So what do you get when you select me as your Mediator?

First, I come to every mediation extremely well-prepared. When I read your submission, I examine the hidden layers that you or opposing counsel might not even be aware of. I look for subtle clues that tell me why your client or the opposition feels angry, disrespected, or even sad. You rightfully focus on legal rights, remedies, and defenses. I study that as well, and seek to understand the motivations, interests, biases, and emotions of the parties and of your opposing counsel.

Second, I understand that cases have to settle, but also realize mediation is a voluntary, self-determinative process. As I have worked through the paradox, for the mediator, of having to settle cases while letting you and your client really control the outcome, I have learned to be a decision architect. My job is to help you and your client make the very best decision possible in light of great uncertainty, risk, ambiguity, and emotion. aspects, I have done my job well.

Third, I connect to you and your client on multiple levels. Emotions flow through every mediation. I have learned to listen carefully, validate and vindicate where appropriate, help create meaning, and provide a safe space for your stories to be heard.

Fourth, as a broad generalist, I’ve been lucky to learn a lot. Each case is another tutorial in life, business, and finance. When you mediate your case, you want a smart, well-prepared, decision architect, not a legal specialist who has not trained nor practiced as a professional mediator. My goal is to get your case settled with a deal that will stick. Managing Partner and Senior Resident Partner of Miami office. In 1983 I launched the Miami law firm of Rumberger, Wechsler & Kirk, an association with Rumberger, Kirk, Caldwell, Cabaniss & Burke, P.A., an Orlando law firm. I specialized in litigation involving motor vehicle crashworthiness and product liability and represented many of the world’s leading automobile, and truck manufacturers in their state and national litigation. Representative clients included: American Motors Corporation, Audi AG, Chrysler Corporation, Dana Corporation, General Motors Corporation, Mitsubishi Motor Sales of America, Inc., Navistar International Transportation Corp., Nissan North America, Inc., Porsche Cars of North America, Inc., Volkswagen of America Inc., and Volkswagen of Germany. I concentrated in personal injury and wrongful death, insurance defense, asbestos, medical malpractice, professional liability and complex commercial matters. 2. Vincent v. Volkswagen AG, Miami, Florida. Crashworthiness case involving rollover of Porsche 914 resulting in quadriplegia to young woman. Issues involved accident reconstruction, computer simulation using CRASH 3 and HVOSM, SAE J996 vehicle drop testing to assess roof performance of the roll bar, performance of “A” pillar, mechanism of injury, seat belt issues, roof crush, service of process and discovery under Hague Convention, occupant kinematics and biomechanics.

3. Farkas v. Volkswagen AG, United States District Court, Southern District of Florida. Crashworthiness case involving front-end collision of Volkswagen van resulting in bilateral below-knee amputations of young man. Issues involved Federal Court jurisdiction, service of process and discovery under the Hague Convention, protection of occupants in front end collision, compliance with Federal Motor Vehicle Safety Standards, accident reconstruction, crash testing, seat belt protection, design of front end of vehicles in bumper override collisions, nose dive characteristics, and biomechanics.

4. McCoy v. American Motors Corporation, Miami, Florida. Case involved rollover of sport utility vehicle (SUV) resulting in brain damage to young man. Issues involved rollover propensity of sport utility vehicle (SUV), door opening, door handle design, ejection, seat belts, accident reconstruction, biomechanics and occupant kinematics.

5. Truppman v. Orange Motors, Miami, Florida. Case involved the design and performance of the transmission of a Porsche 928.

6. Barfels v. Mitsubishi Motor Sales, USA, Inc., Miami, Florida. Crashworthiness

case involving frontal collision in car that did not have an air bag. This was one of

the earliest air bag cases filed where it was alleged that a vehicle was defective

because the manufacturer chose to comply with Federal Motor Vehicle Safety

Standard 208 by installing an active lap and shoulder restraint system instead of an

air bag system. Federal preemption issues were raised challenging state court

actions which would allow state court juries to find vehicles defective for not

having air bags, when this issue was preempted by the federal government. Issues

involved federal preemption, accident reconstruction, vehicle design, compliance

with Federal Motor Vehicle Safety Standards, occupant kinematics and

biomechanics.

7. Greenhouse v. Toyota Motor Corporation, West Palm Beach, Florida.

Crashworthiness case involving side impact of Toyota vehicle causing car to split in half. Driver was ejected resulting in severe brain damage and ultimate death. Issues involved welding, metallurgy, vehicle design and manufacturing, crash performance in side impact, seat belts, accident reconstruction, occupant kinematics and biomechanics.

8. Hane v. Audi AG, Miami, Florida. Unintended acceleration of Audi 5000 resulting in brain damage to baby, heart attack to elderly woman, and orthopaedic injuries to young man. Issues involved whether Audi 5000 passenger car was defective in unexpectedly accelerating causing accidents and injuries. Audi 5000 was subject to recall because of allegations of unintended acceleration, as depicted on CBS’s 60 Minutes.

9. Emerson v. Volkswagen AG, Ft. Lauderdale, Florida. Crashworthiness case

involving rollover of Volkswagen van resulting in death of young woman. Issues involved rollover propensity of Volkswagen microbus, computerized accident reconstruction, occupant kinematics, seat belts, biomechanics, vehicle design and testing, vehicle handling and compliance with Federal Motor Vehicle Safety Standards.

10. Smith v. Toyota Motor Corporation, Ft. Lauderdale, Florida. Crashworthiness of

Toyota vehicle resulting in death of young woman. Issues involved accident

reconstruction, performance and crash protection of occupant, occupant kinematics

and biomechanics.

11. Rogers v. Chrysler Corporation, St. Augustine, Florida. Electrical fire resulting in severe third degree burns of 6 years old girl on all parts of her face and body. Issues involved change of venue, electrical fire in engine compartment, design of vehicle to prevent spread of fire into occupant compartment of vehicle, compliance with Federal Motor Vehicle Safety Standards, vehicle testing, forensic pathology, and bifurcation of liability and damages.

12. Baker v. American Motors Corporation, West Palm Beach, Florida.

Crashworthiness case involving rollover of Jeep CJ-5. Father driving home from

church was broadsided by another car, resulting in rollover of Jeep. Father was

wearing his seat belt, mother in right front seat not belted and ejected, and two small

children in back were belted. Father and children died in accident. Issues involved

rollover propensity of Jeep, tire pressure concerns, roll bar performance, steering

characteristics, accident reconstruction, biomechanics, occupant kinematics and

statistics.

13. Pribisco v. Audi AG, Miami, Florida. Unintended acceleration of Audi 5000, resulting in serious injuries to man. Issues involved accident reconstruction, effect on road edge drop on tires and handling of vehicle, whether Audi 5000 passenger car was defective in unexpectedly accelerating causing accident and injuries. Audi 5000 was subject to recall because of allegations of unintended acceleration, as depicted on CBS’s 60 Minutes.

14. Viruet v. Chrysler Corporation, Tampa, Florida. United States District Court,

Middle District of Florida. Plaintiff was ejected from her car in an automobile accident and sustained significant injuries. She was not wearing her seat belt at the time of the accident, and sued Chrysler for not having a passive restraint system. Case was won for Chrysler on summary judgment based on Federal Preemption.

16. Esmie v. Toyota Motor Sales USA, Inc., Miami, Florida. Crashworthiness case involving crash of Toyota passenger car resulting in personal injuries. Issues involved vehicle design and safety, accident reconstruction, occupant kinematics and injury causation.

17. Lamb v. Volkswagen of America, Inc., United States District Court, Southern District of Florida. Crashworthiness case involving VW Karmann Ghia when vehicle rolled over in car crash resulting in ejection of young man. Plaintiff was rendered paraplegic and was confined to wheelchair for life. Issues involved service of process and discovery under the Hague Convention, rollover propensity of vehicle, accident reconstruction, windshield retention and glazing, statute of repose, occupant kinematics and biomechanics.

18. Djelosevic v. Mazda, Miami, Florida. Crashworthiness case involving crash of Mazda passenger car resulting in personal injuries. Issues involved accident reconstruction, vehicle design, occupant protection, seat belts, and occupant kinematics.

19. McMillian v. Volkswagen of America, Inc., United States District Court, Middle District of Florida. Crashworthiness case involving VW Beetle. Single vehicle accident involving rollover of VW Beetle resulting in ejection of young woman resulting in paraplegia. Issues involved service of process and discovery under the Hague Convention, vehicle handling, over steer and understeer of vehicle, door, seat belts, accident reconstruction, occupant kinematics and biomechanics.

20. Pierno v. Chrysler Corporation, West Palm Beach, Florida. Crashworthiness case involving frontal crash passenger car resulting in severe orthopaedic injuries to woman. Issues involved welding, metallurgy, compliance with Federal Motor Vehicle Safety Standards, occupant protection in crashes, seat belts, accident reconstruction, occupant kinematics and biomechanics.

21. Bishop v. Toyota Motor Sales, USA, Inc., West Palm Beach, Florida. Crashworthiness case involving crash of Toyota passenger car resulting in personal injuries. Issues involved accident reconstruction, vehicle design, occupant kinematics, and crash protection.

23. Government Employees Insurance Co. v. Volkswagen of America, Inc., Miami, Florida. Subrogation case filed by GEICO to recover medical expenses paid out to injured person in Volkswagen van. Issues involved rollover propensity of van, front-end crashworthiness and occupant protection, accident reconstruction, occupant kinematics and vehicle design.

24. Harris v. Alamo Rent-A-Car, v. Toyota Motor Sales, USA, Inc., Miami, Florida. Crashworthiness case involving single vehicle rollover accident of Toyota van, with ejection of 6 year-old boy resulting in severe brain damage. Van was rented from Alamo, who was sued by plaintiff, and Alamo filed third-party complaint against Toyota. Issues involved rollover propensity of Toyota van, center of gravity, testing for rollover propensity, accident reconstruction, handling of vehicle, over steer and understeer of vehicles, occupant kinematics, biomechanics, seat belts, and ejection.
