The Petition of the Grievance Committee for the Sec-ond, Eleventh and Thirteenth Judicial District respect-fully alleges that:

FIRST: Respondents are attorneys duly licensed to practice law in New York State. Who previously provided to the Office of Court Administration (“OCA”) either a business or home address within the Second Judicial Department, or. in the absence of a New York address, were admitted to the practice of law in the Second Judi-cial Department. The Schedule annexed hereto as Exhibit 1 identifies each respondent by name, OCA registration number, address, date of admission and Appellate Divi-sion Department of admission.

SECOND: Upon information and belief, each respondent has been guilty of professional misconduct as defined in Section 691.2 of the Rules Governing the Conduct of Attorneys of the Appellate Division, Second Judicial Department, in that each respondent has failed to re-register as an attorney with OCA, in violation of Judiciary Law §468-a and 22 NYCRR 118.1. as detailed below.

THIRD: Prior to the commencement of this proceeding. OCA mailed a biennial registration form, which notified each respondent of the requirement to re-register, to the home address provided to OCA by the attorney. As each respondent failed to re-register as required. OCA mailed a second notice to the business address provided to OCA by the attorney and, when necessary, mailed a third and final notice to the home address.

FOURTH: When respondents still failed to re-register as required, OCA referred their names to petitioner for disciplinary action, in accordance with Judiciary Law 468-a (5).

FIFTH: Petitioner initiated a disciplinary complaint against each respondent, and exercised due diligence to determine whether the addresses previously provided to OCA by each respondent were still viable, and if not, to find a more current address. Petitioner then sent each respondent correspondence, to the business and/or home address provided to OCA by the attorney, and/or to the address discovered during petitioner’s inves-

tigation. Requesting compliance with the registration requirements and a written answer to the disciplinary complaint.

SIXTH: To date, each respondent has failed to re-register, By reason of the foregoing, each respondent has engaged in professional misconduct, in violation of Judiciary Law §468-a and 22 NYCRR 118.1.

WHEREFORE, petitioner prays that an order be entered suspending from the practice of law each respondent identified in the Schedule annexed hereto as Exhibit I, until further order of the Court, unless, prior to the entry of such order, the Court removes from the Schedule the name of any respondent who has submitted proof from OCA that he or she is in full compliance with the regis-tration requirements pursuant to Judiciary Law §468-a.
