The ‘can’ test is described in section 8 of the IMSBC Code as a spot check a Master can conduct if he is suspicious of the condition of the cargo, and is not meant to replace or supersede laboratory testing which is the responsibility of the Shippers. Section 8 states that if the sample shows signs of liquefaction - i.e. flat surface with evidence of free moisture, arrangements should be made to have additional laboratory tests conducted on the material before it is accepted for loading. Nevertheless cargo should never be accepted on the basis of the ‘can’ test alone. The test may indicate if cargo is unfit for shipment but cannot determine if a cargo is fit to be loaded– this can only be determined by laboratory testing.

9. If the master or the appointed surveyor is presented with any document seeking their confirmation that the cargo is safe to carry they should refuse to sign it. The obligation under the Code is on the shipper to declare that the cargo is safe to carry.

20.3 PROCEDURE FOR SAFE LOADING

Please take necessary precautions as per following guidelines:

1. Vessel would get Cargo declaration which describe TML, FMP & Moisture content at shipment (AMS) from shipper or agent before commence of loading. Test for cargoes declaration should be recent and in particular those for moisture content no more than 7 days before shipment

2. Carry out CAN test during loading, if any suspicion of AMS or in doubt or has detected over-moisture cargo,

Vessel needs to advise P & I surveyor at once. Vessel to inform Charterers, Owners or commercial operators with copy to Fleet Cell.

3. During loading, the Master and his officers must be on high alert for any sign of excessive moisture in the cargo loaded.

4. Vessel to check through IMSBC for cargo details and precautions.

20.4. METAL SULPHIDE CONCENTRATE.

Some concentrates may meet the criteria for classification as marine pollutants under Class 9, UN3077 (environmentally hazardous substances), carrying such cargo in some ports may need to be approved by vessel’s flag state, also cargo residues and washing water are not allowed to dispose to sea. Vessel should obtain a cargo declaration as per IMSBC code Section 4.2 prior to loading and inform office as soon as voyage instruction for loading this cargo is fixed.

SECTION 24 - COLD WEATHER PROCEDURES (Comply with cold weather precautions check list in Appendix of this manual) ** Marine Safety Department has a movie for trading in Baltic in winter. Please send a request for this informative movie in good time.

24.1 GENERAL Trading in very cold climates in winter requires special precautions because of the risk of icing and freezing weather conditions that effect man and machine. During such periods when the ship is operating in conditions when the temperature is below freezing, precautions must be taken to prevent damage to the ship and systems. There is a risk of equipment freezing up. Particular attention must be paid to relief valves and cooling water systems. Heating systems are to be used, if fitted. All vessels are to use the checklist for cold weather in the Annex of this section.

24.2 PNEUMATIC VALVES AND CONTROL SYSTEMS During periods of cold weather pneumatic valves and control systems may be slow to respond or freeze up and fail to operate. It is particularly important that the drier on any control air compressor is operating correctly. When practicable, systems should be operated regularly, water traps cleared and lines blown through to clear any moisture, which may have collected.

24.3 SEA WATER INTAKES The pressure of water from a sea water intake must be closely monitored, particularly when the ship may be in fresh or nearly fresh dock water, to ensure that the intakes are not being progressively blocked by the formation of ice. Steam to sea chest should be used if icing occurs in the dock water.

24.4 FIRE LINE AND OTHER PIPELINES When freezing weather conditions are imminent (sea temperature +2oC or air temperature +1oC) or the temperature will drop below zero degrees Celsius, the following precautions must be taken: The fire line is to be drained completely and afterwards drains and valves are to be closed so the fire line is ready for immediate use.

24.5 BALLAST TANK VENTS Check and ensure the cowls and floats are free of ice prior de ballasting/Ballasting operations.

24.6 LIFEBOATS Lifeboats having water cooled engines – drain all water from the engine jacket and replace it

with an anti-freeze mixture, such as Glycol mixed with water 50% / 50% ratio, to avoid freezing of water in sub-zero temperatures

24.7 CLOTHING FOR CREW Ensure Heavy winter clothing for Crew for example Ski suits etc.

Please refer to Bulk Carrier Practice (pages 258-263) and Code of safe practice for solid bulk cargoes for details. WALLEM must be advised soonest when vessel has been informed that steel products are to be loaded. Port rotation for load & discharge ports along with agent and steel quantity to be informed. WALLEM will arrange for P&I Club attendance. Stowage of steel cargo and Securing during passage are detailed in Bulk carrier practice and are to be complied with. Please also refer to the NE P & I Cargo stowage and securing Booklet for details on stowage of steel products. The Book is included in the SMS DVD. Details of ventilation with steel products is provided in Bulk carrier practice and are to be complied with. Vessel with box shaped holds should load in “California Block Stow” for loading steel cargo as detailed in the NE P & I Cargo stowage and securing Booklet. Vessels which are not having box shaped holds California block stowage is not recommended. Additionally refer to appendix 1.14 for general guidance on steel cargo and clausing mates receipt Carriage of Grain Grain is a product which flows freely. It is liable to shift and endanger a ship's stability and for that reason the regulations governing its carriage are exacting. In addition, grain is perishable and is intended for consumption by humans or by livestock. This calls for holds that are very clean and for high standards in avoiding contamination, damage or infestation. Please refer to the Bulk carrier Practice Book for details on carriage of grain and precautions, ventilation and other details required. Hold preparation, trimming and Ventilation during Passage to be carried out as detailed in the “Bulk Carrier Practice” Book. Carriage of Iron Ore Please refer to Page 256-258 of the “Bulk Carrier Practice” Book for details on carriage of Iron Ore. overside in special area or in Port. Vessel should be more than 25 Miles from nearest land and not in a special area for disposal of previous cargo residue. Similarly, Hold washing with residues cannot be pumped out unless vessel is not in a special area and is more than 25 miles from land. Correct Entries are to made in the WSM Garbage Management and Record Manual of the Cargo Residues disposed to sea. In case of any doubt on the extent of Hold cleaning required, Please contact charterers / owners or Marine Superintendent in Fleet Cell. Loading, Trimming and Weather Precautions Details on any Precautions prior loading, Trimming required as well as weather precautions during loading are provided in the latest Edition of Code of safe Practice for Solid bulk cargoes. These are to be complied with.

APP 1.8 CARGO VENTILATION

Please refer to NE P & I Booklet “Cargo Ventilation” which is included in the SMS DVD. The hold ventilators must be in good working order to fulfill two functions. First, they must provide adequate ventilation to the hold if required. Second, they must be capable of being completely sealed to prevent the entry of water in adverse weather conditions, and the entry of air if a fire occurs, which must be smothered. Vents which are closed by doors should be checked to ensure that the rubber seals have not been covered with paint, become permanently indented or cracked and brittle with age. Confirm also that the door closes properly, and that the sealing bar meets the centre of the door rubber. The hinges should be undamaged, and they and the butterfly nuts should move freely. Located in the trunking of each ventilator, or at the point when it enters the hold, is a light metal grille which prevents sparks, insects and rats from entering. This can be reached by way of an inspection panel, set somewhere in the ventilator trunking. The grille must be renewed if it is damaged or wasted, and loose rubbish and scale must be removed from it. Mushroom ventilators are closed by turning the wheel which is set on top. This brings a damper plate inside the mushroom cowl into contact with the lip of the vent trunking. A 'rubber' (neoprene) seal is set into the damper plate, and it must be in good condition to ensure a watertight fit. The seal can be inspected when the vent is open by looking upwards into the vent cowl from a portion on deck beside the ventilator. The grille in a mushroom ventilator is usually fitted in several parts, located in the position illustrated, and must be renewed if damaged. The shaft of the wheel must be greased and working freely. If the shaft is coated with grease and the grease has become contaminated with dust and grit from the cargo the shaft is likely to jam. Before the vent is opened, the contaminated grease should be removed from the shaft. then the threaded part should be wiped with a rag soaked in paraffin before the ventilator is opened and closed, and the shaft is regreased. The wheel must be clearly marked with the 'Open' and the 'Close' directions, and the marks should be checked to be sure that they have not been reversed ─ mistakes can easily occur on older ships when the original plates have wasted, and been replaced by painted signs. Ventilators which end in mushroom cowls at the heads of samson posts are provided with

APPENDIX 5 - GUIDANCE ON PERFORMANCE OF VOYAGE WITH UTMOST DISPATCH

We are certain that you consider it a matter of professional pride that The Master, officers and crew are the persons in whose hands the Owner entrusts his valuable ship and his business. The business exists to make a profit by trading the ship in a safe and sound manner. If the owner turns a profit we all have jobs and are able to support our families. To maximize the profits the best way is to avoid loss by way of claims from charterer and other parties. Thus trading the ship efficiently is a Commercial venture for the Owner as well as all of us. The Owner employs Wallem Shipmanagement (WSM) as his manager to manage the ship on his behalf. To operate the vessel a commercial operator may be employed, and owners charter the ship to earn freight or charter hire from a Voyage charterer or Time charter. They may in turn sub-charter the ship. The Master thus bears responsibility to all parties in the commercial venture. However remember that the Master’s priority and order of Responsibility is always; First to WSM (as manager) & Owners, Second to Charterer and then to sub charterer. The relationships must be clearly understood. Thus all matters concerning Technical, Navigation or the ship’s day to day operation (husbanding) are Managers primary responsibility on behalf of owner (and not that of the charterer). Any enquiry or concern about such operations must be brought to attention of WSM and if appropriate of the owner (under copy) and not the charterer. WSM and Owners will assist to resolve all such matters. WSM and Owners provide specific instructions in their operations manual which Master must read, understand and follow to perform the voyage with utmost dispatch. Cargo, bunkers and charter speed are charterer’s matters and their instructions are to be followed for loading and/or discharging and performance of the voyage. Bunker delivery notes to be in the name of the Charterer and not Owner. However carrying the cargo safely, issuing Mates Receipts, issuing B/L’s are owners matter and therefore owner’s instructions take precedence over those of the charterer. Contact Owners and/or Commercial operators for this. However before you seek advice please remember the ship’s crew is on the spot and are the company’s eyes and ears. The Master officers and crew are therefore in the best position to think and provide solutions and alternatives. So please first think for yourself and if still in doubt ask us by email or phone call with full information at hand:

• giving full details of the situation, • And what you think are the best possible solutions

We can then work together to find and implement the best solution. Charterer often provides Weather routing for the voyage. This is good guidance for the Master and routes should be planned taking this guidance into consideration. While the Master has the authority to decide the route to be followed, if he intends to take a route different from the one recommended by the Weather routing agency, Master must have good strong and clear reasons for this, which should be discussed with the routing agency under copy to owners, charterer and Marine Superintendent in the Fleet Cell and the changes should be made as most appropriate. If not the charterer can make claims on the owner for extra bunkers and time consumed. Report and log weather conditions truthfully at all times.

A) On receiving voyage instructions: 1. Send copy of Voyage instructions to Owners and/or Commercial operator and Fleet Cell.

Remember in addition to fill out the agent’s details in the Vessel Movement Report Agents details format so that departments have access and record. Seek guidance if necessary.

2. Check the requirements of the cargo to be loaded as per IMSBC code, IMDG code, Ships

certificate or Statement of Compliance for carriage of Solid bulk cargoes, Trim and Stability and/or Loading manual, WSM bulk carrier Manual and SMS documentation DVD for guidance. Send stowage plan to charterer and agents under cc to owner and/or Commercial operator. If any problems or doubts exist then these should be sorted out at this stage by seeking guidance of Marine Superintendent as necessary。

3. Check if clause “Not Always Afloat But Safety Aground” (NAABSA) is agreed by owner in C/P or

voyage instruction for load or discharge port. Prepare for NAABSA precautions in advance. 4. Check if charterer has instructed Master to sign B/L, or if instructed Master to issue Letter of

authorization to Agents to sign B/L's on Master's behalf. If Master to sign B/L or issue Letter of authorization, and charterer or agents provide format of letter, then make sure it states that: " B/L's to be signed in accordance with Governing Charter party and in strict conformity with Mates receipts and all remarks on Mates receipts to be transferred on B/L's ".

(a) Ensure that you inform owners and/or Commercial operator before arrival that you have

been asked to issue Letter of authorization, send them format to be used and obtain their consent.

(b) Check B/L format especially for Freight clause. If "Freight Prepaid" is written,

immediately inform Owners and /or Commercial operator and seek instructions. (c) B/L date must be date of completion of loading and not Pre dated or Post Dated. Any

issue with this consult Owners and/or Commercial operator (d) If Original B/L to be carried on board, inform Owners and/or Commercial operator

advising how many originals to be signed and how many will be on board and seek instructions.

5. Check carefully instructions given regards tendering Notice of Readiness (NOR) at Load port

and Discharge port and ensure you comply precisely with the instructions. If any doubts exist please obtain clarification from the charterer under copy to owners.

6. Check draft, and airdraft requirements and verify drafts and airdrafts in approach channels and

berths in advance with load port and discharge port agents. If any doubts you must contact the charter under copy to owners for clarification.

7. At least 5 days in advance of arrival check with local agents for customary and peculiar special

requirements of local authorities like customs, immigrations, quarantine, PSC, ISPS (PFSO) security levels, channel navigation, pilotage and berthing details and prepare accordingly. If something out of the normal is needed please inform WSM (TD) for follow up. Upon completion of visit to a port where they have some abnormal requirements or situations please do provide a memo to Marine Superintendent as experience feedback for advising other ships.

8. Immediately check Navigational charts and publications, provisions and lubricating oil requirements. Inform Technical superintendent and timely of any shortcomings so that supplies can be arranged in a timely manner.

If bunkers are required inform charterer under copy to owners. 9. Check Lay time Cancellation date/time (Laycan) and make sure vessel can arrive timely. B) On arrival loading port and at loading port: 1. Make sure NOR is tendered on date/time when the ship reaches the right location (pilot station,

anchorage or other Lat/Long within port limits) according to charterer's instructions. If not owner may suffer Off Hire due late tendering or claims due to early tendering. Sometimes with owner’s/chartrers consent second NOR may have to be tendered without prejudice to the first one.

2. On arrival port check with agents what remarks will be acceptable on Mates receipts. Inform the

outcome to owners and charterers in advance even as loading starts. 3. If Letter of authorization to sign B/L is to be issued to agents you should ensure that it is issued

to agents only after completion of loading when Mates receipts are signed. In this way Master to retain control over issuance of B/L’s. Do not come under pressure from agents to issue the letter on arrival itself, but assure them you will do so at the end of discharge when cargo documents are being signed. Once you issue such letter then immediately send copy to owners and /or Commercial Operator of the signed letter. Do not wait for this till departure.

4. If any problems experienced during loading inform owners and/or Commercial Operator and

charterer in timely manner. E.g.: Cargo spillage, contamination, high moisture content on Can test of concentrates or ore cargo, etc. Please send photos along with information.

Owners may arrange P&I to assist or Master can call P&I correspondents directly in case of urgent matter. Note protest to shipper in any case.

In case if Stevedore damage, please send protest to stevedore company through agent, charterer and owner and WSM (TD) should be copied under this situation in order for their follow up. This is not normally a P&I matter but Class may be required to approve repairs done by stevedores or ship staff depending on nature of the damage. In case of any other damage like contact with pier, or barge, or shore equipment, inform Fleet Cell under copy to owners. Master should call P&I club correspondents to assist directly from his side to save time.

5. If vessel touches bottom at Loading berth stop loading , Note protest and inform Owners, charterer and Fleet Cell immediately with soundings around the ship and soundings of all tanks and take precautions not to move rudder or propeller and use high sea chest. Take photos and send with times of HW & LW and inform what can be done to improve situation.

Vessel is to sit on the seabed at the berth (without protesting) only if NAABSA clause is applicable. Even when this happens take all precautions as above, inform all parties and say clearly that NAABSA clause applies for that berth as per Charter party and voyage instructions.

6. If any cargo is shipped on deck inform Owners, and/or Commercial operator and Charterer. In

such case the Mates Receipt and B/L must be claused "Carried on deck, Solely at Shippers Risk and Responsibility. Carrier not responsible for loss or damage howsoever caused”

7. Master to oversee draft survey calculations of Chief Officer on arrival, at time of trimming, and on completion of loading to make sure figures are accurate and no mistakes occur with respect to dock water density, constant and calculations. Master is to be fully involved during the loading to ensure deballasting is keeping up with loading rate to avoid excessive ballast remaining onboard. It may sometimes be necessary to adjust loading sequence, or slow down loading rate or stop loading for a short period to ensure proper trim for stripping tanks. Owners loose lot of money due to deadfreight, or overloading claims due to silly mistakes which are not corrected in a timely manner since deck officers fail to spot the problems and take corrective action in time.

8. If during loading or on completion of loading and draft survey if any cargo figure difference

occurs, or if cargo quality is in doubt, a Note of protest is to be issued to shipper/terminal directly or through agents if necessary.

If cargo “quantity” or “quality” discrepancies exist, insist that remarks are placed on the Mates Receipts (M/Rs). Ensure both shore and ship’s figures are recorded on the M/Rs because the General Remark like “Quality/Quantity unknown “ or “Said to weigh” cannot exempt owners responsibility if consignees claim “quality problems” or “short landing” at discharge port. Follow owners standing instructions. Immediately send the copy of M/R’s to owners and operators and follow up with phone call to confirm all in order and only then the vessel should sail out.

If Master is not allowed to place remarks on M/R’s, then do not sign Clean M/Rs. Instead issue protest for not being allowed to place remarks on the M/R’s. On this protest write the cargo quantities per Shore scale, Ships draft survey quantity and any attending surveyor’s quantities and cargo figure difference. Do not issue Letter of authorization to sign B/L’s, but obtain owners instructions.

In such situation immediately (before departing berth) email to Owner and charterer the shore figures, draft survey figures and Letters of protest under copy to Fleet Cell. DO NOT ONLY SEND EMAIL TO OWNER, MASTER TO FOLLOW UP WITH PHONE CALL TO OWNER TO DRAW IMMEDIATE ATTENTION. Owners need timely notification to make the right decision and will then give instructions to the ship. Owner may arrange for P&I surveyors to attend to cross check and record figures and give advice.

Owners may try and obtain a Letter of Indemnity (LOI) from the charterer before agreeing to sign Clean M/R’s. Sometimes charterer gives such LOI, however many times they do not give LOI. It is solely Owners decision what is to be done in such circumstances, and only they can issue Master instructions to sign MR’s without remarks, issue a protest for this and then sail. Remember in such situation Owners and/or Owners commercial operators instructions are PARAMOUNT, and not those of the charterer. Master must not come under pressure about delay in sailing no matter how much pressure the agents or Harbor authorities exert. Transfer the pressure to Owners. It is more important to get the paperwork done in right manner than delay to sailing. Sometimes ship has to go to anchor and await owner’s and/or Commercial operator’s instructions before final departure. When Final Cargo papers and SOF are being signed Master must be present and not leave this to Chief Officer, so that it is ensured that the correct remarks are entered. Without evidence and remarks owners cannot refute claims.

9. If sufficient cargo is not supplied as per Stowage plan and your cargo demand, the vessel must

issue “Deadfreight letter” and notify shippers, charterer and owners. 10. Remember that even if P&I surveyor is attending it remains Master’s responsibility to inform

owners and/or commercial operators of any problems that are encountered. P&I surveyor may report on his own but Master still has to comply with his obligation.

11. Original B/L’s are not allowed to be carried on board unless owners agree to same. If one

original is carried on board please put remark on it and on other copies “One original retained on board against which discharge may be made under instructions of shipper /charterer.”

C) At Discharge port: 1. Tender the NOR at the right Location and time. 2. Check with agents well before arrival if Original B/L is at hand and will be presented. 3. Do not release cargo unless original B/L is presented to Master and is duly endorsed by

consignee, or their agent.

After receiving original B/L at discharge port, ensure it is remarked “Accomplished”. Send copy of the B/L immediately to owners and/or Commercial operator and charterers advising its receipt and that you are releasing cargo to the consignee. If no original B/L is presented to Master do not discharge the cargo and inform owners and/or Commercial Operator and charterer of the situation immediately.

4. In case destination is changed during the voyage inform all parties. Owners may take LOI from

charterer for change of destination as B/L will have original destination stated on it. 5. Only owners and /or Commercial operator can authorize in writing to Master to release cargo

without original B/L being produced. Owners will likely have taken LOI from charterer if this is to be done. They will email Master with instructions to release cargo. Master is not authorized to accept any LOI from anyone for any matter. If Master is presented with a LOI inform owners. Only owners can accept a LOI.

The same applies if you are asked to work cargo in rain. No "rain letter" or LOI is to be accepted from anyone. Only Owner can authorize cargo work in rain which may be after an LOI is received by them from Charterer.

6. If upon initial draft survey any cargo figure discrepancy is noted, or any cargo damage is noted

or any other trouble at any time during the discharge immediately email owners and/or Commercial Operator and explain reasons under copy to Fleet Cell and follow up with phone call in case of urgency. E.g. Spillage, contamination, wet cargo, etc. Take photos for evidence and send. Owners may arrange P&I surveyor or in urgent case Master can call P&I correspondents directly to assist.

7. If vessel touches bottom at discharge port at the berth Note protest and inform Owners,

charterer and Fleet Cell immediately with sea soundings around the ship and soundings of all tanks and take precautions not to move rudder or propeller and use high sea chest for suction. Take photos and send with times of HW & LW and inform what can be done to improve situation.

If you send any messages to charterer make sure you copy Owners and Commercial operator. Any reply from charterer should also be relayed to owners. In case Master is unable to contact owners and/or Commercial operator for whatever reason then Fleet Cell should be contacted for advice in the matter along with all details as above. We can then guide and assist in contacting owners for confirmation of instructions.

REMEMBER ANY TIME ANY MESSAGE IS SENT TO ANY PARTY ABOUT ANY TROUBLE OR POTENTIAL TROUBLE ALWAYS COPY FLEET CELL Further please GARD P&I club booklet Guidance on Bills of Lading which you have onboard. All ships must carry this. Study and educate your deck officers and act promptly as stated above.
