SUPERANNUATIONAMENDMENT REGULATIONS 1992

Made by His Excellency the Lieutenant-Governorand Administrator inExecutiveCouncil on the recommendationof the Board.

Citation

1. These regulations may be cited as the SuperannuationAmendmentRegulations1992.

Principal regulations

2. In theseregulationsthe SuperannuationRegulations1959* are referredto as the principal regulations.

3. Regulation 3 of the principal regulationsis amendedby deleting thedefinitions of "the Board" and"the Fund" andsubstitutingthe following -

"Board" and "Fund" have the respective meanings given tothem in section 3 1 of the Government EmployeesSuperannuationAct 1987;

PartWA inserted

4. After regulation 21 of the principal regulations,the following Part isinserted-

" PART WA - INFORMATION TO BE GWENTO CONTRIBUTORSETC.

Definitions

2lA.. In this Part -

"Commonwealth Act" means the OccupationalSuperannuation Standards Act 1987 of theCommonwealth;

"member" means a contributor, qualified contributor orsubscriberunderthe Act;

"year", in respect of a member,means the period of 12monthsendingwith the member’sbirthday.

Annual statement

21B. 1 The Board shall for eachyear send to each memberawritten statementsettingout the following information -

a the amount of contributions made by the memberduringtheyear;

b the amount of benefitsvested in the member on thefirst and last days of the year;

2 A statementunder subregulation1 in respectof a yearshall be sentas soonas is practicableafter the end of that year.

Information to be givenon cessationof membership

21C. Whereapersonceasesto be a member,the Boardshall assoon as is practicableafter the cessationof membershipsend tothe person,or the personalrepresentativeif any of thepersonawritten statementsetting out the following information about theentitlement under the Act of the memberor the member’sestate,as the casemaybe -

a the amount of the benefit entitlementof the memberandthe methodof determiningthatentitlement;

b the member’s old RBM as defined by theCommonwealthregulationsif it exceeds11.25 timesthe member’shighestaveragesalaryas so defined;

c if the cessationof membershiparisesotherwisethanby death, invalidity, or retirementafter attainingtheage of 55, the particulars referred to in regulation21B in respect of the period from the cessationofmembershipback to the end of the period coveredbythe last statementunderthat regulation.

2 In subregulation 1 "Commonwealth regulations"meansregulationsmadeunderthe CommonwealthAct.

Member may obtain information from Board

21D. 1 A membermay requestthe Board to give to him orher a documentspecifiedin subregulation3 but may not do somorethanoncein respectof any period of 12 months.

2 The Board shall comply with a request made inaccordancewith subregulation1.

3 The documentsthat may be requestedare -

a a copy of, or extractfrom, an actuarial report on theFund;

b a copy of the auditor’s reporton the Fund;

c a copy of any return, certificate or noticeprovided bythe Board to, or received by the Board from, theInsuranceand SuperannuationCommissioner thatis, the person referred to by that title in theCommonwealthAct.
