 28X18.Sq.ft. plinth area. The DCZMC recommended the proposal for issue of NOC in the meeting held on 23.05.2015.

10.5.4 Request of NOC from Smt. Nirmala Purushottam Moger, for re-construction of residential unit at Sy. No. 89/11 Heble Village, Bhatkal Taluk, Uttara Kannada

District (FEE 246 CRZ 2015).

As per approved CZMP 1996 area between HTL of sea to 500 m & 150 m from River is classified as CRZ-III.

M/s. Mysore Mercantile Co. Ltd., has proposed to set up of warehousing facility of 26088 KL Liquid Cargo Terminal with connecting pipeline from Jetty storage tank at Karwar port area at Sy. No. 1379, Baad-III (Aligadda) Village, Karwar Taluk under CRZ Notification 2011.

The proposal was placed in the DCZMC meeting held on 24.03.2015 and the committee had decided to recommend the proposal for rejection to issue CRZ Clearance as per CZMA Notification 2011, the proposed storage product are not listed in annexure-II of the Notification. Now the proponent have submitted a representation vide letter no. MMCL/MAY/39/2015-16, dated 12.05.2015, stating that storage of non-hazardous cargo such as edible oil, fertilizers, food grains in the notified ports are permitted activities as per CRZ Notification 2011. Therefore they requested to consider their proposal for recommendation of environmental clearance for their proposed facility for edible oil, Bitumen & Molasses. Since the proposal has already been rejected in the DCZMC meeting held on 24.03.2015, the proposal has been withdrawn from the meeting

Preparation of CZMP maps by National Centre for Sustainable Coastal Management,

Chennai

The Secretary, Environment & Ecology explained to the meeting about the progress

made in the preparation of CZMP maps of our state by NCSCM, Chennai. As per the

Director, NCSCMC, that almost all CZMP maps are ready and before sending them to

NCZMA, New Delhi, it is desirable to send our RDs & Spl. Director to Chennai to have

verification of those draft maps. In this regard, it was decided to depute Spl. Director and all

the RDs of coastal District for verification.

With the permission of the chair,

10.6.1. The Deputy Commissioner, Udupi, presented Rural infrastructure development, i.e.,

the improvement of existing roads, and bridges, which inter links fishing colonies

and local habitats. There are 23-Roads and 3–bridges, the repairs/ maintenance of

which requires NOC from KSCZMA. The Authority after discussion and

deliberation decided to issue NoC for repair of existing 23-Roads and 3 – Bridges by

DCZMC. The details of roads furnished below.

10.6.2. Improvements to Hejamadi –Kodi Fisheries Road Under National Cyclone Mitigation Project (NCRMP) in Udupi Taluk and District (FEE 296 CRZ 2015)

Improvements to Hejamadi –Kodi Fisheries Road Under National Cyclone Mitigation Project in Udupi Taluk and District (NCRMP). The proposed site was inspected and found that the proposed area is partially CRZ- III. As per Coastal Zone Management Plan, the length of the road is 660mtr.
